MONTHLY PROGRESS REPORT NO. 5 BROOKE COUNTY ACCESS PIPELINE By letter order dated October 27, 2017 Brooke County Access I, L.L.C. (BCAI) was granted approval by the Federal Energy Regulatory Commission (Commission) to utilize the Commission s Pre-Filing Review Process for the Brooke County Access Pipeline Project (Project) with facilities located in Washington County, Pennsylvania and Brooke County, West Virginia. The Project has been assigned This Monthly Progress Report provides a brief summary of the current Project status and describes activities or changes that have occurred between March 1 and March 31, 2018 ROUTE ACQUISITION Survey permission has been obtained for 100% of the route alignment as of December 31, 2017. Option agreements have been negotiated with 30 (79%) of the 38 landowners covering the Project route and aboveground facilities identified to date. The 29 landowners accepting agreements represent 37 of the 50 properties (77%) crossed by the Project route. The 37 properties currently under agreement represent approximately 11.6 miles of the 16- mile Project route. PROJECT FACILITIES BCAI continues to evaluate minor route adjustments and design modifications in response to landowner coordination and field survey results. BCAI has identified and is evaluating access roads, aboveground facilities and temporary construction workspaces locations. The public comment period for the FERC issued NOI to Prepare an EA ended on March 22, 2018. Several comments were received and BCAI will provide responses to FERC in April 2018. TECHNICAL AND ENVIRONMENTAL SURVEYS Route modifications are being evaluated to avoid or minimize environmental impacts based on the results of field surveys. Wetland and cultural field surveys were completed for 100% of the initial route alignment in November 2017. However, additional route modifications have been identified to avoid or minimize potential environmental impacts or avoid landowner conflicts. Wetland, Habitat and Cultural filed surveys for route modifications extending outside of the current survey corridor are anticipated to early April 2018. Based on consultation with the USFWS, field surveys to identify potential portal hibernacula for bats will be conducted in April 2018. Based on agency consultation to date, no additional species specific surveys are anticipated. ENVIRONMENTAL REPORT STATUS BCAI filed its pre-filing draft of Resource Reports 1 (Project Description) and 10 (Summary of Alternatives) on December 1, 2016 and received comments on those Resource Reports from FERC staff on January 3, 2018. During March BCAI continued revising draft Resource Reports 1 and 10 to address FERC staff s comments. Revised draft Resource Reports 1 and 10, along with all the remaining draft resource reports are anticipated to be filed in April 2018.
Brooke Country Access Pipeline FERC Pre-File Status Report: March 2018 STAKEHOLDER COMMUNICATIONS BCAI continues to work with affected landowners. No other stakeholder outreach was conducted in March 2018. FERC issued a Notice of Intent (NOI) to prepare and environmental assessment for the Project on February 20, 2018. The formal comment period on the NOI ended in March 22, 2018. The NOI encouraged public comment and identified three (3) methods for the public to submit comments: 1. Electronically using the ecomment feature on the Commission s website (www.ferc.gov). 2. Electronically by using the efiling feature on the Commission s website (www.ferc.gov). 3. Bose, Secretary Federal Energy Regulatory Commission 888 First Street NE, Room 1A Washington, DC 20426 AGENCY COORDINATION AND PERMITTING ISSUES BCAI is continuing its efforts to consult with federal, state, and local regulatory agencies to solicit input regarding aspects of the Project, as well as to coordinate the requirements for submission and review of permit and other applications and completion of consultation processes for the Project. Response to agency consultation requests have been received from: o USFWS o PA Fish and Boat Commission o PA Department of Conservation and Natural Resources o PA and WV SHPOs BCAI is coordinating with US Army Corps of Engineers, Pittsburgh District. The District has indicated that they do not think a Project specific pre-application meeting is required at this time SCHEDULE No changes to the scope of the Project have occurred since the Commission approved BCAI s request to initiate the pre-filing review process on October 27. 2017. BCAI is on schedule to submit prefiling review drafts of Resource Reports 1-12 on April 24, 2018 and file its certificate application in June 2018, to permit the Commission to complete its review pursuant to the schedule set forth in the pre-filing request. 2
