ADDENDUM NO. 1 TO CONTRACT DOCUMENTS FOR Contract TCIS-28 Addendum No. 1 Page 1 of 4 SOUTHERLY WASTEWATER TREATMENT CENTER TESTING AND CONSTRUCTION INSPECTION SERVICES FOR THE RENEWABLE ENERGY FACILITY (REF) (TCIS-28) FOR THE NORTHEAST OHIO REGIONAL SEWER DISTRICT March 15, 2010 PROPOSAL OPENING DATE MARCH 26, 2010 4:30 PM (OFFICIAL LOCAL TIME) Addendum No. 1 consists of three (3) pages and one (1) attachment as follows: I. Preproposal Questions Attachment A: Preproposal Conference Sign-in Sheets I. PREPROPOSAL QUESTIONS Q1: Are the testing firm(s) that are currently working for Walsh as a subcontractor eligible to propose on this contract? A1: No. Q2: For the SBE participation requirement, since the services are as needed how do proposers show actual participation? A2: This is part of the proposal. The proposers should demonstrate in the proposal how the SBE participation requirements will be met, regardless of the level of effort that is required. Q3: How will the cash flow for this project work out since it is an as-needed contract? 1
Contract TCIS-28 Addendum No. 1 Page 2 of 4 A3 As part of the monthly report, the consultant is to provide, based on its experience on this project, anticipated cash flow. As the project develops, the consultant will be able to provide a more accurate projection as the resoucr needs are better understood. Q4: How will the recording of inspector daily reports (IDRs) work? How will the inspectors be expected to log the IDRs into Primavera Contract Manager (PCM)? A4: The inspectors will be required to record hand written IDRs in the field and will also be required to use computers in the PMO/NEORSD field office to record reports into PCM on a daily basis. PCM and computers will be provided by the PMO/NEORSD. All reports will be finalized and turned over to the CM on a daily basis. Q5: The RFP indicates the proposal is limited to 60 pages. Please confirm if the proposal is double sided, a 30 page limit applies. A5: Yes, if the proposal is double sided, the 60 page limit still applies (30 pages double sided). Q6: Is the information in the presentation from the pre-proposal meeting included in the CD that was handed out at the meeting? A6: No, the presentation is posted on the NEORSD website. Q7: The RFP requires that the proposers submit overhead rates. Is NEORSD looking for audited or proposed overhead rates? A7: Audited overhead rates are preferred; however proposed rates are acceptable for the proposal. Also, when proposers are proposing teams for the contract, overhead rates for each firm must be included in the proposals. Proposers should include a field rate and office overhead rate. Q8: Since the RFP indicates that shop witness testing services may be required, what type of travel is expected of the consultant? A8: It is anticipated that only local trips would be required for shop witness testing. Q9: If the prime consultant is a certified SBE, is there still a 15% SBE subcontracting requirement in addition to the prime consultant. A9: Yes, this is NEORSD policy. Q10: Are all SBEs eligible to submit as a prime consultant? A10: Yes. 2
Contract TCIS-28 Addendum No. 1 Page 3 of 4 Q11: Can you please clarify the policy on a SBE receiving credit for attaining the project's SBE goal when the SBE is proposing as the prime. Is it still 20% or is it now 0%? A11: The District has made a couple of substantive revisions to its Small Business Enterprise (SBE) Program Policy. Such changes to the policy are as follows: 1) The District will allow utilization of second-tier subcontractors to apply toward SBE subcontracting goals. 2) District-certified SBEs who are performing as prime contractors must obtain 100% of the SBE subcontracting goal. There is no longer a 20% credit toward SBE goals for SBE prime contractors. If a certified SBE is bidding as a prime, the certified SBE must select other certified SBEs to meet the SBE goal. Q12: Are the testing firms currently involved with the design contract for 28 (Under Malcolm Pirnie) eligible to propose. A12: Yes. Q13: Just for clarification, if a testing firm is currently working under contract 28 as a 2 nd tier subcontractor to Walsh Construction; is the firm eligible to propose on this contract? A13: No. Q14: Is Walsh Construction responsible for the quality control of all their subcontractors as part of Contract 28? A14: Yes. Q15: What exactly does the 80% local participation mean? Can the 15% applied to the SBE participation be also applied to the 80% local participation requirement? A15: The 80% local participation is defined as the company being located in the counties of Cuyahoga, Lake, Lorain or Summit Counties. To be a certified SBE, the firm must be located in the same four counties. Therefore the 15% SBE requirement can also be included in the 80% local participation requirement. Q16: Task 3 in the RFP references Exhibits A, B, C and D. Please clarify where the proposers can find these. 3
