PURPOSE AND DESCRIPTION OF SERVICES Pursuant to the California Health and Safety Code Section 25358.6.1, the Department of Toxic Substances Control (DTSC) is requesting a Statement of Qualification (SOQ) from eligible companies (Firms) to establish a list of pre-qualified Firms to contract with DTSC in providing support services for projects involving unexploded ordnance and/or discarded military munitions, now referred to as munitions and explosives of concern (MEC) for the scope of services listed below: A. General Scope of Services The Scope of Services to be performed under this Request for Qualifications (RFQ) No. R-80005 focuses on support services of a California license geophysicist familiar with MEC geophysical investigations, quality control, and quality assurance. Services included under this RFQ include, but are not limited to review of geophysical work plans, contractor or project proponent data, quality control reports and independent geophysical investigations. Agreements authorized under this SOQ/ RFQ process will be for MEC support services for sites handled out of our DTSC Headquarters and Regional offices located in Sacramento, Berkeley, Cypress, Chatsworth and satellite offices in Clovis and San Diego, California. B. Projects Requiring Support Services and Agreement Limits California hosts over 350 formerly used defense Sites (FUDS) as well as several properties closed by Congress through the 1988, 1991, 1993, 1995 and 2005 Base Realignment and Closure Act (BRAC) process that are known or suspected to have MEC present. Investigating these MEC and potentially affected MEC properties requires California licensed geophysicist services not available through DTSC internal resources. The California licensed geophysicist Service Support Agreement developed under this RFQ is anticipated to be for a period of three years and not to exceed $1,000,000.00. No minimal amount for geophysical support services is provided. C. Desirable Qualifications and Expertise Firms should have an established and proven track record of performing geophysical investigations for sites known or suspected to have MEC present. The Firms should be able to process raw and pre-processed data collected from Firm owned or project proponent geophysical platforms. The Firm should have access to and the ability to utilize industry recognized software for processing and demonstrate experience in quality control and/or quality assurance procedures, including seeding Public participation is an integral part of DTSC s site investigation and cleanup process. Firms must be able to prepare technical documents that are understandable to the lay community and to respond to community requests regarding projects. Also, Firms may be required to support DTSC in enforcement proceedings against owners and operators of uncontrolled hazardous substances release sites. In these incidences, the Firms must have the necessary credentials to provide expert testimony.

STATEMENT OF QUALIFICATION REQUIREMENTS Mandatory Minimum Requirements Firms interested in providing services for this contracting opportunity shall submit the following information, together with five (5) complete sets of the Firm s SOQ. SOQs will be scored upon receipt of the following mandatory minimum criteria: Letter of Interest A copy of the Firm s Business license or license(s) entitling the Firm to practice the selected profession(s) in the State of California.. California licensed Geophysicist with a minimum of 3 years experience in the MEC industry. Federal Standard Form 330 for Contractors and key proposed subcontractors. A written statement of Firm s qualification that is in response to the selection criteria described below. Additional materials in an 8 ½ X 11 format, illustrating plans, sketches, or photographs of recent relevant projects, published materials, and awards may be included. Total page limit shall not exceed 100 pages. Completed Disabled Veteran Business Enterprises (DVBE) compliance forms. Firms submitting SOQ shall be knowledgeable in all applicable laws and regulations including, but not limited to, California Health and Safety Code Division 20, Chapters 6.5 and 6.8, Title 40 Code of Federal Regulations Part 300 (the National Contingency Plan), and Department of Defense Explosive Safety Board guidance and standards and related U.S. Corps of Engineers Data Item Description requirements and engineering manuals. IMPORTANT: Please (download and complete) Disabled Veteran Business Enterprise Participation Requirements at www.pd.dgs.ca.gov/dvbe. Compliance will require immediate action on the part of the Firm. DVBE goals must be met, only advertisement is waived. Failure to submit Mandatory information will result in disqualification. III. SELECTION CRITERIA AND EVALUATION The written statement of the Firm s qualifications as requested above must include the following information along with a valid Firm email address: 1. Description of Project Team to be assigned to the project. List Principals and their proposed role within the project. List each key technical personnel and their proposed role within the project. List key subcontractors and their proposed role within the project. Provide education, license, registration, certifications, credentials, and training of key personnel. 2. Professional geophysicist experience of the Firm in relation to the work to be performed. Description of Firm s experience in relevant MEC assessments, investigations and clean ups as related to the geophysical evaluation. Description of key personnel s professional experience including use of blind seeding techniques.

Page 3 of 5 3. Demonstrated competence and specialized MEC experience of Firm and identified personnel. Nature and quality of completed work. Project name date performed, nature of work and contaminants involved. Ability to prepare accurate estimates and to perform work within a stipulated budget. Knowledge of available guidance and applicable standards, codes, laws and regulations. 4. Reliability of Firm. Continuity of Firm s staff and subcontractors. Information on past debarment, defaults and any professional disciplinary actions with their outcomes for key personnel and the Firm. 5. Demonstrate experience in Public Participation and Risk Communication. Provide support services for Public Meetings. Provide services as expert witness. Provide problem resolution. Provide relevant training to DTSC staff or Public. Firms shall respond in writing indicating how they believe their qualifications fulfill the requirements of the above criteria. IV. CONFLICT OF INTEREST A Firm will not be awarded an Agreement if the financial interests are held by a current officer or employee of the State. Additionally, an Agreement will not be awarded to an officer or employee of the State as an independent Contractor to provide goods and service. Likewise, the contracting agency officials and employees shall also avoid actions resulting in or creating an appearance of: Using an official position for private gain; Giving preferential treatment to any particular person; Losing independence or impartiality; Making a decision outside official channels; and Affecting adversely the confidence of the public or local officials in the integrity of the program. Former State employees will not be awarded a contract for 2 years from the date of separation if that employee had any part of the decision making process relevant to the contract, or for 1 year from the date of separation if that employee was in a policy making position in the same general subject area as the proposed contract within the 12-month period to his or her separation from State service. V. CONTRACT AWARD PROCESS Firms will be selected based on the written responses to the SOQ. The written SOQ will be evaluated and scored based upon those Firms who have complied with the minimum qualifications requirements. At the discretion of DTSC, Firms may be requested to provide a presentation and participate in oral interviews for purposes of determining the final ranking. Upon completion of the evaluation process and conclusion of oral interviews/presentations, should they be performed, candidate Firms will be ranked and selected in order of demonstrated qualifications 1, 2, 3, etc. This will make up the short list. DTSC will then select based on the Firm deemed to be the most qualified to provide the requested services.

Page 4 of 5 The State and the Firms on the short list may enter into negotiations on a project-by-project basis in the order of the ranking. In the event that a satisfactory Agreement cannot be negotiated with an individual Firm, the State will terminate negotiations with that Firm and begin negotiations with the next ranked Firm. The State reserves the right to terminate the selection process at any time. VI. FINAL RANKINGS The final rankings of the participants in the RFQ R-80005 will be notified via e-mail. VII. SOQ CONDITIONS In addition to the selection criteria and evaluation in Section III, the following SOQ conditions apply: A. The estimated Agreement amount is $750,000.00. B. The estimated Agreement term is approximately 3 years.

Page 5 of 5 C. A Disabled Veterans Business Enterprise (DVBE) Participation Goals of 3% is required for the Contract. A Small Business Participation Goal of 25% is also highly recommended. D. Federal and/or State prevailing wage rates may apply. This requirement, if applicable, will be specified in the draft Agreement. E. DTSC does not guarantee, either expressly or by implication that any work or services will be required under any Agreement issued as a result of this RFQ. F. A Pre-award or Post-award Audit will be performed on any Agreement issued as a result of this RFQ. X. SMALL BUSINESS PREFERENCE The small business preference is not applicable for RFQ solicitations because the cost is negotiated with the most qualified individual or individuals associated with a Firm. However, DTSC encourages small businesses to participate in the RFQ process.
