CE SESSION #4 Avoiding the Bermuda Triangle: Compliance With the AKS, CMP and FCA Laws and Tips for a Successful Compliance Program Presenter(s): Michael Bittman, Partner, Co-Chair of the Health Law Practice Group, Broad and Cassel LLP Speaker Bio: Mike Bittman is board-certified as a specialist in Health Law and has extensive experience representing clients in the health care profession, including hospitals, nursing homes, managed care companies, pharmacies, medical equipment suppliers, home health agencies and physicians. He has been lead trial counsel in a number of federal, state and administrative health law cases and represents clients in health care fraud investigations, qui tam or whistle blower cases, contract disputes, health insurance claims, malpractice and medical staff disputes. He has also handled fraud and reimbursement cases involving millions of dollars in Medicare and Medicaid funds. Bittman is well-versed in federal and state fraud and abuse laws and his knowledge and experience are invaluable to clients, who receive advice and recommendations regarding their compliance and risk reduction. Prior to joining Adventist Health Care, she held a variety of compliance roles with Kindred Healthcare. Kellie is certified in Healthcare Compliance, is a licensed Speech-Language Pathologist, and holds a Certificate of Competence from the American Speech- Language and Hearing Association.

He is also Certified in Health Care Compliance (CHC) by the Health Care Compliance Association (HCCA). Imperato has extensive criminal, civil and appellate trial experience in administrative, state and federal courts and has personally handled leading national cases concerning criminal and civil health care fraud and abuse and health care law and policy. He has served as Deputy Chief Counsel, Office of the General Counsel, United States Department of Health and Human Services, Dallas, Texas. He advised and represented various agencies of the Department of Health and Human Services, including the Center for Medicare and Medicaid Services, the Public Health Service, the Social Security Administration and the Office of the Inspector General. CE SESSION #10 How Do I Run My Building With All These Changes? Presenter(s): David Gifford, Senior Vice President, Quality and Regulatory Affairs, American Health Care Association Speaker Bio: David Gifford, MD, MPH, is the Senior Vice President of Quality and Regulatory Affairs at the American Health Care Association, the largest association in the country representing long term and post-acute care facilities. He helped create the department which assists providers in their quality improvement efforts and works with Administration officials on regulations and policies impacting the profession. Dr. Gifford also serves on the Board of the Advancing Excellence in America s Nursing Homes campaign and the Baldrige Foundation Board. He is a former Director of the Rhode Island State Department of Health, where he received the National Governor s award for Distinguished Service Award for State Officials and was a semi-finalist for the Harvard Kennedy School of Government Innovations in Government award for work on the nursing home survey process. Prior to that he served as Chief Medical Officer for Quality Partners of Rhode Island where he directed CMS national nursing home-based quality improvement effort. He received his medical degree from Case Western Reserve University and conducted his geriatric fellowship at UCLA where he also earned his Master s in Public Health in Epidemiology.

CE SESSION #16 Guardians, POAs and Health Care Surrogates: Know the Difference Presenter(s): Shawn Harrison, Owner, Shawn Harrison Associates, PLLC Speaker Bio: Shawn Harrison has practiced commercial litigation representing long term care centers for 27 years. He has lectured extensively on the topics of collections and Guardianship at FHCA and AHCA conferences. He currently represents several hundred FHCA member centers. CE SESSION #27 Good Grievance Program Results in Less Lawsuits Presenter(s): Benjamin Broadwater, Attorney, Fudge Broadwater, P.A. Speaker Bio: Ben Broadwater is an AV rated attorney with extensive experience representing long term care facilities, assisted living facilities, health care professionals and clients involved in business litigation. He has successfully handled numerous cases from pre-suit investigations through litigation, mediation, arbitration, jury trials and appeal. He has also represented professionals in administrative actions before state and federal licensing boards. He has assisted his clients in developing best practices to mitigate risks and avoid exposure to litigation. He has represented corporate clients in commercial litigation, advised corporations on regulatory compliance matters and complex international transactions. Ben is licensed in Florida and Alabama and has represented clients in those jurisdictions as well as others across the nation. His areas of practice have also included professional liability, general casualty, property claims, workers' compensation, employment and avitation. He is a graduate of Auburn University (1986) and Widener University School of law (1994).

CE SESSION #27 Good Grievance Program Results in Less Lawsuits Presenter(s): Deborah Franklin, Senior Director of Quality Affairs, FHCA Speaker Bio: Deborah Franklin is the Senior Director of Quality Affairs for Florida Health Care Association (FHCA). She is responsible for leading the Association's internal quality department while pioneering initiatives on quality improvement in long term care. Previously Deborah has served as Director of Operations for the not-for-profit Florida Living Options, which operates the Hawthorne Villages in Florida. She has successful experience with organizational leadership and health care management, opening and managing new facilities and turning around troubled facilities. Deborah Franklin is a past president of FHCA, a Walter M. Johnson, Jr. Circle of Excellence Award an Arthur H. Harris Government Services Award recipient and a graduate of the American Health Care Association Future Leaders of Long Term Care in America program. She has served on the Governor's transition team for the Florida Department of Elder Affairs, the Lt. Governor's Health Care Planning Council and the Hillsborough County Indigent Health Care Advisory Council. CE SESSION #33 Calmer Seas: Labor and Employment Law Update 2018 Presenter(s): Torben Madson, Partner, Miller Tack & Madson Speaker Bio: Torben Madson is a third generation Floridian and former prosecutor who for the last 26 years has focused primarily on Administrative Law to include Workers Compensation, Insurance and Regulatory matters on behalf of businesses. He is widely considered to be the world s worst fisherman and a horrific golfer and thus remains happily married. CE SESSION #33 Calmer Seas: Labor and Employment Law Update 2018 Presenter(s): Michael Miller, Senior Partner, Miller Tack & Madson Speaker Bio: Michael has been Labor Counsel to Florida Health Care Association since 1985, and during this entire period he has provided ongoing advice and counsel to members. Mike is rated "AV" by Martindale Hubbell, the national lawyers rating service, which is the highest rating a lawyer can receive.

CE SESSION #33 Calmer Seas: Labor and Employment Law Update 2018 Presenter(s): Timothy Tack, Partner, Miller Tack & Madson Speaker Bio: Timothy Tack has been representing employers, including health care facilities, in Florida for more than 20 years. He is boardcertified by the Florida Bar in Labor and Employment Law. When not fending off shark attacks from those who claim to be pursuing justice, Tack spends his time pursuing craft beer and elusive ancestors. CE SESSION #33 Calmer Seas: Labor and Employment Law Update 2018 Presenter(s): Sharon Wey, Attorney, Miller Tack & Madson Speaker Bio: Sharon Wey is an attorney in the law firm of Miller Tack & Madson. She has represented numerous health care centers in EEO matters, and regularly counsels health care centers, and provides training in labor and employment matters. Ms. Wey's educational background is in the field of human resource management. CE SESSION #39 Update on Regulatory Matters Presenter(s): Karen Goldsmith, Partner, Goldsmith & Grout, P.A. Speaker Bio: Karen Goldsmith currently serves as FHCA's Regulatory Counsel and previously served as the association's General Counsel since 1980. She is on the American Health Care Association's Legal Subcommittee and served as its Chair for three years. She is active in the American Health Lawyers Association and served as Chair of their long term care subgroup for two years. She has been published in several books produced by AHLA. She practices primarily in long term care.

CE SESSION #44 The New Survey Process, Phase Three of the Requirements of Participation and CMS Updates Presenter(s): Holly Harmon, Senior Director, Clinical Services, American Health Care Association Speaker Bio: Holly Harmon, RN, MBA, LNHA, FACHCA brings both passion and a wealth of practical, real-world, clinical and operational experience to her role as Associate Vice President, Quality & Clinical Affairs at AHCA. Her extensive service in a wide array of settings including post-acute care, long term care, residential care, assisted living, independent living, a psychiatric hospital and occupational health have provided her with insights, knowledge, skills and innovative ideas which she exuberantly shares with others. In addition to her vast clinical experience, Ms. Harmon has put her dynamic energy into leading the statewide Maine Culture Change Coalition/LANE as President, the Maine Partnership to Improve Dementia Care in Nursing Homes as Co-Chair, Vice-President of American College of Health Care Administrators, Maine Chapter and the Maine LANE Co-Convener for the national Advancing Excellence in America s Nursing Homes Campaign. She also served as the Director of Quality Improvement & Regulatory Affairs at the Maine Health Care Association. She puts her boundless energy and warm and energetic personality into training, education and presenting both, nationally and locally. She has made simplifying the complex world of long term and post-acute care policy and practice an art. CE SESSION #49 Silver Collar Crime: Florida Guardianship System Presenter(s): Honorable Sharon R. Bock, Esq., Clerk and Comptroller, Palm Beach County Speaker Bio: Sharon Bock was first elected in November 2004. She serves a local population of more than 1.3 million citizens as the County s Chief Financial Officer, Treasurer and Auditor, Clerk of the Circuit Court, County Recorder and Clerk of the Board of County Commissioners. Clerk Bock continues to advocate for the elderly population, is constantly evaluating new methods to improve and build on all Clerks fiduciary duties and responsibilities as it pertains to guardianship.

CE SESSION #49 Silver Collar Crime: Florida Guardianship System Presenter(s): Anthony Palmieri, Deputy Inspector General and Chief Guardianship Investigator, Palm Beach County Speaker Bio: Anthony Palmieri is a nationally recognized expert on guardianship's. He was an invited delegate to the White House Conference on Aging, a board member for National Guardianship Association and Florida State Guardianship Association; and he was recently appointed to a work group by the Chief Justice of the Florida Supreme Court. CE SESSION #52 Facility Assessment: Requirements and Uses Presenter(s): Carol Maher, Director of Education, Hansen Hunter & Co. Speaker Bio: Carol Maher is a Board Certified Gerontological Registered Nurse with over 30 years long term care experience and has worked in long term care in many roles. Beginning as a nursing assistant, she later became a charge nurse, Nurse Manager and then RNAC. Most recently she was the Senior VP of Utilization Services and Director of Reimbursement for large multi-center organizations. She has worked as one of the Gold Standard nurses for MDS 3.0, serving on the RAP workgroup to prepare the way for the CAAs for MDS 3.0, and participating on a number of Technical Expert Panels related to MDS, Quality Measures and care planning. A sought after speaker, she has given presentations at AANAC, AHCA and Leading Age national conferences as well as many state organization presentations. She is also a frequent author of articles related to the RAI process and PPS. Carol served as a member of the AANAC Board of Directors for nine years. She is presently serving on the AANAC Expert Advisory Panel and as an AANAC Master Teacher. Ms. Maher is the Director of Education for Hansen Hunter & Co. providing MDS and Medicare classes across the country, presenting monthly educational webinars and completing compliance audits. She is the author of Long-Term Care MDS Coordinator s Field Guide (HCPRO 2016).

CE SESSION #55 Medicaid Managed Care: AHCA Bid Results and Contracting Strategies Presenter(s): Frank Rainer, Counsel, Broad and Cassel, LLP Speaker Bio: Frank Rainer has been a practicing lawyer in the long term care profession for over 30 years. He has essentially addressed and is familiar with virtually all topics concerning long term care legal issues. Over the past 20 years, he has become intimately familiar with all managed care contracting issues for long term care centers. He has masters degrees in business, insurance, and taxation.
