5 Introduction This report summarises consultation during the second phase of consultation relating to the Southern Pipeline project the Preliminary Route Options phase, involving the investigation of a range of options. A report on the first phase of consultation (during the Initial Route Options phase) is attached in Appendix 3. The phases of consultation correspond with the various stages of the project and are as follows: 1 st Phase Inception and development (development of Constraints Map and Initial Route Options) 2 nd Phase Options investigated (Preliminary Route Options) 3 rd Phase Assessment of Environmental Effects for the Preferred Route 4 th Phase Construction This report should be read in conjunction with the community communication and consultation plan (Communications Plan, updated January 2006), minutes of meetings (Appendix 1), Summary of Consultation Phase 1 (see Appendix 3), and Cultural Impact Assessments (CIA) provided by hapu and iwi. Stakeholders Consultation and communications during the second phase has followed the direction provided in the communications plan and learnings from Phase 1. Consultation and communications have been conducted with the following groups: Tangata Whenua (6 hapu and 3 iwi); Ngai Tukairangi Orchard Trust (a significant land manager at Matapihi); Utilities (power, telecommunications, rail, roading, gas); City Council service departments; Other statutory authorities (DOC, EBOP); Community groups. Method of Consultation and Communication The Communications Plan (September 2005) identifies the following tasks for Phase 2, the Options Investigation Phase. Brochure No.2 (mail drop); Communication with stakeholders; Update of issues database; Meetings with Project Steering Group; Meeting with Tangata Whenua Collective; Meetings with Tangata Whenua iwi and hapu; Meetings/site visits with significant landowners; Website page; Community open day(s); Review of the plan. The intent of Brochure No.2 had been to provide general information on wastewater pipes. However, on review, it was recommended by the Project Steering Group (PSG) that the brochure not be sent to all potentially affected residents as the route options affected a very large proportion of residents and there was a risk of causing undue anxiety and concern for numerous routes that would not proceed. As an alternative, an article was published in Our City Views on 2 December 2005 providing general information on the project and inviting interested parties to contact the Project Manager. 6 A further brochure will likely be prepared during Phase 3 - Preferred Option, for distribution within the affected community. Community open days were also postponed until later in the project when a preferred route would determine the communities potentially affected. The Project Steering Group also recommended that the project team consult with Waitaha, who had not previously been identified as an iwi with interests in the project area. The consultation issues database was updated during January 2006, thus providing a tracking system for reference during preparation of the AEE. The stakeholders database was also updated and reformatted to provide better use for mail outs. Meetings of the PSG continue, however, a meeting with the Tangata Whenua Collective was not required at this stage. The webpage on the TCC website has been maintained. A media opportunity using a display set up in the foyer of the Council was published in the local Council newsletter. Communication with stakeholders was facilitated by letter. As per the communications plan and learnings from the first phase of consultation, face to face meetings were held with Tangata Whenua groups and follow up issues dealt with by telephone, and post. Eight meetings were held with Tangata Whenua hapu and iwi. Minutes and file notes of meetings are attached in Appendix 1. Contact by telephone was maintained during the second phase with all 11 hapu and iwi with interests in the Southern Pipeline route options. A spreadsheet was used to track iwi and hapu receipt of letter and map, their wish to prepare a CIA and whether they required further meetings. Ngaiterangi and Ngati Ranginui iwi authorities confirmed that they did not require meetings or CIA as these were being conducted by the hapu of each iwi. Ngati Ruahine did not have the capacity to complete a CIA and were comfortable with Ngai Tamarawaho looking after their interests during this stage. Ngapotiki maintain the position of not wishing to participate in consultation and maintaining their opposition consistent with the Wastewater Consent Project. Communication with stakeholders was facilitated by letter. A map was produced detailing the various route options, with a corresponding explanation of each route which was provided to key stakeholder groups and organisations. A list of those organisations to which the information package was sent, is appended. Utilities and City Council internal departments were posted the map with notes and requested to respond in writing. Meetings were held with Transit NZ, EBOP and Ngai Tukairangi Orchard Trust who are a significant land manager on Matapihi Peninsula. Community groups and other stakeholders were posted a letter with map and the brief outline of route options. These groups were asked to indicate any interest and the nature of involvement required. Meetings were also held with Council Takawaenga (Maori unit) staff to discuss the transition of facilitation and co-ordination of consultation by consultants to Council staff. Summary of Key Issues Raised During Consultation Tangata Whenua Ngati Kuku The status of the Maori Road on Matapihi needs to be investigated; 95% of Matapihi is Maori land; A relationship with Council is important protocols are in draft form; The 3 hapu of Matapihi will meet to discuss the pipeline; List from consultation database; Ngati Kuku oppose pipeline until CIA is completed and more meetings satisfy concerns; Matters of detail to be understood for CIA; Wish to hook on to pipeline; Hapu want retention of Maori land; T05044_002_AC_AC_ _CB Page 2

Ngai Tukairangi / Ngati Tapu (Matapihi) The status of the Maori Road on Matapihi needs to be investigated; Preparation of Cultural Impact Assessments; Opportunities for reticulation of Matapihi; Community development initiatives including building homes on Maori land; Historical water issues on Matapihi and provision of appropriate water supply; Formal negotiation process required; Archaeological sites; Pedestrian and cycle access; Need for a community hui; Need to plan for years growth. Ngai Te Ahi Need further information (aerial maps, archaeological sites map, CIA for wastewater consents, last minutes); Crown land south east of Welcome Bay roundabout is Maori land administered by the Moana Maori Trust Board. Ngati He Concern for Welcome Bay Maori land option require list of owners; Biggest concern is works in the harbour; Visual effects of bridge structure from Maungatapu to Matapihi; Request for a map showing current system; Whales and dolphins were in harbour 7 years ago. Stopped by structures; Movement in harbour channels; Effects of drilling on water springs and geothermal; Request for archaeological report when finished. Ngati Pukenga Ngati Pukenga very concerned with a cross harbour route at Asher Road (proximity to sites of significance including urupa and effects on the tahuna). Ngai Tamarawaho Costs of consultation; Pa site affected by section 44 (Route K to Birch Ave); Relationships during the project if Route K was chosen; Archaeological assistance required. Ngapotiki Ngapotiki maintain their opposition to the Southern Pipeline and refuse to participate in consultation; A meeting and correspondence was undertaken by the project manager regarding Ngapotiki opposition to petrometer testing on Rangataua Bay; Concern and opposition to crossing the Rangataua Harbour. 8 Ngai Tukairangi Orchard Trust The status of the Maori Road on Matapihi needs to be investigated; Some blocks on Matapihi not managed by the Trust; Reticulation for marae communities; Retain ownership of Maori land; Provide certainty for pipeline service long term; Lease or easement; Notification of owners/residents before construction; Construction avoids kiwifruit picking/packing season (May-June); Effects on opportunities in the future; Effects on production; Archaeological sites. Ngai Tukairangi Capacity of Te Maunga plant to meet extra demand; Alternative routes; Hook-ups to the pipeline; Treat the waste at source; Damage/maintenance. Regulatory Authorities and Other Organisations City Council Parks and Leisure do not have a preferred route, however prefer no new or expanded pump stations in reserves. Other processes need to be considered with a preferred route, e.g. reviews of reserve management plans; consideration of alternatives to use of reserves; consultation with adjoining landowners (refer Memo from Parks & Leisure dated 2 December 2005; notes of meeting 2 February 2006); Transportation section has interests in cycleway over pipe bridge, cycleway on pipe route in K Valley and easements on land used for footpaths. Issues raised include digging up the road and services etc relocation if gravity sewer. Environment Bay of Plenty Contact in relation to geotechnical investigations and extent of environmental assessment required (refer letter dated 18 November 2005) Meeting held on 25 October 2005 general discussion on project and options; consenting requirements etc Works in streams subject to scour consideration for design If directional drill under harbour, require detail on construction methodology, confirmation that contractor resources appropriate etc Need to justify any new bridge, and structure would need to match profile of existing bridge Department of Conservation Impacts limited to stream crossings and crossings of Harbour; Drilling to minimise disturbance to tidal flats, appropriate buffer to estuary edge; T05044_002_AC_AC_ _CB Page 4

Tai Te Ora Public Health Seek information on potential for system overflows and effects; Request information on pump stations and system details with particular regard to odour nuisance and odour management; Reticulation of Marae and school on Matapihi; (refer telephone record 11 November 2005). Transit New Zealand Meetings held on 10 August, 25 October 2005 and 27 January 2006; Issues relating to extent of works within State Highway, construction methodology, alignment options; Consideration of future State Highway upgrading proposals particularly widening of SH29 north of Poike roundabout, grade separation of Hairini interchange, Maungatapu Matapihi bridge; Plan of route options and locations of State Highway crossings provided to Transit 13 February Port of Interest in any delays or inconvenience to Port traffic during construction phase; (refer letter dated 9 November 2005). ONTRACK Crossing rail at right angles will be treated as any other utility crossing; Routes that inhibit the development of the railway (e.g. future track doubling) by running inside the railway corridor would be discouraged. Utilities Telstra Clear Contact relating to location of services etc; No obvious concerns for southern pipeline. Would like normal care not to harm their hardware, wish to remain informed of project progress; At some stage Telstra planning a duct from BayFair along Matapihi Rd to the Railway bridge. Where To Next Further specific meetings are to be held with key organisations such as Department of Conservation and Environment Bay of Plenty. Follow up consultation with hapu and iwi is expected to continue following receipt of cultural impact assessments and the Steering Group recommendation and Council endorsement for the preferred route. This consultation as per the communications plan will involve: Meetings of the Project Steering Group; Meetings with affected hapu and iwi; Site visits; Meetings with any directly affected landowners; Media release; Open day; Brochure No.2 providing information on the preferred route; Review of the communications plan. There will be opportunities to hook on in the future. (Joe?) Can t we hook up to the pipeline, just like the watermains? (Barry) Not individual homes, risks to great. Need a pump station to do it. Barry clarified that wastewater and sewage were terms used to referred to the same thing. (Joe?) You could look at laying a second main similar to the water supply. (Barry) Opportunities to make submissions to the ten year plan Barry mentioned the development possibilities at Matapihi were restricted by the Smart growth strategy. In the strategy it was identified that Matapihi was to remain a rural zone and that reticulation was not to be extended to these zones. (Hayden Henry) If you make your crap over there, treat it over there. The crossing is an issue (Helen Te Kani) Where is Smart Growth, why aren t they here, they should have come with you. (Mahaki Ellis) Need junctions for future connections (Hayden Henry) What happens if the pipe breaks? What is the maintenance if the pipe is 6 metres under ground. (Barry) Nothing can be guaranteed not to break but all possibilities and risks can be minimised. We want to do it once and do it properly. Rehua offered to pass onto Sandy Tuhakaraina a message about the proposed geotechnical testing across Rangataua Bay. Tuesday 13 December, tried phoning Sandy to advise her of the proposed testing. No answer. Tuesday 13 December, ed Sandy with details of proposed testing and offer to meet on site Sunday 18/12 at 1500 to describe the proposed testing. Sunday 18 December. No one turned up for the 1500 site meeting. Monday 19 December, first thing. Testing commenced. One test completed before tide came in too far. The following events occurred 19 December Around 1000, Hineuni Cooper phoned asking about the testing across the Rangataua Bay, why hadn t Ngapotiki been informed and that there were people upset that it was occurring and she requested the testing stop. I advised her of the sent to Sandy and forwarded her a copy of the and advised the testing would continue. Around 1500, Sandy Tuhakaraina called into the Council office to see me. Sandy advised that due to Ngapotiki s opposition to all aspects associated with the current waste water treatment location, Ngapotiki were totally opposed to any testing and that the testing was upsetting some of their hapu and asked the testing be immediately stopped. I explained how the testing had virtually no environmental impact and was necessary to determine which of the four routes would become the preferred route. Sandy again confirmed the hapu s opposition to the testing. I enquired whether Ngapotiki would be willing to undertake a CIA. Sandy advised that we should use the CIA undertaken for the ocean outfall and Te Maunga WWTP about which Ngapotiki were totally opposed. I enquired about avenues for consultation. Sandy advised they had submitted protocols to CE and Mayou and were only willing to meet in terms of the protocols they had submitted. T05044_002_AC_AC_ _CB Page 26

31 I advised I could not forward the protocols, but could meet with then on all issues relating to the Southern Pipeline project. Upon checking with Kevin Stratton, I called off all further testing from the Asher Rd side and only one further test on the Te Maunga side. I advised Sandy of this and she left. Around 1600 Sandy requested confirmation of the cancellation of the testing. This was sent around Copy of strings below. Sandy, Thanks for coming in and explaining the situation to me. I have instructed the testing from the Asher Rd side to stop. There will be one further test undertaken adjacent to the ponds stopbank on the Te Maunga side accessed from Tip Lane and this will be finished late today, then the consultants will be pulling out with no further testing being undertaken at this stage. This will result in substantially fewer tests than what we were planning to undertake. Our next stage is to use the information we have gather on all 4 possible route options to choose a preferred route. The preferred route will be decided by the Project Steering Group using a quadruple bottom line criteria, i.e. economical, social, environmental and cultural considerations. The Project Steering Group consists of 4 Councillors and 2 (3) Tangata Whenua representatives including Rehua Smallman. The stopping of the tests has not eliminated this route option as a possible route for the Southern Pipeline. Any elimination will be via the quadruple bottom line assessment. I don't know which route will become the preferred route, albeit at this stage the across Rangataua Bay route does not appear top of the list. Should the across Rangataua Bay route become the preferred route, further testing would be required and if this is the case I'll advise you of the situation before any further testing is undertaken. As mention at the meeting, I'm not in a position to establish the protocol agreement between Council and Ngapotiki, however I'm willing to meet with you or representative of your hapu to discuss the Southern Pipeline project. They had been very clear about their concern for crossing the tahuna. If Ngapotiki was concerned, the project team required to have something in writing, like the CIA or a letter. The project team were able to meet at short notice. Antoine offered to set up a meeting with Ngapotiki. The offer was declined by Sandy who proposed that a letter would be better. Antoine informed Sandy that any decision by the PSG for a preferred route as well as dropping other options needed to be substantiated by evidence, such as written letters, cultural assessments from Tangata Whenua and minutes of meetings. If a letter was sent it would need to articulate what the issues are, not just oppose the route. Sandy expressed a wish for a meeting with other hapu affected by the pipeline. 38 Southern Pipeline Summary of Consultation Update 16 th September 2005 This summary covers the identification of Tangata Whenua, confirmation of contacts, nature of consultation to date, results, learnings and the next steps for consultation. The Southern Pipeline Project is a proposal to construct and operate a major wastewater pipeline between Maleme Street and Te Maunga Waste Water Treatment Plant,, Bay of Plenty. The project involves significant costs and potential effects that will require consents under the RMA1991, possibly authorities under the Historic Places Act 1993 and approvals in the Long Term Community Plan under the LGA2002. The project has the potential to affect the interests of 8 hapu and 3 iwi. A communication and consultation plan has been prepared and regularly updated for the project. The plan is a guideline and reference point for consultation with Tangata Whenua during the project. The identification of Tangata Whenua was conducted in liaison with City Council Maori Liaison staff. TCC have produced a series of maps and a contact directory to assist applicants. During consultation with Tangata Whenua confirmation of primary contacts and appropriate bodies was made. These contact details have been added to the stakeholders database contained in the communication and consultation plan. The following groups have been identified: Ngai Tamarawaho Ngati Ruahine Ngai Te Ahi Ngati He Ngai Tukairangi Ngati Tapu Ngati Kuku Ngapotiki Ngati Ranginui Ngaiterangi Ngati Pukenga The nature of consultation to date has included a presentation to the City Tangata Whenua Collective (30 June, 2005) meetings with representatives of all 3 iwi and 8 hapu (during July and August 2005), the provision of maps, aerial photography, and brochures. Minutes for each meeting have been prepared and distributed for confirmation. A website page dedicated to the project has been established, there have been two City Views articles on the project and a brochure is available to the general community. Generally consultation to date has been constructive and honest. Tangata Whenua have openly identified locations of sites and areas of significance, significant issues and articulated preferences for consultation and information requirements. Of the eleven groups, two have stated their opposition to the project (Ngati He and Ngapotiki). This opposition (before routes have been identified) appears to be associated with the cultural concerns with using water as a medium for transporting waste and the presence of the Te Maunga WWTP, rather than the location or route of the pipeline. Ngapotiki refuses to participate in consultation. Groups associated with Matapihi (Ngati Tapu, Ngati Kuku, Ngai Tukairangi) have been supportive, the primary driver being the wish to settle historical infrastructure issues and opportunities to reticulate papakainga. The remaining groups (Ngai Tamarawaho, Ngati Ruahine, Ngai Te Ahi, Ngati Pukenga, Ngati Ranginui, Ngaiterangi) are neutral at this stage, awaiting confirmation of preferred options. Consultation to date has more often been organized by phone and (as letters do not appear to be very effective). Remuneration of costs relating to consultation has been inconsistent with some hapu not requiring payments, whilst others have forwarded invoices requesting payment for time as well as venue hire T05044_002_AC_AC_ _CB Page 34

39 and reimbursement of other expenses. Council has discussed this matter and formalized their position by letter to all iwi and hapu. The position has caused limited resistance and some confusion. Legal advice has been sought regarding Ngapotiki s refusal to be consulted. The recommended approach is to provide all information to the representatives and continue to offer opportunities for Ngapotiki to participate in the process. The project team conducting consultation has learnt the following: Face to face consultation at Tangata Whenua and Council venues are effective Representatives like to see maps, particularly aerial photographs All meetings have observed local tikanga (such as starting and closing with karakia and mihi), at Tangata Whenua venues refreshments provided There is generally an expectation that Tangata Whenua costs of participation will be recovered from TCC The main issues raised during consultations include proximity and effects to sites and areas of significance including water bodies (Waimapu River, Rangataua Bay, the retention of Maori land, opportunities for servicing of existing and future development, costs of consultation, SmartGrowth actions regarding water/waste minimization, cultural impacts of infrastructure and environmental impacts. Historic infrastructure issues have also been raised, e.g. those relating to the existing water supply pipeline at Matapihi and the presence of the power cables at Maungatapu. Matapihi representatives expressed a view that the peninsula has been used as a major service corridor (water pipeline, power cables, state highway, railway) yet the community does not necessarily benefit from these services as others do. The next consultation phase will involve meetings/liaison with trustees of land blocks affected by potential routes, meetings with hapu and iwi representatives regarding geotechnical work and then seeking responses to a preferred route and other options. This will also signal the commissioning of Cultural Impact Assessments (CIA s) to be conducted by Tangata Whenua that will influence the assessment of effects. A key component of the CIA s will also to be to identify possible ways in which to avoid or minimize adverse effects on cultural values and sites.
