Digital & ICT impacts of EU legislation How does the European Commission approach them? Zsofia Sziranyi European Commission, Directorate-General for Informatics 4 September 2018

Framing European Commission the right of initiative Better Regulation Agenda designing and evaluating EU policies and laws: transparently, with evidence, backed up by the views of citizens and stakeholders, in order to achieve objectives and bring benefits at minimum cost. 2

Better Regulation (BR) Guidelines and Toolbox First proposal in 2015, revision in 2017 Better Regulation Guidelines: o General principles; o Dedicated chapters on: Planning Impact Assessments Implementation / transposition Monitoring Evaluations and Fitness Checks Stakeholder consultations Better Regulation Toolbox: à la carte 3

BR Guidelines on Impact Assessments Compulsory to assess the economic, social and environmental impacts of a legislative proposal. But there can be: Digital aspects & ICT impacts 4

Digital & ICT impacts are more and more common Digital environment 5

If ICT impacts are overlooked Problems at implementation No reuse No interoperability 6

Political context Ministerial Declaration on egovernment - the Tallinn Declaration signed on 6 October 2017: We call upon the Commission, building on the Council Conclusions on mainstreaming digital solutions and technologies in EU policy, to fully integrate digital considerations into existing and future policy and regulatory initiatives 7

Better Regulation Guidelines - 2017 «When designing the policy options, always consider: to anticipate important technological or societal developments such as the pervasive role of the internet and other ICTs as well promoting the principles of egovernment; Options that take account of new technological developments and ICTs to lower the costs of implementation whilst ensuring timely data availability. All new initiatives should be "digital and internet ready" and operate effectively both in the digital and the physical worlds;» 8

Better Regulation Guidelines - 2017 Identify all potential impacts of the options: It is also likely that a policy option will require some sort of IT system or network to automate business processes, publish/exchange information, deliver online services via web-based Portals, etc. It means that the impact related to the implementation of new or the adaptation of existing ICT solutions should be assessed. The possibility of reusing what exists already should not be overlooked. A "digital screening" and possible further ICT impact analysis may be needed. 9

Better Regulation Toolbox - 2017 TOOL #27: The Digital economy and society & ICT issues Digital checks Digital screening ICT Impact Assessment Guidelines January 2018 10

ICT impacts: the role of the ISA 2 programme EU Programme, managed by the European Commission, which provides interoperability solutions to public admininstartions, buisinesses and citizens Instrument supporting the implementation of the European Interoperability Framework One specific action around Legal Interoperability 11

Digital screening Systematic screening of new Commission proposals to look for possible ICT and interoperability impacts 280 initiatives screened since 2015: 1/3 of them had ICT impacts Emphasis on follow-up 12

ICT Impact Assessment Guidelines 2018 14

Next steps Within the European Commission: o Raise awareness o Build and provide appropriate support Outside the Commission: Exchange ideas, good practices, e.g.: o How do you break the silos and ensure that IT experts are involved in policy making? o How do you support your policy-makers regarding ICT matters? 15
