Important Ordinances Concerned with Health and Safety Factories and Industrial Undertakings Ordinance, Chapter 59 ( 工廠及工業經營條例 - 香港法例第 59 章 ) Occupational Safety and Health Ordinance, Chapter 509 ( 職業安全及健康條例 - 香港法例第 509 章 ) 4

Factories and Industrial Undertakings Ordinance, Chapter 59 The Coverage This ordinance applies to industrial undertakings, i.e. factories, construction sites, catering establishments, cargo and container handling undertakings, repair workshops and other industrial workplaces. 5

Occupational Safety and Health Ordinance, Chapter 509 The Coverage This ordinance covers almost all workplaces - places where employees work. In addition to factories, construction sites and catering establishments, other places, such as offices, laboratories, shopping arcades, educational institutions also come under the ambit of the law. 6

General Duties of a Proprietor Every proprietor of an industrial undertaking should take care of the safety and health at work of all persons employed by him at an industrial undertaking by: 1) Providing and maintaining of plant and systems of work that are, so far as is reasonably practicable, safe and without risks to health; 2) Arrangements for ensuring, so far as is reasonably practicable, safety and absence of risks to health in connection with the use, handling, storage and transport of articles and substances; 7

General Duties of a Proprietor 3) Providing of such information, instruction, training, and supervision as necessary to ensure, so far as is reasonably practicable, the health and safety at work of all persons employed by him at the industrial undertaking; 4) Providing and maintaining of means of access to and egress from it that are safe and without such risk; 5) Providing and maintaining of a working environment for all persons employed by him at the industrial undertaking that is, so far as is reasonably practicable, safe and without risks to health. 8

General Duties of Persons Employed Every person employed at an industrial undertaking should also contribute to safety and health at work by: 1) Taking care for the safety and health of himself and other persons at the workplace; 2) Using any equipment or following any system or work practices provided by the proprietor. 9

Safety Duties of Front-line Site Staff Purpose Management of site safety and health matters. Providing of information, instruction, training and supervision so as to ensure all workers in compliance with the safety rules and working procedures. All front-line site staff to comply with the safety system and practices. Target Prevent any accidents and incidents. Success 成功 Purpose 目的 Target 目標 10

Front-line Site Management Staff Front-line site management staff Important members of safety organization. Failure to execute their duties Failure of the safety management policy. Past Records: Insufficient supervision One of the major reasons of accidents and incidents. 12

The Ways for Front-line Site Staff to Learn and Handle Matters Through Influence, Excitation and Supervision To achieve the capability of ideal target. Change from guarding workers to coaching and mentoring. Change from inspection to learning opportunity of a team Team building and reward these improved in of health and safety matters. Obtain trust and respect from workers. Allow workers to know the future situation. Form network with other front-line site management staff. Assist the management to create safety culture. 13

Conclusions Though there are no statutory definitions and duties of front-line site management staff, they are important to ensure safety and health on site. Front-line site management staff should Ensure the safety of works on site; Explain to workers about the importance of safety; Reward workers with good safety behaviour; Set good examples with their own conduct; Promote safety hazard identification; Assist to create safety culture. 14

Conclusions To effectively perform the above duties, the front-line site management staff should Have the opportunities to learn and develop their leadership. Have the supports from the employer or top management. 15

Outline for Pay for Safety and Environment Bills for safety and environment are normally included in all government contracts and specific contracts for construction, foundation, demolition and civil engineering works etc. The requirements of these bills are to cause the contractor to include certain amount in the contract price for the payments of the items for safety and environmental matters. 17
