The Goose Creek Consolidated Independent School District ( GCCISD or District ) is soliciting Submissions in response to this Request for Qualifications ( RFQ ) for architectural and engineering services to design and administrate the construction of an new Data Center facility as per the specifications stated in this solicitation document and the form of agreement attached as Exhibit A. Submissions will be received at the GCCISD Administration Building located at 4544 Interstate 10 East, Baytown, Texas until 2:00 p.m., July 15, 2014. At that time all Submissions will be opened and respondents ( Architects ) identified. This RFQ is a qualification based selection process. By law, cost or price related evaluation factors shall not be included in the qualification packages or presentations submitted by Architects for this RFQ. Submissions should be clearly marked with the Architect s name, address and the RFQ number. The District reserves the right to accept or reject any Submission or any part thereof or any combination of Submissions and to waive any or all formalities. All responses in the Submission may be used by the District in the selection process. The District reserves the right to verify the accuracy and completeness of all responses by utilizing any information available to the District without regard to whether such information appears in the Submission. By providing a Submission, each Architect agrees to waive any claim it has or may have against the District, its Trustees, agents and employees, and any reference sources, arising out of or in connection with: the administration, evaluation, or recommendation of any Submission; waiver of any requirements in the Request for Qualifications; acceptance or rejection of any Submission and award of the Contract. Four copies of your response must be submitted with one having the original authorized signature.

OVERVIEW: The District hereby requests professional architectural/engineering design firms to submit their qualifications for the design and construction administration of a new Data Center facility for the District, located in Baytown, Texas. The District may divide the work in any manner it considers in the best interest of the District. BACKGROUND: The Project consists of architectural, engineering, construction administration and consulting services in order to assess plan and design and administrate construction of a new Data Center facility as per the terms of the agreement attached as Exhibit A. The budget for the Project will be determined by the District Board of Trustees ( Board ) in consultation with the selected Architect, using 2013 Bond funds. SCOPE OF SERVICES: The scope of services shall include all architectural, engineering, and consulting services for the design and construction administration portions of the Project as determined necessary by the District in consultation with the selected Architect. INSTRUCTIONS TO RESPONDENTS FOR QUALIFICATIONS PACKAGE SUBMITTAL PROCESS: 1. Four copies of the response must be submitted in a sealed package bearing the name of the firm, the firm s address, telephone number and the RFQ s title. 2. Sealed qualification packages must be addressed and delivered or mailed to the Goose Creek Consolidated Independent School District s Purchasing Department, 4544 Interstate 10 East, and Baytown, Texas 77522, prior to 2:00 p.m., July 15, 2014. At that time all responses will be opened and read at the District s Administration Building. 3. Responses received after the time and date set for receipt and opening will not be considered. 4. All questions regarding this RFQ shall be directed in writing to the GCCISD Construction Department, Attn: David K. Fluker, 3401 N. Main Street, Baytown, Texas, 77521, email: construction@gccisd.net 5. Respondents mailing qualification packages should allow sufficient lead-time to ensure delivery before the opening date and time stated in paragraph two. 6. No response may be changed, amended or modified by any means after the qualification package has been opened at the date and time shown in paragraph two. COMMITMENTS: 1. The GCCISD reserves the right to withdraw this RFQ at any time and for any reason. 2. Receipt of response by the GCCISD or submission of a response to the GCCISD or selection of an Architect for the purposes of negotiating a contract; confers no rights to the Architect, nor obligates the GCCISD in any manner. 3. The GCCISD reserves the right to award or not award a contract. The GCCISD also reserves the right to award the contract to the party or parties that the Board of Trustees of the GCCISD determines to be most qualified and most responsive to this RFQ. 4. The GCCISD is under no obligation regarding this RFQ until a written contract is approved and executed by all parties and funding of the Project occurs. The District s draft form of the AIA B101-2007, as modified by Owner, is attached to this RFQ as Exhibit A. By submitting a response to this RFQ, the

proposer agrees to the terms and conditions to the contract draft unless objections or requests for changes are specifically noted in the response to this request. 5. The cost of developing a response is the sole responsibility of the Architect. The GCCISD shall not provide reimbursement of such cost, and shall not be liable for any response preparation cost for any reason whatsoever. 6. If a contract is agreed upon, and a design is completed or purchased, the District reserves non-exclusive rights to ownership of the designs. Use of the designs by either the District or the Architect at any time without consent of the other is permitted. The District reserves the right to use the designs as many times as desired and with as any Architect as it desires. The Architect maintains the right to use the design with any client it desires and as often as desired. REQUIREMENTS OF THE RESPONSE: Response shall include or address the following items in the same sequence: Section 1: Applicant Introduction 1-1. A cover letter which shall include a brief statement of interest, years of business, and information regarding organizational structure, availability and intent to perform services; general qualifications for selection and signature of an authorized officer of the Architect who has legal authority in such matters. The cover letter should also indicate the submitter s name, address, phone and fax numbers, and person to be contacted regarding the response. 1-2. The name and address of all proposed design and engineering firms including, but not limited to, landscape, architectural, civil, structural, mechanical, plumbing, electrical, and communication consultants. Include number and experience of Architects, Lead Structural, Civil and Electrical Engineers, and Project Managers. 1-3. Provide a statement on the availability and commitment for all team members proposed for this Project. 1-4. Proof of professional licenses required by Federal, State, local or other administrative bodies for performing various components of the services to be provided. 1-5. To the extent not previously addressed the education, experience, capabilities, and accomplishments of Architect s employees who would be assigned to this project. Include brief resumes of these personnel. 1-6. Provide proof of professional liability insurance, general liability, auto liability and worker s compensation/employer s liability insurance. Professional liability insurance should remain in force during the term of the contract. Please state the carrier, agent, amount, expiration date and length of time you have maintained coverage for professional liability, general liability, auto liability and worker s compensation/employer s liability insurance coverage. Provide history of claims regarding design errors and omissions and other professional liability claims. The district will be requesting the architect to carry errors and omissions insurance with a 1 million dollar ($1,000,000.00) limit per project in aggregate Section 2: Proposed Team for GCCISD 2-1. Describe the team proposed for this project, including on-site management. 2-2. Organizational chart, proposed schedule and summary report reflecting the Architect s approach and factors to be considered in designing these projects. Provide a description of planned efforts to provide quality work, meet schedules, and work within an agreed budget for construction. 2-3. Criminal background checks will be conducted for all applicant personnel.

Section 3: Applicant Project Experience 3-1. Provide a list of projects involving new construction of educational facilities for which Architect has provided design and construction administration services in the last seven (7) years. The list shall indicate the name, owner, owner s contact, designers, start and completion dates, size, budget, final cost, cost overrun, and a brief description of each project. Identify projects that have been designed but have not been built or currently under construction. 3-2. Provide a comprehensive list of all projects for which the applicant firm provided comparable Architect services for Texas Public School Districts in the last three years. Include total project cost and Client/Owner contact information. 3-3. Identify all construction projects within the past seven (7) years on which Architect rendered professional services on which a claim was asserted. Claim means litigation, submission to a dispute resolution board, or the use of other alternate dispute resolution such as mediation or arbitration. For each such project identified, please state the nature and description of the claim, including alleged claims for professional errors or omissions, contract extras, delay, disruption or impact claims, time extension claims, or other similar claims; the identity of the owner, architect or consultant, and contractor; whether Architect, or Architect s agents, employees or consultants, was a party or alleged to have some responsibility for the claim; and the disposition of the matter. Section 4: Project Approach 4-1. Describe the Architect s design and administration process for projects of this type. 4-2. Describe Architect s quality assurance program. 4-3. Describe your firm s demonstrated technical competence and Architect qualifications. 4-4. Describe your cost control methods for design and construction phases. How do you develop cost estimates, how often are they updated, and what steps are taken to realign costs? 4-5. Describe the way in which your firm develops and maintains work schedules to coordinate with the Owner s project schedule. 4-6. Describe how your firm manages dispute resolution and claims avoidance services. 4-7. Describe your approach to managing this project expertly and efficiently, including team participation. 4-8. Describe the process of construction observation and inspections, the frequency of field trips recommended, reporting procedures and steps taken to confirm corrective measures are taken to assure the construction is in compliance with the construction documents. 4-9. Describe what you will do to foster teamwork and cooperation from contractors and what you will do to minimize adversarial relationships. 4-10. Provide a description of how you believe your firm would add value to the District s projects. METHOD OF SELECTION: The District will first select the most highly qualified Architect based on demonstrated competence and qualifications, and then attempt to negotiate with the Architect a fair and reasonable fee, TEXAS GOVERNMENT CODE 2254.004. Texas Administrative Code, Title 22, Rule 1.147 provides: Architect may submit information related to the monetary cost of a professional service, including information found in a fee schedule, only after the governmental entity has selected the Architect on the basis of demonstrated competence and qualifications pursuant to the professional Services Procurement Act.

A scoring chart is included as Exhibit B. This chart will form the basis for the Board s analysis of Applicant responses. The questions that make up each subcategory of the Scoring Chart are labeled. The District requires that all Applicant responses to Submission Requirements in Sections 1-4 be clearly marked as to the response to each question asked. For example, when answering Question 1-1, you must clearly label your response as the answer to Question 1-1. The District will not consider any information that is not properly labeled.

REPRESENTATIONS AND CERTIFICATIONS By submitting this RFQ the proposer: 1. Represents that to the best of its knowledge it is not indebted to the Goose Creek Consolidated Independent School District. Indebtedness to the District shall be basis for non-award and/or cancellation of any award. 2. Certifies that no suspension or debarment is in place that would preclude receiving a federally funded or state funded contract. Section 44.034 of the Texas Education Code, Notification of Criminal History, Subsection (a.), states a person or business entity that enters into a contract with a school district must give advance notice to the district if the person or an owner or operator of the business entity has been convicted of a felony. The notice must include a general description of the conduct resulting in the conviction of a felony. Subsection (b) states a school district may terminate a contract with a person or business entity if the district determines that the person or business entity failed to give notice as required by Subsection (a) or misrepresented the conduct resulting in the conviction. The district must compensate the person or business entity of services performed before the termination of the contract. Note: This Is Not Required of a Publicly Held Corporation. CERTIFICATION OF CRIMINAL HISTORY RECORD INFORMATION Senate Bill 9, passed during the 80 th Legislative Session, requires that all Texas public school districts receive certification from any entity with which it contracts to provide services that it has obtained a criminal history background check on all employees who: 1) have continuing duties related to contract services; and 2) have direct contact with students. All entities and individuals who contract with the District to perform services must complete the attached GCCISD Certification of Criminal History Record Information. An additional instruction sheet is included to provide information on how to obtain the required criminal history from Texas Department of Public Safety. Employees who are hired by an entity that contracts with a school district after January 1, 2008, must submit to national criminal history record information review which includes fingerprints and photographs before serving the district. Employees hired before January 1, 2008, must have a criminal history background check obtained from either a law enforcement or criminal justice agency, or a private entity that is a consumer reporting agency governed by the Fair Credit Reporting Act. The district may not allow any employee of the entity or an individual to serve at the district if information is obtained through this review that the employee has been convicted of one of the following: 1. A Title 5 felony offense 2. An offense requiring the individual to register as a sex offender 3. An offense under the laws of another state or federal law that is equivalent to a Title 5 offense. At any time, a school district administrator, including a campus principal or designee, may request copies of the actual criminal background check or national criminal history record information review from the entity or individual who has contracted with the school district or may obtain from any law enforcement or criminal justice agency all criminal history record information that relates to an individual described above. Instructions to School District Contractors Regarding Criminal History Background Searches Under Senate Bill 9 Senate Bill 9 directs school district contractors (i.e., Company) to obtain state and national criminal history background searches on their employees who will have direct contact with students, and to receive those results through the DPS criminal history clearinghouse (Fingerprint-based Applicant Clearinghouse of Texas - FACT). In order for contractors to receive the information through FACT, they must first establish an account with the DPS for FACT clearinghouse access. The Company owner must sign a user agreement with the DPS. PLEASE NOTE: After the Company signs the DPS User Agreement for FACT, DPS will provide the company with a revised FAST Fingerprint Pass that Company will have to provide to its employees and applicants.
