CITY OF NORTH LAUDERDALE COMMUNITY DEVELOPMENT DEPARTMENT TO: THROUGH: BY: Mayor and City Commission Ambreen Bhatty, City Manager Tammy Reed-Holguin, Community Development Director DATE: April 8, 2014 SUBJECT: SEU 14-01 Elite Nursing Academy 1291-1293 S State Road 7 (Cypress Lake Plaza) Special Exception Use permit to operate a post secondary education facility in a General Business District (B-3) in accordance with Section 106-468. APPLICANT: Coretta Waters The applicant, Coretta Waters, on behalf of the Elite Nursing Academy is requesting a Special Exception Use permit to operate a post secondary institution in the Cypress Lake Plaza located at 1291-93 S. State Road 7. This request is made in accordance with Section 106-468 of the City Code of Ordinances to allow for educational institutions by requiring the applicant to obtain a special exception use permit to operate this kind of facility. Elite Nursing Academy is a for profit business. They are proposing to locate within the City s 441/SR7 Mixed Use Redevelopment Overlay District. The site was previously occupied by Allied Health Care, who was issued a Special Exception Use permit in 2009 to operate a training facility for home health care professionals. Elite Nursing Academy is proposing a similar use and the floor plan remains the same as the previous occupant s. Staff has reviewed the proposed request in light of the guidelines and criteria contained in Section 106-468 and Article IV Special Exception Uses of the City Code, and determined that the application meets the criteria for allowing a post secondary educational institute. Economic Analysis The proposed business will provide an increase in revenue to the plaza as well as the City, since the business is for profit and will be required to obtain and pay for a local business tax receipt. Furthermore, the applicant will have a full staff on hand to address all the needs and concerns of their students, thereby increasing employment from the minimum number of jobs provided by the previous business operator. The institution would operate from 8:00 AM until 10:00 PM Monday through Saturday and will accommodate about 40 students.
Traffic/ Parking Analysis It is anticipated that the plaza will be able to accommodate any effect on access, traffic generation, road capacities and parking needs caused by the use for which the special exception use permit is being requested. A similar business has operated in this space since 2010 and no negative impacts have been observed or reported. Should any occur the applicant will be required to provide for the mitigation of any additional impact upon the capacity of utilities, or public services, and to conform to the goals, objectives, policies and land uses established by the City s Code of Ordinances as a condition of approval. The Planning and Zoning Board met on April 1 st, 2014 and after a staff presentation, a public hearing and review by the Board adopted a motion to recommend approval of the proposed Special Exception Use Permit subject to all the conditions of the City Commission. RECOMMENDATION: The City Administration recommends consideration and approval by the City Commission of the proposed SEU permit subject to the following conditions: 1. That all terms, conditions, and provisions imposed herein, including all life, health, and safety Codes pertaining to this facility are met prior to commencing and during operation. 2. In the event that any problems arise as a result of the operation of this establishment, such as noise, parking, traffic and/or other nuisances, the applicant shall make all improvements required to mitigate these nuisances so as not to negatively impact adjacent commercial/residential areas. 3. Applicant shall obtain proper approval such as a Local Business Tax Receipt from the City and any outside agencies such as the County Health Department. 4. That all applicable City and Florida Building Codes regarding such an operation shall be met.
