WHEREAS, the Town Council of the Town of Jupiter, Florida (Town), has adopted a Comprehensive Plan pursuant to Chapter 163, Part II, Florida Statutes, formerly known as the Local Government Comprehensive Planning and Development Act" and now known as the Growth Policy Act (the Act); and, WHEREAS, the Florida Department of Community Affairs, now known as the Department of Economic Opportunity, previously determined that the Town s Comprehensive Plan was in compliance with the Local Government Comprehensive Planning and Development Act; and, WHEREAS, pursuant to Section 163.3174(4)(a) of the Act, the Town s Local Planning Agency (the LPA) has conducted a public hearing to consider amendments to the Intergovernmental Coordination and Capital Improvements Elements, to incorporate provisions

Ordinance No. 7-18 Page B 1 2 3 4 5 6 7 8 9 10 11 of the Town s Interlocal Agreement with the School District of Palm Beach County (the Amendments) and; WHEREAS, the text of the Amendment is as set forth in Exhibit "A" which is attached hereto and incorporated herein; and, WHEREAS, The Town Council has determined that the Amendments would be in compliance with the Act; and, WHEREAS, pursuant to Section 163.3184(11), Florida Statutes, the Town Council has conducted a public hearing to consider the transmittal of the Amendments, and after considering public comments authorized its transmittal pursuant to Section 163.3184(4)(b), F.S. NOW THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF JUPITER, FLORIDA: 12 13 14 Section 1. the Town Council. Section 2. The whereas clauses are incorporated herein as the legislative findings of Ordinance No. 57-89 of the Town of Jupiter, entitled "Comprehensive 15 16 17 18 19 Plan of the Town of Jupiter," is hereby amended to reflect the amendments of the Intergovernmental Coordination and Capital Improvements Elements incorporating the provisions of the Public School Coordinated Planning Interlocal Agreement and to eliminate the Public School Facilities Element from the Town s Comprehensive Plan as set forth in Exhibit "A", which is attached hereto and incorporated herein. 20 Section 3. The Town Clerk is hereby directed to transmit the required copies of the 21 22 23 24 25 proposed Amendments to the Department of Economic Opportunity and all other parties pursuant to Section 163.3184(3)(c)2., Florida Statutes. Section 4. Severability. If any section, paragraph, sentence, clause, phrase or word of this Ordinance is for any reason held by a court to be unconstitutional, inoperative or void, such holding shall not affect the remainder of this Ordinance.

Effective Date. INTERGOVERNMENTAL COORDINATION ELEMENT Objective 2.2: Establish and maintain specific means of coordination with adjacent local governments and other service providers. Policy 2.2.1 The Town shall pursue interlocal agreements with local governments that have identified or adopted future land use designations for adjacent unincorporated areas. These agreements would establish joint planning areas, pursuant to Chapter 163.3177, F.S. The Town shall encourage joint planning agreements that include as many of the following planning consideration as are applicable: a) cooperative planning and review of land development activities within areas covered by the agreement; b) specification of service delivery; c) funding and cost sharing issues within joint planning areas; and d) enforcement and implementation. Policy 2.2.2 The Town shall coordinate with those universities which are part of the State University System, regarding the development of campus master plans or amendments thereto, to be done in accordance with Section 1013.30, F. S. Policy 2.2.3 The Town recognizes the value of Florida Atlantic University (FAU) and the Town shall coordinate programs and partnerships with FAU. Policy 2.2.4 The Town will coordinate with Palm Beach County and the Palm Beach School District in order to develop population projections for future school needs. Policy 2.2.5 The Town will coordinate annually, at a minimum, with other units of local government providing facilities and services, such as, but not limited to Loxahatchee River District, Palm Beach County Solid Waste, Martin and Palm Beach County MPOs, North Palm Beach Heights Water Control District, Northern Palm Beach County Improvement District, and the SFWMD. This coordination shall include obtaining comments on changes to the Town s comprehensive plan, sharing annual reports and updates. Policy 2.2.6 The Town shall coordinate with all parties of the Palm Beach County Public School Coordinated Planning Interlocal Agreement in the event it is determined by the Town that an regarding proposed amendments which are to the agreement is necessary, based on the annual evaluation of coordinating residential development with school capacity. Policy 2.2.7 The Town shall coordinate with the School District of Palm Beach County to share data on an annual basis in order to improve the public school concurrency process. Specifically, the Town shall provide the following information regarding new residential development projects within its municipal boundaries to the School District by October 1 st : a) The number of approved dwelling units by type (single-family, townhome, granny flat, condo, loft & other), and, if available, the number of units by type the developer is proposing to build; b) The number of Certificates of Occupancy issued in accordance with the Public School Concurrency Interlocal Agreement, as amended (on April 1 st and October 1 st ); c) A list of residential developments, which have submitted applications for development approvals to the Town; d) Information on the expiration for development orders and updates if a project has stalled or stopped.

Policy 2.2.78 The Town s Utility Department will continue to coordinate the Town s Water System Master Plan, which includes a 10-year Water Supply Facilities Work Plan, and the Comprehensive Plan with the SFWMD s Lower East Coast Regional Water Supply Plan. Goal 4: Public School Coordinated Planning School Facility siting and Development Coordination. It is the Town s GOAL to maintain and enhance joint planning and the coordination of the siting and the development of public education facilities based upon data received regarding population projections for residential development. This goal shall be accomplished recognizing the constitutional obligation of the school district to provide a uniform system of free public schools on a countywide basis. [former Public School Facilities Element (PSFE) Goal 2] Objective 4.1 To establish and maintain a cooperative relationship with the School District and other local governments so as to coordinate planning the development of public school facilities which are proximate to existing or proposed residential areas they will serve and which serve as community focal points. [former PSFE Objective 2.2] Policy 4.1.1 The Town shall abide by the Palm Beach County Interlocal Agreement with Municipalities of Palm Beach County and the School District of Palm Beach County for Coordinated Planning to establish Public School Concurrency, which was fully executed by the parties involved and recorded with the Clerk of the Circuit Court of Palm Beach County on December 15, 2015 and executed by the Town of Jupiter on December 7, 2016 January 25, 2001, consistent with ss.163.3177(6)(h)1.and 2. F.S. and 163.3180 F.S. [former PSFE Policy 2.2.1] Policy 4.1.2 The Town shall adopt by reference the School District of Palm Beach County s Five-Year Capital Improvement Schedule annually amend Table 11 of the Capital Improvement Element (School District of Palm Beach County Six-Year Capital Improvement Schedule), to which maintains consistency with the School Board s adopted Five Year Plan, and to maintain a financially feasible capital improvements program and ensure that level of service standards will continue to be achieved and maintained in each year of the five year planning period. The Town shall have no obligation or responsibility for funding the School District s Capital Facilities Plan. [former PSFE Policy 1.3.1] Policy 4.1.3 The Town shall provide the School District with periodic annual information generated from the Town s approvals of residential development or redevelopment projects that are needed to maintain school [adequacy] concurrency, including information required for the School District to establish: a) School siting criteria; b) Level of service update and maintenance; cb) Joint approval of the public school capital facilities program; and d) Concurrency service area criteria and standards; and ec) School utilization. [former PSFE Policy 2.2.3] Policy 4.1.4 The Town shall annually provide the School District with its current relevant data and analysis regarding residential development from its Comprehensive Plan, along with any relevant amendments thereto, along with the five-year Land Use and population projections, to assist the School District with school enrollment projections. The Town shall coordinate its Comprehensive Plan and the Future Land Use Map with the School District s long range facilities maps (Maps PS ICE 13.3 and PS ICE 13.4), to ensure consistency with the provisions of Goal 4 of this Element. [former PSFE Policy 2.2.4] Policy 4.1.5 The Town shall coordinate with the School District to share data on an annual basis in order to improve the public school coordinated planning process. The Town shall

provide the following data regarding new residential development projects within its municipal boundaries to the School District for the time-period of April 1 st through September 30 th by October 15 th and the time-period of October 1 st through March 31 st by April 15 th : a) The number of approved dwelling units by type (single-family, townhome, granny flat, condo, loft & other), and, when available, the number of units by type proposed by the developers of residential or mixed use projects; b) The number of Certificates of Occupancy issued in accordance with the Public School Coordinated Planning Interlocal Agreement, as amended; c) A list of the applications submitted for residential development; d) Information on the expiration for development orders pertaining to residential development projects and updates if a project has stalled or stopped; e) A list of all approved future land use map amendments and development orders which pertain to residential development. Policy 4.1.6 The Town shall provide opportunity for the School District to comment on the Town s proposed comprehensive plan amendments, and applications for development orders or other land-use decisions which may impact the public schools facilities plan. The Town shall incorporate letters from the School District identifying school capacity availability into staff reports for applications for development orders or plan amendments which are to be presented to the Town Council. The Town may incorporate conditions of approval into its development orders to mitigate development impacts at the request of the School District, as the Town deems appropriate. [former PSFE Policy 2.2.6] Policy 4.1.7 The Town shall coordinate with Palm Beach County, other municipalities and the School District on emergency preparedness issues which may include consideration of: a) Design and/or retrofit of public schools as emergency shelters; b) Enhancing public awareness of evacuation zones, shelter locations, and evacuation routes; c) Designation of sites other than public schools as long term shelters, to allow schools to resume normal operations following emergency events. [former PSFE Policy 2.2.7] Objective 4.2 To establish a process of coordination and collaboration between Palm Beach County, other municipalities, and the School District in the planning and siting of new public school facilities to coordinate planned infrastructure and public facilities. [former PSFE Objective 2.1] Policy 4.2.1 The Town shall coordinate and provide for expedited review of development proposals with the School District during the development review process to ensure integration of public school facilities with surrounding land uses and the compatibility of uses with schools. [former PSFE Policy 2.1.1] Policy 4.2.2. Upon receipt of notice from the School District of its intent to acquire or lease a property for a school site, the Town shall review and provide a determination of consistency with the existing future land use designation and zoning district of the property with the Town s Comprehensive Plan. The Town comments may address the availability of necessary and planned infrastructure and the collocation of the proposed school facility with other public facilities such as parks, libraries and community centers. Policy 4.2.3 The Town abides by the school siting and development review and building permit procedures outlined in the Palm Beach County Interlocal Agreement with Municipalities of Palm Beach County and the School District of Palm Beach County for Coordinated Planning.

Policy 4.2.4 There shall be no significant environmental conditions and significant historical resources on a proposed site that cannot be mitigated or otherwise preclude development of the site for a public educational facility. Policy 4.2.5 The proposed site shall be suitable or adaptable for development in accordance with applicable water management standards, and shall not be in conflict with the adopted or officially accepted plans of the South Florida Water Management District, or any applicable Stormwater Utility or Drainage District. [former PSFE Policy 2.1.2] Policy 4.2.6 The proposed location shall comply with the provisions of the Coastal Management Element of the Town s Comprehensive Plan, if applicable to the site. [former PSFE Policy 2.1.3] Policy 4.2.7 The Town shall encourage the location of schools proximate to its residential areas by: a) Assisting the School District in identifying funding and/or construction opportunities (including developer participation or Town capital budget expenditures) for sidewalks, traffic signalization, access, water, sewer, drainage and other infrastructure improvements; b) Providing for the review potential of school sites as indicated in Objective 4.2 Policy 2.1.1 above; and, c) Allowing schools as a permitted use within the Public Institutional and Mixed Use all urban residential land use designationscategories. [former PSFE Policy 2.1.4] Policy 4.2.8 The Town shall coordinate with the School District for the collocation of public facilities, such as parks, libraries, and community centers with schools, to the extent possible, as sites for these public facilities and schools are chosen and development plans prepared. [former PSFE Policy 2.1.5] Objective 4.3 To establish a joint process of coordination and collaboration between the Town, Palm Beach County and the School District in the planning and decision making on population projections. [former PSFE Objective 2.3] Policy 4.3.1 The Town commits to working with the School District to improve this the County s Population Allocation Model methodology and enhance coordination with the plans of the School District and other local governments. Student Population and student enrollment projections shall be revised annually by the School District to ensure that new residential development and redevelopment information provided by the municipalities and the County as well as changing demographic conditions are reflected in the updated projections. The revised projections and the variables utilized in making the projections shall be reviewed by all signatories through the Intergovernmental Plan Amendment Review Committee (IPARC). Projections shall be especially revisited and refined with the results of the 2000 Census. The responsibilities of local governments and the School District on population projections are described in Section VIII-B of the Interlocal Agreement. CAPITAL IMPROVEMENTS ELEMENT Objective 1.2 The Town shall coordinate land-use decisions and available or projected fiscal resources with a schedule of capital improvements which maintains adopted level of service standards and meets the existing and future facility needs. The measure of success in using this tool for planning capital facilities shall be the identification of capital facilities projects necessary to ensure that adopted level-of-service standards are achieved and maintained for the five-year period. The projects shall be identified as either funded or unfunded and given a level of priority for funding. Policy 1.2.1 The Town shall utilize the following adopted level-of-service standards in reviewing the impacts of new and redevelopment upon the provision of public facilities and services: Sanitary Sewer - 85 gallons per capita per day Solid Waste - Drainage - Potable Water - 7.13 pounds per capita per day Projects shall be designed and operated so that off-site discharges meet State water quality standards, consistent with Chapter 62-25, Florida Administrative Code (adopted by reference) Residential Accounts - 153 gallons per day Commercial Accounts - 100 gallons per day per 1,000 square feet Transportation Facilities - The Town, in cooperation with Palm Beach County and the Florida Department of Transportation, shall maintain an adopted level of service standard of D on all County and State maintained roads. The Town shall maintain the following adopted level-ofservice standards for all Town-maintained roadways: a) Peak-hour two-way LOS D b) Daily - LOS C c) Intersection LOS D Recreation Facility Standards - Recreation Facility Adopted LOS Standards Activity Facility per Population Tennis 1 court per 4,000 Baseball 1 field per 6,000 Softball 1 field per 12,000 Football 1 field per 12,000 Soccer 1 field per 5,000 Basketball 1 court per 4,000 Racquetball/ 1 court per 7,500 Handball Resource-based Park 1 park per 30,000 Exercise Trail 1 trail per 12,000 Swimming Pool 1 pool per 65,000 Community Center 1.5 square foot per person Lacrosse 1 filed per 12,000 Volleyball 1 field per 8,000

Skate Parks 1 park per 60,000 Roller Hockey 1 rink per 30,000 expansion or addition in increments of 30,000 sq. ft. Policy 1.2.2 Proposed plan amendments and requests for new development, redevelopment, or infill shall be evaluated according to the following guidelines as to whether the proposed action would: a) exacerbate any existing condition of public facility capacity deficits, as described in this Plan; b) generate public facility demands that may be accommodated by capacity increases planned in the Five-Year Schedule of Improvements; c) conform with future land uses as shown on the future land map and urban service areas as described in this Plan. d) if public facilities are developer-provided, accommodate public facility demands based upon adopted level-of-service standards; e) if public facilities are provided, in part or whole, by Town, demonstrate financial feasibility, subject to this Element; and f) affect State agency and water management district plans. Policy 1.2.3 The Town adopts by reference, the Loxahatchee River District s April 1986 Master Plan for Irrigation Quality Water Reuse, as amended by the July 2008 Irrigation Quality Water Program Evaluation, to support the irrigation water programs contained in the Town s 2012 Water Master Plan Update and 2014 10-year Water Supply Facilities Work Plan. Policy 1.2.4 The schedule of proposed capital improvement projects shall give priority to correcting existing deficiencies and the replacement of worn-out or obsolete facilities prior to the extension of new facilities according to the following rank prioritization: a) Elimination of immediate public hazards or safety deficiencies. b) Meeting regulatory requirements or Federal and/or State mandates. c) Correcting existing facility deficiencies in adopted LOS standards. d) Replacement of obsolete or worn-out facilities that are projected to cause facility deficiencies in adopted LOS standards prior to expanding other facilities. e) Addition or expansion of existing facilities to serve vested developments. f) Addition or expansion of existing facilities to serve development needs in designated redevelopment overlay areas that increase the use of existing facilities and promote infill development. g) Addition or expansion of existing facilities for new development in currently unserved areas. Expansions of facilities to unserved areas shall be based on projected growth patterns found in the Future Land Use Element. Policy 1.2.5 The Town shall adopt by reference the School District s Five-Year Capital Improvement Schedule, which is intended to maintain a financially feasible capital improvements program and to ensure that level of service standards will be achieved and maintained each year of the five year planning period. The Town shall have no obligation or responsibility for funding the School District s Capital Facilities Plan. Public School Concurrency Objective 1.6 The Town shall coordinate with the Palm Beach County School District concerning all land development decisions which include residential development in order to maintain a minimum level of service standards for public schools consistent with the Interlocal Agreement on School Concurrency and Public School Facilities Element Policies 1.1.1 and 1.1.3.

Policy 1.6.1 The School District of Palm Beach County shall maintain minimal level of service standards for public school facilities, as defined in the Public School Facilities Element. In the case of public school facilities, the issuance of development orders shall be based upon the School District of Palm Beach County s ability to maintain the minimum level of service standards. Policy 1.6.2 The level of service standards for all public schools within the Town of Jupiter shall be those described in Public Schools Facilities Element Policies 1.1.1 and 1.1.3. Policy 1.6.3 Applications for development orders which include any residential component shall provide a determination of capacity by the School District of Palm Beach County that the proposed development will meet the public school facilities level of service. A determination by the School District is not required for existing single family legal lots of record, in accordance with the Public School Facilities Element Policy 1.1.8. Policy 1.6.4 In determining that the necessary facilities and services shall be in place when the impacts of development occur, the procedures maintained in Capital Improvements Policy 1.4.1 shall continue to consider the facilities and services to be in place when: a) The construction of public school facilities or provision of services is the subject of a binding and guaranteed contract with the School District of Palm Beach County that is executed and guaranteed for the time the Development Order is issued; b) The phasing and construction of the improvements are made binding conditions of the approval of the development order; c) The necessary facilities or services are under construction and bonded at the time that the Development Order is issued; or d) Construction appropriations are specified within the first three years of the most recent approved School District of Palm Beach County Six Year Capital Improvement Schedule, as reflected in Table 11 of this element, which shall reflect the addition of Florida Inventory of School Houses (FISH) capacity for each school as shown in Appendix A (Concurrency Service Area Table) of the Public School Facilities Element Support Data and Analysis. Policy 1.6.5 In accordance with Objective 1.6, Policy 1.5.3, and upholding the exceptions detailed therein, prior to issuance of a Development Order by the Town of Jupiter, the School District of Palm Beach County shall determine that the level of service for public school facilities can be achieved and maintained. The necessary public school facilities shall be considered to be in place when sufficient capacity exists in the Concurrency Service Area (CSA) in which the proposed development is located, or an immediately adjacent CSA. PUBLIC SCHOOL FACILITIES ELEMENT Goal 1: Public School Concurrency. It is a GOAL of the Town of Jupiter to provide for future availability of public school facilities consistent with the adopted level of service standard. This goal shall be accomplished recognizing the constitutional obligation of the school district to provide a uniform system of free public schools on a countywide basis. Level Of Service Objective 1.1. To ensure that the capacity of schools is sufficient to support student growth at the adopted level of service standard for each year of the five-year planning period and through the long term planning period. Policy 1.1.1 The LOS standard is the school s utilization which is defined as the enrollment as a percentage of school student capacity based upon the Florida Inventory of School Houses (FISH). The level of service (LOS) standard shall be established for all schools of each type within the School District as 110 percent utilization, measured as the average for all schools of each type within each Concurrency Service Area. No individual school shall be allowed to operate in excess of 110% utilization, unless the school is the subject of a School Capacity Study (SCS) undertaken by the School District, working with the Technical Advisory Group (TAG) which determines that the school can operate in excess of 110% utilization. The SCS shall be required if a school in the first student count of the second semester reaches 108 % or higher capacity. As a result of an SCS, an individual school may operate at up to 120% utilization. Policy 1.1.2 If, as a result of a School Capacity Study (SCS), a determination is made that a school will exceed 120% utilization or cannot operate in excess of 110% utilization, then the School District shall correct the failure of that school to be operating within the adopted LOS through 1) program adjustments 2) attendance boundary adjustments or 3) modifications to the Capital Facilities Program to add additional capacity. If, as a result of the SCS a determination is made that the school will exceed 110% and can operate within adopted guidelines, the identified school may operate at up to 120% utilization. If as a result of one or more School Capacity Studies that demonstrate that the schools of a particular type can operate at a higher standard than the 110% utilization standard of the CSA, the Comprehensive Plan will be amended to reflect the new LOS for that school type in that CSA. Policy 1.1.3 The School Capacity Study (SCS) shall determine if the growth rate within an area, causing the enrollment to exceed 110 percent of capacity, is temporary or reflects an ongoing trend affecting the LOS for the 5 year planning period. The study shall include data which shows the extent of the exceedance attributable to both existing and new development. Notification shall be provided to the local government within whose jurisdiction the study takes place. At a minimum, the study shall consider: A. Demographics in the school s Concurrency Service Area (CSA); B. Student population trends; C. Real estate trends (e.g. development and redevelopment); D. Teacher/student ratios; and E. Core facility capacity; Policy 1.1.4 The adopted LOS standard shall become applicable to the entire County at the beginning of the 2004-05 school year, by which time the School District has achieved the countywide adopted level of service for all schools of each school type. In the interim, Table 1.1-1 establishes the tiered level of service standards for each CSA by school type. Individual schools of each type may exceed the Tiered LOS standards during the period in which Tiered LOS are in effect. Each individual school exceeding the Tiered LOS during that time shall not be allowed to exceed the utilization standards for that school type as shown in the Maximum Utilization Table of this element (Table 1.1-2). Policy 1.1.5 Concurrency Service Areas (CSA) shall be established on a less than district-wide basis, as depicted 1

on Map PS 1.1 and described in the Concurrency Service Area Boundary Descriptions in the Implementation Section of this element. A. The criteria for Concurrency Service Areas shall be:01 Palm Beach County is divided into twenty-one CSAs. Each CSA boundary shall be delineated considering the following criteria and shall be consistent with provisions in the Interlocal Agreement: 1. School locations, student transporting times, and future land uses in the area. 2. Section lines, major traffic-ways, natural barriers and county boundaries. B. Each CSA shall demonstrate that: 1. Adopted level of service standards will be achieved and maintained for each year of the five-year planning period; and 2. Utilization of school capacity is maximized to the greatest extent possible, taking into account transportation costs, court approved desegregation plans and other relevant factors. C. Consistent with s.163.3180(13)(c)2.,f.s., changes to the CSA boundaries shall be made only by amendment to the PSFE and shall be exempt from the limitation on the frequency of plan amendments, Any proposed change to CSA boundaries shall require a demonstration by the School District that the requirements of b. (1.) and (2.), above, are met. Policy 1.1.6 The Town of Jupiter shall consider as committed and existing the public school capacity which is projected to be in place or under construction in the first three years of the School District s most recently adopted Five Year Plan, as reflected in Table 11 (Six Year Capital Improvement Schedule) of the Capital Improvement Element of the Town of Jupiter s Comprehensive Plan), when analyzing the availability of school capacity and making level of service compliance determinations. Policy 1.1.7 The Town of Jupiter shall amend Table 11 (Six Year Capital Improvement Schedule) of the Capital Improvement Element when committed facility capacity is eliminated, deferred or delayed, to ensure consistency with the School District Five Year Plan. Policy 1.1.8 For purposes of urban infill and in recognition of the entitlement density provisions of the Town of Jupiter s Future Land Use Element, the impact of a home on an existing single family lot of record shall not be subject to school concurrency. Policy 1.1.9 The Town of Jupiter shall suspend or terminate its application of School concurrency upon the occurrence and for the duration of the following conditions: A. School concurrency shall be suspended in all CSAs upon the occurrence and for the duration of the following conditions: The occurrence of an Act of God ; or The School Board does not adopt an update to its Capital Facilities Plan by September15th of each year; or The School District s adopted update to its Capital Facilities Program Plan does not add enough FISH capacity to meet projected growth in demand for permanent student stations at the adopted level of service standard for each CSA and ensures that no school of any type exceeds the maximum utilization standard in any CSA; or The School District Capital Facilities Plan is determined to be financially infeasible as determined by the State Department of Education, or as defined by the issuance of a Notice of Intent to Find an Amendment to a Capital Improvement Element not in compliance as not being financially feasible, by the Department of Community Affairs; or by a court action or final administrative action; or If concurrency is suspended in one-third or more of the CSAs pursuant to Policy 1.1.9.d. below. B. School Concurrency shall be suspended within a particular CSA upon the occurrence and for the duration for the following conditions: Where an individual school in a particular CSA is twelve or more months behind the schedule set forth in the School District Capital Facilities Plan, concurrency will be suspended within that CSA and the adjacent CSAs for that type of school; or The School District does not maximize utilization of school capacity by allowing a particular CSA or an 2

individual school to exceed the adopted Level of Service (LOS) standard; or Where the School Board materially amends the first 3 years of the Capital Facilities Plan and that amendment causes the Level of Service to be exceeded for that type of school within a CSA, concurrency will be suspended within that CSA and the adjacent CSAs only for that type of school. C. The County shall maintain records identifying all Concurrency Service Areas in which the School District has notified the County that the application of concurrency has been suspended. D. Once suspended, for any of the above reasons, concurrency shall be reinstated once the Technical Advisory Group (TAG) determines the condition that caused the suspension has been remedied or the Level of Service for that year for the affected CSAs have been achieved. E. If a Program Evaluation Report recommends that concurrency be suspended because the program is not working as planned, concurrency may be suspended upon the concurrence of 33% of the PARTIES signatories of the Palm Beach County Interlocal Agreement with Municipalities of Palm Beach County and the School District of Palm Beach County to establish Public School Concurrency. F. Upon termination of the Interlocal Agreement the County shall initiate a Comprehensive Plan Amendment to terminate school concurrency. Facilities Requirements Objective 1.2. To provide for mitigation alternatives which are financially feasible and will achieve and maintain the adopted level of service standard in each year of the five-year planning period. Policy 1.2.1 Mitigation shall be allowed for those development proposals that cannot meet adopted level of service standard. Mitigation options shall include options listed below for which the School District assumes the operational responsibility and which will maintain the adopted level of service standards for each year of the fiveyear planning period. A. Donation of buildings for use as a primary or alternative learning facility; and/or B. Renovation of existing buildings for use as public school facilities; or C. Construction of permanent student stations or core capacity. The site plan for buildings being renovated pursuant to number 2 above, that are fifty years of age or older, shall demonstrate that there are no adverse impacts on sites listed in the National Register of Historic Places or otherwise designated in accordance with appropriate State guidelines as locally significant historic or archaeological resources. Policy 1.2.2 A development order shall be issued and mitigation measures shall not be exacted when the adopted level of service standard cannot be met in a particular concurrency service area, as applied to an application for a development order, if the needed capacity for the particular CSA is available in one or more contiguous CSAs. Six-Year Capital Improvement Schedule Objective 1.3. To ensure existing deficiencies and future needs are addressed consistent with the adopted level of service standard. Policy 1.3.1 The Town of Jupiter, in coordination with the School District and other local governments, shall annually amend Table 11 of the Capital Improvement Element (School District of Palm Beach County Six-Year Capital Improvement Schedule), to maintain consistency with the School Board s adopted Five Year Plan, and to maintain a financially feasible capital improvements program and ensure that level of service standards will continue to be achieved and maintained in each year of the five year planning period. Goal 2: School Facility Siting And Development Coordination It is the GOAL of Town of Jupiter to maintain and enhance joint planning processes and procedures for coordination of public education facilities for planning and decision-making regarding population projections, public school siting, and the development of public education facilities concurrent with residential development and other service. 3

School Facility Siting Objective 2.1. To establish a process of coordination and collaboration between the County, local governments, and the School District in the planning and siting of public school facilities in coordination with planned infrastructure and public facilities. Policy 2.1.1 The Town of Jupiter shall coordinate and provide for expedited review of development proposals with the School District during the development review process to ensure integration of public school facilities with surrounding land uses and the compatibility of uses with schools. Policy 2.1.2 The proposed site shall be suitable or adaptable for development in accordance with applicable water management standards, and shall not be in conflict with the adopted or officially accepted plans of the South Florida Water Management District, or any applicable Stormwater Utility or Drainage District. Policy 2.1.3 The proposed location shall comply with the provisions of the Coastal Zone Management Element of the comprehensive plan, if applicable to the site. Policy 2.1.4 The Town of Jupiter shall encourage the location of schools proximate to urban residential areas by: A. Assisting the School District in identifying funding and/or construction opportunities (including developer participation or Town of Jupiter capital budget expenditures) for sidewalks, traffic signalization, access, water, sewer, drainage and other infrastructure improvements; B. Providing for the review for all school sites as indicated in Policy 2.1.1 above; and, C. Allowing schools as a permitted use within all urban residential land use categories. Policy 2.1.5 The Town of Jupiter shall coordinate with the School District for the collocation of public facilities, such as parks, libraries, and community centers with schools, to the extent possible, as sites for these public facilities and schools are chosen and development plans prepared. Intergovernmental Coordination Objective 2.2. To establish and maintain a cooperative relationship with the School District and municipalities in coordinating land use planning with development of public school facilities which are proximate to existing or proposed residential areas they will serve and which serve as community focal points. Policy 2.2.1 The Town of Jupiter shall abide by the Palm Beach County Interlocal Agreement with Municipalities of Palm Beach County and the School District of Palm Beach County to establish Public School Concurrency, which was fully executed by the parties involved and recorded with the Clerk of the Circuit Court of Palm Beach County on January 25, 2001, consistent with ss.163.3177(6)(h)1.and 2. F.S. and 163.3180 F.S. Policy 2.2.2 The Technical Advisory Group (TAG) shall be established by the County, participating local governments, and the School District. The five member TAG will be comprised of a Certified Public Accountant, a General Contractor, a Demographer, a Business Person, and a Planner, nominated by their respective associations as indicated in the Interlocal Agreement to establish Public School Concurrency mentioned in Policy 2.2.1 above. The Technical Advisory Group shall review and make recommendations including but not limited to the following: A. The Capital Facilities Plan; B. The Ten and Twenty Year work programs; C. Schools that trigger a School Capacity Study; D. Concurrency Service Areas boundaries; E. School District Management Reports; and F. Operation and effectiveness of the Concurrency Program; G. Program Evaluation Reports. 4

Policy 2.2.3 The Town of Jupiter shall provide the School District with annual information needed to maintain school concurrency, including information required for the School District to establish: A. School siting criteria; B. Level of service update and maintenance; C. Joint approval of the public school capital facilities program; D. Concurrency service area criteria and standards; and E. School utilization. Policy 2.2.4 The Town of Jupiter shall provide the School District with its Comprehensive Plan, along with the five-year Land Use and population projections, to facilitate development of school enrollment projections and shall annually update this information. The Town of Jupiter shall coordinate its Comprehensive Plan and the Future Land Use Map with the School District s long range facilities maps (Maps PS 3.3 and PS 3.4), to ensure consistency and compatibility with the provisions of this Element. Policy 2.2.5 The Town of Jupiter shall advise the School District of a proposed public school site s consistency with the Town of Jupiter s Comprehensive Plan and land development regulations, including the availability of necessary public infrastructure to support the development of the site. Policy 2.2.6 The Town of Jupiter shall provide opportunity for the School District to comment on comprehensive plan amendments, rezonings, and other land-use decisions which may be projected to impact on the public schools facilities plan. Policy 2.2.7 The Town of Jupiter shall coordinate with local governments and the School District on emergency preparedness issues which may include consideration of: A. Design and/or retrofit of public schools as emergency shelters; B. Enhancing public awareness of evacuation zones, shelter locations, and evacuation routes; C. Designation of sites other than public schools as long term shelters, to allow schools to resume normal operations following emergency events. Population Projections Objective 2.3. To establish a joint process of coordination and collaboration between the Town of Jupiter, Palm Beach County and the School District in the planning and decision making on population projections. Policy 2.3.1 The Town of Jupiter shall provide updated land use maps to the County for the conversion of the BEBR projections into both existing and new residential units and disaggregate these units throughout incorporated and unincorporated Palm Beach County into each CSA, using BEBR s annual estimates by municipality, personsper-household figures, historic growth rates and development potential. These projections are shown in Exhibit E of the Interlocal Agreement as Projected Units Table which shall be amended annually and provided to the School District. Policy 2.3.2 The Town of Jupiter commits to working with the School District and Palm Beach County to improve this methodology and enhance coordination with the plans of the School District and local governments. Population and student enrollment projections shall be revised annually to ensure that new residential development and redevelopment information provided by the municipalities and the County as well as changing demographic conditions are reflected in the updated projections. The revised projections and the variables utilized in making the projections shall be reviewed by all signatories through the Intergovernmental Plan Amendment Review Committee (IPARC). Projections shall be especially revisited and refined with the results of the 2000 Census. The responsibilities of local governments and the School District on population projections are described in Section VIII-B of the Interlocal Agreement. 5

ANCILLARY PLANT - Facilities to support the educational program, such as warehouses, vehicle maintenance, garages, and administrative buildings. 9

CORE FACILITY - Those facilities which include the media center, cafeteria, toilet facilities, and circulation space of an educational plant. DISTRICT SCHOOLS - All District owned regular, elementary, middle, high schools, magnet and special educational facilities. EDUCATIONAL PLANT SURVEY - A study of present educational and ancillary plants and the determination of future needs to provide an appropriate educational program and services for each student. FLORIDA INVENTORY OF SCHOOL HOUSES (FISH) - The report of permanent school capacity. The FISH capacity is the number of students that may be housed in a facility (school) at any given time based on using a percentage of the number of existing satisfactory student stations and a designated size for each program according to s. 235.15, Florida Statutes. In Palm Beach County, permanent capacity does not include the use of relocatable classrooms (portables). PUBLIC SCHOOL CONCURRENCY SERVICE AREA OR CONCURRENCY SERVICE AREA (CSA) - The specific geographic area adopted by local governments, within a school district, in which school concurrency is applied and determined when concurrency is applied on a less than district-wide basis.
