CHAPTER NO.-1 The particular of the organization, function and duties The particulars of organization - TRANSPORT DEPARTMENT According to Rules of Executive Business the main functions and duties of the Transport Department are as follows:- - Control of Motor Transport - Taxation on Motor Vehicles - Shipping and navigation on inland waterways declared by parliament by law as National Waterways as regards mechanically propelled vessels. - Ferries - Railways and minor railways - Control of Bihar State Road Transport Corporation - Control of all officers serving with Transport Department. Important task performed by the Transport Department 1- Registration of Motor Vehicles:- In order to have proper control over the motor vehicles. every motor vehicle is registered by the District Transport Officer (DTO) of each district under Transport Department for the purpose of identification of each vehicle and its owner. 2- Fitness Certificate of the vehicle : - At the time of registration of vehicle, its fitness to ply on public road is examined by the Motor Vehicles Inspector (MVI) or at any testing station authorised by the State Government. Besides this, fitness of passenger/ goods carrier vehicles is tested periodically as prescribed in the Motor Vehicles Act, 1988 in order to ensure their capacity of safe movement. In case of any accident, the vehicle involved is specially tested by the MVI. 3- Collection of Motor Vehicles Tax and Fees At each district level, motor vehicles tax and fees is collected by the DTO. One time tax is paid for personalised vehicles whereas taxes from transport vehicles including goods carrier is collected quarterly, half yearly and yearly. 4- Grant and Renewal of Permit : For the purpose of general control on movement of road traffic and to cater to the socio-economic need of people the passenger/ goods carrier vehicles are granted permit and the permits are renewed by the State Transport Authority on state level and various Regional Transport authorities constituted in each division of the State.

2 5- Grant and renewal of Motor Vehicle Driving Licence Road Transport has positive and effective role to play in the socio-economic need of people. For its proper development fit and efficient drivers are needed. In accordance with the provisions of the Motor Vehicles Act and rules made thereunder the DTO grants Learners Licence and after examining grants Driving Licence or renew the same, when required. 6- Conductor's Licence Keeping in view the importance of proper plying passengers vehicles and for convenience of the passengers conductor's licence is granted to the fit, capable and expert candidate by the DTO. 7- To provide cheap road transport facilities For providing cheap road transport facilities to passengers specially in the remote and rural areas and connecting district headquarters with State capital and other big towns/ cities, the Bihar State Road Transport Corporation has been established. 8- Road Safety Transport Department takes measures to educate the general people and inculcates awareness of road safety and traffic rules. The NGO's working in this field are encouraged. In case of road accidents the transport department helps the local authorities in rescue and trauma management. 9- Pollution Control For maintaining purity and balance of the environment Pollution under control certificate is issued after proper testing of the motor vehicles by the Pollution Testing Centres authorised by the Transport Department. 10- Providing vehicles during elections Under the Representation of People Act for proper conduct of elections, the motor vehicles are seized and provided to the authorities on payment of adequate compensation.

7 CITIZEN'S CHARTER Mission : The main mission of the Transport Department, Bihar Government is to ensure the strict compliance of the Motor Vehicles Act, 1988 by the latest modern technology for promoting the transportation facilities in 21st century to meet with the expectations of the citizens and thus to remain dedicated day and night, to the services of the citizens and to make the public services more and more progressive and environmental friendly and keeping in view the protection of the environment. Objectives : In order to achieve the objectives, the transport department is determined to make available transparent and sensitive administrative services with public cooperation in connection with the works/ jobs like registration of vehicles, tax collection, pollution control and issuance of drivers/ conductor's licences, safe movement of the vehicles and measures of checking accidents etc. and for this the department and its each officer/ officials shall perform the following tasks/ duties :- 1. Every application must be expeditiously dealt with and executed within the stipulated time-limit and during the process every citizen/ applicant shall be dealt friendly. 2. In all circumstances sincerity and dedication to worked shall be maintained. 3. Every applicant/ citizen shall be treated equal/alike and thee must be transparency in working patterns. 4. To render better/improved services all suggestions from the citizen be welcomed and forwarded to the higher authorities for making necessary decisions. 5. The applicant must be informed with the reasons for rejection/non-acceptance of his/her application. 6. Shall display information regarding the prescribed fees and details of officers/officials holding different duties/jobs at an appropriate/ proper place in the office premises. 7. Shall remain vigilant all the time about pollution control. 8. Shall acknowledge the receipt of all letters/ documents. 9. Shall communicate to the applicant any discrepancy/ deficiency by mentioning date and time. 10. The complaint regarding the subordinate staff should be investigated within 15 days and the complainant be informed accordingly. 11. A complaint book be maintained in the office and four copies of every complaint will be prepared. One copy be pasted in the complaint book, second copy to be sent to the controlling authority of the officer against whom complaint is made; third copy will be sent to the state transport headquarters for the needful and the fourth copy will be made available to the complainant. The head of every office will

8 inspect this complaint book every week and ensure necessary action and shall also make arrangements to make the copy available on demand without hesitation and ifs and buts. Transport Department seeking the public cooperation and to make it public oriented expects the necessary held/feedback from the general public to ensure better tax collection, improved road safety measures, to set strict standards for driving test, to restrain fatigued driver to encourage driving and to develop a sensitive public complaint redressal system. The department is determined to make its services more public oriented and people friendly. Introduction : The details of the brief information regarding some important functions executed by the transport department are as follows: - 1. Registration of Motor Vehicles :- In order to have proper control over the motor vehicles, every motor vehicle is registered by the district transport officer of each district under transport deptt. for the purpose of identifications of each vehicle & its owner & for tax collection. 2. Fitness Certificate of the Vehicles :- At the time of registration of the vehicle, its fitness is examined by the M.V.I. or at any testing station authorized by Govt. besides this, passengers vehicles/carrier vehicle fitness is tested in the prescribed period by M.V.I. under the provision of the motor vehicles act in order to ensure their capacity of safe movement. Specially in case of accident each vehicle is tested personally by M.V.I. 3. Collection of Motor Vehicles Tax :- At district level motor vehicle registration fees and road taxes are collected by the DTO. One time tax is paid for the private & personalized vehicles where as commercial taxes are paid quarterly, half yearly and yearly for the commercial vehicles. Road tax is the main resource of revenue for the development expenses of the State. 4. Grant And Renewal Of Permit For Passengers/ Carrier Vehicles :- For the purpose of general traffic regulation utility and have proper control of movement of the passenger/carrier vehicle; their permits are granted and renewed by the regional transport authority at the divisional level and by the State Transport Authority at the State level. 5. Grant And Renewal Of Motor Vehicle Driving Licences ;- Transport Department has positive and effective roll in the state economy. For its proper development, fit and expert drivers are needed. For this purpose in each District Transport Office of the Transport Department in accordance with the provisions of the motor vehicle acts/rules, driving licences are granted to the fit and expert drivers and their licences are renewed in the due time after testing.

Conductor's Licences :- Keeping in view of the importance of the passengers transportation and for proper plying of passengers vehicles, conductor licences are granted to the fit, capable and expert candidates by the Transport Department. 7. Publicity And Advertising For Road Safety :- With the help of Govt. of India, the Transport Department takes measures to educate the general people and to inculcate awareness among them regarding the road safety. 8. To Provide Cheap Traffic Facilities :- For providing cheap passengers traffic facilities to remote rural areas as well as in the big towns/cities, Bihar State Transport Corporation has been established at the state level. Facility of passenger vehicles movement and bus fares are being controlled by transport corporation. 9. Motor Vehicles Pollution Control :- For maintaining the purity and balancing of the environment; Pollution control certificate are issued after proper testing of the vehicles with the cooperation of the Bihar State Pollution Control Board. Pollution is mostly caused by the movement of auto rickshaws and commercial vehicles, hence the Enforcement Wing of the Transport Department is directed to identify such vehicles and to take necessary action accordingly. Transport Department is taking necessary stapes for preparing rules and regulations regarding pollution control. 10. Taking over the vehicles at the time of elections, Natural Calamities, And other Emergencies : Under Public representative Act, at the of elections, flood, drought, etc Natural Calamities in order to provide proper assistance to the general Public regarding security of their lives and properties the local administration can take over the vehicles for transport purpose for which proper compensation are provided. In this work Transport Department Renders proper assistance and cooperation to the local authorities. Requests : In view of the public service and to ensure the availability of the necessary financial resources the Transport Department Requests the vehicle owners not only to ensure timely up to date payment of taxes of their vehicles but they should also inspire other vehicle owners and general public for the same and thus to cooperate to promote the social & harmonic environment. Expectations : For the purpose of making new records of Public Service, Transport Department also solicits public cooperation on the following points.

10 A) Application Form should be submitted b the applicants by filling all the appropriate columns. B) Application Form should be submitted by the applicant with all the required documents and requisite fees. C) Application Form should be submitted personally to the authorized & required documents and requisite fees. D) Help from Middlemen and brokers should not be taken at all. E) No gift or any type of fee should be offered to any officers or employee. F) When needed, Please contact the higher authorities. G) Avoid unnecessary interference in the Government official working. H) Always strictly follow the transport and traffic rules - Road safety is the life safety. I) Don't drive your vehicle without the following documents and also instruct the others for the same. Information :- a. Driving Licence b. Registration of Vehicle c. Insurance Papers. d. Fitness certificate e. Upto-date tax token. For proper office work, the standard of disposal, prescribed time (period) requisite fee and rate of taxes etc are given in the attached appendix. The Secretary, Transport and State Transport Commissioner personally meet people with grievance between 4.00PM to 5.00 PM on every Friday. All the Regional/field officers have been directed to replicate this system in respective offices and to maintain a Public Grievance Register Financial power delegated to various officers All the financial power of the Department is vested in State Transport Commissioner, Bihar, Patna. 12 CHAPTER NO.-2 The power and duties of officers and employees of Transport Department Sr. No. Function / Activity 1 The State Transport Commissioner (a) He will be head of the Motor Vehicles Department and will deal with all matters of policy and correspond with the State Govt. and other. Heads of Departments. He will also be the Chief Executive Officer of the State Transport Authority. (b) He will do correspondence with the Central Govt. and other State Government subject to the general direction of the State Govt. (c) He will have General control over Superintendents of Police regarding control of traffic. (d) He will have General control over Regional Transport Officers, District Transport Officers, Motor Vehicles Inspectors and Enforcement Officers. (e) he will have General control over construction, equipment and maintenance of Motor Vehicles in accordance with the provisions of the Act and the rules. (f) He will ensure Co-ordination of motor transport with other modes of transport. (g) he will implement of Government's policy in respect of motor transport. 2 Additional/ Joint/ Deputy State Transport Commissioner- (a) Functions of Secretary, State Transport Authority under Chapter IV of these rules. (b) Such functions of the State Transport Commissioner as may be delegated by general or special order of the State Transport Commissioner. 3 Assistant State Transport Commissioner (Technical) and State Inspector of Vehicles- (a) Dealing with and advice on all technical matters relating to motor vehicles. (b) Implementation of Government's policy in respect of Motor Transport. (c) Any other function which may be assigned by the State Transport Commissioner and / or State Government. 5 District/ Additional Distt. Transport Officer- District Level (a) To work as Licensing authority under Chapter 11 and 111 of the rules to work Chapter IV of the rule. (b) Implementation of Government policy relating to Motor Vehicles Transport. (c) General Control of Motor Vehicles Inspector/ Enforcement inspector/ Enforcement Sub-Inspector in discharge of their function in the respective districts. 6 Motor Vehicles Inspector- District Level (a) Duties prescribed in rule 250. (b) To assist the Regional Transport Officers/ Distt. Transport Officer/ Additional Distt. Transport Officer in all technical matters relating to road transport. 7 Enforcement Officer- District Level (a) General Control over mobile squad Inspectors and their constables in discharge of their functions. (b) Correspondence with District Magistrates, Superintendents of Police, Regional Transport Officers, etc. on all matters relating to Mobile squads. (c) Details of periodical report (including four diaries, tour programmes, petrol and repair bills) of the Enforcement Inspector/ Enforcement Sub-Inspectors and submission of statistical information to the State Transport Commissioner. (d) Dealing with accounts of the Mobile Squad Branch.

14 (e) Liaison with District Police and other Government Department. (f) Inspection of the Mobile Squads. (g) Any other duties that may be assigned by the State Transport Commissioner. 8 Enforcement Inspector/ Enforcement Sub- Inspector- District Level (a) General enforcement of the Act and these rules. (b) Checking of (i) private carrier in respect of the goods they are allowed to carry (ii) public carriers in respect of their area of operation and (iii) all Transport vehicles including stage carriages, contract carriages and carriages in respect of contravention of the rules and violation of condition of permits. (c) Detection of abuses in respect of the Motor Spirit Rationing Order, 1941. (d) Assisting the public with courtesy instruction. (e) Any other function that may be assigned by the State Transport Commissioner by general or special order. 9 Mobile squad Constables - District Level (a) Driving the vehicle of the squad. (b) Any other duties that may be assigned by the State Transport Commissioner, the Additional/ Joint Deputy/ State Transport Commissioner and the Regional Transport Officer shall exercise the powers, under Section 133, 158 and 206 of the Act, of Police Officer not below the rank of Sergeant or Sub-Inspector of Police authorised or empowered in that behalf; Provided that the State Transport Commissioner the Addl. Joint/ Deputy Transport Commissioner shall exercise such powers throughout the State and the Regional Transport Officers shall exercise the powers within their respective jurisdictions. 10 The Enforcement Officer and the Mobile squad Inspectors shall exercise, within their jurisdiction to be determined by the State Transport Commissioner from time to time, all the powers under Act or the rules, of a Policy Officer not below the rank of Sergeant or Sub-Inspector of Police authorised or Sub-

15 Inspector of Police authorised or empowered in that behalf. 11 Mobile squad constables shall exercise the powers of a Police Officer under clause (a) of sub-section (1) of Section 132 of the Act. The Enforcement Inspector/ Enforcement Sub-Inspector and Mobile Squad Constables shall water the uniform prescribed in the Sixth Schedule to these rues.

37 CHAPTER-17 Other Useful Information The Transport Department is determined to make available transparent and sensitive administrative services with public cooperation in connection with the sevices like registration of vehicles, tax collection, pollution control and issuance of drivers/ conductor's licences, safe movement of the vehicles and measures of checking accidents etc. and for this the department and its each officer/ officials shall perform the following tasks/ duties :- 1. Every application must be expeditiously dealt with and executed within the stipulated time-limit and during the process every citizen/ applicant shall be dealt friendly. 2. In all circumstances sincerity and dedication to worked shall be maintained. 3. Every applicant/ citizen shall be treated equal/alike and thee must be transparency in working patterns. 4. To render better/improved services all suggestions from the citizen be welcomed and forwarded to the higher authorities for making necessary decisions. 5. The applicant must be informed with the reasons for rejection/non-acceptance of his/her application. 6. Shall display information regarding the prescribed fees and details of officers/officials holding different duties/jobs at an appropriate/ proper place in the office premises. 7. Shall remain vigilant all the time about pollution control. 8. Shall acknowledge the receipt of all letters/ documents. 9. Shall communicate to the applicant any discrepancy/ deficiency by mentioning date and time. 10. The complaint regarding the subordinate staff should be investigated within 15 days and the complainant be informed accordingly. 11. A complaint book be maintained in the office and four copies of every complaint will be prepared. One copy be pasted in the complaint book, second copy to be sent to the controlling authority of the officer against whom complaint is made; third copy will be sent to the state transport headquarters for the needful and the fourth copy will be made available to the complainant. The head of every office will

38 inspect this complaint book every week and ensure necessary action and shall also make arrangements to make the copy available on demand without hesitation and ifs and buts. Transport Department seeking the public cooperation and to make it public oriented. Expects the necessary feedback from the general public to ensure better tax collection, improved road safety measures, to set strict standards for driving test, to restrain fatigued driver to encourage driving and to develop a sensitive public complaint redressal system. The department is determined to make its services more public oriented and people friendly For the purpose of making new records of Public Service, Transport Department also solicits public cooperation on the following points. A) Application Form should be submitted b the applicants by filling all the appropriate columns. B) Application Form should be submitted by the applicant with all the required documents and requisite fees. C) Application Form should be submitted personally to the authorized & required documents and requisite fees. D) Help from Middlemen and brokers should not be taken at all. E) No gift or any type of fee should be offered to any officers or employee. F) When needed, Please contact the higher authorities. G) Avoid unnecessary interference in the Government official working. H) Always strictly follow the transport and traffic rules - Road safety is the life safety.
