Motion made by Mr. Kinsey, seconded by Mr.- Concannon, that same be approved as read. Journal of the October 2, 1967 meeting (480th) was read. Motion made by Mr. Kinsey, seconded by Mr. Parker, that same be approved as read. CONSDERATON OF REPORT OF PUBLC NTEREST HEARNG N SUBDSTRCT NO. 257 (RAYBURN AVENUE SUBTRUNK). Report of Public nterest Hearing in Subdistrict No. 257 (Rayburn Avenue Subtrunk) addressed to the Board of Trustees, dated October 9, 1967 (Subdistrict Report Book, Vol Vll, Page 6) signed by Jack B. Enger, Engineer, Subdistrict Development, was presented and read. Mr. Kaiser said he had conducted the public hearing held" October 4, 967 at the J. Milton Turner School, in accordance with Resolution No He said the procedures followed by MSD in the development of this project were outlined. t was explained that the bond issue would build the necessary trunk or interceptor sewers.

2 t was further explained that the septic tanks could not be abandoned, nor could any of the laterals necessary to serve Meacham Park be installed until the trunk or interceptor was built. Mr. Kaiser said that he asked those who were in favor to stand, and all those present did so except two who explained they lived outside the subdistrict. Motion made by Mr. Parker, seconded by Mr. Kinsey, that the above Report be received and filed. CONSDERATON OF RESOLUTON NO. 962 DECLARNG MPROVEMENTS TO BE N THE PUBLC NTEREST N SUBDSTRCT NO. 257 (RAYBURN AVENUE SUBTRUNK) Resolution No. 962 was presented and read, declaring improvements to be in the public interest in Subdistrict No (Rayburn Avenue Subtrunk.) Motion made by Mr. Parker, seconded by Mr. Kinsey, that Resolution No. 962 be adopted. M. M. Kinsey - aye F. J. Lane? aye CONSDERATON OF PROPOSED ORDNANCE NO LEVYNG SPECAL BENEFT ASSESSMENTS N SUBDSTRCT NO. 289 (BLACK OAKS SOUTH) Proposed Ordinance No was presented and read, levying special benefit assessments against all of the land benefited by the construction of sewers within the boundaries of Subdistrict No. 289 (Black Oaks South) of The Metropolitan St. Louis Sewer District; directing issuance of Special Tax Bills evidencing said levy; setting out the form, terms, and provisions of said Special Tax Bills, with an emergency clause. Mr. Sears said this was payment to the contractor for work accomplished within the subdistrict. Motion made by Mr. Parker, seconded by Mr. Concannon, for unanimous consent of all members present for introduction and final voting on proposed Ordinance No at this meeting. M. M. Kinsey - aye F. Lane, Jr., - aye CONSDERATON OF PROPOSED ORDNANCE NO ESTABLSHNG BULDNG LNES OR FLOODWAY RESERVATON LNES ALONG AND ADJACENT TO GRAVOS CREEK AND CERTAN OF TS TRBUTARES (NTRODUCTED 8/24/67 - HELD OVER 9/21/67). Proposed Ordinance'No was presented and read, establishing building lines or floodway reservation lines along and adjacent to Gravois Creek and certain of its tributaries, controlling the use of private lands within such lines, providing for the policing of the lands within such lines, and providing penalties for violations. This proposed Ordinance No was introduced August 24, 1967 by the following Trustees: Messrs. Concannon, HuntingtOQ, Kinsey, Parker, and Lane. Mr. Lane said that Mr. Kaiser and he had attended a committee meeting of the South County Association for Community Benefit, in response tothe request of Mr. James J. Raymond, its president who had appeared on September 21, 967 at the District's Board meeting. Mr. Lane said they had discussed the proposed ordinance with the committee and had answered a number of questions..the Committee agreed that this ordinance should be adopted, but did make several comments concerning some of the problems of the property owners involved. They felt that the District should take any reasonable steps necessary to relieve any of the hardships that might be occasioned by the ordinance. They adopted a resolution in support of this ordinance, and were going to report to the rest of their organization explaing its meaning and effects. Motion made by Mr. Parker, seconded by Mr. Kinsey, that proposed Ordinance No be adopted.. (Ordinance 665) Poll taken: R, E, Concannon - aye A. R. Parker - aye M, M, Kinsey - aye F. J. 4 CONSDERATON OF PROPOSED ORDNANCE NO CONFRMNG CONTRACT C-275 WTH.ROLAND HOFFMANN DTCHNG CO., FOR THE CONSTRUCTON OF STORM SEWERS N SUBDSTRCT NO. 88 (FOUNTAN CREEK. SECTON V) Proposed Ordinance No was presented and read, confirming a contract (C-275) with Roland Hoffmann Ditching Co., for the construction of a storm water channel, with inlets in Section V of Subdistrict No. 88 (Fountain Creek) with an emergency clause. H"^ With the aid of a wall map, Mr. Mattei explained to theboard that this contract was for the portion upstream of the large property adjacent to New Florissant Road and starts from the upstream side of such property in two branches to Costello and St. Anthony Streets. The land owner of the large area is being by-passed for the time being since he is unwilling to grant an easement and we have none on his property now. After a short discussion, motion was made by Mr. Parker, seconded by Mr. Kinsey, for unanimous consent of all members present for introduction and final voting on proposed Ordinance No at this meeting. J, Lane, Jr, - aye Mr. Mattei said that the District had applied to the Federal Water Pollution Control Administration for a grant for the Des Peres Branch of Sugar Creek nterceptor or trunk sewer. We have received a letter from Mr. Clement F. Egger, dated September 5, 1967, offering a grant of $133,500 from the Department of the nterior. The total amount needed is estimated at $445,000. The letter says that we must accept by October (Copy of letter and U. S. Department of nterior Federal Water Pollution Control Administration form for Offer and Acceptance of Federal Grant for Sewage Treatment Works under 33 U. S. C. 466 et seq., Project No. MO-319 in Secretary-Treasurier's File.) Motion made by Mr. Parker, seconded by Mr. Concannon, that the Board of Trustees of The Metropolitan St. Louis Sewer District authorize the Executive Director to accept the grant offer of the. United States Department of the nterior, Federal Water Pollution Control Administration, in the

5 amount of $133, for Project No. MO-319..for construction of the Des Peres Branch of Sugar Creek nterceptor sewer. Poll taken: R, E. Concannon - aye A. R. Parker - aye At 11:00 A. M., C.D.S.T. the Vice Chairman announced that the time for opening bids for the $935,000 General Obligation Sewer Bonds of tbe Watkins Creek Trunk Subdistrict had arrived, and asked if there were any more bids to be submitted. There were none. At the request of the Vice Chairman, the Secretary-Treasurer reported that pursuant to Resolution No. 960, adopted September 7, 1967, he had mailed to all interested financial houses in Missouri and elsewhere printed copies of the Notice of Sale of $935,000 General Obligation Sewer Bonds of the Watkins Creek Trunk Subdistrict, authorized at an election held on the 11th day of April, To each copy of the notice there was attached a form of proposal for the purchase of such bonds. The notice was published one time in the Bond Buyer, the St. Louis Post Dispatch and the St. Louis Globe Democrat, all at least ten days prior to today. The Secretary-Treasurer reported that pursuant to the aforesaid notice, there were f i led with him at or prior to the hour, of 1 1 :00 A.M. Central Daylight Saving Time, on October 11, 1967 three sealed bids for the purchase of the $935,000 General Obligation Sewer Bonds of the Watkins Creek Trunk Subdistrict of The Metropolitan St. Louis Sewer District, and the Secretary-Treasurer then and there presented said sealed proposals to the Board, whereupon the Vice Chairman instructed the Secretary-Treasurer to open the said bids and to read the same aloud in the presence and hearing of the Board and of the bidders assemb.led. Trauernicht, Kaiser and Clardy would retire for the purpose of confirming calculations involved in the bids while the Trustees ahd Staff would remain in public session for theppurpose of continuing the regular board meeting. Mr. Kaiser asked if Mr. Bannister oould take his place since he had to discuss the next item, the 01 in Mathieson lease, which Mr. Lane assented to. CONSDERATON OF PROPOSED ORDNANCE NO AUTHORZNG THE LEASE OF PART OF THE FORMER MSSSSPP VALLEY STOCK YARDS PROPERTY TO OLN-MATHESON CHEMCAL CORPORATON. Proposed Ordinance No was presented and read, authorizing and directing the Executive Director to lease certain real property of The Metropolitan St. Louis Sewer District, lying in the-city of St. Louis, Missouri, to the 01in-Mathieson Chemical Corporation and to execute a leasehold agreement upon the conditions hereinafter set out.

7 Mr. Kaiser said that the 01in-Mathieson Chemical.Corporation had asked for a lease on a portion of the Old Mississippi Valley Stock Yards property which was acquired by the District for future use for. secondary facilities, as it was on the market and something we would have to acquire sooner or later. t is expected that it will not be necessary to use this land for secondary treatment until about The portion under consideration for the lease is 226 feet by 208 feet (indicated on a wall map), and lies in the southeast corner of the property, north of Angelica Street, and adjacent to the 01in-Mathieson subsidiary, which wants to use it for truck parking. The only building on thepproperty is a small former motel and cafe. The lease provided for a monthly rental of $265, an option to renew for two successive five-year periods, first refusal should the District wish to accept an offer to buy; and should the District need to construct its secondary treatment facilities here, the lease would terminate. The lease was negotiated on the basis of 7% of the value as a reasonable rental, particularly in view of the fact that we might have to take it back at any time. Messrs. Kaiser and Parker said that assuming the property is worth $47,000 which would be $1.00 a square foot, 7% would be just under $275 and they thought that since the 7% was considered the going rate for such property under existing circumstances, that even though the $10 monthly difference was minor, as a matter of principle the District should get $275 monthly. Mr. Kaiser said he thought there would be no objection to the $275 rental. There was some general discussion and motion was made by Mr. Concannon, seconded by Mr. Parker that proposed Ordinance No be amended in that the words and figures in the third line of Section 2 be changed from "two hundred sixty-five dollars" ($265-00) to "two hundred seventy-five dollars" ($2/5.00) per month. Motion passed - four ayes, no nays. Motion made by Mr. Concannpn, seconded by Mr. Parker, for unanimous consent of all members present for introduction and final voting on proposed Ordinance No as amended, at this meeting. 8 PLAN APPROVAL - SAPPNGTON AND WESTMNSTER ESTATES The Executive Director presented for approval engineering plans for sanitary sewers in Sappington and Westminster Estates subdistrict. Mr. Kinsey said this project consists of approximately 5900 feet of 8-inch clay pipe and 35 manholes to sei"ve 80 lots. The plans were prepared by R, W, Booker and Associates and approved by the MSD Staff, approved. He said he had examined these plans and moved that they be Motion seconded by Mr. Parker. Mr. Kinsey said this project consists of approximately 1435 feet of 8-inch vitrified pipe with 10 manholes to serve 2/ lots. The plans were prepared by Leo A. Mr. Kinsey said this' project consists of approximately 1,100 feet of 8-inch vitrified clay pipe, 720 feet of 4" cast iron force main, 7 manholes andi-one lift station to serve 35 lots. The plans were prepared by Leo A. Daly Company and approved by the MSD staff.

The Federal Government had been advocating secondary treatment for such projects as the Mississippi River Subdistrict. After a discussion of financial problems and a compariosn with other areas, they have indicated a target date of 1982 for secondary treatment. At 11:45 A. M. Messrs. Carl Trauernicht, Sr., Clardy and Bannister returned tb the meeting. Mr. Trauernicht said'that they had reviewed the bids and had confirmed that the Commerce Trust Company, Account Managers, Kansas City, were the low bidders. Mr. Lane thanked Mr. Trauernicht for his work in determining the best of the bids submitted for the Watkins Creek Trunk Subdistrict bonds. Resolution No. 963 was presented and read in its entirety by Mr. Clardy, acceptfiing the bid of Commerce Trust Company and Associates for the $935,000 General Obligation Sewer Bonds of the Watkins Creek Trunk Subdistrict of The Metropolitan St. Louis Sewer District. Motion made by Mr. Parker, seconded by Mr. Concannon, that Resolution No. 963 be adopted. Poll taken: R. E. Concannon - aye M. M. Kinsey - aye A. R. Parker - aye F. J.
