TITLE Award of RFP 03662 and approval of maximum expenditure for CloudBook student use laptops For Introduction: July 6, 2016 For Action: August 24, 2016 II. WHY BOARD ACTION IS NECESSARY Board action is required because the total amount of the purchase over the term of the awarded Request for Proposal (RFP) 03662 exceeds $250,000. Per Policy No. 6220, Procurement, any contract over $250,000 must be brought to the Board for approval. The purchase of CloudBook laptops under RFP 03662 will exceed $250,000. III. FISCAL IMPACT/REVENUE SOURCE Fiscal impact to this action will be a Not-To-Exceed (NTE) amount of $6 million total (before applicable sales tax) by the Department of Technology Services (DoTS) over the up to five-year term of the RFP. The RFP 03662 has an initial term of 3 years with the option to extend the RFP to a 4 th and 5 th year. The CloudBook laptops for the NTE expenditures will be purchased by DoTS using levy funds available during the contract term that are allocated for school computers. Additional purchases may be made by individual schools utilizing their own allocated funds or funds they obtain from other means such as fundraisers or Parent Teacher Student Association (PTSA) organizations, but no individual purchase by a school is expected to exceed the Board approval limit. A longer term RFP allows the District to obtain the best pricing and allows for consistent pricing regardless of individual order sizes. The revenue source for this motion is BTA IV and BEX IV levy funds allocated for school use computers and classroom technology. Expenditure: One-time Annual Other Source IV. POLICY IMPLICATION Per Policy No. 6220, Procurement, any contract over $250,000 must be brought to the Board for approval. This is a NTE amount of $6 million total by DoTS over the up to five-year term of the RFP.

V. RECOMMENDED MOTION I move that the School Board authorize the Superintendent to execute the Award of RFP 03662 with Thornburg Computer Servers, LLC for Dell CloudBook student use laptops for a not to exceed amount of $6 million from DoTS levy funds allocated for school computers, not including applicable sales tax, during the up to five-year term of the RFP, with any minor additions, deletions, and modifications deemed necessary by the Superintendent, and to take any necessary actions to implement the contracts. VI. BOARD COMMITTEE RECOMMENDATION This item was discussed at the Operations Committee meeting on June 16, 2016. The Committee reviewed the item and moved this item to the full Board for consideration. VII. BACKGROUND INFORMATION As more student resources and student technology use continues to shift toward web based and online resources, the processing power of computers needed to do this work has decreased to the point that most of what a student does no longer requires a high end computer. Lower cost devices, such as ChromeBooks, have become increasingly popular in the K12 environment as a result. In addition, schools have been asking for a lower cost laptop device to allow them to help stretch their available funds. Since the District did not have a supported device at that price point, this led to schools purchasing unsupported devices which has security and support implications. Therefore, DoTS is currently conducting competitive RFP 03662 for a low cost Windows laptop that is commonly called a CloudBook. It is a Windows laptop designed primarily for internet access, web based usage, and Microsoft Office. The CloudBook laptop will be added to the supported devices list published by DoTS. By focusing on these common but less intensive tasks, a lower price point can be reached. A CloudBook does not fit all usage cases, but it does meet a very large majority of student needs. It can also be used for Smarter Balanced Assessment Consortium (SBAC) testing. A Windows CloudBook class of device was selected over a ChromeBook class of device due to security and Family Educational Rights and Privacy Act (FERPA) concerns with the use of Google Apps, the limited computer management ability of ChromeBooks, and the additional flexibility of being able to install small programs on the CloudBook if needed. It is anticipated that DoTS will purchase CloudBook laptops where the usage case aligns to refresh school computers or for additional school computers utilizing DoTS levy funds allocated for this purpose. By using this class of device the District can also obtain more computers for student use within the levy budget. The NTE dollar amount being recommended for approval by the School Board applies to these levy funds. Since schools have been asking for a laptop device in this price range, it is anticipated that schools will also use their campus specific funds, funds raised through PTSA, or other means to

purchase this class of device. No individual school funded purchase is expected to exceed the limit to require Board approval. By doing a longer term RFP, this allows the District to obtain the best pricing and allows for consistent pricing regardless of individual order sizes. The RFP contract is written such that it takes into account future new models of the awarded laptop to provide incremental increases in models at the same or lower price throughout the term of the RFP. After an evaluation process that included Technology staff, teachers, and students, the proposal of the Dell CloudBook by Thornburg Computer Services, LLC was determined to provide the best value for the District. The total cost of ownership for the Dell laptop is lower due to a number of factors that will save time, decrease issues, and decrease maintenance costs. VIII. STATEMENT OF ISSUE Funds available to DoTS and campuses are limited while the needs and expectations of 21 st century students continue to increase. By matching the right device with the right usage case, the District is able to responsibly provide more technology devices to meet student educational needs. A CloudBook laptop provides the tool to meet a large usage case at a more economical price previously not available to schools. IX. ALTERNATIVES 1) Do not approve this item. This is not recommended because laptops would be purchased at a higher price point that will meet the need, but be overkill for the specific usage scenarios discussed. This leads to a lower number of devices that can be purchased within the available funds. X. RESEARCH AND DATA SOURCES / BENCHMARKS In addition to leveraging expertise within DoTS to evaluate devices, DoTS has conducted a hands-on review with instructors and students to determine the best device from the RFP to meet the needs of students. Request for Proposal No. RFP03662 Low Cost Windows Laptops (CloudBooks) I. Introduction Seattle Public Schools (the District) is requesting proposals from vendors interested in providing low cost Windows laptops (Cloudbooks) to be used for student use in the classroom and other situations. The District intends to select a single laptop under this procurement as the preferred CloudBook for students during the terms of the awarded RFP. The selection of the CloudBook will proceed in the following manner: The District will receive proposals no later than April 29, 2016 at 10:00 a.m. (PDT). The proposals will be followed by a determination of shortlisted Cloudbook laptop devices, whereby a vendor(s) will be asked to provide demo laptops for the District for further review. The District reserves the right to reject any vendor who is unable to comply with the District s request for a demo Cloudbook at the date and time determined by the District. The District reserves the right to seek clarifications about the proposals. The District may award a contract based solely on the written proposals. However, the District may elect to engage in negotiations with selected vendors, in order to improve the proposals and obtain the best contract(s) for the District. The District reserves the right to request post-proposal modifications, including best and final offers and considerations. The final selection will be based upon the criteria set forth below. The District reserves the right to negotiate with the successful vendor on pricing and scheduling. The District will select the successful vendor based on the best interests of the District, all factors considered. Background The Seattle School District has approximately 53,000 students and almost 100 school sites. These Cloudbooks may be purchased for students in grades 3 through 12. Schools and PTA organizations often have funds available to purchase computing devices and desire to get as many units as they can with their limited funds. In addition, the rapid growth in web based resources now makes the use of a primarily web station type device more practical to meet many needs. It is expected that Cloudbook laptops satisfy a usage case need for District purchased laptops as well. The District is looking for a longer term partner to provide this product for an extended period of time. III. Project Information The vendor with the selected CloudBook laptop device will be awarded a three (3) year agreement with the District with two (2) optional, one year extensions based on the long-range needs of the District and mutual consent of both parties, for a not to exceed total of five (5) years. The District recognizes that with technology constantly changing and improving, the selected Cloudbook laptop may evolve and improve over the course of this agreement. Replacement/new models offered during the term of this contract shall follow the same general specifications noted in this RFP and should only contain incremental improvements that will be offered to the District at the same or lower price. Large changes in specifications either by the District or as a standard of the new replacement model may result in a price change, but must maintain the same or greater discount percentage. The awarded Cloudbook laptop device will be added to the list of supported and allowed devices for school, PTA, and District purchases. Since these Cloudbooks may be purchased at the discretion of schools and/or their PTA groups, it is difficult to estimate the annual volume of purchases made under this contract in the coming years. The District reserves the right to procure fewer or more Cloudbook laptop devices during the term of this agreement. Page 5 of 11

All costs incurred by vendors choosing to participate in this RFP process shall be borne by the proposing vendors. The procurement of these services will proceed as described below. 1. An initial screening of the proposals will be conducted based on the criteria set forth below. Proposals that do not meet the criteria or Cloudbooks that do not meet the minimum required specifications will not be considered further. 2. A short list of Cloudbook laptop devices will be determined and two (2) demo laptops will be requested from the proposing vendor for further review by the Selection Team and teachers and staff from selected schools. 3. The District reserves the right to select a single vendor for award of a contract based solely on the written proposals, and not to enter into any further discussions or negotiations. 4. The District reserves the option to meet with two or more Vendors and conduct negotiations based on the proposals in order to select the best proposal(s), all factors considered. As part of such negotiations, the District may require key personnel to be assigned to the contract to be present, and to discuss the vendor s approach to management of the project based on their understanding of the contract for policy process and procedure definitions. EVALUATION CRITERIA All proposals received will be reviewed by the Selection Panel to determine if the devices meet the minimum requirements and specifications. Proposed devices must meet the minimum requirements to be considered for further evaluation. Each evaluation criterion has been assigned a maximum number of possible points based on its relative value to the contract as a whole. All costs incurred in the preparation of the Request for Proposal process shall be borne by the proposing vendor. Proposals submitted in response to this Request for Proposal shall become the property of the District and be considered public documents under applicable Washington State laws. The District reserves the right to modify the scope of services as a result of the written submittals and/or interviews. E. Procedures Requirements Any vendor failing to submit information in accordance with the procedures set forth herein may be considered non-responsive. V. Submittal Requirements A. The submittal requirements shall be as follows:

Request for Proposal No. RFP03662 Low Cost Windows Laptops (CloudBooks) The proposing vendor, joint venture or other form of association ( firm ) shall submit three (3) hard copies and two (2) electronic copies (via CD or USB flash) of their proposal for the project. Each hard copy shall be provided in a white 3-ring, loose leaf binder with the vendor name and the Request for Proposal name and number on both the cover and spine. The Proposal document shall be limited to a maximum of twenty (20) pages (8 ½ x 11 ), single sided, not smaller than 12 point type. The following submittal items are excluded from the page limit: o o o o o o Cover letter; Proposal certification form; Table of contents; Section tabs; District provided forms; and Supporting attachments to the Technical Features form. Project cut sheets, including photos, are included in the page limits. Submittals exceeding the page limits may be considered non-responsive. B. Contents of Proposal 1. Signed Proposal Certification Form (page 3 of this RFP - does not count towards the page limit.) 2. Table of Contents (maximum 1 page). 3. Separate section with a tab: Executive Summary. Provide a summary highlighting the vendor s qualifications and expertise to provide the services requested in the Request for Proposal. 4. Separate section with a tab: Company Profile. Identification of vendor (or vendors, if a joint venture or association) including address, telephone number, and date vendor(s) were established. Areas of specialization. Provide total size and breakdown of personnel by category. 5. Separate section with a tab: Experience. Provide examples of past experience of your ability to quickly deploy high volumes of devices within a short time frame. Provide examples of past experience of your ability to provide asset tags using customer s specific specifications. 6. Separate section with a tab: References. Page 8 of 11

Insert your completed Attachment A, Technical Features Form along with your corresponding attachments referenced in your form. Provide detailed device specifications to show that your proposed device(s) meets our system specifications. 8. Separate section with a tab: Availability and Capacity. Please provide your typical standard delivery timeframe and process for various quantity levels. 9. Separate section with a tab: Pricing. Insert your completed Attachment B, Pricing Form. 10. Separate section with a tab: Terms and Conditions. Include any comments or proposed changes to the District s standard form of contract. VI. Contract and Contracting Provisions A. Standard Form of Contract Page 9 of 11 The District s standard form of contract is included as Attachment 3. The proposal should include any comments or requested changes. Please note: the District reserves the right to reject any firm that is not willing to accept the District s terms and conditions as noted in the standard form of contract. B. Contract Period The contract term shall be in effect for three (3) years from the effective date. Subject to satisfactory annual evaluation of the Vendor by the District, this contract may, with mutual agreement of both parties, be extended up to two (2) additional, one-year terms under the same terms and conditions. The District reserves the right to terminate the contract with thirty (30) days written notice. C. Protest Procedures 1. Any actual or prospective Vendor who is aggrieved in connection with the solicitation or award of this contract may protest to the District in accordance with the procedures

Protests based on the terms in this Request for Proposal, which are apparent prior to the date established for submitting the proposal must be received seven (7) days prior to the submittal deadline. Protests based on other events must be received within three (3) working days after the aggrieved person knows, or should have known, of the facts and circumstances upon which the protest is based; provided, however, that in no event shall a protest be considered if all proposals are rejected or if the protest is received after the award for this contract. 2. In order to be considered, a protest shall be in writing and shall include: the name and address of the aggrieved person; the contract title under which the protest is submitted; a detailed description of the specific grounds for protest and any supporting documentation; and the specific ruling or relief requested. Upon receipt of a written protest, the District shall promptly consider the protest. The District may give notice of the protest and its basis to other persons, including Proposers involved in or affected by the protest; such other persons may be given an opportunity to submit their views and relevant information. If the protest is not resolved by mutual agreement of the aggrieved person and the District, the District will promptly issue a decision in writing stating the reasons for the action taken. A copy of the decision shall be mailed by certified mail, return receipt requested, or otherwise promptly furnished to the aggrieved person and any other interested parties. The District decision may be appealed to the Superintendent by written notice together with all supportive evidence, received at the address set forth in paragraph 2, not more than two (2) working days after receipt of the decision. The Superintendent s decision shall be final and conclusive. 4. Strict compliance with the protest procedures set forth herein is essential in furtherance of the public interest. Any aggrieved party that fails to comply strictly with these protest procedures is deemed, by such failure, to have waived and relinquished forever any right

No person or party may pursue any action in court challenging the solicitation or award of this contract without first exhausting the administrative procedures specified herein and receiving the District s final decision. 5.
