1 1 5 1 Overview and Important Dates 2 General Terms 3 Application Form for Kabinett Please submit pages 3 5 Dear Gallerist, Your gallery has been selected for inclusion in the Galleries or Edition sector for the 2016 edition of Art Basel in Miami Beach. As a result, you are invited to submit a proposal for the Kabinett sector, which offers a platform for curated projects such as one-person shows, installations, film/video programs, and collections of art-historical material, installed in a separate area of your Galleries booth, but separated from the booth s other artworks by architectural delineation. Proposals may be submitted only by galleries admitted to the Galleries or Edition sector. More than one project may be submitted, but each gallery can only have one Kabinett. Promotional benefits for the sector include special Kabinett guided tours for VIP guests and a special publication devoted to the sector's projects. 2 2 5 GENERAL TERMS Admission A submitted application does not automatically result in admission to the Kabinett sector. Decisions on admission to the Kabinett sector are made by the Art Basel in Miami Beach Selection Committee, a jury comprised of expert gallerists. Acceptance of submitted projects for the sector will be confirmed in writing. Deadline for applications Please note that applications received after August 8, 2016 may not be considered. Services provided by Art Basel Special mention on the floor plan and in the additional promotional print material of Art Basel's show in Miami Beach; Kabinett publication devoted to the sector's projects; additional booth signage; Marketing and public relations by the Show Management of Art Basel; Kabinett guided tours for VIP guests. Technical information The same equipment and technical services proposed for the Galleries sector apply for Kabinett. Price There is no handling fee for participation in Kabinett. All expenses involved in presenting the project (walls, lighting, ceiling, painting, electrical outlets, etc.) are the responsibility of the exhibitor. If you are submitting more than one project, please make a separate application for each proposal. Insufficiently documented projects will not be juried. The descriptive text will also be used for signage in the Kabinett. A Kabinett sign (A3 format: 29,7 42 cm / 11.69 16.54 in) will be provided by Art Basel.

4 4 5 CONDITIONS The Kabinett area occupies part of the regular booth area, but must be separated from the other artworks and through architectural delineation such as a 3-wall-enclosure, header, painted walls, colored carpet and/or a ceiling. The architectural delineation must be approved by the Show Management. The descriptive text will also be used for signage in the Kabinett. A Kabinett sign (A3 format: 29,7 42 cm / in) will be provided by Art Basel. It has to be installed by the Exhibitor on a wall within the delineated Kabinett space. Admitted projects must be realized according to the submitted description. Please note The application documentation, once submitted, remains in the possession of Art Basel U.S. Corp. and will not be returned. Art Basel U.S. Corp. retains the right to use or dispose of the documentation as they see fit.

5 5 5 Terms of application Only galleries selected for the 2016 edition of Art Basel in Miami Beach are eligible to apply. The conditions of the Art Basel in Miami Beach Exhibition Regulations, the Booth Design Regulations, the Miami Beach Convention Center Fire and Safety Requirements, the Limitation of Liability and Responsibility and the online Showkit apply and are binding as part of the application agreement. Art Basel U.S. Corp. must be in receipt of this application by August 8, The undersigned gallery guarantees the authenticity of the artworks presented at Art Basel and confirms that the artists proposed are aware of the application and agree to it(unless the application is posthumous). Admission The number of selected projects is limited. Decisions on admission are made exclusively by the Selection Committee. Terms of admission The terms of admission for Art Basel are specified in the Exhibition Regulations, which are available for download at artbasel.com/miamibeach/applications. The properly completed application, bearing a legal signature and submitted in compliance with the deadline, is understood solely as an application and confers no automatic right of admission to the show. The contract confirmation from the Show Management removes the conditional status of admission and gives legal validity to the exhibitor contract. Withdrawal from contract and penalties Exhibitors withdrawing after receiving confirmation of admission are subject to a penalty charge. All withdrawing exhibitors agree to pay this penalty. The penalty is USD 2,000 for withdrawal on or after October 2, Applicable regulations The exhibitor confirms that they have downloaded and read a copy of the Exhibition Regulations, the Booth Design Regulations, the Miami Beach Convention Center Fire and Safety Requirements, the Limitation of Liability and Responsibility and the online Showkit, and agrees such regulations are binding on the exhibitor and agrees to strictly observe and follow these regulations and requirements, especially in regard to the construction of their stand. Contract confirmation by the Show Management If accepted, the exhibitor will receive a confirmation by from the Show Management that his application has been approved by The Committee. At this time, the admission to The Show ceases to be provisional, and the exhibitor contract becomes legally binding in its entirety upon the exhibitor, including, without limitation, the Showkit. After confirmation, the exhibitor will be informed of the stand positioning plan showing the stand's area and location. Place of jurisdiction This contract shall be governed and construed exclusively in accordance with the laws of the state of Florida. All disputes under these regulations shall be resolved by the courts of the state of Florida including the United States District Court for the Southern District of Florida, and the parties all consent to the jurisdiction of such courts, agree to accept service of process by mail, and hereby waive any jurisdictional or venue defenses otherwise available to it. However, Art Basel U.S. Corp. shall be entitled to pursue any claims it may have against an exhibitor before the courts holding jurisdiction for the place at which the exhibitor has their domicile or seat.
