PSO 3801 Page 1 EXECUTIVE SUMMARY STATEMENT OF PURPOSE The purpose of the PSO is to ensure that Area Managers, Heads of Groups and Governing Governors have in place a system for effectively managing health and safety, which includes a comprehensive Health and Safety Policy, which complies with the requirements of the Health and Safety at Work etc Act etc1974 to ensure the health and safety of staff and others who may be affected by the Service s undertakings. DESIRED OUTCOME The desired outcomes include: MANDATORY ACTIONS An improvement in staff safety and well being; A reduction in accidents and occupational ill health; A reduction in sickness absence; An improvement in safety performance; A reduction in compensation claims; Compliance with health and safety legislation and a reduction in regulatory action by the Health and Safety Executive (HSE). Area Managers, Heads of Groups with staff in locations other than Cleland or Abell House and Governing Governors must: Cleland and Abell House Prepare a local health and safety policy which includes a policy statement, and the organisation and arrangements for implementing the policy, and bring this to the attention of all their staff; Appoint a member of the SMT as the health and safety sponsor; Ensure access to competent advice and the appointment of staff designated for specific health and safety roles; Ensure that arrangements are in place for consultation with staff; Carry out risk assessments and ensure that measures are implemented to eliminate or control all the significant risks; Have arrangements in place to ensure the safety of staff and others in the event of a fire or other emergency; Ensure that staff are trained to carry out their work safely; Have sufficient number of trained first aiders in place; Implement a system for accident reporting and investigation; Have in place arrangements to regularly audit, monitor and review the health and safety performance. Heads of Groups with staff in Cleland and Abell House must ensure the health and safety of their staff through co-operation and compliance with the requirements of the Cleland and Abell House Health and Safety Policy, and participation in and co-operation with the Headquarters Health and Safety Committee. Establishment Liaison Officers must replace all existing copies of PSO 3801 with this new version.

PSO 3801 Page 4 PSO HEALTH AND SAFETY CHAPTER 1: HEALTH AND SAFETY POLICY 1.1 Legislation 1.1.1 The Health and Safety at Work etc Act 1974 requires employers to provide a safe place of work that is without risk to health and to ensure the health and safety of others who may be affected by their undertakings. The Management of Health and Safety at Work Regulations 1999 requires employers to put systems in place to manage health and safety. This PSO sets out the core policy requirements to ensure compliance with current legislation. It should be read in conjunction with PSO 8900, Occupational Health. 1.2 Responsibilities 1.2.1 The Prison Service Management Board, as the employing authority, is responsible, so far as is reasonably practicable for ensuring: The health, safety and welfare of its staff; Conducting the business of the Service so as not to endanger the health and safety of others who may be affected by their undertakings; That systems are in place to effectively manage health and safety; That the Service s health and safety performance is reviewed annually. 1.2.2 At a strategic level, the Director General is responsible for ensuring the health and safety of all staff and others who may be affected by the Service s undertakings. This responsibility is delegated through the management line to Heads of Groups, Area Managers, Governing Governors, managers and those in charge of other Prison Service buildings. 1.2.3 This PSO sets out the actions that Area Managers, Heads of Groups and Governing Governors must take to ensure that systems are in place to manage effectively the risks to which staff and others are exposed while at work. 1.3 Health and Safety Policy The Health and Safety at Work etc Act requires employers to: Prepare a general policy on health and safety; Detail the arrangements and organisation for carrying out the policy; Bring the policy to the attention of all employees; Revise the policy as appropriate and bring any revision to the attention of all employees. 1.3.2 The Director General s and the Board s commitment to ensuring the health and safety of staff and others who may be affected by their undertakings, together with the organisational structure for health and safety, is set out in the Prison Service Health and Safety Policy Statement. A copy of this statement is at Annex 1 of this document. 1.3.3 The Director General is responsible for developing the Prison Service Health and Safety Policy and this is done through the issue of this PSO and Guidance documents. However, the complex nature of the organisation, coupled with the widespread location of establishments and other workplaces, make it impossible for one single policy document to be uniformly applicable. Local Policies, based on the guidance given in centrally issued policies and guidance notes and taking into account existing circumstances and risks must be developed and implemented locally.

PSO 3801 Page 5 1.3.5 Heads of Groups, Governing Governors, and those in charge of other premises must have in place a local statement detailing the health and safety policy of that establishment or Prison Service building. This policy statement must: Include a general health and safety policy statement which sets out the ownership and clear commitment of senior management to the policy; Detail arrangements for consultation with staff through their appointed safety representatives and non trade union members of staff; Detail how health and safety is to be planned, implemented, measured and audited and include the allocation of individual responsibilities; State the arrangements for monitoring performance; State the arrangements for carrying out the policy i.e. the systems and procedures; Include objectives for improving health and safety performance locally. 1.3.6 Guidance on the preparation and implementation of local policy statements, their organisation and arrangement is given in the Prison Service Guidance Note Strategy for Managing Health and Safety (GN 1 2005). 1.3.7 Heads of Groups and Governing Governors must ensure that the Health and Safety Policy is brought to the attention of all staff. All local policy statements must be reviewed when any significant changes take place, but at least annually. Any changes must be brought to the attention of all staff. Line managers at all levels are responsible for implementing health and safety policy in their areas of responsibility. Headquarters and Other Office Accommodation 1.4.1 Health and Safety policies for Cleland House and Abell House will be prepared and monitored centrally by the Health and Safety Section in PMG, in consultation with the Heads of Groups occupying those buildings and other stakeholders such as HQEM and the HQ Health and Safety Committee. 1.4.2 However, individual Heads of Groups are responsible for ensuring that health and safety is effectively managed in areas under their control in HQ buildings, within the framework set by the policy. 1.4.3 Area managers and Heads of Groups are responsible for ensuring that systems for managing health and safety as described in this PSO are in place in any outlying offices under their control. 1.4.4 In buildings where the Prison Service is a minor occupant, consultation must take place between the Prison Service staff occupying the building concerned and the major occupier primarily responsible for the premises. 1.4.5 Auditing of HQ buildings and other outlying offices will be carried out using the Health and Safety Standard for Headquarters and other Office Buildings.

PSO 3801 Page 6 Health and Safety Sponsor: Member of the SMT (formally know as Health & Safety Co-ordinator) 1.5.1 Governing Governors must appoint a member of the Senior Management Team as the health and safety sponsor, to assist the Governor in the co-ordination of all health and safety activities within the establishment and to ensure effective implementation of the local health and safety policy. The Health and Safety Sponsor must be suitably trained to undertake the role. 1.5.2 Health and Safety Sponsors must be at least functional head level and will be a member of the Senior Management Team. Health and Safety Sponsors must be trained and qualified to IOSH Managing Safely level.

PSO 3801 Page 7 CHAPTER 2: ORGANISATION 2.1 Introduction 2.1.1 Overall responsibility for health and safety rests with the highest management level. However, many of the duties and responsibilities will be delegated to line managers. 2.1.2 The organisational section of the local policy must: clearly detail the responsibility for health and safety at all levels; identify key roles with health and safety responsibility. enable staff at all levels to be able to identify their own responsibilities for health and safety and recognise where to report problems or seek advice. 2.1.3 To avoid rewriting the policy when individual staff members change roles, job titles may be used in the policy, with an annex which names the members of staff. 2.2 Access to Competent Advice Health and Safety Advisor 2.2.1 Governing Governors must ensure they have access to competent advice on health and safety matters through a suitably qualified health and safety advisor. Suitably qualified will mean either a NEBOSH Diploma, a degree in health and safety or NVQ Level 4. For Headquarters buildings competent advice will be available from the Health and Safety Section (PMG). 2.2.2 It is recognised that there may be occasions, especially where appointing to part-time health and safety posts, where it may not be possible to appoint an already qualified health and safety advisor and it is necessary to appoint someone who is not yet competent but is undergoing or committed to undergo the required training. Where this occurs Governors must ensure that the appointed person attains NVQ level 4 or equivalent within two years of appointment. During this period, Governors must ensure that they are still able to access competent advice when required, for example from their Area Health and Safety Advisor. Occupational Health Advisor 2.2.3 Governors must have access to competent occupational health advice. This will either be through the appointment of an establishment based, suitably qualified occupational health advisor or through a contract with an external provider. Radiation Protection Supervisors 2.2.4 Where sources of ionising radiation are used Governing Governors must appoint a radiation protection supervisor (RSP) to ensure the health and safety of staff and prisoners who may be exposed to radiation. RPSs must be given appropriate training and time to carry out the role. Where an establishment has radiation sources located in different areas within the prison, such as security and health care an RPS must be appointed in each area. 2.2.5 Further information on radiation safety is given in PSOs 3842 and 3843 Fire Safety Officer 2.2.5 Governing Governors must appoint a fire safety officer to provide advice on all fire matters within the establishment. Fire officers must attend the Prison Service Fire Officer Course as soon as possible after appointment to the fire safety officer role.

PSO 3801 Page 8 Time for Competent Persons to Carry out the Role 2.2.6 Governing Governors must carry out an assessment of the needs of their particular establishment to determine the time needed by competent persons to carry out their designated health and safety roles. Where the role being fulfilled by a competent person is deemed to be a part-time post, arrangements must be made to ensure that there is sufficient time allocated to the health and safety role. 2.3 Consultation with staff 2.3.1 Area Managers, Heads of Groups and Governing Governors must have arrangements in place for consultation on health and safety issues with staff through their appointed safety representatives and non trade union members of staff. 2.3.2 Governors must ensure that appointed safety representatives are given time off with pay to carry out their function and to attend basic training. 2.3.3 Where safety representatives who do not belong to a union are appointed to represent staff Governors must ensure that they are provided with training. Governors must meet the cost of any such training. 2.3.4 Governing Governors must ensure that a Health and Safety Committee is set up at each establishment and that it is chaired by the Health and Safety Sponsor who will be a member of the SMT. 2.3.5 For HQ buildings a Health and Safety Committee made up of key stakeholders and chaired by a senior member of the Personnel Directorate will be responsible for overseeing the management of health and safety. 2.3.6 Further advice on communicating with staff is given in Guidance Note 03/2006, Consultation with Staff.

PSO 3801 Page 9 CHAPTER 3: PLANNING AND IMPLEMENTING 3 Introduction 3.1 Planning is essential for the effective implementation of health and safety policies. It is concerned with the prevention of accidents and occupational ill-health through the identification, elimination and control of hazards and risks. Planning and implementing will include the following: Assessment of all the significant risks to which staff are exposed to while at work. Risk assessments must also include others who may be affected by the Service s undertakings; Operational plans to implement measures to eliminate or control the identified risks; Identification of the legislation applicable to the undertakings and the implementation of measures to ensure compliance with statutory duty; Setting standards and agreeing resources for health and safety. 3.2 A list of the common risks and other processes for which arrangements will need to be in place is given at Annex 2. This list is not exhaustive and Heads of Groups and Governing Governors must ensure that arrangements are in place to manage all the significant risks identified by the risk assessment. 3.2 Risk Assessment 3.2.1 The Management of Health and Safety at Work Regulations 1999 requires employers to carry out an assessment of all the risks to which their employees are exposed whilst at work. The employer must also assess the risks to the health and safety of persons not in their employment who may be affected by their undertakings, such as contractors, members of the public and prisoners. Under the Regulations employers are also required to implement preventative and protective measures to eliminate or control the risks identified by the assessment. 3.2.2 As well as the duty to carry out general risk assessment under the Management of Health and Safety at Work Regulations 1999, other regulations place a duty on employers to carry out assessments for specific risks. These include: The control of Noise at Work Regulations 2005; The Control of Vibration at Work Regulations 2005; The Control of Lead at Work Regulations 2002; The Control of Substances Hazardous to Health Regulations 2002; The Manual Handling Operations Regulations 1992 as amended; The Health and Safety (Display Screen Equipment) Regulations 1992 as amended; The Personal Protective Equipment Regulations 1992; The Provision and Use of Work Equipment Regulations 1999; The Asbestos at Work Regulations 2002: The Work at Heights Regulations 2005 3.2.3 Area Managers, Heads of Groups and Governing Governors must carry out an assessment of the risks to which their staff and others who may be affected by their undertakings are exposed and ensure that measures are in place to eliminate or control the risk. Area Managers, Heads of Groups and Governing Governors must detail the arrangement for carrying out assessments and managing the significant risks identified by the assessments. 3.2.4 Further information on carrying out risk assessment is given in Guidance Note 01/2006 Risk Assessment.

PSO 3801 Page 10 3.3 Management of Asbestos 3.3.1 Area Managers, Governing Governors and Heads of Groups (for buildings other than Cleland House and Abell House) must have in place a plan for the effective management of any asbestos that may be present in their area of control in line with the advice given in the Control of Asbestos at Work Regulations 2002. 3.3.2 Governing Governors must ensure that they have at least one member of staff trained in asbestos management to the standards developed by Property Services Group. 3.4 Safe Systems of Work 3.4.1 Where significant risks have been identified through the risk assessment process, written safe systems of work must be prepared, and be available to and be adhered to by all staff carrying out the task or process to which they refer. 3.5 Contingency Planning 3.5.1 Governing Governors must have arrangements in place to ensure the safety of staff, visitors, prisoners and others who may be affected by their undertakings in the event of a fire or other emergency. 3.5.2 Area Managers, Heads of Group and Governing Governors must ensure that staff, prisoners, visitors and others such as contractors are made aware of the procedures to be followed in the event of a fire or other emergency. 3.5.3 Area Managers, Heads of Groups (for buildings other than Cleland House and Abell House) and Governing Governors must ensure that testing of emergency equipment is carried out in accordance the Prison Service Fire Safety Manual. 3.6 Management of Legionella 3.6.1 Governing Governors must have in place a scheme for the effective management of the risks from Legionnella bacteria in water systems. 3.6.2 Governing Governors must ensure that a manager with sufficient authority and competence 1 is appointed to be managerially responsible for providing supervision for the implementation of precautions. 3.6.3 Governing Governors must ensure that a competent 2 member of staff is appointed to carry out the checks on hot and cold water systems as required by the Control of Substances Hazardous to Health Regulations 2002 as amended. 3.6.4 Area managers and Heads of groups must ensure that systems for managing legionella as described above are implemented in their area of control. 3.6.5 In Cleland and Abell House Amey are responsible for carrying out the risks assessments and monitoring of the water systems. 3.6.6 Further information on the management of legionella bacteria is available in PSO 5901, Technical Manual - Section 14, Water Management. 1. Competence for this role will be through successful completion of the Legionella Awareness for Managers Course which is run at Newbold Revel. 2. Competence for this role will be through the successful completion of the Legionella Identification and Treatment course which is run at Newbold Revel.

PSO 3801 Page 11 3.7 Training 3.7.1 Area Managers, Heads of Groups and Governing Governors must conduct a training needs analysis for their area of control to identify the health and safety training required by each member of staff to ensure that they are competent to carry out their role safely. Training identified by the training needs analysis must be carried out and refresher training given as required. All health and safety training must be recorded. 3.8 First Aid 3.8.1 Governing Governors must carry out an assessment to identify the number of first aiders required by their establishment and ensure that a sufficient number of trained first aiders are available at all times. This assessment must take account of holidays, sickness absence and the shift patterns operating in the establishment. 3.8.2 In Headquarters and other Prison Service buildings Area Managers and Heads of Groups are responsible for ensuring that a sufficient number of first aiders are appointed and trained. (Health and Safety Section in PMG will co-ordinate requirements for Cleland House and Abell House). Heads of Groups and Governing Governors must ensure sufficient first aid supplies are provided. 3.8.3 Further advice of first aid provision is given in IG 32/96 First Aid Arrangements. 3.9 Accident Investigating and Reporting 3.9.1 Governing Governors must have in place a system for the investigating and reporting of all accidents. For Headquarters, Health and Safety Section in PMG will implement an appropriate system. 3.9.2 Further advice on reporting accidents is given in PSI 11/2002 Accident Reporting. 3.10 Management of Contractors 3.8.1 Area Managers, Governing Governors and Heads of Groups must have in place procedures for managing contractors to that they carry out their work in a safe manner. 3.11 Radon 222 Gas 3.11.1 Governors must ensure that for prisons in radon affected areas and for all occupied workplaces below ground surveys for radon 222 gas are carried out and where required actions are taken to reduce the levels as far as is reasonably practicable. 3.11.2 Advice and information on radon gas is given in Guidance Note 01/2007, Radon 222 Gas. 3.12 Cleaning 3.12.1 Governors must have arrangements in place for adequate, safe cleaning in prisons. Arrangements must include training for staff who routinely supervise cleaners and prisoners who carry out cleaning to the BICSc standard. PSO 3801 Page 12 3.12.3 The British Institute of Cleaning Science (BICSc) standard is the training standard which must be used for training cleaning supervisory staff and prisoners who carry out cleaning. 3.12.4 Further Guidance on cleaning and the BICSc standard can be found in Guidance Note 02/2007, Cleaning in Prisons. 3.13 Monitoring Performance 3.13.1 Area Managers, Heads of Group (other than for staff in Cleland House and Abell House) and Governing Governors must put procedures in place to monitor the health and safety performance of the establishment or other area of control. They must also ensure that regular safety inspections are carried out. Trades Union appointed safety representatives must be invited to take part in safety inspections. 3.13.2 The local Health and Safety Committee is responsible for ensuring the quality and frequency of local safety inspections and for identifying remedial action which may need to be carried out following an inspection. 3.14 Performance Review 3.14.1 Governing Governors are responsible for carrying out an annual review of the health and safety performance in their area of control. This should be discussed by the local Health and Safety Committee. For Headquarters, this will be undertaken by the Health and Safety Section in PMG. 3.15 Audits 3.15.1 A formal audit of the systems in place to manage health and safety is carried out biennially at each establishment by the Home Office Health and Safety Advisors. 3.15.2 Governing Governors are responsible for ensuring that any recommendations made as a result of a health and safety audit are completed in a timely manner. 3.16 Guidance 3.16.1 A number of PSOs, PSIs and IGs which give guidance on health and safety matters have already been issued. A list of these is given at Annex 3. 3.16.2 In the future, Health and Safety Guidance documents will be issued to underpin this PSO. These will be issued instead of PSOs or PSI and will set out advice on the actions that Area Managers, Governing Governors and Heads of Groups need to follow to ensure compliance with the requirements of this policy and relevant legislation. PSO 3801 Page 13 THE PRISON SERVICE HEALTH AND SAFETY POLICY STATEMENT AND ORGANISATIONAL CHART INTRODUCTION Annex 1 Legal Duty The Prison Service recognises the need to implement organisational health and safety policies and procedures utilizing a risk assessment process which combines prevention and management programmes focused on both the work environment and the individual in keeping with the Health and Safety at Work Act 1974 and other statutory provisions. The Service recognises and accepts its responsibility as an employer for ensuring as far as is reasonably practicable a safe and healthy workplace for all its employees and others who may be affected by its undertakings, such as prisoners, visitors and contractors. Duties of the Employer Responsibility for ensuring a safe and healthy workplace rests with the Director General. This responsibility is exercised through the management line. All line managers and employees are responsible for discharging their responsibilities and duties under Health and Safety legislation and statutory provision. The Prison Service Health and Safety Organisation chart is attached. STATEMENT OF INTENT In support of this Policy the Prison Service will: Implementation Provide and maintain safe and healthy working conditions, equipment and systems of work for all employees; Ensure full compliance with relevant health and safety legislation; Provide employees with the information, instruction, training and supervision that they require to perform their work safely and efficiently; Carry out risk assessments and implement effective control measures; Provide a mechanism for regular monitoring, auditing and reviewing of performance; Consult and involve employees and their representatives on health and safety matters; Implement arrangements for the use, handling, storage and transport of articles; Provide effective communication to all employees on health and safety matters; Include health and safety in the Annual Report. TO ENSURE THIS POLICY IS EFFECTIVE Duty of Employees The Prison service will: Bring this policy statement to the attention of all employees and consult on its implementation; Promote the principle that operational responsibility for safety lies with management and each individual employee; Consult with and involve employees and their representatives on

PSO 3801 Page 14 health and safety matters; Review the policy document annually, or when significant business changes occur and bring such changes to the attention of all employees. DUTIES OF EMPLOYEES The implementation of this policy requires the participation of all employees in working safely and taking reasonable responsibility for themselves and others who may be affected by their acts or omissions. In particular, employees have a duty to co-operate in the operation of this policy in that they will: Take reasonable care of their own safety; Take reasonable care of the safety of others who may be affected by their acts or omissions; Co-operate with others in enabling the organisation to meet its statutory duties; Not interfere with, misuse or wilfully damage anything provided in the interests of health and safety. In addition to this the Director of Personnel acts as the focal point within PSMB for; The provision of strategic advice to the PSMB; Monitoring and reporting of progress to the PSMB and the Director general. AREA MANAGERS, HEADS OF GROUPS Area Managers and Heads of Groups are responsible for ensuring that robust systems are in place in their establishments/groups for the implementation, monitoring, resourcing and auditing of health and safety in their area of control. GOVERNORS UNIT/FUNCTION HEADS Governors and Unit/Function Heads are responsible for ensuring that effective measures are in place for managing the risks to which staff and others are exposed. HEALTH AND SAFETY SECTION (HASS) Advising the Board on health and safety issues: Developing Prison Service H&S policy. Providing strategic advice to area managers, governors, managers and local advisors on H&S issues. Maintaining accident data base and compiling statistics And through the Home Office advisors: Providing advice and support on H&S matters in prisons. Carrying out specialist investigations such as noise, dust monitoring. Auditing H&S systems. Delivering training.
