IN THE THIRD DISTRICT COURT - ALL DEPARTMENT IN AND FOR SALT LAKE COUNTY, STATE OF UTAH AFFIDAVIT FOR SEARCH WARRANT STATE OF UTAH ) :ss County of Salt Lake ) The undersigned affiant, Detective ANTHONY CLARK STOCKING of Utah Transit Authority Police, upon an oath or written affidavit subscribed under criminal penalty, declares: That your affiant has reason to believe: THAT On the premises known as 11760 U.S. Highway 1 suite 600, North Palm Beach, FL 33408, further described as doing business as an AT&T store located at 3758 West 7800 South, West Jordan Utah in the County of Salt Lake.; In the City of West Jordan, County of Salt Lake, State of Utah, there is now certain property or evidence described as: All customer/subscriber information for (801) 709-4474, including any listed addresses, telephone numbers, social security numbers, dates of birth, names, any other customer identifying information, mobile handset or device identifiers/serial numbers (MEID, ESN, IMSI, IMEI) activation date and deactivation date, if applicable. Call detail records for (801) 709-4474 from May 11, 2016 to present, including detailed information in reference to all known outgoing and incoming calls associated with the account, dates and times calls were made, and duration of all calls made or received. Text, SMS, MMS detail records for (801) 709-4474 from May 11, 2016 to present, including detailed information in reference to all known outgoing and incoming SMS and MMS associated with the account, dates and times messages were made. This is to include any other pertinent message detail records including special features codes, or any other codes that are maintained in the normal course of business for AT&T, of any AT&T cellular numbers identified in the course of the investigation. In the event the requested Call Detail Records contain other AT&T customer numbers, identified as either incoming or outgoing calls, AT&T will provide subscriber information to the specific numbers identified, if requested. Cell site information, to include all known cell towers associated with outgoing and incoming calls (Call Detail Records). This information is to include any sector information, if known, cell site location, and any other related material that would be necessary to identify the location and sector in reference to the cell site information associated with the call detail records. Cell Site locations for all AT&T Cell Sites, sector information, including Azimuth headings, in the regional market associated with the requested cell site information. and that said property or evidence: Was unlawfully acquired or is unlawfully possessed; has been used or is possessed for the purpose of being used to commit or conceal the commission of an offense; or is evidence of illegal conduct. Affiant believes the property and evidence described above is evidence of the crime or crimes of Aggravated Robbery, Kidnapping and Criminal Homicide.. The facts to establish the grounds for issuance of a Search Warrant are: Your Affiant is a Certified Peace Officer in the State of Utah, and has 24 years of law enforcement experience, which 15 years has been in investigations. Your Affiant has received training in numerous aspects of white collar crime involving wire fraud, mail fraud and identity theft. Your Affiant completed the HIDTA/DEA Drug Academy, which includes specialized training in drug identification and recognition. Your Affiant has also attended training courses to include Basic Undercover Operations, Marijuana grow operations, Managing Informants, Counter Surveillance Techniques, Gang Investigations, and Advanced Interview and Interrogation. update narcotics investigators on new trends being utilized by drug trafficking organizations. Your Affiant has been involved in numerous investigations involving computer related crimes, interstate fraud and money laundering, illegal gambling operations, drug trafficking and prostitution. Your Affiant has investigated numerous property theft crimes, some of which were in conjunction with the United States Postal Service, Federal Bureau of Investigations, and the Utah Identity Fraud Task Force. Your Affiant has extensive experience with confidential informants, surveillance techniques, making controlled purchases, interviewing suspects, and following up on intelligence reports from citizens. Your Affiant is currently assisting in the investigation of a possible homicide, wherein the victim was possibly abducted in the area of Salt Lake City Utah and transported out of state. The investigation started on May 12, 2016, wherein an employee of Utah Transit Authority did not report back to work after being in the field during his assigned working hours. During the search it was noted that the employee s company truck was never returned and was not located. Further investigation conducted by Your Affiant and assisting detectives found surveillance video of the employee s vehicle leaving the area of 971 South 200 West. A review of the video showed the victim s cell phone falling out of the window or bed of the work truck. The surveillance could not identify the occupants of the vehicle to determine whether the missing person was in the vehicle. The cell phone recovered in this case was confirmed to belong to the potential victim Kay Ricks, and confirmed with the assistance of his spouse. The cell phone was recovered a short distance from a UTA substation and turned into police by a citizen as suspected found property. The recovered cell phone was transferred to Your Affiant as possible recovered lost property initially. On May 17, 2016 Your Affiant learned the victim s vehicle a 2013 Ford truck belonging to Utah Transit Authority, was captured on a surveillance camera in Diamondville Wyoming, and sent to Your Affiants department for verification. Your Affiant was able to verify that the vehicle pictured on the surveillance video was the truck formally driven by the missing person, Kay Ricks. Your Affiant was advised that a person of interest was identified as driving the vehicle when it was recorded in a Maverick convenience store parking lot. Your Affiant responded to a Utah Transit Authority substation after assisting detectives discovered evidence linked to the missing person. Your Affiant discovered a partial piece of a cell phone case that matches the case that was recovered after the cell case was thrown from the window of the truck. that was recovered with the cell phone attached was 2 blocks to the south of the substation, and was recovered as the victim s vehicle travelled south on 200 west. On May 17, 2016 Your Affiant was informed that the victim in this case, Kay Ricks had been located in Wyoming and was deceased. The victim suffered unknown trauma that lead to his apparent murder. Your Affiant request that the full records related to the cell phone recovered be available to review to determine their relevance to the location of the victim at the time of the abduction. This affidavit has been reviewed by Vincent Meister of the SLCO District Attorney Office, and it has been approved for presentation to the court. WHEREFORE, your affiant prays that a Search Warrant be issued for the seizure of said items. I declare under criminal penalty of the State of Utah that the foregoing is true and correct.
