Professional services a. Legal services (CPC861) To allow a Macao law firm that has set up a representative office in the Mainland to operate in association with a Mainland law firm. No geographic restrictions will be imposed on the Mainland law firms engaged in the association. Sectoral classification is based on WTO s GATS Services Sectoral Classification List (GNS/W/120). For the contents of the sectors, reference is made to the relevant CPC, United Nations Provisional Central Product Classification.

1. Business services A. Professional services h. Medical and dental services (CPC9312) 1. The requirement on total investment for Macao service suppliers to set up medical institutions in the Mainland, on equity joint venture or contractual joint venture basis, will be lowered from not less than RMB 20 millions to not less than RMB 10 millions. 2. To allow Macao services suppliers who have obtained the Mainland s Medical Practitioner s Qualification Certificate to set up individual medical clinics in the Mainland in accordance with the criteria stipulated for establishing individual clinics by Mainland medical practitioners. Should be approved by provincial health administrative departments. 2

To allow Macao service suppliers to set up wholly-owned enterprises in the Mainland to provide software implementation services. 2. To allow Macao service suppliers to set up wholly-owned enterprises in the Mainland to provide data processing services. 3

Real estate services Residential or non-residential property management services on a fee or contract basis (CPC82201, 82202) The total gross floor areas that Macao service suppliers have contracted to manage, both in Macao and in the Mainland, will be taken into account in assessing their application for the qualification of property management enterprises in the Mainland. 4

To allow Macao service suppliers to set up joint-venture enterprises in the Mainland to engage in the business of printing publications and other printed matters. Macao service suppliers shareholding in the joint venture should not exceed 49%. 2. To allow Macao service suppliers to set up wholly-owned enterprises in the Mainland to provide printing and binding services for printed matters of package ornaments. 11

1. Business services F. Other business services Translation and interpretation services (CPC87905) To allow Macao service suppliers to set up wholly-owned enterprises in the Mainland to provide translation and interpretation services. 12

1. Business services F. Other business services Convention services and exhibition services (CPC87909) 1. To allow Macao service suppliers to organize exhibitions, in the cross-border mode of supply, in Guangdong province or Shanghai Municipality on a pilot basis. 2. To allow Macao service suppliers to set up wholly-owned, equity joint venture or contractual joint venture enterprises in Guangdong province or Shanghai Municipality, on a pilot basis, to provide services of organizing overseas exhibitions. Participating exhibitors should be enterprises registered in Guangdong province or Shanghai Municipality correspondingly. Should be submitted to the Ministry of Commerce for approval in accordance with relevant laws and regulations in the Mainland. Should be submitted to the China Council for the Promotion of International Trade for approval in accordance with relevant laws and regulations in the Mainland. 13

2. Communications services C. Telecommunications services Valued-added services To allow Macao service suppliers to set up equity joint-venture enterprises in the Mainland, without geographic restriction, to provide internet virtual private network services in the Telecommunications Business Classification. Macao service suppliers shareholding in the joint venture enterprises should not exceed 50%. 14

Audiovisual services Videos distribution services (CPC83202), Sound recording products distribution services Cinema theatre services Chinese language motion pictures and motion pictures jointly produced Technical services of cable television Jointly produced television dramas Others The synopsis of each episode in the proposal of the television dramas to be jointly produced by the programme production organizations of the Mainland and Macao will be adjusted to a minimum level of not less than 1500 words. 15

4. Distribution services A. Commission agents services (excluding salt and tobacco) B. Wholesale trade services (excluding salt and tobacco) C. Retailing services (excluding tobacco) D. Franchising For the same Macao service supplier which opens more than 50 stores accumulatively in the Mainland, if the commodities for sale include pharmaceutical products, pesticides, mulching films, chemical fertilizers, vegetable oil, edible sugar and cotton, and the above commodities are of different brands and come from different suppliers, the Macao service supplier is allowed to become the controlling shareholder, with the proportion of capital contribution not exceeding 65%. If the commodity for sale is processed oil, Mainland s commitments to members of the World Trade Organization are still applicable. 16

6. Environmental services (excluding environmental quality monitoring and pollution source inspection) A. Sewage services (CPC 9401) B. Refuse disposal services (CPC 9402) C. Sanitation services (CPC 9403) To allow Macao services suppliers to set up wholly-owned enterprises in the Mainland to provide environmental protection services. 17

7. Financial services A. All insurance and insurance-related services a. Life, health and pension/ annuities insurance b. Non-life insurance c. Reinsurance d. Services auxiliary to insurance 1. To agree on setting up an examination center for the Mainland insurance intermediary qualification examination in Macao. 2. To allow Macao insurance agency companies to set up wholly-owned enterprises in the Mainland to provide agency services to Mainland insurance enterprises. 18

7. Financial services B. Banking and other financial services (excluding insurance and securities) a. Acceptance of deposits and other repayable funds from the public b. Lending of all types, including consumer credit, mortgage credit, factoring and financing of commercial transaction c. Financial leasing d. All payment and money transmission services, including credit, charge and debit cards, travellers cheques and bankers drafts (including import and export settlement) e. Guarantees and commitments f. Trading for own account or for account of customers: foreign exchange For a Macao bank to carry out equity acquisition in a Mainland bank, the total asset requirement on the Macao bank at the end of the year prior to the application is lowered from not less than 10 billion USD to not less than 6 billion USD. 19

7. Financial services B. Banking and other financial services Securities 1. To allow Mainland fund management companies approved by the China Securities Regulatory Commission to set up subsidiaries in Macao to operate relevant businesses. 2. For Mainland securities companies to set up subsidiaries in Macao, the timeframe for completing their registration in Macao will be extended from 6 months to 1 year. 20

8. Health related services and social services C. Social services Welfare services delivered through residential institutions to the aged and the handicapped (CPC93311) Welfare services not delivered through residential institutions (CPC93323) To allow Macao service suppliers to establish elderly service agencies in the form of wholly-owned private non-enterprises to provide caring services for the elderly in Guangdong Province on a pilot basis. 21

9. Tourism and travel related services A. Hotels (including apartment buildings) and restaurants (CPC641-643) B. Travel agency and tour operator services (CPC7471) Others 1. The annual business turnover should not be less than US$8 million for Macao travel agencies setting up joint venture travel agencies in the Mainland. 2. The annual business turnover should not be less than US$15 million for Macao travel agencies setting up wholly-owned travel agencies in the Mainland. 3. To allow Macao travel agencies established on a wholly-owned or joint venture basis in the Guangxi, Hunan, Hainan, Fujian, Jiangxi, Yunnan, Guizhou, Sichuan Provinces or Autonomous Region, to apply, on a pilot basis, to provide group tours to Macao and Hong Kong for residents registered with permanent residence in these provinces or autonomous region. 22

10. Recreational, cultural and sporting services A. Recreational services (excluding audiovisual services) 1. To allow Macao service suppliers to set up wholly-owned performance agencies in the Mainland. 2. To allow Macao performance agencies or performing arts groups, in the cross-border mode of supply, to organize commercial performances in the Guangdong Province and the Shanghai Municipality on a pilot basis, after obtaining the approval of the relevant authorities of that Province or Municipality. The performance agencies or performing arts groups organizing in the Mainland should obtain approval of the Ministry of Culture. 23

10. Recreational, cultural and sporting services D. Sporting and other recreational services (CPC964) Sporting services (CPC96411, 96412, 96413) To allow Macao service suppliers to set up wholly-owned enterprises in the Mainland to provide sports event promotion and organization services; and sports facility operation services (excluding the construction of golf courses). 24

11. Transport services A. Maritime transport services H. Auxiliary services International transport (freight and passengers) (CPC7211, 7212, less cabotage transport services) Container station and depot services Others To allow Macao service suppliers to set up joint venture enterprises in the Mainland to provide third party international shipping agency services, in which the proportion of Macao service suppliers shareholding should not exceed 51%. 25

11. Transport services C. Air transport services d. Repair and maintenance services to aircrafts (CPC8868) Other supporting services for air transport (CPC74690) Computer Reservation System (CRS) services Sales and marketing services for air transport 1. To allow Macao service suppliers to submit the economic guarantee provided by China-capital banks in the Mainland or guarantee companies recommended by the China Air Transport Association, when applying for setting up wholly-owned, equity joint venture or contractual joint venture air transport sales agencies in the Mainland. 2. In applying for setting up wholly-owned, equity joint venture or contractual joint venture air transport sales agencies in the Mainland, Macao service suppliers are not required to go through the substantive preliminary vetting by local representative offices of the China Air Transport Association. The application materials can be submitted directly to the China Air Transport Association for examination. 3. To allow Macao service suppliers to set up joint venture enterprises with the Mainland Computer Reservation System (CRS) service suppliers in the Mainland. The Mainland side shall hold controlling shares in the joint venture enterprises. The licenses for the establishment of joint venture enterprises are subject to economic needs test. 26

11. Transport services F. Road transport services Interurban regular passenger transportation (CPC71213) To allow Macao service suppliers to set up joint venture enterprises in the Mainland to provide interurban regular passenger transportation services. 27

Service sectors (sectors not set out in GNS/W/120) Individually owned stores To allow Macao permanent residents with Chinese citizenship to set up, in accordance with the relevant Mainland laws, regulations and administrative regulations, individually owned stores in all provinces, autonomous regions, municipalities directly under the Central Government in the Mainland, without being subject to the approval procedures applicable to foreign investments. The number of employees for each store shall not exceed 8 persons. The scope of business for individually owned stores, excluding franchising, includes: computer services, software services; loading/unloading and porterage services related to road transport, other transport services 1, storage and warehousing services 2 ; translation and interpretation services 3. 1 Excluding international freight forwarding agency and courier services. 2 The business area for storage and warehousing services should not exceed 300 square meters. 3 Confined to business activities only. 28
