CALL MEETING TO ORDER CALL TO The public meeting of the Chester County Board of Commissioners was called to ORDER order at 10:02 a.m. on May 14, 2015 in the Commissioners Boardroom by Chairman of the Board of Commissioners Terence Farrell. Commissioner Kathi Cozzone and Commissioner Michelle Kichline were also present. 2. PLEDGE OF ALLEGIANCE PLEDGE OF Commissioner Farrell asked intern Justine Gluck to lead the Pledge. ALLEGIANCE 3. COUNTY OF CHESTER COMMONWEALTH OF PENNSYLVANIA RESOLUTION NO. 20-15 RESOLUTION OF THE CHESTER COUNTY COMMISSIONERS CLOSING OUT COMMUNITY CONSERVATION PARTNERSHIPS GRANT PROJECT (BRC-TAG-18-141) WHEREAS, the Brandywine Creek and its surrounding watershed covers 352 square miles, or 23 percent of Chester County including valuable natural, historical, and recreational resources which contribute significantly to the County s quality-of-life and economic viability; and WHEREAS, the County Commissioners of Chester County, in coordination with the Chester County Planning Commission, have prepared the Brandywine Creek Greenway Strategic Plan; and WHEREAS, the Plan was completed through a process which involved coordination with community stakeholders, the public, and representatives of the City of Coatesville; the Boroughs of Downingtown, Honey Brook, and Modena; and the Townships of Birmingham, Caln, East Bradford, East Brandywine, East Caln, Honey Brook, Newlin, Pocopson, Pennsbury, Upper Uwchlan, Uwchlan, Wallace, West Caln, West Bradford, West Brandywine, West Fallowfield, West Nantmeal, and Valley; and WHEREAS, the purpose of the Plan is to provide short to long term strategies to be implemented over a 20+ year timeframe beginning in 2015. The Plan includes over-arching strategies for municipalities, county agencies, non-profit groups, and other stakeholders. It also identifies recommended projects that are unique to each watershed municipality or agency. The Plan includes a Tool Kit which provides regulatory and nonregulatory tools, resource maps, and sources of funding available to implement wide-ranging initiatives; and, WHEREAS, the Plan was financed in part by a Community Conservation Partnerships Program grant under the administration of the Pennsylvania Department of Conservation and Natural Resources, Bureau of Recreation and Conservation, under contract number BRC-TAG-18-141. NOW THEREFORE BE IT RESOLVED that, the County Commissioners of Chester County, Commonwealth of Pennsylvania affirm that: A. The project was completed in accordance with the Grant Agreement. B. All project expenditures have been made and were in accordance with the Grant Agreement. C. The Plan and related materials are acceptable to the County Commissioners of Chester County. D. The Plan and related materials will be used to guide future recreation and conservation decisions. This Resolution adopted this day of June, 2015, by the Board of County Commissioners. COUNTY OF CHESTER, COMMONWEALTH OF PENNSYLVANIA RESOLUTION # 21-15 APPROVING A FINANCING BY THE CENTRAL AND WESTERN CENTRAL AND WESTERN CHESTER COUNTY INDUSTRIAL DEVELOPMENT AUTHORITY OF A PROJECT FOR DEVON HORSE SHOW AND COUNTRY FAIR FOUNDATION WHEREAS, in accordance with the requirements of the Tax Equity and Fiscal Responsibility Act of 1982, as amended, the Central and Western Chester County Industrial Development Authority (the Authority ), after publicizing notice thereof in a newspaper of general circulation, held a public hearing on May 20, 2015 regarding the application of Devon Horse Show and Country Fair Foundation (the Project Applicant ) for the financing of its capital project (as more fully described in the attached public notice announcement, the Project ); and WHEREAS, the Authority has determined that the Project conforms to the public purpose, eligibility and financial responsibility requirements of the Pennsylvania Economic Development Financing Law, and, at its May 20, 2015 meeting, approved the Project and the issuance by the Authority of its revenue bonds in the maximum amount of $2,000,000.00 (the Bonds ), the proceeds of which will be loaned by the Authority to the Project Applicant to fund a portion of the Project; and WHEREAS, Section 147(f) of the Internal Revenue Code of 1986, as amended, 26 U.S.C. 147(f) (the Code ), requires that the applicable elected representatives of the governmental unit on behalf of which bonds are issued and of a governmental unit having jurisdiction over the area in which any financed facility is located approve private activity bonds after a public hearing in order for such bond to be a bond qualifying for tax-exemption under the Code; and WHEREAS, the Board of County Commissioners constitutes the appropriate elected representative for the purposes of giving approval under Section 147(f) of the Code; and WHEREAS, pursuant to Section 147(f), the Project Applicant and the Authority have requested the Board of County Commissioners to approve the issuance of the Bonds for the purposes of Section 147(f) of the Code. NOW, THEREFORE, IT IS HEREBY RESOLVED by the Board of Commissioners of Chester County, Commonwealth of Pennsylvania, as follows: SECTION 1. The Project, as defined in the preambles hereto, and the issuance of the Bonds by the Authority are hereby approved, it being understood that such approval shall not, directly or indirectly, obligate the taxing power of Chester County or otherwise obligate Chester County in any way whatsoever.

SECTION 2. The foregoing determination, declaration and approval are for the purposes of the applicable provisions of the Code and do not constitute approval for any permit, license or zoning required for the construction or occupancy of any facilities to be financed or refinanced as part of the Project. SECTION 3. All actions of this Board of Commissioners of Chester County taken in conformity with the intents and purposes of these Resolutions are ratified, confirmed and approved in all respects. SECTION 4. This Resolutions shall take effect immediately. All prior Resolutions or portions thereof inconsistent herewith are hereby repealed. RESOLVED AND ADOPTED this 11th day of June, 2015 at a regular meeting of the Board of Commissioners of Chester County, Pennsylvania.
