Eligibility Criteria of Applicant Be legal, non-profit-making persons; Be registered in the Republic of Moldova or Ukraine at least one year before the call is launched; Be established and located in the Republic of Moldova or Ukraine ; The lead applicant and at least one co-applicant be registered in the eligible regions of the other participating country;

Public bodies: Eligibility of applicants/co-applicants Republic of Moldova Local and regional public authorities (Law on Local Public Authorities no.436 of December 28, 2006) Public equivalent bodies: Public bodies : Ukraine Local self-government bodies (Law of Ukraine On Local Self-government in Ukraine of May 21, 2007; No. 280/97-BP) Local state administrations (Law of Ukraine On Local State Administrations of April 9, 1999; No. 586-XIV) Public equivalent bodies : Communal and municipal enterprises (Government Decision approving the Regulation of Municipal Enterprises, no.387, Non-governmental and non-profit organisations: Legal entities of public law established by the decision of local selfgovernance bodies or state administrations (Civil Code of Ukraine of January 16,2003; No. 435-IV, Art 81) Non-governmental and non-profit organisations: Public associations organisations Public associations (Law of Ukraine On Public Associations of March 22, 2012; No. 4572-VI) (Law on Public Associations, no. 837 of May 17, 1996) Charity organisations (Law of Ukraine On Charity and Charitable Organizations of July 5, 2012; No. 5073-VI) Any other national legal form complying with the definition of public bodies, public equivalent bodies, non-governmental and nonprofit organisations as per Directive 2004/18/EC (see footnote 4)

Eligibility Criteria of Applicant Be directly responsible for the preparation and management of the action; Must prove sufficient and stable financial sources for the institution functioning and co-financing of the action Be owner of the land or premises where equipment have to be installed/used or it is leased at least for 10 years; Must not be in any of the situations listed in Section 2.3.3 of PRAG (Declaration by the Applicant ); Must not be affected by potential conflict of interest with the Structures of the Programme.

IMPORTANT Eligibility Criteria of Applicant Please note that political parties, churches and parishes are not eligible, neither as applicants nor as co-applicants or affiliated entities. Co-applicant(s) must satisfy the eligibility criteria as applicable to the lead applicant himself. Non eligibility of one partner lead to rejection of the ACTION!!!! Only bodies located in the eligible area can receive financial support under this programme. Legal entities not falling in any of these categories are welcome to participate in projects as associate partners

Farther Co-applicants 2 or 3 co-applicant may be registered outside the eligible regions of the Moldova or Ukraine BUT!!! Should have demonstrable experience of operating in the eligible regions of Molodva or Ukraine Shoul prove that its participation would bring substantial added value for the eligible regions and it is essential for achieving cross-border impact Head offices of farther co-applicants might be registered outside the eligible countries (Ukraine and Moldova), provided that they operate in the above mentioned countries through registered branches or representations

Applicant registred & located in the eligible area Partnership First Co-applicant registred & located in the eligible area Third Co-applicant Could be registred outside the eligible area Second Co-applicant Could be registred outside the eligible area IMPORTANT!!! at least two cros-border applicants located in the eligible area of Moldova and Ukraine partnership will not be accepted when established between operators responding to the same name and belonging to the same mother organisation, irrespective of the fact that they are established in each of the two eligible participating countries.

MEMBERSHIP the beneficiary is legally defined as a e.g. network, federation, association in which the proposed affiliated entities also participate

The Concept of the Lead Applicant will become the beneficiary and signs the grant agreement with the Contracting Authority (CA); shall be the sole recipient of the payments of the CA; will act as the coordinator and shall sign partnership agreements with the co-beneficiaries; has full financial responsibility towards the CA; is responsible for reporting (financial and narrative); is responsible in the event of audits, checks, monitoring or evaluations.

Eligibility of action IMPORTANT!!! Soft actions and samall scale infrastructure development actions could be financed under this Call Small scale infrastructure is defined as an investment made in infrastructure necessary for the achievement of the project objectives and implementation of the project activities, limited by the budget and programme priorities. The investment should not exceed 30% of the total project budget and includes works activities such as restoration, rehabilitation and repair works, installation of the equipment, etc.

Eligiility of costs IMPORTANT Only eligible costs can be covered by a grant The costs must be: acctually incurred by the Beneficiary(ies) and affiliated entity(ies) within the project implementing period realistic, justified and necessary for implementation of the project are indicated in the estimated overal budget of the project (Annex B) could be verified and in conformity with the tax and national social legislation

IMPORTANT!!! Before sending you application form check all eligibility requirements for you and your partners The eligibility of applicants and co-applicants could be check at any stage of the evaluation procedure Non-respect of eligibility criteria will lead to the project rejection!
