7 JOSHUA TOOMEY CHAIR DARKINJUNG LOCAL ABORIGINAL LAND COUNCIL Moving into my second year here at Darkinjung Local Aboriginal Land Council, I continue to be inspired and motivated by our passionate members and staff who are always striving to achieve our organisational goals. It is so rewarding to have been given the opportunity to continue our great work throughout the Central Coast community and every day I am absorbing the knowledge and experience of my fellow Board members so that I may grow further, not only as a person, but also as a leader. It is an absolute pleasure working alongside these people, in addition to our Chief Executive Officer Sean Gordon. Together we are committed to working towards improving the future of Indigenous people living on the Central Coast. This year we continued to deliver on our succession plans which sees the experience of the Board blending with the youth and enthusiasm of our emerging leaders to concentrate on areas of focus for our organisation. We have fought for what we believe in and what are passionate about and we have been committed to creating a voice for our land, our culture and heritage and most of all, our people. Over the course of this year, we have celebrated the beauty of Aboriginal art through the Indigenous art exhibition at Terrigal. The project titled the Painting of the Hoardings - saw almost 100 incredible artworks installed along the footpath that hugs the coastline at Terrigal. Four local Aboriginal artists visited over 20 primary schools in the region to educate students on Aboriginal art, history and culture in order to produce the artwork. It means a great deal to our Land Council to have had the opportunity to share our heritage with younger non-indigenous children. Not only has it meant that we have been able to continue to educate our younger generations, but this project has also resulted in an impressive installation for the entire Central Coast community to enjoy for year to come. Darkinjung has also continued to tackle environmental issues, having undertaken a massive clean-up of illegal dumping on the Central Coast this year. Thanks to the funding grant from the NSW Environment Protection Authority (EPA), Darkinjung will continue to devise strategies to implement further clean-up and prevention projects in the region. Darkinjung is committed to building for the future and 2015 saw us complete the development of nine new residential homes at Menindee Ridge. The Menindee Ridge development aims to deliver a strong cultural, social and economic environment for the community. It has been an extremely rewarding project to see come to life and it has been a joy to watch these families settle into their new homes. I would like to take this opportunity to thank those organisations and our community and corporate partners who continue to support Darkinjung. Building and maintaining these relationships is an integral part of the success of our organisation. As I reflect on the year that has passed, I feel incredibly honoured to have contributed to the amazing work our Land Council undertakes. I am excited for what lies ahead in our local community and the projects we have in the pipeline that will have a positive impact. As in many other years, we understand that there may be obstacles that we need to overcome in order to achieve our goals. However, I am confident that Darkinjung will stand by our values and vision when handling these challenges and ultimately our efforts will make a difference to the members of the Central Coast community. 6

8 SEAN GORDON CEO DARKINJUNG LOCAL ABORIGINAL LAND COUNCIL 2014 saw Darkinjung celebrate an historic anniversary, marking 30 years since our establishment as a Land Council. Looking back at our history, it allowed for a time to reflect on the amazing achievements of our organisation and the challenges we have overcome in order to succeed. As we moved into 2015, Darkinjung focused on looking forward and building a future for our community. The most immediate threat to Land Rights in NSW came toward the end of 2014 when the Crown Lands Amendments (Coastal Lands) Bill was being pushed through parliament without any consultation or input from Land Councils. Darkinjung in partnership with the Land Rights Network responded immediately to oppose this threat and were successful in getting the Bill withdrawn. We are incredibly proud of the work that has been undertaken at Menindee Ridge in order to accomplish our vision of creating a socially and economically sustainable development on the Central Coast. It is a humbling experience handing over keys to deserving families, watching these people turn houses into homes and knowing that Darkinjung played the role of the enabler with a mere base of bricks and water. In addition to Menindee Ridge, in December 2014 after much consideration, Darkinjung Board and Members voted in favour of the proposed CASAR Development. Darkinjung is poised to sign a 60 year lease for the land which will see a $14 million motoring complex built on the site. This development will provide a significant boost to our local community and economy, estimating to generate up to $17 million annually and provide approximately 200 jobs and 200 training positions, in which 20% is targeted toward the Aboriginal community. This has all been achieved whilst also allowing Darkinjung to retain ownership of its asset (land). As a Land Council, our focus continues to hone in on protecting our land and the rights of our Aboriginal community. Within the last twelve months we have undertaken an extensive clean-up of illegal dumping within the Wyong region and Darkinjung will continue to implement prevention programs and future clean-ups. Darkinjung has also fought for the conservation of sites of significance on the Central Coast. Our region is rich with an extensive Aboriginal history and it is our obligation to preserve and protect our land and culture. Recently, Darkinjung has been dealing with the Office of Environment and Heritage to have work seized on a property at Booker Bay. It is instances like this that shows a lack of communication and understanding of Aboriginal heritage, a flaw that Darkinjung is working towards rectifying with local government and appropriate environment agencies. The Barang Regional Alliance, Barang, continues to forge a new path for the organisations involved, in particular with the launch of the Empowered Communities: Empowered People report. The report outlines the long-term reform required across commonwealth, state and territory governments, in a new partnership with Indigenous and corporate leaders. The report calls for a formal agreement, to a 10-year Indigenous Empowerment policy framework. Finally, I would like to thank Darkinjung s Board and members for their continued faith and support in me. It is an honour to have my term extended for an additional three years. I love my job and it is a pleasure to work beside so many talented and dedicated individuals at Darkinjung and I look forward to continuing build a future for our Central Coast community. 7

10 COMMUNITY PARTICIPATION AND WELLBEING SOCIAL PROGRAMS NAIDOC WEEK Darkinjung and the Central Coast NAIDOC Committee of Barang Members hosted two spectacular events for NAIDOC Week has been the best year so far with the Family Golf Day and Family Fun Day receiving record numbers, almost doubling for this year. The community enjoyed games of netball, soccer, skills workshops with the Central Coast Mariners. There was didge playing for the kids by Bara Barang and a kids corner by Yerin Aboriginal Health Service. Performances by Street Warriors and Australian Idol finalist Shannon Noll were also a big hit on the day, attendees also enjoyed having a chat with some of their favourite NRL players. Mixed teams competed in a round robin competition throughout the day and there were rides, a friendly tug-of-war and obstacle courses for the younger children, thanks to Commando Kids with YMCA Lake Haven. We had over 140 participants who registered and attended the Family Golf Day. It was a great day of 18 holes, with participants ageing from 12 through to our Elders. We would like to thank those who helped bring these events to life. Without the involvement and financial support of these people our celebrations would not have been possible. 30 YEAR ANNIVERSARY DINNER On August 23, Darkinjung celebrated its 30 year anniversary with an event held at Wyong Leagues Club. Over 200 Darkinjung members enjoyed a sit down dinner, great entertainment and speeches about Darkinjung history by Barry Duncan, Roy Ah- See and a closing address by Chairperson, Joshua Toomey CENTRAL COAST COMMUNITY AWARDS On Saturday 22 November, Wyong Rugby League Club hosted the Central Coast Community Awards which saw community members recognised for their prestigious work and commitment to the Central Coast community. The event included the Welcome to Country by Gavi Duncan, entertainment by the Simpson Brothers and a key note address by Ms Avron Lincoln and Mr Mick Pittman with the theme being Serving Country Centenary and Beyond. Darkinjung was nominated for Aboriginal Organisation of the Year and also had three staff members nominated on the evening - Sharon Hodgetts, Sean Gordon and Jodi Shannon DARKINJUNG CHRISTMAS PARTY Over 350 attendees enjoyed a great day at Wyong Pool for the members Christmas Party. There was great music by Trevor Simpson, special guests Street Warriors and kids enjoyed rides, jumping castles and water slides all day long with a special visit by Black Santa. 9

11 COMMUNITY PARTICIPATION AND WELLBEING FUNDS GRANTED TO NON-GOVERNMENT COMMUNITY ORGANISATIONS Darkinjung LALC is dedicated to supporting its members and the Aboriginal Community of the Central Coast through the development of valuable partnerships. Over the last twelve months, in addition to nurturing a number of partnerships already established with local Aboriginal organisations, Darkinjung LALC focused on developing new partnerships as well as strengthening the Aboriginal connection and recognition within the community. 14 CULTURE, HERITAGE AND ENVIRONMENT SUMMARY REVIEW OF OPERATIONS CALGA SAND QUARRY Darkinjung LALC continues to actively oppose a number of projects which interfere with Aboriginal land rights on the Central Coast. We have spent considerable time objecting the Calga Sand Quarry Southern Extension. Darkinjung lodged a formal objection to the extension of Calga Quarry and as a result spent approximately 14 days during August and September 2014, with a further three days during April 2015, in the New South Wales Land and Environment Court. Darkinjung considers the Calga Aboriginal Women s Site, surrounding Aboriginal sites and overall cultural landscape to have important cultural significance to Aboriginal people and more importantly, to Aboriginal women. Darkinjung has since applied to include the Calga Aboriginal Women s Site and surrounding cultural landscape as an Aboriginal Place. If achieved, this will enable the area as a whole to be protected under the NSW National Parks and Wildlife Act (1974). We are currently waiting on a decision from the court hearing and are optimistic for a positive outcome. ABORIGINAL CULTURAL HERITAGE ASSESSMENT REPORT Both local government councils located within the Darkinjung boundaries require an Aboriginal Cultural and Heritage Assessment Report to be prepared by Darkinjung as part of a developers, Development Application and the required Environmental Impact Assessment. Each request requires a thorough site inspection. This year, our Cultural and Heritage team have continued to perform our core business conducting a number of site surveys and assessments that resulted in full reports and formal letters of participation. The reports identify Aboriginal sites and outline management procedures for the developer to ensure the protection and preservation Aboriginal cultural sites. PROTECTION OF ABORIGINAL CULTURAL HERITAGE SITES Darkinjung continues to re-discover, identify and record Aboriginal cultural heritage sites. Our team has recently identified a previously unrecorded rock engraving site within Brisbane Waters National Park. We have also recorded an occupation cave and rock engraving site at Somersby and an occupation cave with stone artefacts at Kincumba Mountain. The sites are required to be registered with the Office of Environment and Heritages, Aboriginal Heritage Information Management System (AHIMS). Currently our team is conducting cultural site assessment and cultural landscaping mapping of the proposed Darkinjung Cultural Education Facility located at Mangrove Mountain. ABORIGINAL SITES CONSERVATION PROGRAM This year we have been working on the formation of an Aboriginal Sites Conservation Works and Training Program which we expect will be up and running by the end of The program will instruct the team on Aboriginal site protocol and the delicate process of restoring Aboriginal sites. Our vision is that this team will form part of our future cultural Rangers Program. The Rangers will be responsible for the inspection and maintenance of the thousands of Aboriginal sites within our boundaries. REPATRIATION OF ANCESTRAL REMAINS Darkinjung repatriated the ancestral remains of two individuals returned from Sydney University s Shellshear Museum. The remains were found at two different locations on the Central Coast a male found at Shelly Beach in 1958 and a female found at Pretty Beach, date unknown. Investigations found that the Aboriginal remains date back prior to European contact. The formal repatriation was achieved through cooperation between NSW National Parks and Wildlife Regional Staff, Darkinjung LALC, Guringai Tribal Link Aboriginal Corporation and the Office of Environment and Heritage. The ancestors were laid to rest with traditional cultural practices including a traditional smoking ceremony. 13

15 CULTURE, HERITAGE AND ENVIRONMENT SUMMARY REVIEW OF OPERATIONS DAMAGE TO ABORIGINAL SITES In April 2010, Darkinjung received a Development Application from Gosford City Council for the demolition of an existing dwelling and construction of a new two story unit block located at 396 Booker Bay Road, Booker Bay. Darkinjung formally objected to the development citing Aboriginal remains were found within the property in the 1970s. As a result, of investigations, it was found that the property contained an Aboriginal midden and possible Aboriginal cemetery. The development required further investigation, an application of an Aboriginal Heritage Impact Permit and after considerable consultation, the development was not continued. In February 2015, Darkinjung discovered that a development had commenced on the site and reported this to the Office of Environment and Heritages Environment Line. Illegal construction works commenced at the property had caused damage to the midden. The property had been sold to NSW Family and Community Service (FACS) and a group home had been partly constructed by Urban Growth. The group home did not need approval under State Environmental Planning Policies (SEPP) Affordable Rental Housing and was approved as part of Complying Development. A stop work order was imposed by the Office of Environment and Heritage and the continuation of the development works has since been suspended pending an investigation with the Compliance and Regulation Officer from the Environment and Heritage. Somersby Industrial Park has been an ongoing issue for Darkinjung since the park s inception in 2000 with a large number of registered Aboriginal sites located within the park. The site is thought to be part of a dreaming track and ceremonial grounds. In 2000, in consultation with Darkinjung, Gosford City Council developed the Somersby Industrial Park Plan of Management (POM) which details Aboriginal Heritage Management Zones. Over the years a number of these Management Zones have been encroached upon and neglected, while other Aboriginal sites within the park have been illegally damaged or totally destroyed. Recently, it has come to our attention that a number of industrial developments have been approved without Darkinjung s consultation. As a result Darkinjung is currently working with Gosford City Council, along with the Department of Planning and a number of NSW Ministers to resolve the issues of Complying Developments and the Somersby Industrial Park Plan of Management. FUTURE CULTURAL MAPPING Darkinjung is currently developing a regional-wide Aboriginal Cultural Sensitivity Mapping overlay for Gosford and Wyong Councils. Ongoing incremental damage and destruction to our cultural heritage sites and cultural landscape, through inadequate planning laws, legislation and lack of cultural education has made this issue a priority. This mapping tool will guide future developments and the management of Aboriginal sites within our boundaries. KARIONG SACRED LANDS ABORIGINAL PLACE Darkinjung has worked closely with the Office of Environment and Heritage (OEH), National Parks and Wildlife Service (NPWS) and Gosford City Council (GCC) to have the lands along Bambara Road at Kariong acquired and included into the neighbouring Brisbane Water National Park. On Saturday 27 June 2015 celebrations were held to acknowledge the acquisition and inclusion of the remaining lots at Bambara Road into Kariong Sacred Land Aboriginal Place. NSW NATIONAL PARKS AND WILDLIFE SERVICES PARKS PARTNERSHIP PROGRAM Darkinjung have been involved with NSW National Parks and Wildlife Service (NPWS) as part of the Office of Environment and Heritage Aboriginal Parks 14

16 Partnership Funding Program. The objective of the program was to bring the Aboriginal community back onto Country by assisting NPWS Rangers and staff to re-located, re-recorded land and give management advice on Aboriginal sites. Darkinjung s Aboriginal Cultural Officers were consulted to discuss management recommendations and future site conservation works, assist in conservation works, along with providing interpretation and cultural knowledge and training Aboriginal community members. ENVIRONMENT REPORT Illegal dumping Darkinjung LALC has identified five hotspot areas that have been flagged as areas of high illegal dumping activity, these being Somersby, Wallarah, Bushells Ridge, Doyalson and Crangans Bay. We have completed two area clean-ups including one at Wyee Road, funded under the Aboriginal Lands Clean-Up Program (ALCUP). The second is the North Wyong cleanup which is the currently being undertaken thanks to funding from the Environment Protection Authority. Illegal access Darkinjung has identified there were inadequate records of access to their Landholdings and accordingly introduced a restricted key system. We have had major issues in Wyong Local Government Area with unmonitored access. We will continue to monitor known access points, and will introduce covert surveillance sending images to the police, the Environment Protection Authority or the Regional Illegal Dumping Squad. Bushfire Darkinjung continues representation on the Bush Fire Management Committees in both Local Government Areas. In Wyong Shire Council we have acknowledged and approved two requests for hazard reduction at Charmhaven and Norah Head and have worked with Rural Fire Services and Crown Lands to develop and implement the Norah Head Fire Trails. In Gosford City Council, four hazard reduction certificate applications have been lodged for areas in Horsefield Bay, Kariong, Somersby and Mangrove Mountain. Conferences, Forums and Projects During this year, Darkinjung s Environment Officer has attended a number of conferences, forums and projects including: National Conservation Councils Bushfire and Ecology Conference in Sydney Environment Protection Authority Litter and Illegal Dumping Forum In partnership with Gosford City Council, Taronga Zoo and Catholic schools, Darkinjung participated in the Yellow Belly Glider Conservation Project held Kincumber Mountain. 15

18 BUSINESS AND ECONOMIC DEVELOPMENT ECONOMIC OR OTHER FACTORS Darkinjung s Community Land and Business Plan sets a goal for Business and Economic Development as To maintain economic stability through investments and management of current and future assets. During the 2014/2015 year Darkinjung has produced a gross income of $8,534, from the economic opportunities below. MENINDEE RIDGE Located at Blue Haven in the northern region of Wyong Shire, Menindee Ridge is Darkinjung s inaugural residential development. The development comprises of 109 residential lots, with 50% of the civil works associated with the development having been completed in the 2013/2014 financial year. All stages of this development has been funded by Darkinjung with the final stage due for completion in September Menindee Ridge represents the first residential land release in Wyong Shire for many years. Darkinjung has marketed and sold 98 lots with the remaining 11 lots being developed by the Land Council for inclusion in our Affordable Housing Program and other community benefit schemes. During this year Darkinjung has constructed five four-bedroom houses that have housed five Land Council members in need of accommodation. Darkinjung is preparing designs for dual occupancy villas in the final stages of Menindee Ridge for housing of married couples, single persons and elderly. WALLARAH 2 COAL MINE Darkinjung LALC brought proceedings in the Land and Environment Court to restrain the Minister and the Planning Assessment Commission from granting development consent to Wyong Area Coal Joint Venture (WACJV), the owner of the proposed Wallarah 2 coal mine. On 12 June 2014 the Land and Environment Court upheld Darkinjung s challenge. WACJV has constantly lobbied both government and industry bodies in an attempt to pass legislation, providing NSW Aboriginal Land Council with the right to reject such a proposal changed. To date their efforts have not been fruitful. Darkinjung has met with WACJV several times during 2014 in an attempt to negotiate an outcome acceptable to both parties. In early February 2015, the NSW Government requested that Darkinjung take part in a mediation process with WACJV in order to arrive at an agreement. In spite of concessions provided on behalf of Darkinjung, a resolution was not agreed upon. HALEKULANI MANUFACTURED HOME ESTATE In June 2012 Darkinjung submitted a Development Application with Wyong Shire Council for the construction of a manufactured home estate at Halekulani. The original proposal raised significant community interest, with 2,157 submissions received. The proposal was later modified, responding to some of the issues raised by the community and Council. On 13 August 2014, at a Wyong Shire Council meeting, Darkinjung s Development Application for a caravan park (to be delivered as a manufactured home estate) proposed upon Lots 259 & 627, MacLeay Drive Halekulani was refused. On 17 October 2014, Darkinjung lodged an appeal to Wyong Shire Council s decision to refuse the proposed development in the Land and Environment Court. The works were amended to reflect 99 lots and a much more environmentally and aesthetically pleasing proposal. On 1 June 2015 a hearing was held on site which provided objectors and supporters a chance to voice their opinion. After the onsite hearing, the court transferred to Wyong Shire Council Chambers and a mediation hearing was held. Darkinjung have carried out further amendments and are currently waiting to resolve these matters early in the 2015/2016 financial year. Darkinjung intend to 17

19 start work on this proposal during the 2015/2016 year. The proposed development has been given the name Gurawarang Waters, meaning is a long time in the future or past in Darkinyung language. NORTH WYONG RE-ZONING APPLICATION Darkinjung have assessed their landholdings located within the North Wyong region and have identified five parcels of land as potential development sites. To achieve statutory approvals to developments we are obliged to illustrate that we have balanced such development with preservation of the environment. We have, therefore, also identified a large number of sites currently held or under claim by Darkinjung that will be maintained as environmental holdings. Applications to rezone Darkinjung s North Wyong landholdings were lodged with Wyong Shire Council in June The State Government is yet to decide whether rezoning is applicable and all but one of the proposals has been passed by Wyong Shire Council to the State Government for assessment. As Council deferred the proposal to rezone land in Bushells Ridge Road, Bushells Ridge for a period greater than 90 days, Darkinjung was able to lodge an appeal with the Department of Planning to permit their consideration of the proposal. Darkinjung is currently awaiting hearing dates. CASAR MOTORSPORTS PRECINCT On 16 December 2014, Darkinjung s members approved entering into an agreement with CASAR Supporters Inc Pty Ltd to lease two pockets of land at Bushells Ridge for a period of 60 years. The land will be developed into a motorsports precinct with the lease including an employment agreement between CASAR and Darkinjung. The parties to the documents have been negotiating final legal terms and it is anticipated that the documents will be signed early in the 2015/2016 financial year. On 30 June 2015 CASAR lodged a development application for the proposal with Wyong Shire Council. GOVERNMENT SUBMISSIONS Darkinjung have made submissions/recommendations to the New South Wales Government in regard to Crown Land Amendments Bill 2013, Aboriginal Land Rights Amendments Bill 2013 and the Central Coast Regional Growth Plan. LAND CLAIMS Darkinjung have made 372 Land Claims under the Aboriginal Land Rights Act 1983 during this year. Darkinjung has withdrawn eight Land Claims after clarification that the effected properties were not under Crown ownership. Three properties were granted to Darkinjung Ownership by the Crown. Darkinjung have been in consultation with the Aboriginal Unit of Crown Lands in regard to processing of future land claims and the effect of the Aboriginal Land Rights Amendment Bill As a result of these discussions, Darkinjung have identified seven Land Claims that they would like to be assessed by Crown Land as priorities. 23 STAFF REPORT At Darkinjung Local Aboriginal Land Council, we like to celebrate the diversity of our staff and the energy they bring to our organisation. During the 2014/2015 financial year our capacity increased to fourteen people which represents a diverse mixture of culture and backgrounds within the Central Coast community. This increase has been driven by the ability to attract and retain suitably qualified and skilled people, which is an important factor for Darkinjung to achieve one of its objectives within our Community Land and Business Plan. Darkinjung is a firm believer in growing our employees. A traineeship is a way to combine paid employment and training to obtain a nationally recognised qualification. In January this year, it was clear that there was substantial interest in our new approach to training programs and commenced the search for three new trainees - two school-based and one full-time. The introduction of these new employees, coupled with our existing full-time trainee Adam, would see our capacity in traineeships quadruple. TELL US ABOUT YOUR TRAINEESHIP? Undertaking a traineeship in a field I haven t worked in was an overwhelming step, but one I haven t looked back on. Darkinjung has welcomed me with open arms and I have soon become a part of the family. Working with such amazing people has made it a pleasure to go to work every day and learn more about our culture while giving me experiences that have helped me grow as a person and a productive member of the Darkinjung and Aboriginal communities. - Brooke Harb, Full-time Trainee Receptionist I feel this traineeship has given me experience that not many people my age will get the chance to develop. I am currently 17 years old and completing year 11. I am enrolled in the trade school program at Wyong High as part of my trade school is a school based traineeship. 29 CHARTER The Darkinjung Local Aboriginal Land Council (referred to from now on as Darkinjung LALC ) is constituted in accordance with the provisions of the NSW Aboriginal Land Rights Act, 1983 as amended and administers the relevant provisions of that Act as they apply to the functions listed under Aims and Objectives. This Act provides that the Minister for Aboriginal Affairs may, by notice published in the Government Gazette, constitute an area as an Aboriginal Land Council Area. AIMS AND OBJECTIVES The aims and objectives and ranges of services which the Darkinjung LALC can pursue or provide must be in accordance with the objects and functions as provided for in the NSW Aboriginal Land Rights Act and set out hereunder: WORKPLACE DIVERSITY The Darkinjung LALC is an equal opportunity employer and has the required approved policy and procedures. DISABILITY PLANS The Darkinjung LALC has a Disability Plan and has the required approved policy and procedures. LAND DISPOSAL As part of stage development Menindee Ridge (Lot#562 DP# ) Darkinjung LALC will expose of individual residential lots at market value. PAYMENT OF ACCOUNTS All Darkinjung LALC accounts are paid through the accounts office as they fall due and in accordance with the regulations associated with the NSW Aboriginal Land Rights Act and other relevant financial reporting requirements. RISK MANAGEMENT AND INSURANCE ACTIVITIES Business Insurance and workers compensation insurance provided by Broker Garaty Murnane Insurance brokers has Darkinjung LALC well covered for misfortunate events whilst on the job and travel to and from the office. Site Staff are protected through proper personal protective equipment and sound work vehicles. CONTROLLED ENTITIES NAME OBJECTIVE OPERATIONS ACTIVITIES PERFORMANCE TARGETS Darkinjung Funeral Fund Pty Ltd. To provide a contributory Funeral Fund for Darkinjung LALC members, this pays up to $6, towards the funeral of fund contributors upon their death. Operated from the offices of the Darkinjung LALC and currently services 153 contributors. Collection of contributions from members and investment of Funds at interest. Budgets and performance targets are established annually. LEGAL CHANGE There has been significant changes to the Aboriginal Land Rights Act (1985) NSW as amended. These will take effect on the 01 July ACTUAL PERFORMANCE MEASURES Actual performance including comparison to budget is measured and reported to management monthly and audited annually. MULTICULTURAL PRIORITIES STATEMENT AND ANY AGREEMENT Darkinjung LALC recognises and values cultural and ethnic diversity. The council through its policy and procedures promotes protects and celebrates culture, race, religion, sexual orientation and other forms of diversity. AGREEMENTS WITH MULTICULTURAL NSW The Darkinjung LALC has no agreements in place with the Community Relations Commissioner. WORKPLACE HEALTH AND SAFETY The Darkinjung LALC did not lose any time as a result of work related injuries, work-related illnesses nor was any action taken against the LALC as a result of prosecutions under legislation covering Workplace Health and Safety. RESEARCH & DEVELOPMENT Darkinjung undertook research and development activities in a wide range of areas including Economic Development, Investment, Community Development and Culture and Heritage. WASTE The Darkinjung LALC does not have a policy with respect to the Government Waste Reduction and Purchasing Policy; however as a matter of good practice the LALC minimises the generation of waste and uses recycled materials as and when practical. 29

32 DARKINJUNG FUNERAL FUND Darkinjung is committed to what we see as our responsibility to support our members and the Aboriginal population within our boundaries. The Darkinjung Funeral Fund is an initiative designed to offer peace of mind and security to our members and their families when needed most. The cost of a funeral can be unexpected and the costs incurred are often passed onto loved ones or members of the community. The flexible funeral plans are specifically tailored to our members to help meet the costs of culturally appropriate funeral services for our people. The progression of memberships during the year, including spouse and dependant members saw an increase of approximately 22 per cent. 35 JAWUN SECONDEE PROGRAM Established in 2001, the Jawun model focuses on a two way skills sharing/transfer exercise that builds capacity within Aboriginal organisations and provides professional and personal development opportunities to secondees. Jawun was invited to operate on the Central Coast in February At the conclusion of the 2014/2015 financial year, the Central Coast organisations involved had hosted 91 secondees over three years. More than 20 people a year contributing skills and expertise to Central Coast organisations. More importantly, there is an even greater impact to this program - the different conversations about Aboriginal Australia that will be shared and taken back to the friends and family of the secondees. The total number of secondees since 2012 per organisation is - Darkinjung LALC (23), NAISDA (11), The Glen (13), Bungree (6), Mingaletta (6), Bara Barang (7), Yerin (2), Barang/Empowered Communities (23). The in-kind value for year end June 2015 alone is estimated to be $1.5 million. 38 JAWUN EMERGING LEADERS Jawun s Emerging Leaders program began in 2011 and is operated every second year. The program provides established leaders and the next generation of emerging leaders with the opportunity to engage and connect across regions and bring new ideas and influence back to their home communities. The theme for the 2015 program was Action leadership for innovative change. The candidates underwent a competitive selection process and those who were successful came from across Australia including, Inner Sydney, Goulburn Murray, Central Coast, North East Arnhem Land, the East Kimberley and Cape York. Two candidates from the program sponsors, Commonwealth Bank and Leighton Contractors, were also successful. The 2015 Emerging Leaders who represented the Central Coast were Joshua Toomey and Belinda Field. The 2015 Emerging Leaders were invited to the following private receptions where they prepared and presented questions based on the program theme: Senator the Honourable Nigel Scullion, Minister for Indigenous Affairs and a tour of Parliament House with The Honourable Alan Tudge, Parliamentary Secretary to the Prime Minister The Jawun Board Noel Pearson, Marcia Langton and Sean Gordon EMERGING LEADER BELINDA FIELD I have been on a remarkable leadership journey this year as a member of the 2015 Jawun Emerging Leaders program. I ve been very fortunate to travel alongside seven other Emerging Leaders from around the country, all bringing our cultural uniqueness to the group. I ve travelled parts of this country that I never thought I would. Travelling to Cape York, particularly Hope Vale was very moving. Empowered Communities and Welfare reform has initiated positive, measured change. Observing direct instruction as a teaching method and watching a traditional language class moved me. Jawun, celebrated its 15 years with official proceedings and formalities taking place in Canberra. Amazingly, along with my other Emerging Leaders, I sat, dined and talked frankly with Minister Scullion and Secretary Tudge. The highlight of the celebratory trip was spending undivided time with Noel Pearson, Marcia Langton and Sean Gordon - slightly star struck, however, thought provoking in terms of their leadership journey. I am grateful to these influential Aboriginal leaders that work tirelessly to advance our people, from these experiences I am both driven and humbled. 51 SUMMARY REVIEW OF OPERATIONS COMMUNITY LAND AND BUSINESS PLAN The Community Land and Business Plan builds on the achievements of Darkinjung Local Aboriginal Land Council during the past three years. It continues the direction set in the previous Community Land and Business Plan (CLBP) where we have improved our governance and operational functions, enhanced our profile within the business sector, extended our leadership at both a regional and state level, fostered strong partnerships with our Aboriginal community and organisations and secured a financially strong organisation. Darkinjung LALC can be immensely proud of what the organisation has achieved through the commitment, enthusiasm and efforts of our members, board and staff. MANAGEMENT AND ACTIVITIES COMMUNITY LAND AND BUSINESS PLAN 2012/2015 The Darkinjung Local Aboriginal Land Council Annual Report was established in line with the Darkinjung Community Land and Business Plan and was developed to provide the Members, Board Members and the NSW Aboriginal Land Council with a greater understanding of Darkinjung s achievements since the adoption of the Plan. The legend below is the reporting technique used to indicate the progression of the goals and objectives of Darkinjung. Red light means that no action has been taken for the goal/objective. Orange light means that action has been taken by the board or the CEO and is further progressing. Green light means that action has been taken and a strategy has been developed and implemented. Black light means that the goal/objective has been achieved and that no further action is required other than ongoing monitoring/management. Note: Actions that have achieved the status of being complete must continue to meet the reporting requirements as set out in the NSW Aboriginal Land Rights Act, and may be subject to change due to policy and procedural requirements and amendments to the NSW Aboriginal Land Rights Act. Concept designs have been developed and four possible locations for the construction of the Centre have been identified. Further works is to be conducted on the feasibility and a funding source identified. Darkinjung conducts meetings and further comply with the ALR Act of 3x ordinary meetings and 1x Annual General Meeting. In addition to this there were 2x Extra Ordinary Meetings held. January January Continue to provide resource information to assist our community in researching their family history. 1.4 Expand youth programs that encourage, mentors and supports Aboriginal youth to embrace culture, community and develop leadership skills. 1.5 Participate in cultural programs to ensure that our members have an opportunity to share and gain knowledge of other communities. 1.6 Continue to develop, maintain and formalise partnerships and relationships to enhance the outcomes and possibilities within the Aboriginal community. 1.7 Continue to provide advocacy, support in attaining and upholding fundamental human rights for our people. 1.8 Funeral Fund maintain and promote the Darkinjung LALC funeral fund to improve its viability and services to members. 1.9 Support Aboriginal Elders groups that reside within the Darkinjung LALC boundaries. Information is provided to community people wanting to become members and assistance and support is provided them in completing their membership application forms. Darkinjung support and sponsor a wide range of programs that support youth initiatives i.e. Indigenous Surf Life Saving Program, NAISDA End of Year Show, Scholarships for students and sporting programs. Darkinjung are actively involved in cultural programs both locally and externally with other communities. Darkinjung and members also attended the Cultural Gathering to support changed to the Crowne Land Amendments Bill. Partnerships with all key stakeholders have been developed and maintained to ensure maximum opportunities are created for the Aboriginal community. This is standard practice for Darkinjung especially matters pertaining to Culture and Heritage. The Darkinjung Funeral Fund is currently being reviewed to ensure that it is operating to the funeral fund Act and a brief is being developed for the board to address the issue of the existing loan. Elders are supported through various programs throughout the year and have access to the Howarth Street for their programs. The Housing sub-committee is drafting a policy document for consideration by the Board in 2015/2016 year. Partnerships have been developed with other Organisations to develop a facility to provide service to the aged, frail and young disabled. Darkinjung provide significant community benefit schemes that enhance and add value to the communities social, health and wellbeing. Further to this Darkinjung are working to ensure that all residential properties are of a high quality standard. During the year Darkinjung developed a new Affordable Housing Policy. Darkinjung has been the masthead for the establishment of a Jawun corporate partnership on the Central Coast with the support of 6 other Aboriginal Community Controlled Organisation s on the Central Coast that support and deliver services to our community. Darkinjung initiated the development and submission for funding on behalf of a consortium of Not For Profit service providers, to construct a facility on Darkinjung owned land at San Remo. Regional Development Australia Funding of $2.7M secured in August New Government revoked funding in January Negotiations continuing. Darkinjung led consortium of Central Coast Aboriginal Community Controlled Organisation s to secure three year funding form NSW Government to deliver Local Decision Making initiative and establish Central Coast Aboriginal Regional Partnership Agreement which we now call Barang Regional Partnership. Darkinjung continue to developed a good working relationship/ partnership with the Central Coast Aboriginal men s group to undertake cultural affirmation activities and participated in NPWS Aboriginal Cultural Gathering. Darkinjung have again been successful in its bid to the Office of Environment and Heritage and local government for Illegal Dumping funds to assist in securing, protecting and regenerating our land. Recorded and registered a number of new Aboriginal sites and updated sites on OEH AHIMS database. Participate in OEH NPWS Parks Partnership Program. Made application to OEH for Calga Aboriginal Place. Darkinjung continue to utilize our data base to assist us with the management of our Cultural Heritage sites and furthermore to protect sites from being destroyed through development. Darkinjung continued to vigorously defend Aboriginal rights to protect Cultural and Heritage sites that have been threatened by development in the Land and Environment Court such as the current objection to proposed development at the Rocla Sand Quarry at Calga. Acquisition and inclusion of lands at Bambara Rd into Kariong Sacred Lands AP within National Park. Report damaged and destroyed sites to OEH, EG Booker Bay and Somersby Industrial Park. Developing an Aboriginal Cultural Sensitivity Mapping overlay for Local Councils. Working with Gosford City Council and Department of Planning and a number of Ministerial Offices to resolve issues of Complying Development, SEPP, review Council LEP s and reviews the Somersby Industrial Park Plan of Management. Darkinjung are engaged at all levels of the development process to ensure that we are protecting, preserving and maintaining our cultural site. Review and update Plans of Management for Somersby Industrial Park and Ware Warren AP. Darkinjung have again been successful in its bid to the Office of Environment and Heritage and local government for Illegal Dumping funds to assist in securing, protecting and regenerating our land. Darkinjung s Illegal dumping Environment Officer will continue to identify incidents and collect information of the pile, report to EPA or LGA rangers and organise clean up and disposal. Within this reporting year 150 piles of waste have been found, 26 piles have been cleaned up to date, 124 piles will be cleaned up in the North Wyong Clean-up ALCUP Grant. Access issues- ranges from dog walkers, motorbike riders, 4x4 drivers to Contractors, a new restricted key system was introduced to secure and restrict access to the landholdings and keeping records of who is accessing what properties and for what reason January January January August

Darkinjung s policies are the collective voice of the Members, Board and Staff. Policies are the big-picture guidelines that set out what we are to achieve, the long term vision and goals along with the performance standards and expected outcomes. The policies provide the overarching framework under which procedures are then designed. Policies are reviewed annually and amended as required by current practice and legislation. Darkinjung successes are promoted through our website, social and local media and newsletters to ensure that our members are informed. Darkinjung operate and function to the highest professional standards and ensure that all presentations and reports meet legal and fiduciary standards. The reports are continually updated and evolve to meet the changing needs of Darkinjung. Without good, qualified staff, Darkinjung wouldn t be able to serve its Members. By creating a strong brand in Darkinjung we have been able to maintain excellent staff retention. This year Darkinjung s internal capacity increased to 14 employees and will continue to increase. We have implemented an induction program for new staff through an induction program and seen an increase in transferable skills, a number of staff have been redeployed to various positions throughout the organisation. All Board and staff of Darkinjung undertake professional development and training throughout the year. The increase in skills and abilities can be demonstrated in their achievements. We aim to both improve performance in relation to current positions and also develop capabilities for future roles. Plans are developed and utilised to ensure that the goals of the CLBP are being achieved. 3.7 Maintain funding status in accordance with NSW ALR Act. Darkinjung this year continued to achieve 100% compliance in all Performance Improvement Plan (PIP) and Risk Assessment System (RAS) areas. With the areas being Governance, Human Resources, Property Management, Financial Management and Administration. Darkinjung is still considered to have low risk for the third consecutive year. These partnerships are being developed to ensure that there is greater opportunity for Aboriginal business development and social enterprise development. Darkinjung are currently working with the Crown Lands Department to resolve outstanding land claims, particularly seven land claims for sites identified as priorities. Darkinjung have completed 75% of the development Blue Haven residential subdivision known as Menindee Ridge. Darkinjung have approved and agreed terms for a 60 year lease over land at Bushells Ridge to CASAR Supporters Inc who will develop a motorsports precinct. 3.4 Manage the investment funds in the best interests of Darkinjung LALC. The investment funds are managed within the requirements of the NSW ALR Act and have been maintained and sustained during difficult financial times. 3.5 Engage, negotiate and assist in the development and the promotion of Aboriginal enterprises. 3.6 Continue to build and strengthen our networks at local, regional, state, national and international levels to identify business development and investment opportunities. 3.7 Upgrade, acquire or dispose of rental assets as per the requirements of the NSW ALR Act. These partnerships are being developed to ensure that there is greater opportunity for Aboriginal business development and social enterprise development. Opportunities have been identified in the proposed manufactured home estate located at Halekulani. Darkinjung have continued to build its profile and are working with many corporate partners to identify future opportunities to invest. During the past twelve months, Darkinjung have completed both minor and major renovation works and has completed construction of three houses to be used for affordable housing in our Menindee Ridge development at Blue Haven. 64 PHOTOGRAPHERS PROFILE BILLY BRIDLE - PHOTOGRAPHER Billy is a Central Coast-based photographer, snapping shots for the last 24 years. Billy s love of photography first started when he was 16 years old after he was given his first manual SLR camera. From that moment on, he was hooked. Billy has had an extensive career, travelling around the country working with magazines, newspapers and as a professional photographer. In 2007, his skills brought him back to the Central Coast where he established his own company BillyB Photography. Darkinjung Local Aboriginal Land Council has been working with Billy since 2011, engaging his services on a regular basis for many of the Land Council s meetings, events and social activities. Darkinjung CEO Sean Gordon said, Billy has captured many great moments in Darkinjung history over the years. He is a pleasure to work with and he is someone the Land Council can depend on. Billy said, I have enjoyed working for Darkinjung and getting to know the local Aboriginal community and Barang organisations. A highlight of my year is always the NAIDOC Week and Family Fun Day celebrations that Darkinjung puts on. They are events that I participate in each year and is something I always look forward to, concluded Billy. In his spare time Billy also enjoys being involved as a volunteer fundraiser with IMP and is passionate about a healthy and positive lifestyle. He is heavily involved with the Knockout Health Challenge - Central Coast team with their fitness and healthy eating program. On behalf of Darkinjung Local Aboriginal Land Council, we would like to thank Billy for his hard work and dedication to our organisation.
