VICTORIAN BRANCH NURSES DEPARTMENT OF EDUCATION AND TRAINING ENTERPRISE AGREEMENT 2016 Log of Claims
PREAMBLE TO 2016 NURSING STAFF CLAIM Experienced nurses must have job satisfaction to ensure that they remain in school nursing and working on the maternal and child health line and the conditions must be suitably attractive to encourage other nurse to take up these positions. Agreement and implementation of the 2016 Nursing Staff Claim will allow the following to occur: 1. Experienced nurses will continue working on the maternal and child health line and as school nurses. 2. The Victorian Government will be able to demonstrate its commitment and how it values these nurses and the service they provide. 3. DET nurses will be able to better balance the competing work, family and life issues with which they are faced. 4. Provide a better incentive to those considering a career in nursing in DET. The Victorian community values and respects the contribution nurses make, to students as school nurses and mothers through the Maternal and Child Health Line. The DET can also demonstrate that respect through meeting the following claims.
Part A Maintenance of a Nurses Agreement & Service Delivery Partnership Plan (SDPP) 1. The new Agreement to retain those provisions from the Nurses (DEECD) Agreement 2012 not varied as a consequence of the SDPP or the claims contained herein. 2. Assist in the review of existing documentation and piloting of any changes (e.g. SEHQ) to better meet the needs of students and their families. 3. Positive contribution to the review of the MCHL to identify and prioritise service improvement opportunities and innovations for application within the MCHL. 4. Where necessary standardise operational procedures and simplified clauses in the Agreement, compared to VPS Determination and DET EBAs to provide for better alignment and service delivery. 5. Assist in the review of health and wellbeing services in schools and identify demand pressures and target improvements in that service. Part B New Claims Summary a. Salaries to be increased to reflect interstate and/or territory public sector nurses b. Two additional salary points for each Grade in the Classification structure c. All school nurses to be classified at no less than Grade 4A d. All school nurses to have access to Grade 4 B based on agreed criteria e. Nurse Manager positions mandated for the PSNP and the SSNP within each Region f. Senior Nurse positions mandated for the PSNP and the SSNP within each Region g. Two Senior Nurse positions mandated for MCHL h. Introduce a ratio of PSNP nurses to students and provide for an SSNP nurse in every secondary school i. Annual leave in accordance with the Nurses Award j. 5 days paid professional development leave, Qualification Allowances (Hospital Certificate or Graduate Certificate 4%, Post Graduate Diploma or Degree 6.5%, Masters 7.5% and Doctorate 10%.).
Detail Clause Title Amendments Sought 4 Commencement 1.1.2016 7 Anti - Discrimination Amend on advice from VEOHRC 8 Implementation of Change Amend to reflect the wording of the Model Consultation Term in Schedule 2.3 Fair Work Act. Add provision detailing the type of information that is required to be provided. Change affected employee to relevant employee 10 Workload Introduce a ratio of PSNP nurses to students and provide for on SSNP nurse in every secondary school 11.2 Usual place of work Needs to refer to specific schools or MCHL workplace so that if there is a change a relocation allowance applies. 14 Home Based Work Amend to provide that requests will not unreasonably be refused. 17 Classification Structure Two additional salary points for each Grade. Nurse Manager and Senior Nurse positions for PSNP and SSNP within each Region. Two Senior Nurse positions for MCHL. 19 Salary Progression To be amended to provide that progression will occur unless the employer demonstrates that performance against the Grade descriptors has not been met. 20 Salary Increases Salaries to be increased to reflect interstate and/or territory public sector nurses 23 Allowances Add qualification allowances (Hospital Certificate or Graduate Certificate 4%, Post Graduate Diploma or Degree 6.5%, Masters 7.5% and Doctorate 10%.) Introduce Overtime or TIL or Allowance provision for school camps. 23.2 Higher Duties Allowance Amend to provide for after 1 day. 24.7 Permanent relocation of Amend to specify change of schools. usual place of work 26 Hours of Work Add provision to enable nurses to bank time to cover school holidays or days between Christmas and New Year. 27 Shift Work Increase night shift rate to 20%. An additional allowance (equal to difference between current top of 4B and the new top salary point) for a MCHL nurse who performs the sole role on night shift.
27.3 Substitute Leave for Public Increase to 13 days for new public holidays. Holidays 27.4 Alteration to Roster Redraft to reflect model arrangements. Arrangements 28 Overtime Amend to provide for double time after 2 hours, overtime for part timers beyond their shift length or ordinary hours on any day and to remove the exceptions. Time in lieu of overtime to be at the overtime penalty rate. Introduce Overtime or TIL or Allowance provision for school camps. 31 Annual Leave Annual leave in accordance with the Nurses Award. Remove the calculation cap for Annual Leave Loading. Annual leave to be re-credited if nurse needs to utilise Personal Leave during a period of annual leave. 33 Infectious Diseases/Dangerous Medical Conditions Amend clause 33.2 to require the employer to make reasonable adjustments in respect to an employee with an illness/injury/disability. 34 Public Holidays Amend to include Easter Sunday and Friday before AFL Grand Final. 36 Compassionate Leave Increase quantum to 5 days. 37 Parental Leave Amend to increase primary carer leave to 26 weeks and partner leave to 4 weeks and remove gender references and instead refer to primary/secondary carer. Increase pre- natal leave quantum to 38 hours. 40 Long Service Leave Review subject to the Victorian Parliamentary Inquiry into Portability. 52 OH&S Amend to provide for workspaces in Schools and Regional Offices that is compliant with Worksafe codes and meets privacy and information technology requirements. Provide for secure on-site parking for MCHL nurses where the shift concludes after 6pm. 55 Protection and Facilities for Accredited Union Representatives Amend to include paid leave where a nurse is elected to the Victorian Branch Council of the ANMF New Professional Development Leave 5 days paid leave to meet Registration requirements. New Family Violence Leave Gender neutral paid leave for nurses experiencing family violence. New Right to Request Flexible Working Arrangements As per the NES.
