Transnational Territorial Cooperation Programme MED Call for proposals 2009 Procedures to respect for the submission of the final application file approved by the Monitoring Committee on December 19 th 2008 IMPORTANT NOTICE: the non-respect of the procedures stated hereafter will entail the non admissibility of your pre-application. I. Context European territorial cooperation programme 2007-2013 with a budget of 256 617 688 co-financed by the ERDF, the involves the Mediterranean and coastal regions of nine EU Member States (Cyprus, Spain, France, Greece, Italy, Malta, Portugal, UK, and Slovenia) as well as three Mediterranean countries that are candidates or potential candidates to the EU: Bosnia-Herzegovina, Croatia and Montenegro). The budget for each participating IPA country comes from IPA (Instrument of Pre-Accession) funds. The main objectives of the Programme are: - Improving the competitiveness of the cooperation space while guaranteeing growth and employment for the future generations - Promoting territorial cohesion and protecting environment in coherence with sustainable development The finances transnational cooperation projects. Following the decision of the Monitoring Committee approved during the meeting of the 15 th October 2008, the call for proposals for the year 2009 will be opened between the 16th February 2009 and the 13th March 2009. II. Documents of reference Before any submission of project, it is fundamental to refer to the Commission Regulations, in particular EC 1080/2006, EC 1083/2006, EC 1828/2006, EC 1085/2006 and EC 718/2007, as well as to the framework documents of the Programme (Operational Programme, Implementation Guide and Evaluation Chart) These documents can be consulted and downloaded on the programme Website at the following address: www.programmemed.eu III. Two step procedure The call for proposals is a two-step procedure: the first part being a pre-application process, open to all typologies of beneficiaries described in the implementation guide; followed by the full proposal which is reserved for selected pre-candidates. Selected pre-candidates will have three months to submit a full application form, which will be then assessed in order to select the projects to be financed by the. Each candidate will be officially informed by the Managing Authority about the result of its pre-application. The two-step procedure forms one unique call for proposal. 1/8

IV. Priority Axes and targeted objectives This Call for proposals welcomes the Classic Projects and is open to all priority axes and objectives of the Operational Programme. V. Eligible beneficiaries All eligible beneficiaries, as defined by the, can participate in this call. Nevertheless, only beneficiaries from the EU can benefit from ERDF funding. Beneficiaries from eligible candidate and potential candidate countries (Bosnia-Herzegovina, Croatia and Montenegro) participate with IPA funding. VI. Budget available (ERDF and IPA) The global budget allocated for this second call is around 53 000 000.00. The Selection Committee reserves the right to not allocate the total budget, should the project quality criteria defined by the Programme not be met. The maximum amount of Community contribution for the participation of Croatia in this call with the 2007 funds of the IPA cross-border co-operation component, shall be EUR 53 020 as approved by Commission Decision C(2007) 6121 of 12 December 2007. The indicative amount, through the 2008 IPA funds, for the participation of Croatia is EUR 106 080. The maximum amount of Community contribution for the participation of Montenegro in this call with the 2007 funds of the IPA cross-border co-operation component, shall be 200 000 as approved by Commission Decision C(2007)6429 of 20 December 2007. The indicative amount, through the 2008 IPA funds for the participation of Montenegro, is EUR 200 000. The maximum amount of Community contribution for the participation of Bosnia and Herzegovina in this call with the 2008 funds of the IPA cross-border co-operation component will be EUR 100 000 as approved by Commission Decision C(2008)5609 of 7 October 2008. Information concerning IPA countries only: The conclusion of the grant agreements for Croatia resulting from this call for proposal is subject to the fulfilment of the following events: The adoption by the Commission of a decision conferring to the national authorities of Croatia management powers to implement funds under the "Cross-border cooperation component" of the Instrument for Pre-accession Assistance (Council Regulation (EC) No 1085/2006 of 17 July 2006); The conclusion between the Commission and Croatia of a Financing Agreement implementing the "Programme on financing the participation of Croatia in the ERDF European Territorial Co operation transnational programmes "South East Europe" and "Mediterranean" under the IPA Cross border Co operation component, for the year 2007". The conclusion of the grant agreements for Montenegro is feasible from this call for proposal since the conclusion between the Commission and Montenegro of a Financing Agreement implementing the "Programme on financing the participation of Montenegro in the ERDF European Territorial Co-operation transnational programmes "South- East Europe" and "Mediterranean" under the IPA cross-border co-operation component, for the year 2007" was concluded on 27 March 2008. The conclusion of the grant agreements for Bosnia and Herzegovina resulting from this call for the proposal is subject to the fulfilment of the following event: The conclusion between the Commission and Bosnia and Herzegovina of a Financing Agreement implementing the Programme on financing the participation of Bosnia and Herzegovina in the ERDF European Territorial Cooperation transnational programmes South-East European Space and Mediterranean Space under the IPA Cross-border Co-operation component, for the Year 2008. The conclusion of the grant agreements for Bosnia and Herzegovina, Croatia and Montenegro resulting from this call is subject to the EC delegation ex ante approval of the evaluation report and the list of joint operations selection for financing. 2/8

VII. Contents of proposals The pre-proposal (hard copy) has to contain the following elements: - The project pre-application form - Letters of intent from all participating partners with the annex named pedagogic file filled in by each partner - Questionnaire State aid and/or de minimis declaration from each partner IMPORTANT for letters of intent > scans, photocopies, faxes will be accepted at the condition that for the final candidature (2 nd phase), each project (partnership) is able to present the original copies of the letters of intent submitted at the time of the 1st phase (pre application). These original copies will have to be identical to the copies of letters (scans, faxes and photocopies) and will have to arrive at the MED JTS within 15 business days of their request sent by e-mail on behalf of the MED Management Authority. The list of the documents to be used and to be taken into account for presenting a pre-proposal is available on the Website: http://www.programmemed.eu/ VIII. Modalities for submission The pre-application (1 st step of the procedure) has to be sent to the Joint Technical Secretariat (JTS) between the 16 February and the 13 March 2009. The interested partnerships have to fill in and to submit the pre-application online, using the monitoring system of the : http://med.presage-cte.org Should any technical problem occur, the Joint Technical Secretariat (JTS) must be contacted immediately We remind you that, to be valid, the submission of the pre-application must be submitted through PRESAGE CTE, but must also be sent by regular mail and by e-mail. These three parallel forms of submission must be achieved by March the 13, 2009 midnight (France local time). All 3 submitted versions of the application form of the pre-application must be identical to the form validated on PRESAGE CTE (with the mention submitted version ). Detailed modalities of submission: I/ Submission and validation of the final pre-application on the Monitoring System PRESAGE CTE The pre-application must be submitted and validated in the Monitoring System of the PRESAGE CTE (available at the following address: https://med.presage-cte.org) before midnight on March 13 th 2009 (France local time). Once the pre-application is entirely filled, the submission will only be effective after having pressed the validation button (a confirmation e-mail is automatically sent by the system when the validation has been performed correctly). Should you encounter any problem in filling or validating the pre-application form in PRESAGE CTE, it is imperative to contact the JTS. Any candidature not validated definitively on PRESAGE CTE (in respect of the expected coherence checks) will not be accepted. II/ Sending by post of the paper version of the final application file (.PDF format) A paper version of the pre-application signed in original (no scan, stamp or electronic signature) by the representative of the Lead Partner (a printed.pdf version of the pre-application validated on Presage CTE), all Intent letters (of the Lead Partners and of each partner), original copies or copies (fax, scans, photocopies under the conditions written above); with the annex pedagogic file as well as the questionnaire State aid and/or de minimis declaration ; must be sent before midnight on March 13th 2009 (France local time), postal stamp as 3/8

proof, by post, registered letter or carrier (DHL, UPS, etc.), to the postal address of the JTS only: Secrétariat Technique Conjoint MED (STC / JTS MED) Région Provence-Alpes-Côte d'azur 27, Place Jules Guesde 13481 MARSEILLE Cedex 20 France Attention: only the date on the official mailed envelope can be taken into account (postal stamp), no other receipt will be valid (receipt of deposit of the envelope of a dispatch rider for example). All the above elements (pre-application, Intent letters with annex, questionnaire State aid and/or de minimis declaration) must be sent to the JTS in one single envelope. The envelope must bear the mention Call for proposal MED, the name and the acronym of the project, the name of the Lead Partner and the number of the priority axis and objective targeted. Concerning the paper version of the pre-application file (.PDF format) The.PDF version of the validated pre-application must bear the mention «submitted version» printed on every page. If it is not the case, be careful, because this means that you did not correctly validate your pre- application form on PRESAGE CTE. The paper version must be dated and signed in original handwriting by the Lead Partner in the space provided (point 2. Official signatures of the application form) with the official stamp of the structure/organisation/ institution of the Lead Partner. The paper version of the signed pre-application must be in the working language chosen for the project (English or French), including the summary, where indicated, in the second language. The sending of this version signed in the language chosen for the project is sufficient, it is not necessary to send to the JTS the version in the second language. Concerning the letters of intent The postal sending of the paper version of the pre-application must include the originals copies of all the Intent letters (of the Lead partner and of each partner) or failing this, it must include the copies (scans, photocopies, fax) are accepted under the conditions written above: the originals copies (identical to these supplied copies) will be requested from the projects selected for the second phase. You must use the standard documents provided by the Programme (published on the Programme Website: www.programmemed.eu). No other type of document and no modification to the standard document provided will be accepted. The amounts indicated in the Intent letters must be identical to the amounts filled in the co-financing spreadsheet of the pre-application form («total per partner and co-financing amount per partner»): total national co-financing. III/ Sending by e-mail of the electronic version (PDF Format) of pre application file validated on PRESAGE CTE A copy of the pre-application file (.PDF version of the pre-application submitted and validated in PRESAGE CTE) as well as Intent letters, scanned with their annex pedagogic file must be sent before midnight on March 13th 2009 (France local time) to the JTS at the following address: stc-med@regionpaca.fr For technical reasons linked to the electronic mailbox, scans of the Intent letters can be sent using one or more separated and numbered e-mails (the MED JTS mail box accept a maximum of 6 Mega per e-mail). You are not asked to transmit by e-mail the questionnaires State aid and/or the declarations of minimis. IV/ General terms Generally speaking, we kindly remind you that it is essential to also consult the documents of reference of the Programme (Operational programme, Implementation guide) when preparing your project. However, we would like to insist on the following items: 4/8

- For the pre-application, all accessible sections provided in PRESAGE CTE must be filed in. - Translation of the sections «short description and summary» in the other programme language than the one chosen by the project is mandatory. You must pay particular attention concerning the quality of this translation. The latter must be clear and comprehensible. - The financial section (budget) of the pre-application must be coherent with the budgetary elements of the financial plan. PRESAGE CTE will perform coherence checks and will prevent application from any validation if incoherencies occur. - The ERDF co financing rates for each country of the Programme must be observed. - The postal and e-mail addresses of the JTS must be scrupulously observed for the sending of the.pdf paper version and electronic version of the pre-application. If the JTS does not receive them, you will need to produce proof of the correct sending within the deadlines (postal or electronic mail acknowledgement of receipt ). - For the signature of the hard/paper copy of the pre-application: scanned, photocopied or electronic signatures will be refused - Once you validate your final application form, you cannot modify it anymore. We invite you to fill in your pre-application in PRESAGE CTE as early as possible. You can fill in the different sections as you progress in the preparation of the application file and modify them after if needed (before the final validation of course). You can also launch the coherence checks throughout the drafting and before the final validation. Do not hesitate to contact the JTS for any further information. IX. Selection criteria See the eligibility and evaluation grid MED, included in the Application pack. More information is available in the Implementation Guide published on the Website: http://www.programmemed.eu X. Procedure for complaints Any complaint following the communication of the results of the instruction and the decision by the MED Selection Committee will have to be done in writing (by e-mail, fax or regular mail) and submitted to the MED JTS. The aforementioned complaint will imperatively have to arrive from the Lead Partner to the JTS within 20 business days, starting from the notification, sent by the JTS by e-mail, of the official results of the selection.
