Statutory Document No. 279/11 EUROPEAN COMMUNITIES (ISLE OF MAN) ACT 1973 EUROPEAN UNION (LIBYA SANCTIONS) (APPLICATION) (AMENDMENT) (No. 5) ORDER 2011 Approved by Tynwald: 17 May 2011 Coming into operation in accordance with article 2 The Council of Ministers makes this Order under section 2A of the European Communities (Isle of Man) Act 19731. 1 Title This Order is the European Union (Libya Sanctions) (Application) (Amendment) (No. 5) Order 2011. 2 Commencement This Order comes into operation immediately after it is made. 3 Application of EU Instrument (1) Subject to paragraph (2) and to the modifications set out in the Schedule, Council Implementing Regulation (EU) No 360/20112 of 12 April 2011 implementing Article 16(1) and (2) of Regulation (EU) No 204/20113 concerning restrictive measures in view of the situation in Libya applies as part of the law of the Island. (2) This Order does not apply in respect of provisions that apply as part of the law of the Island under section 2(1) of the European Communities (Isle of Man) Act 1973. 4 Revocations The following statutory documents are revoked (a) European Union (Libya Sanctions) (Application) (Amendment) (No. 3) ' 1973 c.14 2 OJ L 100, 14.4.2011, p. 12 3 OJ L 58, 3.3.2011, p. 1. Omit Article 2. 2. After Article 2, omit the statement of effect and application. EXPLANATORY NOTE (This note is not part of the Order) This Order applies the provisions of Council Regulation (EU) No 360/2011, as amended by the Schedule to the Order, to the Isle of Man as part of the law of the Island. This EU Regulation amends Council Regulation (EU) No 204/2011 concerning restrictive measures in view of the situation in Libya, which was applied to the Island with certain modifications by SD 157/11, by replacing Annex II and III to that Regulation. A copy of Council Regulation (EU) 360/2011 as modified is included in an Annex, but the Annex does not form part of the Order. The Order revokes the European Union (Libya Sanctions) (Application) (Amendment) (No. 3) Order 2011 and Libya Sanctions (Amendment) (No. 3) Regulations 2011 as they are made redundant by the making of this Order and Libya Sanctions (Amendment) (No. 5) Regulations 2011 (SD 279/11). 4 SD 191/11, which applied Council Implementing Regulation (EU) No 288/2011 to the Island with certain modifications 5 SD 192/11; which made consequential amendment to the Libya Sanctions Regulations 2011 (SD 158/11) as a result of making SD 191/11 2

Annex COUNCIL IMPLEMENTING REGULATION (EU) No 360/2011 of 12 April 2011 implementing Article 16(1) and (2) of Regulation (EU) No 204/2011 concerning restrictive measures in view of the situation in Libya THE COUNCIL OF THE EUROPEAN UNION, Having regard to Council Regulation (EU) No 204/2011 of 2 March 2011 concerning restrictive measures in view of the situation in Libya', and in particular Article 16(1) and (2) thereof, Whereas: (1) On 2 March 2011, the Council adopted Regulation (EU) No 204/2011 concerning restrictive measures in view of the situation in Libya. (2) In view of the gravity of the situation in Libya, additional persons and entities should be included in the list of persons and entities subject to restrictive measures as set out in Annex III to Regulation (EU) No 204/2011. (3) Furthermore, one person should be removed from the list in Annex III, and the information relating to certain persons and entities included in the lists in Annexes II and III to that Regulation should be updated, HAS ADOPTED THIS REGULATION: Article I Annexes II and III to Regulation (EU) No 204/2011 shall be replaced by the text set out in Annexes I and II respectively to this Regulation.
