Ths chapter establshes the method of calculatng the dstrbuton of appropratons from the Indan Gamng Specal Dstrbuton Fund for grants to local government agences mpacted by trbal gamng. 12711. (a) It s the ntent of the Legslature to establsh a far and proportonate system to award grants from the Indan Gamng Specal Dstrbuton Fund for the support of local government agences mpacted by trbal gamng. It s also the ntent of the Legslature that prorty for fundng shall be gven to local government agences mpacted by the trbal casnos that contrbute to the Indan Gamng Specal Dstrbuton Fund. (b) It s the ntent of the Legslature that n the event that any compact between any trbe and the state takes effect on or after the effectve date of ths chapter, or that any compact between any trbe and the state that took effect on or before May 16, 2000, s renegotated and reexecuted at any tme after ts ntal effectve date, money provded to the state by a trbe pursuant to the terms of these compacts shall be appled on a pro rata bass to the state costs for the regulaton of gamng and for problem gamblng preventon programs n the Offce of Problem and Pathologcal Gamblng wthn the State Department of Alcohol and Drug Programs. (c) It s the ntent of the Legslature that f any compact between any trbe and the state takes effect on or after the effectve date of ths chapter, or f any compact between any trbe and the state that took effect on or before May 16, 2000, s renegotated and reexecuted at any tme after ts ntal effectve date, any revenue sharng provsons of that compact that requres dstrbutons to nongamng or noncompact trbes shall result n a decrease n the amount that the Legslature approprates pursuant to ths chapter. 12712. As used n ths chapter: (a) "County Trbal Casno Account" means an account consstng of all moneys pad by trbes of that county nto the Indan Gamng Specal Dstrbuton Fund after deducton of the amounts approprated pursuant to the prortes specfed n Secton 12012.85. (b) "Indvdual Trbal Casno Accounts" means an account for each ndvdual trbe that has pad money nto the Indan Gamng Specal Dstrbuton Fund. The ndvdual trbal casno account shall be funded n proporton to the amount that the ndvdual trbe has pad nto the Indan Gamng Specal Dstrbuton Fund. (c) "Local government jursdcton" or "local jursdcton" means any cty, county, or specal dstrct. (d) "Specal dstrct" means any agency of the state that performs governmental or propretary functons wthn lmted boundares. "Specal dstrct" ncludes a county servce area, a mantenance dstrct or area, an mprovement dstrct or mprovement zone, or any other zone, dstrct, or area that meets the requrements of ths subdvson. "Specal dstrct" does not nclude a cty, county, school dstrct, or communty college dstrct.

The Department of Fnance, n consultaton wth the Calforna Gamblng Control Commsson, shall calculate the total revenue n the Indan Gamng Specal Dstrbuton Fund that wll be avalable for the current budget year for local government agences mpacted by trbal gamng. The department shall nclude ths nformaton n the May budget revson. 12714. (a) A County Trbal Casno Account s hereby created n the treasury for each county that contans a trbal casno. (b) The amount to be deposted nto each elgble county's County Trbal Casno Account shall be calculated n the followng way: (1) (A) For countes that do not have gamng devces subject to an oblgaton to make contrbutons to the Indan Gamng Specal Dstrbuton Fund, the total amount to be approprated by the Legslature for grants to local government agences mpacted by trbal gamng shall be multpled by 5 percent. (B) The amount determned pursuant to subparagraph (A) shall be dvded by the aggregate number of gamng devces located n those countes that do not have gamng devces subject to an oblgaton to make contrbutons to the Indan Gamng Specal Dstrbuton Fund. (C) The amount determned pursuant to subparagraph (B) shall be multpled by the number of gamng devces located n each county for whch an appropraton s beng calculated that are not subject to an oblgaton to make contrbutons to the Indan Gamng Specal Dstrbuton Fund. (D) The amount determned pursuant to subparagraph (C) shall be deposted nto the County Trbal Casno Account for the county for whch the appropraton was calculated. (2) (A) For countes that have gamng devces subject to an oblgaton to make contrbutons to the Indan Gamng Specal Dstrbuton Fund, the total amount to be approprated by the Legslature for grants to local government agences mpacted by trbal gamng shall be multpled by 95 percent. (B) The amount determned pursuant to subparagraph (A) shall be dvded by the aggregate number of gamng devces located n those countes that have gamng devces subject to an oblgaton to make contrbutons to the Indan Gamng Specal Dstrbuton Fund. (C) The amount determned pursuant to subparagraph (B) shall be multpled by the number of gamng devces located n each county for whch an appropraton s beng calculated that are subject to an oblgaton to make contrbutons to the Indan Gamng Specal Dstrbuton Fund. (D) The amount determned pursuant to subparagraph (C) shall be deposted nto the County Trbal Casno Account for the county for whch the appropraton was calculated. 12715. (a) The Controller, actng n consultaton wth the Calforna Gamblng Control Commsson, shall dvde the County Trbal Casno Account for each county that has gamng devces that are subject to an oblgaton to make contrbutons to the Indan Gamng Specal Dstrbuton Fund nto a separate account for each trbe that operates a casno wthn the county. These accounts shall be known as Indvdual Trbal Casno Accounts, and funds may be released from these accounts to make grants selected by an Indan Gamng Local Communty Beneft Commttee pursuant to the method establshed by ths secton to local jursdctons mpacted by trbal casnos. Each Indvdual Trbal Casno Account shall be funded n proporton to the amount that each ndvdual trbe pad n the pror fscal year to the Indan Gamng Specal Dstrbuton Fund. (b) (1) There s hereby created n each county n whch Indan

The selecton of all grants from each Indvdual Trbal Casno Account or County Trbal Casno Account shall be made by each county's Indan Gamng Local Communty Beneft Commttee. In selectng grants, the Indan Gamng Local Communty Beneft Commttee shall follow the prortes establshed n subdvson (g) and the requrements specfed n subdvson (h). Ths commttee has the followng addtonal responsbltes: (A) Establshng all applcaton polces and procedures for grants from the Indvdual Trbal Casno Account or County Trbal Casno Account. (B) Assessng the elgblty of applcatons for grants from local jursdctons mpacted by trbal gamng operatons. (C) Determnng the approprate amount for rembursement from the aggregate county trbal account of the demonstrated costs ncurred by the county for admnsterng the grant programs. The rembursement for county admnstratve costs may not exceed 2 percent of the aggregate county trbal account n any gven fscal year. (2) Except as provded n Secton 12715.5, the Indan Gamng Local Communty Beneft Commttee shall be composed of seven representatves, consstng of the followng: (A) Two representatves from the county, selected by the county board of supervsors. (B) Three elected representatves from ctes located wthn four mles of a trbal casno n the county, selected by the county board of supervsors. In the event that there are no ctes located wthn four mles of a trbal casno n the county, other local representatves may be selected upon mutual agreement by the county board of supervsors and a majorty of the trbes payng nto the Indan Gamng Specal Dstrbuton Fund n the county. When there are no ctes wthn four mles of a trbal casno n the county, and when the Indan Gamng Local Communty Beneft Commttee acts on behalf of a county where no trbes pay nto the Indan Gamng Specal Dstrbuton Fund, other local representatves may be selected upon mutual agreement by the county board of supervsors and a majorty of the trbes operatng casnos n the county. However, f only one cty s wthn four mles of a trbal casno and that same casno s located entrely wthn the unncorporated area of that partcular county, only one elected representatve from that cty shall be ncluded on the Indan Gamng Local Communty Beneft Commttee. (C) Two representatves selected upon the recommendaton of a majorty of the trbes payng nto the Indan Gamng Specal Dstrbuton Fund n each county. When an Indan Gamng Local Communty Beneft Commttee acts on behalf of a county where no trbes pay nto the Indan Gamng Specal Dstrbuton Fund, the two representatves may be selected upon the recommendaton of the trbes operatng casnos n the county. (c) Sxty percent of each Indvdual Trbal Casno Account shall be avalable for nexus grants on a yearly bass to ctes and countes mpacted by trbes that are payng nto the Indan Gamng Specal Dstrbuton Fund, accordng to the four-part nexus test descrbed n paragraph (1). Grant awards shall be selected by each county's Indan Gamng Local Communty Beneft Commttee and shall be admnstered by the county. Grants may be awarded on a multyear bass, and these multyear grants shall be accounted for n the grant process for each year. (1) A nexus test based on the geographcal proxmty of a local government jursdcton to an ndvdual Indan land upon whch a trbal casno s located shall be used by each county's Indan Gamng Local Communty Beneft Commttee to determne the relatve prorty for grants, usng the followng crtera: (A) Whether the local government jursdcton borders the Indan lands on all sdes.

(C) Whether the local government jursdcton mantans a hghway, road, or other thoroughfare that s the predomnant access route to a casno that s located wthn four mles. (D) Whether all or a porton of the local government jursdcton s located wthn four mles of a casno. (2) Ffty percent of the amount specfed n subdvson (c) shall be awarded n equal proportons to local government jursdctons that meet all four of the nexus test crtera n paragraph (1). If no elgble local government jursdcton satsfes ths requrement, the amount specfed n ths paragraph shall be made avalable for nexus grants n equal proportons to local government jursdctons meetng the requrements of paragraph (3) or (4). (3) Thrty percent of the amount specfed n subdvson (c) shall be awarded n equal proportons to local government jursdctons that meet three of the nexus test crtera n paragraph (1). If no elgble local government jursdcton satsfes ths requrement, the amount specfed n ths paragraph shall be made avalable for nexus grants n equal proportons to local government jursdctons meetng the requrements of paragraph (2) or (4). (4) Twenty percent of the amount specfed n subdvson (c) shall be awarded n equal proportons to local government jursdctons that meet two of the nexus test crtera n paragraph (1). If no elgble local government jursdcton satsfes ths requrement, the amount specfed n ths paragraph shall be made avalable for nexus grants n equal proportons to local government jursdctons meetng the requrements of paragraph (2) or (3). (d) Twenty percent of each Indvdual Trbal Casno Account shall be avalable for dscretonary grants to local jursdctons mpacted by trbes that are payng nto the Indan Gamng Specal Dstrbuton Fund. These dscretonary grants shall be made avalable to all local jursdctons n the county rrespectve of any nexus to mpacts from any partcular trbal casno, as descrbed n paragraph (1) of subdvson (c). Grant awards shall be selected by each county's Indan Gamng Local Communty Beneft Commttee and shall be admnstered by the county. Grants may be awarded on a multyear bass, and these multyear grants shall be accounted for n the grant process for each year. (e) (1) Twenty percent of each Indvdual Trbal Casno Account shall be avalable for dscretonary grants to local jursdctons mpacted by trbes that are not payng nto the Indan Gamng Specal Dstrbuton Fund. These grants shall be made avalable to local jursdctons n the county rrespectve of any nexus to mpacts from any partcular trbal casno, as descrbed n paragraph (1) of subdvson (c), and rrespectve of whether the mpacts presented are from a trbal casno that s not payng nto the Indan Gamng Specal Dstrbuton Fund. Grant awards shall be selected by each county's Indan Gamng Local Communty Beneft Commttee and shall be admnstered by the county. Grants may be awarded on a multyear bass, and these multyear grants shall be accounted for n the grant process for each year. (A) Grants awarded pursuant to ths subdvson are lmted to addressng servce-orented mpacts and provdng assstance wth one-tme large captal projects related to Indan gamng mpacts. (B) Grants shall be subject to the sole sponsorshp of the trbe that pays nto the Indan Gamng Specal Dstrbuton Fund and the recommendatons of the Indan Gamng Local Communty Beneft Commttee for that county. (2) If an elgble county does not have a trbal casno operated by a trbe that does not pay nto the Indan Gamng Specal Dstrbuton Fund, the moneys avalable for dscretonary grants under ths subdvson shall be avalable for dstrbuton pursuant

(f) (1) For each county that does not have gamng devces subject to an oblgaton to make payments to the Indan Gamng Specal Dstrbuton Fund, funds may be released from the county's County Trbal Casno Account to make grants selected by the county's Indan Gamng Local Communty Beneft Commttee pursuant to the method establshed by ths secton to local jursdctons mpacted by trbal casnos. These grants shall be made avalable to local jursdctons n the county rrespectve of any nexus to any partcular trbal casno. These grants shall follow the prortes specfed n subdvson (g) and the requrements specfed n subdvson (h). (2) Funds not allocated from a county trbal casno account by the end of each fscal year shall revert back to the Indan Gamng Specal Dstrbuton Fund. Moneys allocated for the 2003-04 fscal year shall be elgble for expendture through December 31, 2004. (g) The followng uses shall be the prortes for the recept of grant moneys from Indvdual Trbal Casno Accounts: law enforcement, fre servces, emergency medcal servces, envronmental mpacts, water supples, waste dsposal, behavoral, health, plannng and adjacent land uses, publc health, roads, recreaton and youth programs, and chld care programs. (h) In selectng grants pursuant to subdvson (b), an Indan Gamng Local Communty Beneft Commttee shall select only grant applcatons that mtgate mpacts from casnos on local jursdctons. If a local jursdcton uses a grant selected pursuant to subdvson (b) for any unrelated purpose, the grant shall termnate mmedately and any moneys not yet spent shall revert to the Indan Gamng Specal Dstrbuton Fund. If a local jursdcton approves an expendture that mtgates an mpact from a casno on a local jursdcton and that also provdes other benefts to the local jursdcton, the grant selected pursuant to subdvson (b) shall be used to fnance only the proportonate share of the expendture that mtgates the mpact from the casno. () All grants from Indvdual Trbal Casno Accounts shall be made only upon the affrmatve sponsorshp of the trbe payng nto the Indan Gamng Specal Dstrbuton Fund from whose Indvdual Trbal Casno Account the grant moneys are avalable for dstrbuton. Trbal sponsorshp shall confrm that the grant applcaton has a reasonable relatonshp to a casno mpact and satsfes at least one of the prortes lsted n subdvson (g). A grant may not be made for any purpose that would support or fund, drectly or ndrectly, any effort related to the opposton or challenge to Indan gamng n the state, and, to the extent any awarded grant s utlzed for any prohbted purpose by any local government, upon notce gven to the county by any trbe from whose Indvdual Trbal Casno Account the awarded grant went toward that prohbted use, the grant shall termnate mmedately and any moneys not yet used shall agan be made avalable for qualfed nexus grants. (j) A local government jursdcton that s a recpent of a grant from an Indvdual County Trbal Casno Account or a County Trbal Casno Account shall provde notce to the publc, ether through a slogan, sgnage, or other mechansm, statng that the local government project has receved fundng from the Indan Gamng Specal Dstrbuton Fund and further dentfyng the partcular Indvdual Trbal Casno Account from whch the grant derves. (k) (1) Each county's Indan Gamng Local Communty Beneft Commttee shall submt to the Controller a lst of approved projects for fundng from Indvdual Trbal Casno Accounts. Upon recept of ths lst, the Controller shall release the funds drectly to the local government enttes for whch a grant has been approved by the commttee. (2) Funds not allocated from an Indvdual Trbal Casno Account

Moneys allocated for the 2003-04 fscal year shall be elgble for expendture through December 31, 2004. Moneys allocated for the 2008-09 fscal year shall be elgble for expendture through December 31, 2009. (l) Notwthstandng any other law, a local government jursdcton that receves a grant from an Indvdual Trbal Casno Account shall depost all funds receved n an nterest-bearng account and use the nterest from those funds only for the purpose of mtgatng an mpact from a casno. If any porton of the funds n the account s used for any other purpose, the remanng porton shall revert to the Indan Gamng Specal Dstrbuton Fund. As a condton of recevng further funds under ths secton, a local government jursdcton, upon request of the county, shall demonstrate to the county that all expendtures made from the account have been n complance wth the requrements of ths secton. 12715.5. In San Dego County, the Indan Gamng Local Communty Beneft Commttee shall be comprsed of seven representatves, consstng of the followng: (a) Two representatves from the county, selected by the county board of supervsors. (b) One elected representatve from the cty located wthn four mles of a trbal casno n the county, selected by the county board of supervsors. (c) Three representatves selected upon the recommendaton of a majorty of the trbes payng nto the Indan Gamng Specal Dstrbuton Fund n the county. (d) The sherff of San Dego County. 12716. (a) Each county that admnsters grants from the Indan Gamng Specal Dstrbuton Fund shall provde an annual report to the Charperson of the Jont Legslatve Budget Commttee, the charpersons of the Senate and Assembly commttees on governmental organzaton, and the Calforna Gamblng Control Commsson by October 1 of each year detalng the specfc projects funded by all grants n the county's jursdcton n the prevous fscal year, ncludng amounts expended n that fscal year, but funded from appropratons n pror fscal years. The report shall provde detaled nformaton on the followng: (1) The amount of grant funds receved by the county. (2) A descrpton of each project that s funded. (3) A descrpton of how each project mtgates the mpact of trbal gamng. (4) The total expendtures for each project. (5) All admnstratve costs related to each project, excludng the county's admnstratve fee. (6) The funds remanng at the end of the fscal year for each project. (7) An explanaton regardng how any remanng funds wll be spent for each project, ncludng the estmated tme for expendture. (8) A descrpton of whether each project s funded once or on a contnung bass. (b) A county that does not provde an annual report pursuant to subdvson (a) shall not be elgble for fundng from the Indan Gamng Specal Dstrbuton Fund for the followng year. (c) Ths secton shall become operatve on January 1, 2012.

The State Audtor shall conduct an audt every three years regardng the allocaton and use of moneys from the Indan Gamng Specal Dstrbuton Fund by the recpent of the grant moneys. The State Audtor shall report ts fndngs to the Legslature and to all other approprate enttes. 12718. Ths chapter shall reman n effect only untl January 1, 2021, and as of that date s repealed, unless a later enacted statute that s enacted before January 1, 2021, deletes or extends that date.
