That prompted Cope to help found the Waianae Coast Comprehensive Health Center more than 40 years ago. It now has satellite clinics in Kapolei and Waipahu, Kanahele said. Cope died Nov. 16 at the Ka Punawai Ola rehabilitation center in Kapolei. She was 91. Cope s contributions to the community were many: becoming a founder of the Waianae Coast Culture and Arts Society as well as the Council of Elders, and having a traditional Native Hawaiian healing center named in her honor. She was an extremely grounded person always thought about the community first, said former U.S. Rep. Colleen Hanabusa, who grew up on the Waianae Coast. Hanabusa said many people who otherwise would have been unable to afford medical care have benefited from services at the Waianae Coast Comprehensive Health Center. Kanahele said that what crystallized the need for a health center occurred in the 1950s when a large group of seniors in Hawaiian communities became sick. He said his mother, who assisted the group in seeking medical attention, looked everywhere for affordable services but was unable to find a hospital or clinic to help them. She decided that Waianae needed its own clinic and persuaded the Hawaiian Homes Commission to provide land for it, Kanahele said. She then proceeded to raise money for it, including donations from bake sales. She had all kinds of fundraisers, Kanahele said. Hanabusa said the Waianae Coast Culture and Arts Society helped schoolteachers develop their arts programs. Cope was born on Oahu. She was a graduate of Farrington High School, Honolulu Business College and the University of Hawaii. She taught at Waianae and Nanaikapono elementary schools. She also was a hula dancer for her grandmother, grand hula master Lokalia Montgomery, and a traditional Native healer. She worked with the late author John Dominis Holt to develop a collection of oral histories passed from one generation to the next about the Waianae Coast titled Ka Poe Kahiko o Waianae: Oral Histories of the Waianae Coast of Hawaii. In 2009 she was awarded an honorary Doctor of Humane Letters degree by the University of Hawaii at Manoa. She was also named a Living Treasure by the Honpa Hongwanji Mission and honored by the Office of Hawaiian Affairs for her role as a grand kumu hula and Native Hawaiian traditional healer. Gov. Neil Abercrombie proclaimed April 8, 2011, as Agnes Kalaniho okaha Cope Day in the state. She is also survived by daughters Annie Kuuleilani Au Hoon and Georgiana Kekuialono Kahele, and sons Danny Haawi Kanahele and David Kalani Kanahele. A celebration of her life will be held at 10:30 a.m. Dec. 16 at Hawaiian Memorial Park. Burial to follow services. In lieu of flowers, the family requests donations to the Dr. Agnes K. AHCC Adopts Resolution 15 L33, Urges Support of DOI Proposed Rules At our Annual Convention last month, the House of Delegates voted overwhelmingly to support Resolution 15 L33: "Urging support of the administrative rules proposed by the United States Department of the Interior that facilitate the re establishment of a formal government to government relationship to more effectively implement the special political and trust relationship between the United States and Native Hawaiians." There are just two weeks remaining before the December 30 deadline for testimony and comments to the U.S. Department of the Interior (DOI). All members, clubs, and councils are encouraged to submit testimony in support prior to this deadline. The time to act is now! All 196 Hawaiians who ran as candidates will be offered a seat as a delegate to the Aha to learn about, discuss and hopefully reach a consensus on a process to achieve selfgovernance. Nai Aupuni President Kuhio Asam said Nai Aupuni s goal has always been to create a path so Native Hawaiians can have a formal, longoverdue discussion on self determination. We anticipated that the path would have twists and turns and even some significant obstacles, but we are committed to getting to the Aha where this long overdue discussion can take place. He said due to the delays caused by the ongoing litigation that could continue for years it was decided that the most effective route at this point would be to offer to convene all of the remaining delegate candidates and allow them to an opportunity to organize Hawaiians and achieve self governance. Nai Aupuni said Election America has been informed to stop the receipt of ballots, to seal ballots that have already been received, and to prevent anyone from counting the votes. Nai Aupuni attorney William Meheula said consistent with offering to seat all candidates, Nai Aupuni has decided that the election votes will never be counted. Thus, the Akina litigation, which seeks to stop the counting of the votes, is moot, and Nai Aupuni will take steps to dismiss the lawsuit, he said. To be clear, Nai Aupuni does not know and will never learn the election results. Asam said Nai Aupuni will manage the process of the Aha but not the substance of the discussions. We have retained Peter Adler and Linda Colburn of The Mediation Center of the Pacific to serve as facilitators to lead the instruction week and to thereafter assist in organizing the delegates, he said. They will contact the candidates who decide to participate in the Aha. The confirmation deadline to participate in the Aha is Dec. 22, 2015. An email will request that the candidates confirm whether they intend to accept the terms and attend the Aha that runs the month of February 2016 and will be held at a meeting facility in Kailua, Oahu. On Dec. 23, 2015, Nai Aupuni will post the list of delegates on its website. Asam said a key component of the Aha is the education and information the delegates will receive during the first week regarding constitution building, federal Indian law, international law regarding de occupation, decolonization, the rights of indigenous people, U.S. Constitution issues that relate to Native Hawaiian self governance, the ceded lands claim, background on Hawaiian Home Lands, Kingdom Law and constitutions drafted by sovereignty groups. Patchwork is a form of needlework that involves sewing together pieces of fabric into a larger design. The clever use of colors and patterns along with the creative efforts of the quilter using shadow techniques highlight the uniqueness of each one of a kind image. The finished quilt sewn together into a final and beautiful work of art is a symbol of how we as individuals are connected to each other, in Families, Communities, Islands, Countries, and the World our Island Earth. Click here for more information on the Scholarship Aha Court Finds State Illegally Denied Funds to DHHL After an eight (8) day trial which concluded in July, First Circuit Court Judge Jeannette Castagnetti ruled on November 28, that the State violated its constitutional duty by its continuing failure to provide adequate funding to the Department of Hawaiian Home Lands (DHHL). In a 40 page decision issued late Friday afternoon, the court concluded, the legislature has failed to appropriate sufficient sums to the Department of Hawaiian Home Lands for its administrative and operating budget in violation of its constitutional duty to do so. This failure includes every fiscal year since at least 1992. In her ruling Judge Castagnetti noted that the DHHL suffers from a lack of funding and staffing, which adversely affects beneficiaries of the Hawaiian Home Lands Trust. Moses Haia, the Executive Director of the Native Hawaiian Legal Corporation applauded the decision. This has been a long time coming. We are thankful that the Court has provided the State and the DHHL with a roadmap for making good on the State s constitutional mandate and on both the State s and the DHHL s trust duties under the Hawaiian Homes Commission Act. beneficiaries living on Hawaiian Home Lands. In fiscal year 2009, the legislature provided DHHL with less than $900,000 in general funds for its administrative and operating budget. For the next four fiscal years, the legislature appropriated no general funds to DHHL. Funding was only restored after the Hawai`i Supreme Court ruled in 2012 that the State has failed, by any reasonable measure... to provide sufficient funds to DHHL. For the last three years, the legislature has provided $9.6 million to the department. Friday s court s ruling will require that the legislature appropriate at least $28 million to the department for this coming fiscal year. In her ruling, Judge Castagnetti also left no doubt about whom the Hawaiian Homes Commission and DHHL owe a duty of loyalty to. Insofar as the years of underfunding by the State continued to place DHHL in the intolerable position of having to use the Department s own funds.... to pay for its administrative and operating expenses, it was beyond the bounds of reasonable judgment for the DHHL Defendants to not take action, to not file suit against the State and to oppose Plaintiffs in this case... She concluded that the Hawaiian Homes Commission has a duty of loyalty to the beneficiaries of the Hawaiian Home Lands Trust not the governor or the Department of Budget and Finance. Six native Hawaiians: Richard Nelson III, Kelii Ioane, Sherilyn Adams, Kaliko Chun, James Akiona and Charles Aipia, filed this lawsuit in 2007. Akiona and Aipia have since died. According to Kaliko Chun, This suit was filed on behalf of all native Hawaiians; to make the State live up to its constitutional obligation; to get DHHL the money it needs; to get Hawaiians off the waitlist and back on the land; and to get DHHL to act like a trustee.
