1. PROMOTION Bank Simpanan Nasional s ( BSN ) ( Promotion ) shall commence from 15 August 2016 and ends on 15 November 2016 ( Promotion Period ) unless notified otherwise. 2. ELIGIBILITY 2.1 This Promotion is exclusively for New-To-Bank ( NTB ) Customer who during the Promotion Period applies for the BSN Visa Platinum Credit Card/-i or BSN Visa Gold Credit Card/-i (not applicable to Co-Brand Cards). 2.2 NTB Customer who: (a) performs Qualified Retail Transaction with a minimum of 3 swipes of any amount; OR (b) Perform Qualified Retail Transaction with a cumulative minimum spend of RM800 in 3 swipes within sixty (60) days from the credit card approval date will qualify to participate in this Promotion and stand a chance to win the Gift. 2.3 Only Principal Cardholders qualify to participate in this Promotion. However, any retail transaction(s) made by the Supplementary Cardholder will be aggregated to Principal Cardholder s Credit Card/-i and qualify the Principal Cardholder s for the Promotion. 3. PROMOTION MECHANICS 3.1 To participate in this Promotion, no pre-registration, Short Messaging System (SMS) or Promotion entry form is required. 3.2 NTB Customers whose credit card application is made during the Promotion Period and is approved by BSN on or before 30 November shall qualify for this Promotion. 3.3 The NTB Customer account must be valid and in good standing at all material times including during the Promotion Period and the period leading to Gifts delivery. 3.4 The following categories of persons shall not be considered as NTB Customer and SHALL NOT BE ELIGIBLE to participate in this Promotion: (a) Existing Principal Cardholders of any BSN Credit Card/-i; M/surat 1 drp. 6

GIFTS (b) (c) (d) (e) TERMS AND CONDITIONS Former Cardholders who are no longer hold any valid BSN Credit Card; Cardholders whose Credit Card account(s) is/are delinquent; Cardholders who have cancelled their BSN Credit Cards and have reapplied for a New BSN Credit Card as a Principal Cardholder within six (6) months from the date of such cancellation; or Cardholders who have committed or are suspected of committing any fraudulent, unlawful or wrongful acts in relation to any of the facilities granted by BSN or have been declared bankrupt (pursuant to a petition by either banks or by any third party) or are subject to any bankruptcy proceedings at any time prior to, during or after the Promotion Period. 4.1 Subject to availability of stocks and strictly on first come first serve basis, the NTB Customer will be entitled to receive the following gifts ( Gifts ) subject to the terms and conditions of the Promotion: (a) Barry Smith Luggage Bag worth RM1,299 (RRP) (i) NTB Customer who performs Qualified Retail Transaction with cumulative minimum spend of RM800 with a minimum of 3 swipes within sixty (60) days from the credit card approval date will receive ONE(1) unit of Barry Smith Trolley Bag worth RM1,299 (RRP). (b) Barry Smith Luggage Bag worth RM459 (RRP) (i) NTB Customer who performs Qualified Retail Transaction with minimum 3 swipes of any amount within sixty (60) days from the credit card approval date will receive ONE (1) unit of Barry Smith Luggage Bag worth RM459 (RRP). 4.2 The Qualified Retail Transaction refers to retail transactions made locally and overseas, including online transactions. 4.3 The following transactions shall be considered as Non-Qualified Retail Transaction for the purpose of this Promotion:- (a) BSN Auto-billing, (b) BSN Balance Transfer Programme, M/surat 2 drp. 6
(c) (d) (e) (f) (g) (h) (i) (j) BSN EasyCash Plan, BSN 0% EasyPay Plan, BSN Instalment-Pay Plan, Cash Advance/Withdrawal Transactions/Cash Back, Reversals or Refunds, Disputed, Unauthorized and/or Fraudulent Retail Transactions, Split and/or Void Transactions, Any other fees or charges such as cash advance fees, finance charges and late charges. 4.4 Any determination by BSN as to what constitutes retail transaction shall be conclusive and shall not be challenged in any manner whatsoever. 4.5 BSN reserves the right to substitute the Gift with other merchandise of equal or greater value if the Gift is unavailable for any reason. Gifts will be given based on stock availability and strictly on first come first serve basis. 4.6 The Gift will be provided on an As Is basis. Visuals of the Gift shown in printed materials and/or website are for illustration purpose only. Such visuals may not depict the actual colour, model of specifications of the Gift and the Gift does not include any additional accessories. 4.7 BSN gives no representation or warranty with respect to the quality and/or suitability of the Gift and any dispute/claim arising from warranty or information concerning Gift received under this Promotion shall be settled between the NTB Customer and the manufacturer and/or dealer and no recourse should be sought from BSN. 5. CLAIM OF GIFTS 5.1 The Gift will be delivered to the Winner s billing address as per BSN s records between six (6) to ten (10) weeks from the notification date. 5.2 In the event that the Winner does not receive the Gift, the Winner is to notify BSN Credit Card Centre at 03-20286610 or 03-20286612 (from 9.00am to 5.30p.m., M/surat 3 drp. 6
Monday to Friday) of the same not later than 12 April 2017. Failure of the Winner to make any claim, the Gift will be automatically awarded to other NTB Customer as BSN deem fit. BSN will not be liable in any manner whatsoever for non-receipt and/or unclaimed Gift due to the failure of the Winner to notify BSN Credit Card Centre within the stipulated period. 5.3 The above Gifts are non-transferable and non-exchangeable for cash, credit, cheque or in kind. 5.4 The Gift is valid on a first-come, first-served basis, subject to stock availability. 5.5 Each Winner is eligible to win ONE (1) Gift only. 5.6 All Winners will be notified by mail and/or any other method(s) deemed suitable by BSN. 5.7 BSN reserves the rights to select other Winner(s) to substitute any Winner(s) who may be ineligible or disqualified for any other reason whatsoever throughout the Promotion Period. 6. GENERAL 6.1 By participating in this Promotion, the NTB Customer agrees: (a) that BSN s decision on all matters relating to the Promotion shall be final, conclusive and binding on all NTB Customer and no further correspondence and/or appeal to dispute BSN s decision shall be entertained; (b) to be bound by the Terms and Conditions ( T&Cs ) of the Promotion; (c) to access official website at www.mybsn.com.my (BSN s website) at regular time intervals to view the T&Cs and ensure to be kept up-to-date on any change or variation to the T&Cs. 6.2 BSN reserves the right: M/surat 4 drp. 6
(a) (b) (c) to add, delete, suspend or vary the T&Cs contained herein, either wholly or in part at its absolute discretion, by way of posting on BSN s website or in any other manner which BSN deems practical; to disqualify any NTB Customer for any reason whatsoever as BSN may in its absolute discretion deem fit to participate in this Promotion and/or be entitled to the Gifts; and to forfeit the Gifts in the event of non-compliance to the T&Cs herein. 6.3 This Promotion is not applicable in conjunction with any of BSN s ongoing credit card application Promotions (if any) unless otherwise stated. 6.4 The NTB Customer and/or Winners are liable and shall personally bear all applicable taxes, government fees or any other charges that may be levied against them under applicable laws, if any, in relation to participation in this Promotion and/or collection of the Gifts. 6.5 These T&Cs are in addition to the Cardholders Credit Card Agreement applicable to the Credit Card Cardholders in respect of the Promotion. In the event of inconsistency between the T&Cs and the said Agreement, the former shall prevail in so far as they apply to this Promotion. 6.6 In the event of any discrepancy between these T&Cs as compared to any advertising, promotional, publicity and other materials relating to or in connection with this Promotion, the final T&Cs on BSN s website shall prevail. Any matter with regards to the Promotion which is not covered in these T&Cs will be determined solely by BSN at its discretion. 6.7 Any termination of BSN Visa Platinum Credit Card/-i or BSN Visa Gold Credit Card/-i account at any time prior to the delivery of the Gift will give right to BSN to automatically disqualify the NTB Customer from receiving any Gift in the event the NTB Customer is selected as a winner. 6.8 The NTB Customer and/or Winner(s) also agrees and consented to their personal details including without limitation personal data or information being collected, processed and used by BSN for the purposes of the Promotion. BSN reserve the right to request any documentation or written proof of the Winners identity and details for verification purposes. 6.9 NTB Customer and/or Winner(s) hereby expressly provide consent to BSN, at its discretion, publishing and/or displaying materials and/or any information including but not limited to the names and/or photographs of the NTB Customer and/or Winner(s) for current and future advertising and promotional purposes in any manner that BSN deem appropriate. 6.10 BSN shall not be responsible and/or liable nor shall it accept any form of liability whatsoever nature and howsoever arising or suffered by NTB Customer resulting directly or indirectly from the NTB Customer participation in the Promotion or otherwise. Furthermore, BSN shall not be liable for any default of its obligation under this Promotion due to any force majeure event which include but not limited to act of God, war, riot, lockout, industrial action, fire, flood, drought, storm or any event beyond the reasonable control of BSN. 6.11 The T&Cs herein shall be governed by and construed in accordance with the laws of Malaysia and the NTB Customer agrees to submit to the jurisdiction of the Courts of Malaysia.
