No. 22 in 1987 Occupational Health and Safety Instructions In accordance to articles 152 & 108 / second of Labor Law no. (71) of 1987 we decided to issue the following instructions: Article one: these instructions apply to private sector projects, cooperative and mixed. Article two: The Inspection department at the Labor and Social Security office deals with the following tasks: First: the supervision of the application of safety and occupational health according to the provisions of the Labor Law No. (71) of 1987 and the instructions issued there under. Second: follow-up and completion of transactions related to occupational safety and health. Third: coordination with the National Centre for Occupational Health and Safety for the implementation of work precautions and occupational safety and health. Article three: First: The special Committee on Labor Inspection will draft observations on the level of precautions work and the obligations of the employer and employee with the instructions in its report on the inspection visit to the project Second: the Committee of the Labor Inspection will be responsible if deliberately ignored or neglected the description of the work precautions and the commitment to implement the Occupational Safety and Health in the Project Article four: First: the responsibility of safety and health in the project is determined in accordance with the following formula: A. In projects that the number of employees working is 50 employees or less, the responsibility will be granted to one of the employees working on the project in addition to his duties among those who are familiar with this matter. B. In projects which the number of employees working more than 50 to 100 workers, the responsibility will be granted to one of the employees working on the project full-time and be fully committed to this responsibility as long as that have passed the basic course at the National Centre for Occupational Health and Safety C. In projects that the number of employees more than 100 workers up to 500 employees, the responsibility will be granted to a Committee within the project called the safety and occupational health committee and it is formed as follows: 1 - The employer or his representative Chairman 2 - Technical Director and the heads of technical sections Members 3 The doctor or the project s nurse Member 4 - A representative of the union Member 5 - one of the workers, responsible of safety and occupational health Member and reporter of the Commission that have passed the basic course at the National Centre for occupational Health and Safety. D. In projects that the number of employees working are more than 500 employees, the responsibility will be granted to a Committee which is formed in the same way mentioned in paragraph c above with the increase in the number of officials with the Occupational Safety and Health of the Committee to two members devoted full-time to this task. Second: The functions and responsibilities of the occupational health and safety in the project is as follows: A. The Committee meets regularly once a month and during working hours< it may be invited by the Chairman to convene an emergency meeting at the grave of an accident for the purpose of discussing the conditions and causes of the incident and to develop treatments to avoid it. 1

B. Record the meetings in a record created for this purpose and the reporter will be responsible for keeping and recording the meeting in it. C. The record must be stamped by the seal of the labor and social security department and subject to inspection by the inspection committees working at any time. D. It is required in the Committee meeting the attendance of the majority of members, including the representative of the labor union and in the absence of a quorum, the meeting will be postponed to another time during the same month, the meeting will be considered correct in this case no matter what was the number of attendees E. the Committee shall establish in coordination with the official bodies concerned with safety and occupational health programs and complete plans in the project and that does include: 1 - Study the causes of incidents and injuries and to establish precautions to prevent it. 2- Provide first aid and fire extinguishers and fire pits in different places of the project and chose the right clothing 3 Monitoring and inspection of all parts of the project periodically to ensure the application of these instructions. 4 Awareness and guidance of the workers to the means of occupational health and safety, and follow up the implementation of the instructions and decisions of the work inspection office in the Labor and Social Security Department. 5 - Put instructions and data related to occupational health and safety in clear and obvious places in the building of the project for the purpose of inform the workers with the profession hazards and work needs to be followed Third: A: A safety and occupational health officer will be selected by the employer among workers on the project, taking in consideration when choosing the following: 1 - participate in the seminars held the National Centre for Occupational Health and Safety and pass it successfully, or obtain a special certificate of competence in occupational safety. 2 To be able to train workers in various areas of occupational safety and health 3 - capable of planning and implementing Occupational Health and Safety programs. 4 - Experienced with industrial information conducted in the project. B: The duties and functions of the safety officer and occupational health in the project include: 1 - Raise awareness and preventive education among workers in the project 2 - Regular inspection of the workplace and to all sections of the project, discover the dangers and warnings to prevent them from happening and make sure to use preventive means. 3 - Diagnosing the causes of accidents and work injuries and presenting proposals for occupational health and safety, raise the matter to the Commission on the project or the employer to find precautions to prevent their recurrence and to ensure the safety of workers on the project. 4 - Organizing statistics related to work injuries and occupational diseases and preparing periodic reports about it. 5 - Overseeing the implementation of occupational health and safety programs. 6 - Training on the use of personal protective equipment and the ability to inspect, maintain and direct the workers on cleaning and reserving methods. Article five: The employer shall take the necessary precautions to protect workers during the work from health damage, work and machinery hazards and provide the means of protection from the work dangers, through the followings: 1 Put special instructions for safety and occupational health and hang it in obvious places explaining what the workers have to do or not to do, in a way that guarantees secure proper working conditions in order to achieve suitable environment for the workers and provide the necessary requirements of protection for their health and safety and for protecting the project from risks and work accidents, it is not allowed to hold or deduct any amount from the workers for providing this protection 2 - create and provide an appropriate place for the workers break time, where they can have their food, and provide resting amenities and sanitary conditions like heating, cooling and ventilation, desks and chairs to sit and furnish the floors 3 - creating rooms equipped with cabinets for keeping the clothing of the female workers and male workers separately 2

4 - creating bathroom facilities and Washing places in proportionate to the number of workers and employees in the project 5 - Provide clean, healthy drinking water and cool water in the Summer 6 provide first aid kits in quantities adequate with the number of the employees and nature of work on the project so that in every work hall there will be a first aid kit and nominate a person to be responsible for this kit to continue providing materials of first aid, he/she have to be trained adequately on various means of first aid 7 - provide occupational safety requirements for the project that is appropriate with the nature of work and to provide equipments, tools and number of means of personal protection required by the Occupational Safety and preserve these means with training of the personnel to use it, it is not allowed to give the workers cash instead of these equipments. 8 - Regulate the storage of raw materials and produced materials accurately and organize appropriate distribution for the workers and to secure protection requirements for the health and safety of workers in the project 9- maintaining the cleanliness of the buildings and facilities of the project well and provide special means for disposing of waste and harmful materials to the health resulting from the remnants of the production process providing that it will be far from the residential areas and does not harm the public health of residents outside the workplace. 10 - providing all means of prevention needed to fight fire and work on removing flammable materials and explosives from the heating sources and fire and storage it in safe places and examine it constantly to make sure of its safety and validity for action 11 - Provide adequate fire fighting equipment and alarms, examined the equipments periodically and train at least 25% of workers in the project on using it. 12 - protecting the workers from the dangers of electricity, secure equipments and good extensions that is suitable for the nature of the project, isolate hazardous devices in closed room or put appropriate barriers and prevent non-authorized personnel from approaching it. 13 - In work that requires lifting, lifting machinery must be provided and make sure of the ropes and chains and other parts attached to it thereto to be of good mechanical design and to be subject to periodic scrutiny by technician and the same for the mechanical means of transportation. 14 - maintaining the whole of the steam boilers and various compressors and its accessories and conduct periodic inspection annually by the competent authorities, with obtaining of certificates and reports of its safety record with the date of inspection written and the proposed date of the next check providing that the person examined it holds an authorization from the Committee for examining Boilers at the National Centre for Occupational Health and Safety, provide copies of these reports to the Safety Division. 15 - Provide and create employment conditions and preventive issues that help to reduce the noise in the work halls so that it will not be more than 85 / Decibel. 16 - Provide adequate lighting either natural or industrial to be appropriate to the nature of work and that it will not be less than what is mentioned in the instructions of the hard and harmful work and to take all precautions to prevent glare, shadows and reflections surfaces from hurting the workers eyes. 17 Store all hazardous materials properly in special stores that is marked to indicate the seriousness and take all necessary precautions when entering into these places and maintain the safety of workers when handling these materials. 18 - a. In projects which are in or produce toxic substances, the work must be in separate rooms or separate areas and conduct these operations in closed containers or devices to prevent the workers from contacting harmful substances and in a form that helps prevent leakage of gas and harmful fumes, and dust to the work atmosphere through the use of working materials appropriate for that. B. Apply instructions No. 2 in 1984 issued under the Public Health law No. 89 related to carcinogenic chemical substances C. Apply instructions No. 6 in 1986, issued under the Public Health Act No. 89 of 1987. 19 - creating healthy working halls on projects that require that and insure the safe adopted distances, where at least ceiling height is about 2.5 meters and the distance between one machine to the other is 1.5 meters and secure ventilation and lighting and all the other requirements of the Occupational Safety in it. 3

20 - Fencing all hazardous operations, stairways, corridors and all other work places which is expected where the workers might be in danger and to protect them from work injuries. 21 - creating the pro side of the hazardous work to preserve the safety of workers from the risk of collapse while working and to provide mobile staircases appropriate and sound for business requiring that. 22 Conduct primary medical examination before starting work and matching between the physical ability of the worker and the work required to do, conduct periodic medical examinations according to the special instructions issued by the facility doctor or the entity responsible for the medical treatment of workers to ensure their safety and health fitness to insure that the workers are not infected by occupational diseases, these tests must be registered in the worker s files and will be subject to inspection. 23 - The doctor of the project have to report on occupational diseases and dangerous situations that may threaten the safety of workers immediately to the relevant health authority and to the National Centre for Occupational Health and Safety, Division of Occupational Safety 24 - In projects which deals with gas cylinders.. The type of the gas must be written on the gas cylinders and provide automatic means of transportation for these gas cylinders to be places vertically permanently, noting not to store oxygen gas cylinders near rapid oxidation and ignition. 25 - Must take action to ensure occupational safety and provide effective protection for workers exposed to fuel or materials that contain it. 26 - All necessary actions must be taken to prevent leakage of fuel fumes aromatic in the work atmosphere, in the buildings that fuel is produced, stored or used in it or materials that contain it 27 - operations involving the use aromatic fuel or materials that contain it must be performed in close containers.. as possible 28 - the necessary action must be taken to replace harmful industrial raw materials by materials that is less dangerous and harm whenever it is possible 29 - protect workers from radioactive materials in accordance with the provisions of the law preventing harmful radiation No. 99 of 1980 and the instructions issued there under 30 - Protection of workers in the construction and installing business by providing equipment for lifting and steel ropes, cranes and scaffolding. 31 - Protection of workers in the work of cutting and welding rods, train them on the proper use of Khartoum and the work torch, welding wire, handles and means of personal protection. 32 - Actions must be taken to ensure the worker psychological and social stability through the providing of appropriate healthy housing near the workplace for workers and their families especially in remote areas, secure appropriate transportation to and from the workplace. Article six: the worker must commit to the following: 1 Compliance with the Occupational Health and Safety instructions stated in the project or the one that he/she was notified of, with the use of all tools, equipments and means of personal protection required by the nature of the work. 2 It is prohibited for the worker to take any act that may lead to the failure of implementing the instructions of occupational health and safety or abuse the substantive means set to protect his/her health and safety, damage or destruction of the means of his/her protection. 3 - not to repair any machine or replace any part of the machine thereof prior to shutting down of the work and not to re-operating before ensuring the return of all the parts and covers to its location under the supervision of the technician or work supervisor. 4 The worker is prohibited from exercising any work generated by the radiation unless preparing all the preventive means to do so. 5 Commit to the timelines of the periodic inspection and all instructions issued by the project doctor or the competent medical authority that is related to the occupational health and safety. Article seven: Miscellaneous Provisions 1 The Labor and social security department shall approach the work inspection Department in all matters related to occupational safety and work precautions mentioned in the Labor Code 4

2 The violator of these instructions shall be punished by the penalties stipulated in the Labor code No. 71 of 1987 and our instructions to the rules of discipline typical number of 17 in 1987. 3 - Repeal occupational safety instruction number 3 in 1985 Article eight: these instructions shall be implemented from the date of publication in the Official Gazette Minister of Labor and Social Affairs 5
