(Simple majority vote for passage) COMMENTS: Attached is the Resolution for Youngstedts Car Wash approving the PUD Concept Stage Plan for a car wash facility located at the corner of 96 th Ave N and Maple Grove Parkway. The property in question is in multiple parcels, one owned by a private party with which the applicant has a purchase agreement and two that are former rights-of-way of I-94 and now owned by the City of Maple Grove. The applicant has been in negotiations with City Engineering staff regarding these properties. As noted in the Assistant City Engineer s memo, any approval of this plan should be contingent upon the sale of the City owned property. RESOLUTION NO. 15-005 CITY OF MAPLE GROVE RESOLUTION APPROVING PLANNED UNIT DEVELOPMENT CONCEPT STAGE PLAN FOR YOUNGSTEDTS CAR WASH WHEREAS, CLS IV (hereinafter referred to as the "Applicant") has made application for a Planned Unit Development Concept Stage Plan on property located at Maple Grove Parkway and 96th Ave. N., Maple Grove, Minnesota and shown on attached Exhibit A ("Property"); and WHEREAS, the Applicant proposes to develop the Property into a full service tunnel car wash; and WHEREAS, the land to the north, south and west of the Property is zoned B-PUD, Business PUD. The land to the east of the Property is 1-94; and WHEREAS, the City staff studied the matter, made a report, and provided other information to the Planning Commission and City Council; and WHEREAS, the City Planning Commission held a public hearing and considered the matter on December 8, 2014; and matter. WHEREAS, the City Council at its December 15,2014, meeting, has considered the NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Maple Grove hereby approves the Planned Unit Development Concept Stage Plan for the Property drafted by Architectural Consortium, LLC, dated November 7,2014 (hereinafter referred to as the "Concept Plan") limited, pursuant to City Code 36-64(a)(1), to the overall maximum PUD density, general location of major streets and pedestrian ways, general location and extent of public and common open space, general location of land uses and approximate type and intensities of development, and subject to the following requirements that must be met, to the satisfaction of the City, prior to any other approvals, including, but not limited to, Development Stage Plan: 1. Access to the proposed carwash will be by right-in right-out driveway located on the north side of the Property to 96th Avenue. Traffic exiting the Property may have a tendency of making a U-turn at the intersection of 96th Avenue and Black Oak Lane. City staff shall review the need to extend the center median in 96th A venue further west to the aforementioned intersection and the need for any signage regarding illegal U turns. Any required extension and signage shall be addressed at the time application is made for Development Stage Plan. 2. The development of the Property requires the sale of City owned land to the Applicant located on the easterly side of the Property. At the time of Developer Stage

Plan, the sale shall be reviewed and made part of the approval process with terms of said sale that include, but are not limited to, payment by Applicant of any assessments for street and utility benefits that have not been previously assessed. 3. The Property currently has an 8-inch watermain that can be used to serve the proposed building. Sanitary sewer is located in the median and will be required to be extended to the Property. Plans submitted as part of the Development Stage Plan process shall include the sanitary sewer service being installed using some form of horizontal directional drilling rather than open cutting the street. Storm sewer service to the Property shall be reviewed by the City at the time of Development Stage Plan. 4. The Applicant shall comply with all requirements of the Minnesota Department of Transportation for development of the Property and the Concept Plan shall be modified and plans submitted as part of the Development Stage Plan process shall include the requirements of the Minnesota Department of Transportation, which modifications and inclusions are subject to the review and approval of the City. 5. The proposed building elevations shall conform to City Code requirements contained in the B, Business District for exterior treatments, which shall be addressed at the time of Development Stage Plan. 6. The Property and the development thereof shall be, at all times, in compliance with applicable City Code and other governmental rules and regulations. 7. The Applicant shall pay upon demand all expenses, determined by the City, that the City incurs in relation to this development and Resolution, and shall provide an escrow deposit in an amount to be determined by the City. Said expenses shall include, but are not limited to, staff time, including, but not limited to, hourly wage, overhead and benefits, engineering, legal and other consulting fees incurred in relation to the development. 8. If the Applicant fails to deliver an application for PUD Development Stage Plan within one (1) year from the date of this Resolution, the approvals granted by this Resolution shall become void and expire with no further action of the City Council. 2

The Minnesota Department of Transportation (MnDOT) has reviewed the site plan and has the following comments: Water Resources A drainage permit may be required. The proposed development will need to maintain existing drainage rates (i.e., the rate at which storm water is discharged from the site must not increase). The City or project developer will need to submit existing / proposed hydraulic computations for both 10 and 100 year rainfall events verifying that all existing drainage patterns and systems affecting MnDOT right of way will be perpetuated. ~ - Cityof Maple Grove MEMORANDUM TO: FROM: Peter Vickerman, City Planner Jupe Hale, PE, Transportation Operations Engineer DATE: December 2, 2014 SUBJECT: Youngstedt's Car Wash - PUD Concept Stage Plan I have reviewed the Concept Stage Plan for Youngstedt's Car Wash and offer the following comments: 1. The right-inlright-out (R1RO) access is problematic (as discussed in Assistant City Engineer Terry Muller's Memorandum dated November 25,2014). Currently, the only method to exit the immediate area (other than westbound County Road 30) is to proceed south on 96th Avenue to Maple Grove Parkway. Ultimately, 96th Avenue will connect to future Garland Lane to the west, which will access both directions of County Road 30 via a traffic signal. However, even with this connection in place, it is unlikely that car wash traffic that wishes to access Maple Grove Parkway and/or 1-94 will use this connection. I estimate that at least two-thirds of site traffic will attempt to access southbound/eastbound 96th Avenue from the site, regardless of any future connection. 2. It is my opinion that the majority of the traffic exiting the site will do one of the following three maneuvers: a. Make a U-turn near Black Oaks Lane; b. Turn left onto Black Oaks Lane, then use the cul-de-sac to return for a right turn onto 96th Avenue; or c. Make a right turn into the Holiday Station lot, circulate north and west through the site to the driveway opposite Black Oaks Lane, then turn left onto 96th Avenue. 3. The proposed land use (3800 SF Automated Car Wash) is estimated to generate 40 PM peak hour trips (caveat: data for this use in Trip Generation Manual is limited). For context given the size of the site and potential uses, anticipated PM peak hour trip generation would be 20-30 trips for a 5000 SF stand-alone specialty retail store, 75 trips for a 5000 SF office, and 150 trips for a 3000 SF fast-food restaurant. 4. The U-turn movement will be undesirable from a safety standpoint. It is not currently signed as an illegal move, but we will require such signage with any approved development at this location. Further, I second Mr. Muller's suggestion that the existing center median be extended to the west to discourage U-turns and make it more straightforward to turn left onto Black Oaks Lane.

5. The cut-through traffic may be problematic for Holiday, which not only has a busy and congested site with fuel pumps and convenience store, but also is a direct competitor for the proposed car wash. I do not see any reasonable means for preventing this maneuver from taking place without negatively impacting access to Holiday. No land will be requested for parks or trails with this proposal. Staffwill recommend the Park Board accept a cash dedication. Park dedication fees for a commercial subdivision are calculated by the acre. The current rate is $11,000 per acre. Fees will apply to all platted lots and all outlots improved as part of the subdivision. Fees also apply to the first 80-feet of all road rights-of-way classified as a minor arterial or smaller and all private storm and infiltration basins. Based on site data provided the park dedication cash requirement for the proposal would calculate as: 1.02 acres x $11,000 = $11,220
