DRAFT MINUTES CITY PLAN COMMISSION MEETING CITY OF DE PERE, WISCONSIN - MARCH 28,2011 The Plan Commission ofthe City of De Pere, Wisconsin, met in regular session at the Council Chambers in City Hall on February 28,2011. Mayor Michael Walsh called the meeting to order at 7:00 p.m. Roll call was taken and the following members were present: Tom Walsh, Derek Beiderwieden, James Kalny, Elizabeth Runge, Alderpersons Robert Wilmet and Kathy Van Vonderen. Also present: City Planning Director Kenneth Pabich, and members of the public. 1. Derek Beiderwieden moved, seconded by Alderperson Wilmet, to approve the minutes ofthe meeting held on February 28,2011. Upon vote, motion carried unanimously. 2. Review Precise Implementation Plan application for the 162,340 square foot Menards located on Lawrence Drive. Mayor Walsh moved, seconded by Jim Kalny, to open the meeting to the public. Upon vote, motion carried unanimously. Pat Foley, 1317-1319 South Crown Court, complained of water runoff from the site where Menards will be located and Murphy Concrete, and the foot traffic through his yard when Menards is built. Scott Gigot, 1336 South Ninth Street,complained oflight from Wal-Mart and worried about light from Menards. Mayor Walsh moved, seconded by Tom Walsh, to go back to regular order. Upon vote, motion carried unanimously. Jim Kalny moved, seconded by Alderperson Wilmet, to approve the Precise Implementation Plan. There were further questions on backup beepers on forklift trucks and outside speaker systems. Menards Agent, Aaron Morrissey, indicated their trucks do not have backup beepers and Menards does not have an outside speaker system. Upon vote, the previously made motion was then carried unanimously. 3. Review the Conditional Use Application at 400 Reid Street to allow the West De Pere Phantom Knight Charter School to be allowed as an accessory use to the principal use of the West De Pere District Office. Mayor Walsh moved, seconded by Tom Walsh, to open the meeting to the public. Upon vote, motion carried unanimously. Jason Lau (representing the West De Pere School District), 2391 HopfLane, De Pere, provided the Commission with an explanation of a Charter School.

DRAFT MINUTES Valerie Tillman, representing Nicolet Highlands Senior Apartments, 660 W. Ridgeview Drive, Appleton, had questions regarding the number of students that would be attending the Charter School, the term ofthe school, if the classes started at the same time, and parking. Jason Law indicated the number of students would be 30. Classes start at 7:45 and end at 2:45 p.m. Students have the flexibility to leave the building. The lease is 10 years. Mike Fritsch, Managing Director, De Pere West Development, 3505 Hidden Valley Court, indicated there is plenty of parking available. Mike also indicated the tenants in the area are pleased to have the students in the neighborhood. Mayor Walsh moved, seconded by Derek Beiderwieden, to go back to regular order. Upon vote, motion carried unanimously. Alderperson Van Vonderen moved, seconded by Derek Beiderwieden, to approve the Conditional Use Application. Upon vote, motion carried unanimously. 4. Future agenda items. There was no discussion. 5.
