(ACDBE and DBE) North Chesterfield, VA (For Possible Action) Ms. Munoz introduced this item and Amy Shaw presented the certification material. Creative Insurance Concepts, Inc. (CICI) provides risk management, insurance, bonding and document management services. On July 23, 2013, CICI was certified as a DBE by the Virginia Unified Certification Program. CICI has requested certification as a DBE and ACDBE based on opportunities to do business with several rental car agencies. Pursuant to 49 CFR 23.31 and the procedures and standards of 26.61-91, this application is processed as an interstate certification pursuant 49 CFR 26.85. July 29, 2014 Meeting Minutes Page 2 of 6

Meg Blonde Ale Holdings, LLC (ACDBE) Los Angeles, CA (For Possible Action) Ms. Munoz introduced this item and Amy Shaw presented the certification material. Meg Blonde Air Holdings, LLC (MBAH) sells locally-made artisan products, specifically Golden Road Brewing products. MBAH was certified as an ACDBE by the California Unified Certification Program on April 3, 2014. Pursuant to 49 CFR 23.31 and the procedures and standards of 26.61-91, this application is processed as an interstate certification pursuant 49 CFR 26.85. NDOT expressed concerns regarding the connection between the applicant and Golden Road Brewing: The owner is the founder and president and still works for Golden Road Brewing, and Golden Road Brewing is providing warehouse space gratis. The overlap between the two companies raises concerns regarding independence. California should have conducted the on-site at the applicant s business but opted to conduct the on-site at their office. Concern that the applicant is currently employed with Golden Road Brewing which is prohibited by 26.71 (j) which states, In order to be viewed as controlling a firm, a socially and economically disadvantaged owner cannot engage in outside employment or other business interests that conflict with the management of the firm or prevent the individual from devoting sufficient time and attention to the affairs of the firm to control its activities. MBAH will operate as a broker and place orders with artisan breweries for delivery directly to HMS Host at LAX. Placing daily orders will not take significant time and the owner s current full-time employment will not conflict with the owner s ability to devote sufficient time to the service the MBAH will provide. (DBE) Las Vegas, NV (For Possible Action) Ms. Munoz introduced this item and Al Sotelo presented the certification material. JLB Land Surveying, Inc. provides construction land surveying services. The firm does not meet the eligibility standards of 49 CFR Part 26.71(h) as the owner of the firm does not have Professional Land Surveying (PLS) license as required by the Nevada Revised Statute (NRS) 625.040 and NRS 625.480. Question was asked of how the company can operate without the owner having a PLS. NDOT stated that they left out one citation - 625.040 1(j) from their Summary Report. Owner provided a license for an individual from California who he intends to hire. The Barajas Group (DBE) Las Vegas, NV (For Possible Action) Ms. Munoz introduced this item and Al Sotelo presented the certification material. The Barajas Group provides land surveying, mapping and construction layout services. The firm does not meet the eligibility standards of 49 CFR Part 26.71(h) as the owner of the firm does not have Professional Land Surveying (PLS) license as required by the Nevada Revised Statute (NRS) 625.040 and NRS 625.480. Owner does not have a PLS but his dad who is an employee of the firm has a PLS. VIII. Other Issues/Discussions a. B2G Now Website Posting of DBE/ACDBE Firms - Update NDOT was recently informed that a DBE certified firm was not getting SBE work because the firm was listed as a DBE but not a SBE on the website. In order to find an SBE on the website, the viewer would need to choose which certification (DBE or SBE) to view. Based on a follow-up with B2G Now, in order for a DBE firm to be listed as an SBE, NDOT would have to copy DBE information and input it again for SBE designation. Will brainstorm to see if there are any other solutions to this issue. Reno-Tahoe Airport has a project with SBE goals and the Pre-bid Conference is this Friday. Kathy will advise that DBEs are also SBEs. In conducting a search for firms by NAICS codes, a different mix of companies is listed by NAICS code. For example purposes only, a search for companies certified under NAICS 42111 listed certain firms, and then a search for 421110 (adding a 0) yielded a different mix of companies. The site does not appear to pick up a complete list of companies under the 5 digit code. Kathy will forward an e-mail to NUCP members which she sent to NDOT regarding the specifics. NDOT is the only agency that can enter new information and make changes/updates to the website. There is no update on how other agencies can enter new information or make changes/updates to those firms they certify. b. SBE Application No comments or updates. c. Interstate Certification Copy of DOT guidance issued on July 9 th regarding Interstate Certification was e-mailed to NUCP members on July 25 th. d. ACDBE/DBE Summary Report Modifications e. Other Documents have been revised and the banking and payroll information has been removed. NCUP logo has been developed in an effort to represent that the NUCP is a unified certification group. Tracy recommended that a workshop be scheduled to facilitate open dialogue on a number of issues, i.e. B2G Now, codes, forms, goal vs. regulations, etc. The various agencies have different programs and the public does not view us as a unified program. Video conferencing can be held at NDOT facilities. Consideration to schedule the workshop at the end of a UCP meeting. Discuss the DBE program as a whole particularly the Fuel Index Revenue projects and how to better give out information on what the project is. NDOT recently hosted a peer-to-peer workshop and the Arizona DOT is willing to come back to share information on their best practices which can help in unifying our program. Arizona uses the B2G Now Program. They were one of the first users and will be a good resource to discuss how they worked through start-up issues. Recommendation to schedule a half-day workshop following the September 30 th UCP meeting. Tracy will develop a preliminary list of discussion points to share with the UCP members. IX.
