Application of EU Instrument (1) Subject to paragraph (2) and to the modifications set out in the Schedule, Council Regulation (EU) No 1032/20L0 of 15 November 20L0 amending Council Regulation (EC) No 774120052 imposing restrictions on the supply of assistance related to military activities to Côte-d'Ivoire shall apply as part of the law of the Island. (2) This Or,ier does not apply in respect of provisions that appiy as part of the law of the Island under section 2(1) of the European Communities (Isle of Man) Act1973. SCHEDULE [article 3(1)] LIST OF MODIFICATIONS TO THE APPLIED INSTRUMENT COUNCIL REGULATION (EU) No 103212010 of L5 November 2010 amending Council Regulation (EC) No 17412005 imposíng restrictions on the supply of assistance related to military activities to côte-d'ivoire. 1. Except where otherwise provided below, references in the Regulation to "Member State", "the tinion", artd "the European ljnion" shall be read as if the Island were itself a Member State, its territory were included within the Union territory and for the purposes of European Union law were a separate country from the United Kingdom. 2. In Article 1.(2), inparagraph 2 of the inserted Article 4a- (a) after the words "shall inform" omit the word "the"; (b) after the words "the Commission" insert the words "as it considers appropriate", 3. Omit Articie 2. 4. After Article 2, omit the statement of effect and application. EXPLANATORY NOTE (This note is not pørt of the Ordet) This Order applies the provisions of Council Regulation (EU) No 1032/2010, as amended by the Schedule to the Order, to the Isle of Man as part of the law of the Island. This EU Regulation amends Council Regulation (EC) No 17412005 imposing restrictions on the supply of assistance related to military activities to Côte-d'Ivoire, which was applied to the Island with certain modifications by SD i59l05. A copy of Council Regulation (EU) 1.03212070 as modified is included in an Annex, but the Annex does not form part of the Order. 2

Annex COUNCIL REGULATION (EU) No 1032/2010 of l5 November 2010 amending Regulation (EC) No 17412005 imposing restrictions on the supply of assistance related to military activities to Côte-d'Ivoire THE COUNCIL OF THE EUROPEAN UNION, Having regard to the Treaty on the Functioning of the European Union, and in particular Article 215 thereof, Having regard to Council Decision 20l0l656lCFSP of 29 October 2010 renewing the restrictive measures against Côte d'lvoire r, Having regard to the joint proposal Íìom the High Representative of the Union for Foreign Affairs and Security Policy and the European Commission, Whereas: ( l) Council Regulation (EC) No 11412005 of 3l January 2005 imposing restrictions on the supply of assistance related to military activities to Côte d'lvoire a provides for prohibitions on the export of equipment which might be used for internal repression and on the provision of certain technical assistance, financing and fìnancial assistance. Thosç restrictions were enacted in accordance with Council Common Position 2004l852lCFSP of l3 December 2004 concerning restrictive measures against Côte d'lvoire 5. (2) Taking into account United Nations Security Council Resolution 1946 (2010) of 15 October 2010 and Decision 20l0l656lCFSP, it is necessary to amend Regulation (EC) No 11412005 in order to permit the export of non-lethal equipment, as well as non-lethal equipment capable of being used for internal repression, intended solelyto enable the Ivorian securify forces to use only appropriate and proportionate force while maintaining public order, as well as the provision of related technical assistance, financing and fi nancial assistance. (3) The list of equipment which might be used for internal repression should be updated following recommendations made by experts, taking into account Council Regulation (EC) No 123612005 o121 June 2005 concerning trade in certain goods which could be used for capital punishment, torture or other cruel, inhuman or degrading treatment or punishment 6. (5) Regulation (EC) No 17412005 should be amended accordingly, HAS ADOPTED THIS REGULATION: Regulation (EC) No 11412005 is amended as follows: Article l (l ) Article 4(l) is replaced by the following: '. (2) trl (4) (5) (d) the provision of technical assistance related to arms and related materiel intended solely for suppoft ofor use in the process ofrestructuring defence and security forces pursuant to paragraph 3, subparagraph (1; of the Linas-Marcoussis Agreement, where such activities have also been approved in advance by the Sanctions Committee; (e) the provision of financing or f,rnancial assistance related to arms and related materiel intended solely for supporl ofor use in the process ofrestructuring defence and security forces pursuant to paragraph 3, subparagraph (f) of the Linas-Marcoussis Agreement; (Ð the sales or supplies temporarily transferred or exported to Côte d'lvoire to the forces of a State which is taking action, in accordance with international law, solely and directly to facilitate the evacuation of its nationals and those for whom it has consular responsibility in Côte d'lvoire, where such activities have also been notified in advance to the Sanctions Commiltee; (g) the provision oftechnical assistance, f,tnancing or financial assistance related to non-lethal military equipment intended solely to enable the lvorian security forces to use only appropriate and proportionate force while maintaining public order.'; the following Article is inserted: 'Arlicle 4a L By way of derogation ftom Article 3, the competent authority, as listed in Annex Il, of the Member State where the exporter or service provider is established may authorise, under such conditions as it deems appropriate, the sale, supply, transfer or export of non-lethal equipment listed in Annex I or the provision of technical assistance, financing or financial assistance related to such non-lethal equipment, after having determined that the non-lethal equipment concerned is intended solely to enable the Ivorian security forces to use only appropriate and proportionate force while maintaining public order. 2. The relevant Member State shall inform the-other Member States and the Commission as it considers appropriate ofany authorisation granted under paragraph l ' 3.
