EGG HARBOR TOWNSHIP POLICE DEPARTMENTAL DIRECTIVE Date Issued: March 22, 2004 Date Effective: Immediately # Directive: GENERAL ORDER Directive # 04-14 Section # O-15 Subject: ACY Law Enforcement Officers Response Plan I. Purpose: A. In accordance with United States Transportation Security Administration (TSA) promulgated 49 CFR, Part 1542.215 regulations, the Egg Harbor Township Police Department is now joined by the New Jersey State Police as duly designated Law Enforcement Agencies for the Atlantic City International Airport (ACY). B. This policy will provide guidelines and information necessary to appropriate response to airport related incidents and events. Since the nature of this task is multi-jurisdictional, this document is issued by the Egg Harbor Township Police Department but may be affected by, and interact with, New Jersey State Police policy and procedure. II. Definitions: A. ACY Atlantic City International Airport AOA Defined as the airport s runways and taxiways, aircraft parking aprons and ramps. APU Airport Police Unit, comprised of members of the Egg Harbor Township Police Department and New Jersey State Police. Page Two SIDA SJTA TSA VBIED Security Identification Display Area - SIDA is defined as the Air Carrier Operations area within the AOA. At ACY, the SIDA is a roughly rectangular 800' x 350' area bounded on the North and East sides by the FAA Administration Center. The South side is bounded by security fencing and the Terminal Building South Jersey Transportation Authority United States Transportation Security Administration Vehicle Borne Improvised Explosive Device III. Policy: A. It is the policy of this agency to provide, in partnership with the New Jersey State Police, full-service law enforcement coverage at the Atlantic City International Airport. B. This agency will, in accordance with the agreement with the SJTA, permanently assign to the airport a detachment of sworn Police Officers whose mission is to provide the law enforcement coverage mentioned above. C. Members of this Airport Police Unit will respond to all calls for police and emergency service at the airport. If assistance is needed, elements of the duty Patrol Squad will respond as backup. D. In addition to normal police matters, members of the APU will be required to support the aviation security mission that is unique to the airport environment. Closely allied with that mission is the issue of homeland security and the assorted tasks related to it. E. In order to accomplish the aviation security mission, members of the APU will be required to remain up to date on specialized regulations, procedures and terminology that is unique to the aviation industry and homeland security. F. Key to the success of this mission is the cooperation with the elements of the NJSP assigned to the airport. Communication between and among agencies must be of paramount importance in a multi-agency environment. All members of this agency assigned to ACY will operate with effective inter-agency communications and cooperation as primary goals.

In addition to the NJSP, members of the Airport Police Unit will be required to coordinate efforts and cooperate fully with members of an assortment of other law enforcement and emergency management agencies. For example, members of the TSA are assigned to the airport on a regular basis and bear a large responsibility for security of the airline passengers and baggage. Also based on the same facility are the 177 th Fighter Interceptor Group, Federal Air Marshal Service, United States Coast Guard, and the Wackenhut Security organization which provides security for the FAA Technical Center. IV. Procedures: A. Reports 1. Airport assigned officers will complete the appropriate reports or CAD entries for every significant event in which they are involved. 2. Copies of approved reports will be forwarded to the other agency as soon as possible. 3. An Event Log or CAD printout will be exchanged each day in order to effectively brief officers coming on duty. 4. In addition to OmniForm reports and/or CAD comments, Officers will complete an ACY Incident Report or ACY Firearms Incident Report. Both are available in Omni and are to be completed as soon as possible after the incident, printed out and handed to the senior TSA representative. This report does not travel through the EHTPD chain of command outside of the ACY Unit. B. Arrests & Investigations 1. Notification to the other agency is to take place immediately or as soon as practicable after an arrest is made or an investigation is begun. 2. Supervisors will decide when cooperative investigations will be conducted. 3. Responsibility for the particular case will be determined by the supervisors onscene or available on-call, on a case-by-case basis. The highest regard will be paid to the functions of best completing the investigation and cooperation.

Page Four C. Incident Management 1. All critical incidents will be managed using the Incident Command System (ICS), in accordance with the National Training Curriculum, utilizing the best resources of both agencies. a. In order to establish a common set of objectives and strategies without losing agency authority, responsibility, or accountability, the Unified Command concept will be incorporated. 2. In those incidents which dictate the activation of the ICS, the command and control system will be headed by the agency having the necessary resources most readily available. Command may change as additional assets become available or as the situation evolves. D. Media Releases 1. In compliance with Executive Order 69, news releases on routine arrests will be made by the agency making the arrest. 2. News releases on major events will be made jointly by representatives designated by both agencies. 3. In cases directly affecting the South Jersey Transportation Authority, and when appropriate, the Authority s Media Relations Department will be included in the news release process. 4. News releases involving policy or personnel will be made by the agency affected by the release. V. Specific Incident Procedures: A. Weapons of Mass Destruction Incident (See EHTPD General Order #03-13 Suspected Terrorism or WMD Incidents. ) 1. Upon receipt of a call for a suspected terrorist or WMD incident, LEOs will assure that notifications are made to: a. ACY Operations b. TSA c. FBI d. Atlantic County Office of Emergency Management (ACOEM) e. NJ Office of Counter-Terrorism

Page Five f. Egg Harbor Township Emergency Management Coordinator. g. Atlantic City PD EOD, 177 th FIG EOD and NJSP Bomb Unit, if explosive device is suspected. 2. Approach to the suspected scene must be with regard for the nature of the incident. a. Be aware of wind direction and shifts b. Avoid contamination from victims already exposed to nuclear, biological or chemical substances. c. Suspicious packages or devices must not be moved. d. Establish a perimeter and begin evacuation procedures to a safe distance, based upon the size and type of the device or package. e. Avoid the use of cell phones and radios within 300 feet of a suspected device. 3. Secure the crime scene and establish a command post (CP) in a secure area. 4. Identify and isolate possible victims. 5. Locate and identify items of possible evidential value. B. Aircraft Hijack (Code 75) / Air Piracy: 1. Jurisdiction for incidents on board an aircraft In-Flight is: a. FBI if aircraft is still on the ground but the doors are closed. b. FAA/TSA if the aircraft has left the ground. 2. In an actual or suspected incident, the FBI will respond to handle the incident. 3. During the time between the notification of the FBI and the arrival of FBI teams, the first-responding Incident Commander will be responsible to develop an Emergency Assault Plan to be executed if circumstances require it. C. Suspicious packages: 1. Unattended baggage protocol is as follows: a. LEO checks baggage name tag. b. If name is on it, make announcement, attempt to locate owner, have owner pick up bag c. If no name or no response, conduct dog search along with radiological pager. d. If no hit or no dog is available, have TSA screener swab bag @ ETD

Page Six (1) If there is an ETD hit, establish a 300 ft. perimeter and begin evacuation procedures. (2) Contact ACY Operations (3) Contact EOD e. TSA personnel will conduct X-Ray examination of bag @ screening checkpoint f. If still negative, bag is turned over to airport lost and found. 2. Suspected IED, VBIED, or LVIED a. LEO views suspected device using due caution based upon location and situation. b. If determined to be a suspicious item that may be an IED, VBIED, or LVIED, notify EOD c. LEO establishes 300 foot perimeter at minimum, based upon the size of the suspected device. (See Attachment A, IED Safe Standoff Distance Cheat Sheet ) d. Notify ACY Operations e. Begin evacuation procedure, if necessary. D. Large Crowd Disturbances: 1. LEOs will handle a disturbance according to normal and accepted police procedures. 2. Special attention will be paid to maintaining the integrity of the SIDA and AOA secure areas. 3. Passenger screening checkpoint security remains the responsibility of TSA personnel. 4. Screening area security gate will not be lowered without direct order from the LEOs. E. Terminal Evacuation: 1. All evacuations will be handled in the same way, regardless of the reason or event requiring the evacuation. 2. If evacuation becomes necessary, Airport Operations will be notified immediately of the need and the reason.

Page Seven 3. If the cause for evacuation is a fire in the building, the A.C.E. system will be utilized; a. A - Alarm. Activate the nearest fire pullbox located throughout the building on the walls. b. C - Confine the fire, if possible. Close all doors in the area of the fire. c. E - Extinguish the fire or Evacuate. 4. If evacuation due to fire becomes necessary, guidelines established in the Emergency Action & Evacuation Plan for the Main Terminal Building will be followed. [See Attachment] 5. LEOs will take the lead in maintaining security during the evacuation. Public safety will remain the paramount issue, while preserving an acceptable level of security. a. Assure that the second floor of the building is clear, including stairwells, retail and storage spaces. b. Assure that all airline ticket counters and office spaces are abandoned and secure. c. Physically determine that the car rental counters and baggage claim area are evacuated and secure. d. Verify that the airport administration offices are evacuated and secure. 6. The commercial parking area located to the Northeast of the main terminal entrance is designated as the evacuation area. It is the location to which all evacuees are to be directed. a. LEOs should scan the evacuation area and the route of travel to it to assure that there are no hazards present. ( i.e. secondary devices, etc.) b. The evacuation area must be staffed by sufficient LEOs to assure that no evacuees return to the terminal until the all clear is given. c. In the event of inclement weather, evacuees may be bused to another location, held on location aboard buses, or removed from the area altogether. Circumstances will dictate the proper course of action. (Subject to SJTA policy and practice) 7. If circumstances allow, LEOs not assigned to the evacuation area will maintain a post at the perimeter of the terminal building to prevent entry until after the all clear is signaled.

Page Eight a. If the situation presented makes it unadvisable to stay at the perimeter posts, LEOs are to abandon those posts and muster at the evacuation area. F. No Fly List Hit: 1. LEO makes the determination on validity of name match. 2. If the match is verified, a. LEO will contact the FBI and TSA s TSI Watch at (202) 267-3099. b. LEO will conduct an NCIC check c. Passenger will not fly 3. If the match is not verified, a. LEO will conduct NCIC check b. Passenger can fly. 4. LEOs are not involved with Selectee List issues. G. Crew Member Under Influence of Alcohol or Drugs: 1. LEOs will be notified immediately by airline, TSA or ACY Operations personnel 2. Responding LEO will conduct investigation according to standard DWI enforcement standards. Authority is NJSA 6:1-18. H. Aircraft Accident (See EHTPD General Order #97-7, Aircraft Accident Procedures. ) 1. Alert 1: Indicates aircraft approaching with minor equipment malfunction. LEOs to be notified by ACY OPS. No action to be taken unless the situation worsens. 2. Alert 2: Indicates that a pilot or ATC personnel have requested ARFF stand-by. Airport is closed. a. LEOs will notify EHTPD Communications of the incident and communicate with any responding Patrol units. b. Inform EHTPD units of incident and response locations. c. Stand by for response to scene, if needed.

Page Nine 3. Alert 3: Indicates that an aircraft accident has occurred on or adjacent to the airport. a. LEOs will notify EHTPD Communications of the incident and communicate with any responding Patrol units. b. Inform EHTPD units of incident and response locations. c. Coordinate with inbound Patrol units in establishing inner and outer perimeter. d. ACY LEOs must insure the security of the terminal building. It must not be left unattended. VI. Screening Checkpoint Procedures: A. Security Breach 1. Contained Security Breach a. Location of suspect is known b. Suspect is contained and under control c. Event is no longer escalating 2. Uncontained Security Breach a. Location of suspect is unknown or, b. Location is known but suspect is not under control or in custody. c. Event is, or may be, escalating. 3. Level of response will be a cooperative effort between LEOs and TSA. 4. ACY Operations will be notified of the event and any impending evacuation plan. 5. Decision to evacuate the secure area based upon a security breach is the responsibility of the FSD. Concourse evacuation should not occur absent a significant threat. B. LEOs Flying Armed 1. Referred to ACY LEO by airline ticket agent. 2. Identification and authorization letter checked by ACY LEO 3. ACY LEO escorts passenger LEO around the screening checkpoint via the side hallway.

Page Ten 4. Passenger LEO signs the checkpoint logbook and boards aircraft as normal for non-leo passenger. C. LEOs Flying Armed, Prisoner Escort 1. Same procedure as in Section V.B.1, 2, & 3, LEOs Flying Armed 2. TSA procedure followed for boarding aircraft. D. On Duty FAMs Flying Armed 1. Duty FAM team checks in at ticket counter. 2. Airline notifies ACY LEO to meet FAM team in the hallway at the rear of the ticket counter. 3. LEO verifies FAM identification. 4. FAM team boards aircraft without entering the passenger area or as determined by FAMs. 5. Off duty FAMs follow procedure for LEOs flying armed as outlined in Section V, B, above. E. Weapons at the Passenger Screening Checkpoint 1. LEOs will be notified immediately. 2. LEOs will evaluate the incident pursuant to NJSA Title 2C, Chapter 39 a. If probable cause exists that NJ State law has been violated, the suspect will be arrested and charged with that violation. b. If the weapon is not illegal under NJ State law, and absent any other violation, no action will be taken and the incident will remain under the jurisdiction of the TSA. 3. FBI - Linwood Office will be notified immediately of any weapons related event at the airport.

Page Eleven F. Passengers in Possession of TSA Prohibited Items. 1. TSA screening personnel will seize articles which are prohibited by TSA regulations. 2. LEOs will generally not be involved except to facilitate the process and maintain the peace. G. Other Illegal Items in Possession of Passengers 1. Cases involving passengers in possession of items such as CDS, stolen property, forged documents or any other illegal item (s) will be investigated and handled as per standard police procedure. 2. TSA will not search personal property for contraband but will notify ACY LEOs if it is discovered during the course of their screening duties. H. Unresolved ETD alarms 1. TSA screening manager will contact LEO for assistance. 2. LEO will conduct an investigation including an interview with the passenger whose luggage caused the ETD alarm. 3. As part of the investigation, the LEO will conduct an NCIC check of the passenger or passengers involved. 4. LEO will then assist the screening manager in making the final decision as to whether the passenger can board the aircraft, and with or without the luggage item in question. I. Unruly or Disorderly Passengers 1. ACY LEOs will respond to any report of disorderly conduct and take appropriate action pursuant to standard police procedure and New Jersey State Law. J. Inappropriate Comments / Hoax Bomb Threats 1. LEOs to be notified by TSA, ACY or airline personnel as soon as possible.

Page Twelve 2. LEO will respond immediately and assess the situation. 3. All threats will be taken as serious. 4. Arrests will be made for violations of appropriate NJ Statute ( Disorderly Conduct, Terroristic Threats, etc). 5. FBI will be notified immediately. Presentment to US Attorney may follow, superceding State prosecution. VII. Reporting of Incidents: A. EHT Police Officers will utilize the established CPLIMS and Omni-Form reporting system as prescribed by EHTPD Policy. B. Notification to the FBI is necessary when: 1. A weapon is involved, 2. Any breach of security occurs, 3. Any arrest is made on airport property, 4. There is media attention to the incident. C. EHT Police Officers will immediately notify the NJSP members of the ACY LEO Unit in the event of any incident requiring police action. D. The specifically designed, ACY Incident and Firearms Incident Reports are intended to be completed as soon as possible after the incident. 1. Distribution is as follows: a. NJSP b. TSA c. FBI 2. A copy of this report will accompany the regular EHTPD reports for filing in EHTPD Records Section. 3. Review outside of the ACY Unit is not required prior to filing in Records. tj John J.
