Official Rules of Hack.Bangalore 2018 Mercedes-Benz R&D India Pvt Ltd BY PARTICIPATING, YOU AGREE TO THESE OFFICIAL RULES. 1. Overview 1.1 Mercedes-Benz Research and Development India Pvt. Ltd. is the organizer of this Event (the Organizer ). 1.2 The Event (the Event or the Hackathon ) is designed for minimal viable product and ideas on the strategic fields, CASE, that will shape the future of mobility. 1.3 The Final Event will take place on 19 th Jan 2017 in Bangalore. For detailed information of venue and agenda please refer to the email sent and website. 1.4 The prize of this event is provided by organizer. 1.5 In these Official Rules, the terms we, us, or our refer to the Organizer, and the term you refers to you, the entrant, participant or applicant, both as an individual and as part of your team. 1.6 These rules were last updated on December 4 th, 2017 2. Eligibility 2.1 The Hackathon is open to registered participants over the age of 18 years perusing bachelors, masters or any equivalent course. 2.2 If you are an employee or student of an academic institution, you are responsible for ensuring that your participation in the Hackathon complies with all policies of your college, institution or university and may have regarding participation in contests of this type. We are not responsible for any disputes arising between you and your colleges/university. 3. Registration Requirements 3.1 Applicants can register for the event through the HackerEarth page and can also get additional information on our official website. 1
3.2 Applicants must provide and fill in correct information. After the registration, if any false information is found, the organizer reserves the right to disqualify the applicant. 3.3 Individuals are responsible to ensure the entries have not been shortlisted or awarded in any previous hackathon or such events. 4. Team Formation 4.1 We will select few teams from all the nominations received. Teams should comprise of a minimum of three person and a maximum of 5, including 1 leader. The team leader is responsible for team contact and representation. 4.2 You may not be part of more than one team. 4.3 Pick your team members carefully because after this point, you will not be allowed to switch teams, or add or remove team members. 4.4 We are not responsible for, and will not assist in resolving any disputes between team members. 5. Participant selection According to the pre-selection rules, we will start team pre-selection after the idea phase ends on 05Jan- 18. The results will be announced on the HackerEarth page and the shortlisted teams will be intimated by email. 5.1 The event organizer will arrange a panel of judges to select suitable candidates based on their submitted information. 6. Prizes 6.1 Winning teams will be awarded cash prizes. The prize money will be divided evenly among all team members. 6.2 If a judge or participant identifies to us a conflict of interest, that judge will be recused from judging the Entry with the conflict. An alternate judge will be identified as a substitution for the judge with the conflict. Entries may be subject to a due diligence review at any time for eligibility and compliance with these Official Rules. Determination of eligibility and compliance is at our sole discretion, and may result in your personal disqualification and/or the disqualification of your team s Entry, including subsequent disqualification and reclamation of any prizes awarded. Our decisions and those of the judges are final. 2
7. General Terms 7.1 By registering and participating in the Hackathon, you indicate your full and unconditional agreement to these Official Rules and other instructions related to the Hackathon, as well as to our decisions regarding the Hackathon, which are final and binding. Winning a prize is contingent upon fulfilling all requirements in these Official Rules. 7.2 We may modify any provision of these Official Rules, at any time, by informing participants on rules on our official website/emails. 7.3 Without limiting our rights and remedies, we reserve the right, in our sole discretion, to disqualify any individual or team who: a) Fails to comply with any provision of these Official Rules; b) Cheats or tampers with the operation of the Event, or otherwise acts in a disruptive or inappropriate manner; or c) Engages in conduct that is unlawful, offensive, or otherwise leads us to conclude, in our sole discretion, that public association with you could cause controversy or embarrassment to us or our partners. 7.4 In the event that the operation, security, administration of the Hackathon, or our judgment are impaired in any way, we may, in our sole discretion, without limitation: a) Suspend the Hackathon to address the impairment and then resume the Hackathon; b) Award the prize according to the criteria set forth above from among the eligible entries received up to the time of the impairment, c) Extend any deadlines, d) Take any other reasonable action as we deem necessary and appropriate to the circumstances, or e) End the Hackathon prematurely without awarding prizes. 7.5 By entering, you agree to release, defend organizers, subsidiaries affiliates, and each of their respective officers, directors, employees, and agents (the Released Parties ) from and against any claim or cause of action arising out of your culpable conduct in the course of the participation in the Hackathon, including, but not limited to: a) Your unauthorized human intervention in the Hackathon; b) Any claim or allegation that your participation in this Hackathon, or your Entry, was in violation of these Official Rules, or that your Entry infringes any copyright, trademark, or any other intellectual property right; c) Disputes between team members; d) Disputes between team members and their employers; 3
e) Claims relating to damage to persons or property relating in any way to your participation in the Hackathon. 8. Privacy and Publicity 8.1 Personal data you submit to us when you participate in the Hackathon will be treated in accordance with applicable data protection laws. Your personal data will be collected, processed and used by us, as the responsible entity (data controller), for the purpose of conducting the Hackathon. 8.2 You agree that after the Hackathon, you and/or your Entry may be publicized in advertisements related to the Hackathon. These advertisements may be distributed online and posted on our site or third party websites. You further agree that you may be filmed or photographed while you are participating in the Hackathon and that we may use your name, likeness, photographs, audio visual footage, comments, and any other record of your participation in the Hackathon for promotional purposes at any time and in any media without any compensation to you. 9. Health condition requirement Participants declare that they can participate and are in a healthy physical and psychological condition during the activity. The organizer is not liable for any personal injury which caused by individual physical and psychological condition during the activity. The organizer will provide each participant with commercial insurance as basic protection. 10. Venue property protection Participants should not destroy any property provided by organizer. The organizer reserves every legal enforcement rights to the behavior that caused property damage. 11. Compliance All participants consent that their behavior starting from registration until the end of event will be in compliance with all Indian laws and regulations. 12. Intellectual Property Rights In this Hackathon all intellectual property ideated, created, developed and presented shall stand assigned unconditionally, without any reward in favor of the organizers by virtue of the opportunity availed by the participant. Further to the forgoing: O Organizers shall have the freedom to use some or all of the results. 4
O If any other parties gain unauthorized access to your entry, we will not be held responsible. We expect that all submitted content is original and belongs to the participants. We will not be liable for any infringement related to the contestants using third party intellectual property and content. Participants declare their prototypes and ideas do not infringe any third party's intellectual property rights. Participants submitting content sharing intellectual property rights with a third party are obliged to get the consent of that third party. Organizers have the right to ask the contestants for evidence of the consent of third parties where required. O Although we retain the right, we shall have no obligation to use your entries, even for prizewinning works. O Nothing in these rules shall be interpreted as granting you permission to use or display any of Mercedes-Benz trademarks (including any logo or brand) or rights in any provided technologies or IP. You agree to inform us prior to promoting or publicizing your participation in/winning the Hackathon. ------- End of Document ------ 5
