MINISTRY OF SCIENCE AND TECHNOLOGY ----------------------------- THE SOCIALIST REPUBLIC OF VIETNAM Independence - Freedom Happiness ---------------------------------- No: 217/QD-BKHCN Hanoi, February 18, 2014 DECISION On issuing the Regulation on Organization and Operation of Vietnam Agency for Radiation and Nuclear and Safety MINISTER OF SCIENCE AND TECHNOLOGY Pursuant to Decree No. 20/2013/ND-CP dated February 26, 2013 by the Government on defining the functions, tasks, powers and organizational structure of the Ministry of Science and Technology; At the proposal of the Director of the Department of Organization and Personnel, DECIDES: Article 1: The Regulation on Organization and Operation of Vietnam Agency for Radiation and Nuclear Control and Safety is issued enclosed herewith this Decision. Article 2: This Decision will be put into effect as date of signing and will replace Decision No 2248/QĐ-BKHCN dated October 10, 2008 by the Minister of Science and Technology on issuing the Regulation on Organization and Operation of Agency for Radiation and Nuclear Control and Safety. Article 3: The Director of Department of Organization and Personnel, the Director of National Office of Intellectual Property of Vietnam, and leaders of related agencies are responsible for implementing this Decision. MINISTRY OF SCIENCE AND TECHNOLOGY ----------------------------- THE SOCIALIST REPUBLIC OF VIETNAM Independence - Freedom Happiness ---------------------------------- REGULATION on Organization and Operation of Vietnam Agency for Radiation and Nuclear Safety (Issued enclosed herewith Decision No 217/QD-BKHCN dated February 18, 2014 by the Minister of Science and Technology) Chapter I FUNCTIONS, TASKS AND POWERS Article 1. Position and functions Vietnam Agency for Radiation and Nuclear Safety (in short called VARANS) is an agency under the Ministry of Science and Technology, which assists the Minister to fulfill State management functions in terms of radiation safety, nuclear safety; security of radio-activity sources, nuclear materials, nuclear units; nuclear control and implement professional activities in order to fulfill the above-mentioned functions. The Agency has the international transaction name of Vietnam Agency for Radiation and Nuclear Safety, abbreviated as VARANS. The Agency has its legal status; own stamp and can open accounts of domestic and foreign currency at the State Treasury and Bank. The headquarter of Vietnam Agency for Radiation and Nuclear Safety is located in Hanoi City. Article 2. Tasks and powers 1. Organizing the formulation to submit to the Minister of Science and Technology for approval according to the Ministry s delegation of authority or to the State competent agencies for approval legal and regulatory documents on nuclear safety, security and inspection. Participating in the formulation of legal and regulatory documents for atomic energy field; standards, technical specifications, guidelines on nuclear safety, security and inspection; special mechanisms and policies for those working in atomic energy field. 1

2. Developing and submitting to the competent leaders for approval and organizing the implementation of policies, development planning, annual and 5- year programs and plans on nuclear safety, security and inspection. 3. Organizing the declaration of radio-activity sources and equipment, nuclear materials and equipment; granting permits for carrying out radiation tasks; granting certificates for radiation staff; organizing granting and withdrawal of operational registration certificates and professional certificates for services of supporting atomic energy use relating to radiation and nuclear safety, including training for radiation staff; training and providing updated professional knowledge as required by organizations and individuals who carry out radiation activities; measuring radiation doses for individuals, assessing radiation activities; verifying and standardizing equipment measuring radiation, radiation equipment, nuclear equipment; installing, maintaining, repairing radiation equipment and nuclear equipment; removing radiation; changing and reversing fuel for nuclear reaction piles; installing radiation sources and services of supporting atomic energy use relating to radiation and nuclear safety as assigned by the Ministry. 4. Appraising and organizing the appraisal on safety of radiation activities; appraising and organizing the appraisal on security for radio-activity sources, nuclear materials and units; 5. Carrying out professional examinations and investigations on nuclear safety, security and inspection as stipulated by laws; handling violations and complaints, denunciations on nuclear safety, security and inspection according to the delegated authority. 6. Providing guidance, directions and coordinating with Departments of Science and Technology, relevant agencies and units which fulfil the State management functions on nuclear safety, security and inspection. 7. Providing technical support for the State management activities on safety, security and nuclear inspection; organizing and studying the use of S&T achievements and implementing services on nuclear safety, security and inspection; controlling professional irradiation, civil irradiation and medical irradiation. 8. Carrying out State management activities on safety and security of radioactivity wastes, nuclear fuel, used nuclear fuel, environmental radioactivity, emergency response and nuclear radiation incidents, controlling professional irradiation, civil irradiation and medical irradiation; coordinating 2

the Directorate for Standards, Metrology and Quality in the management of the system of Radiation Measurement Standard Departments. 9. Organizing nuclear inspection activities. 10. Establishing the national information system on nuclear safety, security and inspection. 11. Carrying out activities of science information and mass information on nuclear safety, security and inspection. 12. Chairing and coordinating to organize training, foster and provide updated professional guidelines on nuclear safety, security and inspection. 13. Organizing the implementation of international cooperation activities on nuclear safety, security and inspection; studying, proposing the signing and entering of international treaties and agreements on nuclear safety, security and inspection; participating in the implementation of international treaties and agreements of which Vietnam is a member; 14. Managing personnel, assets and documents of Vietnam Agency for Radiation and Nuclear Safety according to the delegated authority and the Ministry s regulations. 15. Carrying out other tasks assigned by the Minister. Chapter II ORGANIZATIONAL STRUCTURE Article 3. Leaders of the Agency 1. Leaders of Vietnam Agency of Radiation and Nuclear Safety consist of the Director and Deputy Directors. 2. The Director of Vietnam Agency for Radiation and Nuclear Safety is appointed, dismissed by the Minister of Science and Technology and responsible to the Minister and to the laws for the Agency s entire organization and operations. 3. Deputy Directors of Vietnam Agency for Radiation and Nuclear Safety are responsible for assisting the Director with the Agency s work; allowed to make decisions on issues under their assigned management scopes and responsible to the Director for their assigned tasks. The Deputy Directors are appointed and dismissed by the Minister of Science and Technology based on the Director s proposals. 4. In case the Director is absent, one Deputy Director is authorized to manage and deal with the Agency s work on behalf of the Director. 3

Article 4. Organization structure of the Agency 1. Units assisting the Director to fulfill State management functions: a) The Agency s Office. b) Department of Planning and Finance. c) Department of Legislation and Policy. d) Department of Permit Grant. đ) The Agency Inspectorate. e) Department of Nuclear Safety and Inspection. g) Department of Safety Standards. h) Department of International Cooperation The Agency s Office has its own stamp and can open accounts of domestic and foreign currency at the State Treasury and Bank. 2. Administrative units under the Agency a) Technical Support Center for Radiation Safety and Incident Response. b) Center for Information and Training. c) Technical Support Center for Radiation Safety in Ho Chi Minh City. Administrative units under the Agency specified in Clause 2 of this Article have their own stamp and can open accounts of domestic and foreign currency at the State Treasury and Bank to operate and carry out transactions as stipulated by laws. 3. The establishment, merge, splitting, dissolution of departments and units under Vietnam Agency for Radiation and Nuclear Safety are decided by the Minister based on proposals of the Director of Vietnam Agency for Radiation and Nuclear Safety and Director of Department of Organization and Personnel. 4. The Director of Vietnam Agency for Radiation and Nuclear Safety stipulates specific functions, tasks, powers, organization structure and operation of department and units under the Agency. 5. The Director of Vietnam Agency for Radiation and Nuclear Safety appoints, dismisses head, deputy head levels of departments and units directly under the Agency according to the Ministry s delegation of authority on personnel and as stipulated by laws. 6. The Director of Vietnam Agency for Radiation and Nuclear Safety is entitled to establish the Advisory Council for Nuclear Safety, Advisory Council for Radiation Safety and other advisory councils in fields under the Agency s management functions. Functions, tasks, powers, organizational structure and 4

operation of the Council are specified by the Director of the Agency of Radiation and Nuclear Safety. Article 5. Human resources of the Agency 1. Officials and civil staff; 2. Staff working with labor contracts. 3. Collaborators. Article 6. Working mechanism 1. Vietnam Agency for Radiation and Nuclear Safety organizes its work according to a mechanism in which the leadership integrates with collective discussion. 2. Vietnam Agency for Radiation and Nuclear Safety follows working regulations and relations with leaders of agencies under the Ministry according to the Ministry's working regulations and other regulations issued by the Minister. 3. Vietnam Agency for Radiation and Nuclear Safety is responsible for closely coordinating with related agencies, organizations and individuals outside the Ministry as stipulated in the implementation of assigned functions and tasks. Chapter III FINANCIAL AND ASSEST MANAGEMENT Article 7. Income 1. From the allocated State budget; 2. From charges, fees allowed to be kept as stipulated by laws; 3. From professional activities and relevant service activities; 4. Other incomes as regulated by laws. Article 8. Expenses 1. Payments for regular activities according to assigned functions and tasks; 2. Payments for professional activities, service provision; 3. Payments for labor hiring; 4. Other expenses as regulated by laws. Article 9. Financial and asset management The Director of Vietnam Agency for Radiation and Nuclear Safety is responsible for managing and efficiently using the Agency's financial sources; 5

fulfill tasks of contributing to State budget and follows the accounting system according to the State existing regulations. Chapter IV IMPLEMENTATION PROVISIONS Article 10. The enforceability validity 1. This Regulation is put into effect as of the date of signing. 2. The Director of Vietnam Agency for Radiation and Nuclear Safety is in coordination with the Director of Department of Organization and Personnel to implement this Regulation. Article 11. The amendment and supplementation of this Regulation The amendment and supplementation of this Regulation is carried out by the Director of Vietnam Agency for Radiation and Nuclear Safety in coordination with the Director of Department of Organization and Personnel to submit to the Minister of Science and Technology for review and approval.
