II. BACKGROUND Owner Background Ricardo Flores Magón Academy (RFMA) serves students in grades Kindergarten through 8th grade. This school provides services to approximately 280 students and is chartered through the Colorado Charter School Institute. RFMA Vision: Be the flagship socially conscious preparatory school for the Latinx population of Metro Denver; and to be the model of culturally relevant, academically rigorous, and inspiring arts education. RFMA Mission: The RFMA colectivo takes absolute responsibility to prepare all students for high school, college, and life- regardless of home language or background- by employing high expectations, a profound passion for teaching and learning, and an emphasis on social consciousness. Magonistas succeed not by chance, but rather through hard work, preparation, and urgency. By embracing our cultural heritage, RFMA educators work collectively to inspire our students to be champions in the classroom, on the tennis court and chess board, in college, and beyond. Project Description RFMA has received a Colorado Department of Education Building Excellent Schools Today (BEST) Cash Grant and an Adams County Open Space (ACOS) Grant to help fund the construction of a new 33,000 Square Foot PK-8 facility to replace its current facility. The new facility is to be constructed on the north portion of the existing site. The following are provided for informational purposes in regard to the project: 1. III. RFQ/P CONSTRUCTION MANAGER/GENERAL CONTRACTOR OBJECTIVE The purpose of this RFQ/P is to solicit and contract with a CM/GC (aka Construction Manager @ Risk) firm that will work with the Owner and the Owner s consultants to complete the project described in the above project description. IV. SUBMITTAL REQUIREMENTS Organize your RFQ/P responses using the following outline. Please separate each section with dividers or tabs using the appropriate section labels. Provide 1 electronic copy via USB Flash Drive + 5 Original Copies. The SOQ/Proposal shall be limited to a maximum of thirty (30) pages of information. Resumes, the Cover Sheet, Table of Contents and divider pages are not counted in the page count. A font of no less than 11 point will be allowed. No fees shall be included in the RFQ Submittal. Only contractors selected for interview will be required to provide CM/GC Fee and General Conditions proposals. SECTION 1 LETTER OF INTEREST A maximum one-page letter of interest that includes a synopsis of the firm, business principals, distinguishing characteristics, approach to completing this project, primary contact information, and signed by the principal-in-charge. Include statement of agreement to allow duly authorized agents of the Owner to any books, documents, papers, or records which are directly pertinent to the Project for the purposes of making audit examinations, excerpts, and purposes of transcriptions and to maintain all required records for three years after the Owner s final payment and all other pending matters are closed. Acknowledge receipt of addenda, if any. SECTION 2 EXPERIENCE AND QUALIFICATIONS CM/GC Please address each criterion listed below as it relates to your firm s relevant experience and qualifications. 1. Identify the individual who will be the main point of contact and the team responsible for providing services for the duration of the project. (the Owner reserves the right to determine the acceptability of these individuals) 2. Provide experience of all key personnel assigned to this project, background and responsibilities including resumes. Provide three client references for each individual. Include percentage of time each person will be working on the project. Also include the projects and types of projects the key team members have worked on together. a. The following positions on the Project Team are anticipated to be described at a minimum: Project Manager, Site Superintendent, Pre-construction Manager, and Estimator. b. Please identify what services your firm will not include that the Owner might want to consider with suggested firm/individual information and costs for those services. c. The Owner expects the team members to participate throughout the duration of the project. Any

changes in key staff must be reviewed and approved by the Owner and the Owner s consultants. 3. Provide your firm s project organization structure and responsibilities utilizing an organization chart. 4. Identify projects your firm has completed with a similar size and scope to the proposed project. Describe which members of your proposed team was involved in each (if applicable), and in what role. 5. Identify and describe any claims, lawsuits or legal settlements your firm has had in the past (5) five years or are currently pending. 6. Knowledge of LEED & CO-CHPS criteria and program requirements. a. It is intended that your firm will provide assistance to the A/E in the USGBC LEED or CO-CHPS process in pursuit of a LEED Gold or CO-CHPS certification for the project. Describe your firm s USGBC LEED and CO-CHPS project experience. Does your firm employ LEED Accredited Professionals? How specifically will your firm support the Owner and the Design team to evaluate on-going operations and maintenance cost as well as first cost and to support the LEED or CO-CHPS certification of this project? 7. Describe your experience and understanding of the local construction market. How might you take advantage of local resources when appropriate to achieve the best value for the Owner? 8. This project requires the Candidate to carry liability insurance as described in the CM/GC Agreement-Exhibit F of this RFQ/P. Demonstrate your ability to carry the required insurance. SECTION 3 SCOPE OF SERVICES The Owner s Updated Master Plan and ALTA Survey will be provided by October 26, 2018. The Owner requests proposals to include complete Construction Management/General Contracting services to provide pre-construction assistance and construction of the project described in the grant information, and further clarified by additional attached documents. The proposal is to include, but is not limited to, the following scope of services items. 1. Describe your approach to providing pre-construction services. 2. Describe your estimating methodology during the design phase, prior to the establishment of a GMP. How do you provide accurate and reliable cost data? How do you assist in the development of design options to react to market conditions? Provide a sample cost estimate prepared at schematic design and at design development. 3. Describe your firm s approach to assuring safety throughout the project on an occupied site. Include reference to safety training, resumes of individuals on the team responsible for safety, and frequency of safety inspections. 4. Describe your approach to quality control during pre-construction and construction. 5. Provide a sample of your standard Change Order Log, RFI Log, Submittal Log and punch list in the format you propose to use on this project. Change Orders will require detailed backup, including material, labor, and OH&P markups at the subcontractor and GC level. Is there an electronic system used by the contractor? If so, is this system available to the A/E and the Owner Representative? If available, is there an additional cost? 6. Show your ability/approach to organize and meet schedules.

Please provide a description of your approach to the scope requested, describing quantity and types of proposed meetings, site visits, unique methodologies, etc. Additional services or scope may be proposed and identified in the final contract, fees for these services should be identified as a line item in the fee proposal for consideration. Any exclusions from services or deliverables described must be explicitly identified in this submittal. SECTION 4 SCHEDULE Based on your current workforce and staffing, list your firm s currently contracted projects and what proposed staff is involved in these projects? Please provide your available bonding capacity. Provide an example of a detailed project schedule used on a prior project, as well as short term look-ahead schedule, and describe how they are generated, updated, and utilized throughout the project. It is expected that your firm has the current capabilities and capacity to complete the project. Provide a proposed staffing plan for the project. Provide reasoning, in this section, for any modifications or alterations your firm wishes to make to the recommended project schedule. For purposes of fee evaluation, please assume a construction duration per the schedule provided. SECTION 5 REFERENCES Utilizing the attached matrix, provide a comprehensive list of ALL school projects completed or begun within the last 5 years, with contact information, along with a project description. Identify in the reference list which projects this CM/GC team has performed collectively. The Owner reserves the right to check additional references beyond those provided in the submittal. V. SUBMITTAL REVIEW & SELECTION PROCESS The selection process consists of two phases, followed by negotiations with the apparent winner. Phase 1 RFQ Review The Owner s Selection Committee will evaluate and score the RFQ submittals based on the selection criteria listed below: Selection Criteria Max Point Possible Section 1: Letter of Interest. How complete and concise was the letter of interest and RFQ/P response? Was the RFQ/P well organized, with complete information responding to all of the submittal criteria? Page 6 of 8 5 points Section 2: Experience and Qualifications Provided a comprehensive and insightful experience and qualifications package which highlighted key personnel in addition to other items as stated. 25 points Section 3: Scope of Services. Candidate has affirmed each of the Owner s requirements for this project and demonstrated a clear understanding of Owner's needs and clear direction toward completing the scope of work. 25 points Section 4: Schedule. Ability to complete the planning tasks within the timeframe needed. Submitted a complete & understandable schedule. 20 points Section 5: References. Candidate has provided a comprehensive project list with contact information for projects completed over the last five years. 25 points Total Points 100 points Phase 2 Interview An interview invitation will be sent out to the three to five Candidates with the highest RFQ/P submittal scores on the date noted in the project schedule. The invitation will explain the interview requirements and provide the time and location. The purpose of the interview is to ensure a full understanding of the RFQ/P responses and to introduce the key members of the CM/GC team. The interviews will consist of a short presentation followed by a longer period for questions and answers.

During the short presentation, the single-point of contact throughout the duration of the project should be identified along with members of the CM/GC team. Please note team members that will not be directly working on the project are not invited to the oral interviews. The intent is to hear from the day-to-day team

members the School will be working with throughout the project. The apparent winner will be determined based on the interview score, which is separate from their RFQ/P submittal score. The interview score will include additional reference checks, and a fee proposal evaluation. VI. FEE PROPOSAL Shortlisted Candidates shall prepare a detailed fee proposal as outlined below, representing the costs of pre-construction, general conditions, and overhead and profit, based on the Hard Cost Budget provided in Section II. A Guaranteed Maximum Price (GMP) is anticipated to be established at a mutually agreed upon phase. The fee proposal is to be submitted in a sealed envelope prior to the start of the interview. Failure to provide a fee proposal which addresses each of the items listed below may result in disqualification from the RFQ/P process. Detailed fee proposals shall include the following separately, as a not to exceed dollar value. Assume a GMP of $10.9 million to $11.9 million: Preconstruction Fee General Conditions (assume this includes construction surveys, layout, printing costs for own forces, and all typical GC costs. (Do not include permitting and plan check fees). Utilize the attached Method of Payment Matrix to assist in determining general conditions costs. o Performance and Payment Bond cost o Weather allowance o Builder s Risk insurance o All other insurance Overhead & Profit lump sum amount Itemized list of any other fees or costs outside of direct subcontractor costs, CM/GC s general conditions, and Overhead and Profit The negotiated fee is anticipated to result in an initial lump sum format contract for pre-construction services, followed by a Guaranteed Maximum Price at a mutually agreed upon phase which will include a lump sum overhead and profit fee. Fee proposals will be carefully evaluated following the scoring of the interviews. If the apparent winner s fee exceeds the Owners budget, and if subsequent negotiations with the apparent winner are unsuccessful, the Owner reserves the right to negotiate with the next highest-scoring Candidate. VII. Acceptance and Rejection After the final selection has been made, the Owner will provide a summary of scores and a decision memorandum to each of the RFQ/P Candidates.

The Owner reserves the right to select any or reject any and all proposals in their best interest. The Owner also reserves the right to pre-qualify any or all Candidates or reject any or all Candidates as unqualified, including without limitation the right to reject any or all nonconforming, nonresponsive, unbalanced, or conditional, qualifications. The Owner also reserves the right to re-solicit, waive all informalities not involving price, time, or changes in the work, and to negotiate contract terms with the apparent successful proposer. The Owner is not responsible for cost incurred in preparation of this proposal. Proposals will not be returned and become the property of the Owner once submitted. By submitting a proposal all Candidates agree to the terms and conditions of this RFQ/P and the RFQ/P will become part of the awarded Candidates contract. The apparent winner will be responsible for submitting a draft agreement to be used for this project. The Owner and the Owner s legal council will review the agreement and negotiate terms prior to commencement of work. Page 8 of 8
