Medicaid EHR Incentive Payment What is it? EHR Incentive Programs established by law American Recovery & Reinvestment Act of 2009 Incentive programs for Medicare and Medicaid Programs for hospitals and eligible professionals Must use certified EHR technology AND demonstrate adoption, implementation, upgrading or meaningful use Programs differ between Medicare and Medicaid Medicare incentive program is federally run by CMS Medicaid incentive program is run by States and is voluntary New Mexico Human Services Department

Medicaid EHR Incentive Payment What is it? Program runs from 2011 through 2021 For any given provider, the program may last up to a maximum of 6 years. Program participation can start as early as 2011 or as late as 2016. Payments are not required to be consecutive years. Eligible Professional (EP) may switch once b/t Medicare and Medicaid incentive before 2015 New Mexico Human Services Department 4

Medicaid EHR Incentive Payment - Who is eligible? Eligibility determined in law Hospital-based EPs are NOT eligible for incentives DEFINITION: 90% or more of their covered professional services in either an inpatient (POS 21) or emergency room (POS 23) of a hospital Definition of hospital-based determined in law Incentives are based on the individual, not the practice New Mexico Human Services Department

Medicaid EHR Incentive Payment - Who is eligible? Medicaid Eligible Professionals include: Physicians Nurse practitioners Certified nurse-midwives Dentists Physicians assistants working in a Federally Qualified Health Center (FQHC) or rural health clinic (RHC) that is so led by a physicians assistant EPs may not be hospital-based New Mexico Human Services Department

Medicaid EHR Incentive Payment - Who is eligible? Medicaid Eligible Professionals must also meet one of the three patient volume thresholds: Have a minimum of 30% Medicaid patient volume Pediatricians ONLY: Have a minimum of 20% Medicaid patient volume Working in FQHC or RHC ONLY: Have a minimum of 30% patient volume attributed to needy individuals CHIP, sliding scale, free care only count towards thresholds if working in RHC or FQHC New Mexico Human Services Department

Medicaid EHR Incentive Payment - Who is eligible? Medicaid patient volume percentage required: Provider * Physicians 30% - Pediatricians 20% Dentists 30% Nurse Practitioners 30% Minimum Medicaid Patient Volume Threshold OR if the Medicaid EP practices predominantly in a Federal Qualified Health Clinic (FQHC) or Rural Health Clinic (RHC) Certified Nurse Midwives Physician Assistants (PAs) when practicing at an FQHC/RHC that is led by a PA 30% 30% 30% threshold may include needy individual patient volume threshold New Mexico Human Services Department

Medicaid EHR Incentive Payment Who is Eligible? Patient volume for EPs in Group practices An EP can use a group practice s patient volume as proxy for their own patient volume 3 conditions apply per the final rule The group s patient population is appropriate methodology to calculate PV, e.g., all Medicare is not appropriate Practice must and EPs use one methodology - use entire practice s PV or EP as individuals Auditable source to support PV determination New Mexico Human Services Department

Medicaid EHR Incentive Payment - How Much are Incentive Payments? Cap on Net Average Allowable Costs 85% allowed for EPs $25,000 in Year 1 for most EPs $21,250 $63,750 $10,000 in Years 2-6 for most EPs $8,500 $16,667 in Year 1 for pediatricians $14,167 $42,500 with a minimum 20% patient volume, but less than 30% patient volume, Medicaid patients $6,667 in Years 2-6 for pediatricians with a minimum 20% patient volume, but less than 30% patient volume, Medicaid patients $5,667 Maximum cumulative incentive over 6 years New Mexico Human Services Department 10

Medicaid EHR Incentive Payment - NM Specific Program Issues To receive incentive payments, EPs must: Meet eligibility requirements per final rule Hold status as an active NM Medicaid fee-for-service provider Billing or Unrestricted Servicing providers can assign payments to the entity as part of the EP s business arrangement Providers may assign payment to State Designated Entity recognized by MAD as a qualified organization promoting the use of EHR technology New Mexico Health Information Collaborative (NM HIC) and New Mexico HIT Regional Extension Center (NM HITREC)* New Mexico Human Services Department 11

NM Medicaid - EHR Incentive Payment - NM Specific Program Issues NM Medicaid requires adopt, or implement, or upgrade (AIU) for first payment year Subsequent payment years achieve and demonstrate Meaningful Use (MU) MU criteria defined in final rule Meeting MU criteria is graduated and increasingly more challenging over the course of the incentive program. Currently NM Medicaid has elected not to adopt Public Health objectives as core objectives for Stage 1 meaningful use (MU) New Mexico Human Services Department 12
