Office of Physical Plant Ed Poprik, Director VI-B To: From: RE: Board of School Directors Ed Poprik Park Forest Middle Crosswalk Date: July 9, 2018 At the Park Forest Middle School, a crosswalk on Valley Vista Drive is periodically used by students to access the athletic fields and tennis courts on the tract of land across that road. The crosswalk had been equipped with flashing lights that were activated by pedestrians through the use of a button. The system is very old and is currently non-functional. At the time of the system failing, the district became aware of a State grant program that was a potential source of funds for a new system. The program was not open to school districts; however, municipalities could make applications. The district partnered with Patton Township to submit an application, which was successful. The grant of $108,964.47 is planned for the following improvements: Page 1 of 2 New School Zone Flashers with cabinet and time clock placed at the appropriate distance given the prevailing speed limit on Valley Vista Drive. Rectangular Rapid Flashing Beacon with sign and push button at the crossing for each approach. Active actuation using radar detection for pedestrians. Detectable warning surfaces at the ends of the crosswalk. New thermoplastic, high visibility, high reflectivity pavement markings for the crosswalk.
State College Area School District, PFMS crossing project July 9, 2018 As Patton Township was being used as the applicant and would be the recipient of the funds, they have proposed the following Memorandum of Understanding. The agreement sets parameters for the district to complete the project while the township would receive and disperse the grants funds to the district. The Board will be asked to approve the MOU at the July 23, 2018 meeting. Additionally, administration will seek permission to hire ELA, Group Inc. to prepare bidding documents for the project. PATTON TOWNSHIP CENTRE COUNTY, PENNSYLVANIA MEMORANDUM OF UNDERSTANDING (MOU) between PATTON TOWNSHIP And the STATE COLLEGE AREA SCHOOL DISTRICT (SCASD) for AUTOMATED RED LIGHT ENFORCEMENT (ARLE) PROGRAM PROJECT GRANT FUNDING FROM THE PENNSYLVANIA DEPARTMENT OF TRANSPORTATION WHEREAS, Patton Township ( Sponsor ) submitted a grant application to the Pennsylvania Department of Transportation ( Department ) at the request of and on the behalf of the State College Area School District ( SCASD ) for the replacement of the flashing pedestrian crossing signals on Valley Vista Drive in the vicinity of Park Forest Middle School ( Project ), and WHEREAS, Patton Township has been notified that said grant, in the amount of $108,964.47, is to be awarded to Patton Township, and WHEREAS, the Department has prepared Agreement No. 02E29 ( Agreement ), to be executed by Patton Township and Department, for the reimbursement of eligible expenses for the Project, and WHEREAS, many elements of the Agreement involve expenditures or actions required for the Project that will be the responsibility of SCASD, and WHEREAS, Patton Township and the State College Area School District both desire to complete the project utilizing the available grant funds, now THEREFORE the parties agree to the following: 1.0 PATTON TOWNSHIP RESPONSIBILITIES: 1.1 Patton Township shall execute the Agreement with the Department following execution of this MOU by both parties. The Agreement is attached to this MOU as Exhibit A. 1.2 Patton Township shall provide a point of contact who shall cooperate and coordinate as needed with the Department and SCASD to complete the project within the scope of the Agreement. 1.3 Patton Township shall make periodic submissions to the Department for reimbursement of eligible expenses; and shall disburse to SCASD any reimbursements received for approved eligible expenses. See Section 9 of the Agreement.
MOU for ARLE Grant Page 2 V1.0 dje 6/27 1.3 The contact person for the township will be the title. 2.0 SCASD RESPONSIBILITIES: 2.1 SCASD shall provide a point of contact who shall cooperate and coordinate as needed with the Department and Sponsor to complete the project within the scope of the Agreement. 2.2 SCASD shall fulfill the duties and responsibilities of the Sponsor as enumerated in the following sections of the Agreement: 2.2.1 Section 2, GENERAL PROVISIONS, subsections (a) through (d) 2.2.2 Section 3, DESIGN, subsections (a) through (b) 2.2.3 Section 4, UTILTIY, RIGHT-OF-WAY AND PUC MATTERS 2.2.4 Section 6, CONTRACT DEVELOPMENT, subsections (a) through (e) 2.2.5 Section 7, LETTING AND AWARD, subsections (a) through (c) 2.2.6 Section 8, CONSTRUCTION INSPECTION, subsections (a) through (b) 2.2.7 Section 9, PAYMENT PROCEDURES AND RESPONSIBLITIES, subsections (f) through (i) 2.2.8 Section 10, RECORDS AND AUDIT REQUIREMENTS 2.2.9 Section 12, MAINTENANCE AND OPERATION OF IMPROVEMENTS, subsections A.(a) through A.(f) 2.2.10 Section 15, REQUIRED CONTRACT PROVISIONS 2.2.11 Section 16, CONTRACTRO INTEGRITY PROVISIONS 2.2.12 Section 19, PROVISIONS CONCERNING THE AMERICANS WITH DISABILITIES ACT 2.2.13 Section 20, CONTRACTOR RESPONSIBILITY PROVISIONS 2.2.14 Section 23, COMPLETION OF WORK 2.3 With reference to Section 5 of the Agreement, SCASD, by executing this MOU, certifies that it has on hand, or will obtain over the life of the Project, sufficient funds to meet all of its obligations under the terms of this Agreement. Further, the SCASD, and not the Sponsor or DEPARTMENT, shall provide all funds needed to pay any costs incurred in excess of those costs eligible for state assistance and shall bear such excess costs. The SCASD shall be solely responsible for one hundred percent (100%) of this portion of the total Project costs. The SCASD may use any combination of funds from its own budget and/or outside sources, whether public or private. 2.4 With reference to Section 9, PAYMENT PROCEDURES AND RESPONSIBLITIES, subsections (b) through (d) and (k), SCASD shall submit payment requests to Sponsor to be submitted to the Department as noted. 2.5 (reserved) 2.6 The contact person for SCASD will be the (title).
MOU for ARLE Grant Page 3 V1.0 dje 6/27 3.0 HOLD HARMLESS (reserved) 4.0 TERMINATION 4.1 If the Department terminates the Agreement per Section 18, this MOU shall be terminated and any reimbursements received from the Department for eligible work undertaken by SCASD shall be disbursed to SCASD. 4.2 If SCASD abandons or indefinitely postpones the Project, it may terminate this MOU by sending the Sponsor a thirty- (30-) day written notice of termination, with the understanding that, since the DEPARTMENT will not participate in any costs of a Project that is not completed and since the DEPARTMENT must be reimbursed for all costs incurred by it for the Project, the SCASD must reimburse the DEPARTMENT accordingly. Furthermore, the DEPARTMENT itself may consider the Project to be abandoned because of lack of activity on the Project by the SCASD or failure to pay its contractor(s) or consultant(s). In either case, the SCASD shall reimburse the DEPARTMENT, within thirty (30) days of receipt of a statement from the Sponsor, in an amount equal to the sum of (i) all state funds received by the SPONSOR for redeposit into Appropriation 244 of the Motor License Fund and (ii) all costs incurred by the DEPARTMENT under this Agreement prior to receipt of notice of termination that have not been reimbursed by the SCASD. 4.3 Sponsor may terminate the Project by sending SCASD a thirty- (30-) day written notice of termination, with the understanding that,sponsor will be responsible for all reimbursements to Department in accordance with Section 11 of the Agreement and reimbursement to SCASD for eligible expenses incurred but not yet submitted to the Department. 5.0 NOTICES.
