Request for Proposals HUD-CPD Programs Consultant City of Waco Waco, TX. Posted: April 3,2013 Submittal Deadline: April 19,2013 Website: http://www.waco-texas.com/ The City of Waco ( City ) is seeking competitive proposals from qualified persons to provide consultation services for its CDBG, and HOME programs (collectively referred to as CPD programs ). TIME IS OF THE ESSENCE for this Project. The consultant must be available immediately after selection is made. Responders are encouraged to submit responses in P.D.F. format to the following email address: jwall@ci.waco.tx.us. Responses will be received until 5:00 p.m. C.D.T., Friday April 19, 2013. In lieu of a letter of intent, please indicate your interest in responding to this RFP by sending an email to jwall@ci.waco.tx.us immediately. Please also submit any questions about this RFP, via email to the same address, before Wednesday April 10, 2013. All questions and answers shall be sent to everyone who submits an email address and requests to be on the mailing list. I. Scope of Work The City is a HUD-entitlement community. The City will receive approximately $1,816,695 for Program year 2013-2014 for its CDBG and HOME programs (collectively CPD programs ). The City s Housing and Community Development Services Department ( H&CD ) has experienced several key staff departures and seeks expert consultation to transition and

train new and existing H&CD staff and assist in the preparation and training of staff for certain HUD reports (see listing of reports). Consultant will agree to answer questions from the City during this contract period. The City requires the services of a qualified professional to assist the City in making this transition. The contract will begin immediately after selection, and preference will be given to qualified individuals who can start promptly and devote sufficient time to this Project to expedite successful completion. The City anticipates that the transition and training will take at least 90 days with the possibility that the reports associated with training may run through 12/31/14, if requested by the City. The contract will terminate when the transition and reports are complete, in the sole discretion of the City. The consultant will be hired as an independent contractor and not as a City employee. II. Required Professional Qualifications a) Consultant must have a graduate degree in urban planning, public administration, governmental affairs, community development, or the equivalent thereof. b) Consultant must have at least ten (10) years of experience as a HUD-certified or experienced in CDBG and HOME programs. City prefers consultant to have had municipal experience in administering HUD grants. Please provide evidence of any certifications and a complete description of your experience. c) Consultants shall provide a list of communities in which they have provided CPD services, said list to include contact information for references, as well as a brief description of responsibilities, accomplishments, and dates of services. d) Consultant must have experience working successfully with the HUD offices in charge of CDBG and HOME funds and have a thorough working knowledge of all applicable federal statutes and HUD regulations. e) The City shall have no financial interest in the business of and shall not be liable for any debts or obligations incurred by the Consultant. f) Consultant, in the performance of its operations and obligations hereunder, shall not be deemed to be an agent of City but shall be deemed to be an Independent Contractor in every respect. g) Consultant shall acknowledge that its identity and peculiar capacity to provide the services described hereinabove shall constitute a material consideration for the City s execution of a contract with Consultant. Therefore, Consultant shall not transfer or assign an awarded contract or any of the rights or privileges granted therein without the prior written consent of City. Such consent shall be granted or denied solely at the City s discretion.

h) If selected, Consultant shall agree to comply strictly with all ordinances of the City of Waco, Texas, and the laws of the State of Texas and of the United States while performing its obligations i) Consultant agrees that, if selected, it will comply with Title 6 of the Civil Rights Act of 1964 which provides that no person will be excluded from participation in, or be denied benefits of, or otherwise be subjected to discrimination on the grounds of race, sex, color, national origin or disability, in connection with federally funded programs. III. Selection Process and Schedule Proposals will be reviewed by Housing and Community Development Services director and staff with interviews conducted at the option of the City between April 24,2013 and April 26,2013. The City s Housing Director shall make the final selection and submit the selected proposal to the Office of the City Manager for final approval. The following schedule applies: a). Publication of Request for Proposals: Wednesday April 3,2013 b). Deadline for questions regarding RFP: Wednesday April 10, 2013(5:00 p.m CDT.): c). Deadline for receipt of responses to RFP: Friday April 19, 2013(5 p.m. CDT). Please note: Any response received after this date and time will be returned, unopened. d) Possible Interviews: April 24-26, 2013. Please note that in-person interviews are preferred. e). Completion of proposal review and selection: Friday May 3, 2013. f). Contract start date: Immediately after selection process is completed. IV. Format for Responses Your response should be sent in P.D.F. format, and must include a cover letter, (including dates of availability and a schedule of fees broken out in detail by each job/report); resume; three letters of reference (which must be submitted independently by their authors to the email address listed on page 2 of this RFP); a statement responding in detail to the information requested in Section II(c) of this RFP; and evidence of your HUD CPD certifications and experience. If the response is sent by a firm, partnership or any organization other than an individual, provide the requested information for all individuals who will perform the work. V. Selection Criteria The City will evaluate each proposal, based on the following criteria and scoring

25% The Consultant s qualifications and successful experience with CDBG and HOME programs along with familiarity with and knowledge of applicable federal statutes and HUD regulations. 25%The City s perception of the Consultant s ability to successfully accomplish the transition and training of HUD program administration, including the Consultant s ability to effectively work with personnel, communication and writing skills, and time management. In addition, the consultant s ability to successfully provide timely and professional HUD reports as requested by the City. 25%Availability and ability to commit to successful and expeditious completion of the Project. 25% Consultants fees and charges fees and charges need to be broken down in detail as to trainings and individual reports. INSTRUCTIONS FOR CONFLICTS OF INTEREST QUESTIONNAIRE [Form CIQ] H.B. 914, passed during the 2005 Texas legislative session, as amended by H.B. 1491 passed in 2007, requires certain persons who wish to conduct business or be considered for business with a city to file a conflict of interest questionnaire. The Texas Ethics Commission (TEC) created the conflict of interest questionnaire (FORM CIQ). These laws are codified in Chap. 176 of the Texas Local Government Code. What vendors/persons are subject to Chapter 176? The word person includes a partnership, corporation or other corporate body, including those performing professional services. Such partnerships or corporations act through individuals, but it is the partnership or corporation that would be seeking to do business with the city. Any person who contracts or seeks to contract for the sale or purchase of property, goods, or services with a local governmental entity An agent of a person who contracts or seeks to contract for the sale or purchase of property, goods, or services with a local governmental entity A vendor shall file a completed conflict of interest questionnaire if the person has a business relationship with a local governmental entity and: (1) has an employment or other business relationship with an officer of that local governmental entity, or a family member of the officer that results in taxable income exceeding $2,500 during the 12 month period preceding the date a contract is executed or a contract is being considered; or (2) has given an officer of that local governmental entity, or a family member of the officer, one or more gifts with the aggregate value of more than $250 in the 12 month period preceding the date a contract is executed or a contract is being considered What triggers the requirement to file a conflict of interest questionnaire? When a person begins (1) contract discussions or negotiations with the city or (2) submits an application, response to request for proposals or bids, correspondence, or another writing related to a potential agreement, Form CIQ must be completed. Whether the person initiates the discussion or the city initiates the discussions, Form CIQ must be completed. Even if the vendor has no affiliation or business relationship with an officer or employee of the city, Form CIQ must be completed and submitted To what type of contracts does the bill apply? Any written contract and any implied contract, such as purchase orders, procurement card purchases, utility purchases, or any exchange of money or other consideration for some service or property. The monetary amount or value of the contract/purchase does not matter. When must a vendor file the conflict of interest questionnaire? No later than seven days after the date the person: (a) begins contract discussions or negotiations with the city, or (b) submits an application or response to a request for proposals or bids, correspondence, or another writing related to a potential agreement with a city, or (c) becomes aware of an employment relationship with a local government officer or family member of the officer, or (d) becomes aware of a qualifying gift.. What has to be revealed? Section 176.006 requires disclosure of a person s employment or business relationships. This includes each employment or business relationship with a corporation or other business entity with respect to which a local government officer services as an officer or director or holds an ownership interest of 10% or more. 08/03/2011 1

How do I go about filling out the Conflict of Interest Questionnaire form? Each number below corresponds with the number on FORM CIQ: 1. Fill in the full name of the person who is trying to do business with the City. If the person is a corporation, partnership, etc., then it is the name of that corporation, partnership, etc., that is required on Form CIQ. 2. Check box if the form is an update to a form previously completed. Updates are required by the 7th business day after an event that makes a statement in a previously filed questionnaire incomplete or inaccurate. Updates are also required by September 1 of each year in which the person submits a proposal, bid or response to the City of Waco or begins contract discussions or negotiations with the City. 3. Complete this Section by listing the name of the local government officer (member of City Council or City Manager) with whom there is an affiliation to or business relationship and you checked the Yes box in Section 3 A, B, or C. If there is more than one local government officer (City Council or City Manager) with whom there is an affiliation or business relationship, more than one page two may be needed to provide information on each local government officer. 4. State whether the local government officer named on the form receives or is likely to receive taxable income, other than investment income, from the vendor filing the questionnaire. 5. State whether the filer receives or is likely to receive taxable income, other than investment income, from or at the direction of the local government officer named on the form AND the taxable income is not received from the local governmental entity. 6. State whether the filer is employed by a corporation or other business entity with which the local government officer serves as an officer or director or holds an ownership interest of 10% or more. 7. Describe each employment or business relationship with the local government officer named on the form. 8. Signature box. Person completing form must date and sign the form. If the form is being completed for a corporation, partnerships, etc., the person signing should be someone who is authorized to act on behalf of the corporation, partnership, etc. A signature is required in box #4 regardless of any other entry on the form. CONFLICT OF INTEREST QUESTIONNAIRE For vendor or other person doing business with local governmental entity FORM CIQ This questionnaire reflects changes made to the law by H.B. 1491, 80th Leg., Regular Session. This questionnaire is being filed in accordance with Chapter 176, Local Government Code by a person who has a business relationship as defined by Section 176.001(1-a) with a local governmental entity and the person meets requirements under Section 176.006(a). By law this questionnaire must be filed with the records administrator of the local governmental entity not later than the 7th business day after the date the person becomes aware of facts that require the statement to be filed. See Section 176.006, Local Government Code. A person commits an offense if the person knowingly violates Section 176.006, Local Government Code. Texas Public Information Act Steps To Assert Information Confidential or Proprietary All proposals, data, and information submitted to the City of Waco are subject to release under the Texas Public Information Act ( Act ) unless exempt from release under the Act. You are not encouraged to submit data and/or information that you consider to be confidential or proprietary unless it is absolutely required to understand and evaluate your submission. On each page where confidential or proprietary information appears, you must label the confidential or proprietary information. Do not label every page of your submission as confidential as there are pages (such as the certification forms and bid sheet with pricing) that are not confidential. It is recommended that each page that contains either confidential or proprietary information be printed on colored paper (such as yellow or pink paper). At a minimum the pages where the confidential information appears should be labeled and the information you consider confidential or proprietary clearly marked. Failure to label the actual pages on which information considered confidential appears will be considered as a waiver of confidential or proprietary rights in the information. In the event a request for public information is filed with the City which involves your submission, you will be notified by the City of the request so that you have an opportunity to present your reasons for claims of confidentiality to the Texas Attorney General.
