CANADA-LUXEMBOURG CO-DEVELOPMENT AND CO-PRODUCTION INCENTIVE FOR AUDIOVISUAL PROJECTS GUIDELINES 2018-2019
Canada-Luxemburg C-Develpment and C-Prductin Incentive fr Audivisual Prjects The Canada-Luxemburg C-Develpment and C-Prductin Incentive fr Audivisual Prjects ( Incentive ) is a cllabratin between the Canada Media Fund ( CMF r Party ) and the Fnds natinal de sutien à la prductin audivisuelle/film Fund Luxemburg ( FFL r Party ) ( CMF and FFL cllectively the Parties ) t supprt the c-develpment f televisin prjects (fictin and animatin), animated feature films, and digital media prjects, as well as the c-prductin f digital media prjects (AR VR transmedia prjects - new technlgies) fr eligible prjects invlving prducers frm the tw cuntries. The Parties wish t cllabrate fr the purpses f the Incentive fr a perid f tw years (2018 2019 and 2019 2020), but reserve the right t mdify these Guidelines prir t their renewal in 2019 2020. The ttal cmbined budget f the Incentive is CA$900,000 (r apprximately 600,000) per year (fr a ttal f CA$1,800,000 (r apprximately 1,200,000) fr the tw-year perid), with each party cntributing CA$450,000 (r apprximately 300,000) per year. The ttal maximum cmbined cntributin fr each funded develpment prject (televisin, animated feature film r digital media) is CA$100,000 (r apprximately 65,000), and the ttal maximum cmbined cntributin fr each prductin prject (digital media) is CA$500,000 (r apprximately 320,000). The cntributin f each cuntry t selected prjects will be determined n a case-by-case basis. The Incentive may be cmbined with funding frm ther prgrams f the FFL and CMF. Hwever, the maximum cntributin by either cuntry in any ne prject is limited t 75% f eligible expenses fr that cuntry. The cntributin is in the frm f nn-repayable cntributin fr develpment r prductin. The purpse f the Incentive is t supprt the creatin f new prjects. Fr this reasn, prjects that have already received funding frm ne f the Parties during a prir financial perid are nt eligible fr the Incentive. Eligible prjects must meet the fllwing criteria: 1. The prject is a c-develpment (televisin, animated feature film r digital media) r a c-prductin (digital media). Televisin prjects must be a dramatic series, animated series r animated feature film. Digital media prjects must be in the area f virtual r augmented reality, transmedia prject, r new technlgy. 2. The wnership, financial cntrl and creative cntributins (based n key creative psitins) are t be determined in the c-develpment r c-prductin agreement between the prducers. Hwever, the CMF and FFL expect these elements t be prprtinal t each cuntry s financial cntributin. The minrity c-prducer must wn at least 15% f the prject s cpyright. Hwever, the Incentive encurages prjects in which the wnership share is clse t equal. 3. The prject must invlve at least ne Luxemburgian prducer eligible under FFL criteria and at least ne Canadian prducer eligible under CMF criteria. Hwever, a prject c-develped r c-prduced by a prducer with a third cuntry prducer is als eligible prvided that the Canadian and Luxemburgian prducers have significant financial and creative invlvement in the prject (i.e., the third cuntry prducer must nt wn mre than 15% wnership r cntrl f the prject). 4. The prject presents cultural cntent and has the ptential t interest audiences in bth cuntries and transcend natinal brders. 5. The c-prducers must ensure that the prject meets the criteria f the funding rganizatin in their respective cuntries. In this regard, Canadian applicants must meet the requirements set ut in sectin 3.1 f the 2018 2019 CMF Prgram Guidelines, and Luxemburgian applicants must meet the requirements f the Li du 22 septembre 2014 relative au Fnds natinal de sutien à la prductin audivisuelle and f the Règlement grand-ducal du 4 nvembre 2014 prtant exécutin de la li du 22 septembre 2014 relative au Fnds natinal de sutien à la prductin audivisuelle and f any ther rules and criteria in effect. 6. Prjects submitted must cmply with rules pre-established in the Agreement between the Gvernment f Canada and the Gvernment f the Grand-Duchy f Luxemburg regarding Audi-Visual C-Prductin. Types f prject nt eligible fr funding include: Prjects cntaining prngraphic r racist material, r material cndning vilence; Prductins that aim t prmte a specific rganizatin and its activities; Prducts f a specifically cmmercial r industrial nature r primarily intended fr prmtinal purpses; Catalgues r cmpilatins f repurpsed material presented withut any new, value-adding riginal cntent;; System sftware; Archival aggregatin websites; Any ther type f prgram listed in sectin 3.2.TV.2 f the CMF 2018 2019 Perfrmance Envelpe Prgram Guidelines r in sectin 3.2.2.1 f the CMF 2018 2019 Experimental Stream Guidelines. Selectin Criteria and Prcess Prjects will be evaluated by a selectin cmmittee cmpsed f representatives f the CMF and FFL in cllabratin with an internatinal expert, especially in the case f digital prjects (AR VR transmedia new technlgies). Applicatins will be assessed in accrdance with the evaluatin criteria belw. Furthermre, the selectin cmmittee will adpt a reciprcity apprach in rder t ensure a fair balance f investment prvided by Canada and Luxemburg and a fair balance between majrity and minrity prjects between bth cuntries. Only csts related t the acquisitin f cpyright shall be eligible retractively, fr a perid f 12 mnths preceding the date f the submissin. Each c-prducer is respnsible fr submitting the cmplete applicatin t the authrity (CMF r FFL) in its wn cuntry. The same set f dcuments must be submitted by each c-prducer and the applicatin frm must be signed by all c-prducers.
