We appreciate your leadership in introducing S. 1908 to streamline the Internal Revenue Service (IRS) reporting process under the Affordable Care Act (ACA). S. 1908 is an important first step in providing individuals, employers, insurance carriers, states and the federal government with more clarity about who may be eligible for premium tax credits and streamlining the costly and complex compliance burden. Under the ACA s reporting requirements (Code sections 6055 and 6056), employers and insurance carriers are required to report numerous data points annually to the IRS and individuals. This data is used to verify compliance with the individual and employer mandates and administer tax credits and cost sharing subsidies under the state and federal insurance Exchanges. Unfortunately, the information currently required is unnecessarily complex for employers and individuals and must be reported to the IRS at the end of a calendar year, not during the Exchange enrollment process when it could provide more clarity on which individuals are eligible for tax credits. The voluntary prospective reporting system created under S. 1908 would make important data available during the Exchange enrollment process, rather than after a coverage year has ended, and streamlines the reporting requirements for employers and insurers. Additionally, S. 1908 protects the privacy of individuals Social Security numbers, authorizes the electronic transmission of reporting information, and establishes oversight of reporting verification. These are commonsense changes that help individuals, employers and insurers. Again, thank you for your leadership on this critical issue. The Commonsense Reporting Act provides individual consumers with much-needed safety nets, employers with relief from the burdensome reporting requirements, and Exchanges with an additional tool to verify tax credit and subsidy eligibility. We look forward to working with you and your colleagues in a bipartisan manner to enact S. 1908.
