President Message Dr. M. Balasubramanian State President, IMA TNSB RIGHT TIME & RIGHT WAY TO PROVE OUR MIGHT All of us should feel proud of us as the privileged members of Indian Medical Association, the largest association of modern Medical Practitioners in the World which has been tried, tested and trusted since 1928. IMA has played significant pivotal role in all National Health Programmes and established itself as the largest NGO with network in all the districts all over India. Our IMA Head Quarters with our National President Dr.Jitendra Patel and Secretary General Dr. NarendraSaini has announced Blood Donation Camp to be organized in all its 1800 branches on June 29th to mark the Doctors Day on July 1st. IMA Tamilnadu is one of the top state branches with rich activities and relied to perform better. IMA Tamilnadu has found the right partner with Tamilnadu Branch of Indian Red Cross Society to bring donors for the blood donation camps. DME & DMS have issued letter at our request to all the Government Blood Banks to co-operate and co-odinate with IMA and send their team for our Camps. Now the ball is in every local branch court. Executive Committee of each branch should meet respective district I.R.C.S. and nearest Government Blood bank and arrange the Blood Donation Camp on any day between June 23rd Monday to June 29th Sunday and send the reports to our IMA State Office. Past & Present State Office bearers role as a catalyst will be really useful to relish the success. We thank Dr. A. Muruganathan, our Past State President and Vice President of Indian Red Cross Society for arranging our His Excellency Governor of Tamil Nadu to inaugurate on 23rd June, 2014 at IRCS Campus in Chennai Egmore. It is the right time and right way to prove our might. World Environment Day ('WED') is celebrated every year on June 5 to raise global awareness to take positive environmental action to protect nature and the planet Earth. IMA family members children have secured high marks in their Board Examination. We welcome and congratulate the new Central Government for the Betterment and Bright future of our Great Nation. +2 Students Topper Dr.Sadagopan's award is issued every year for the IMA Member's children, who achieved high marks in the 12th Standard Board Examination. Membership Drive The fees for the New Life membership will be increased by June 30th 2014. All the branchs of IMA are requested to enrol more members. This May we have enrolled 156 new members which is disappointing. 279th State Council Meeting 279th State Council Meeting is going to be conducted at King Chic Hall, VV Towers, Palayamkottai, Thirunelveli on June 15th 2014 Sunday. All State office Bearers and State Council Members of each and every branch are requested to attend the 279th state council meet, because your suggestion are valuable for the new projects. Thirunelveli Branch is making elaborate arrangements and also for sightseeing to nearby places. Nursing Home Board Meeting We are going to have 101 Nursing Home Board meeting at Cuddalore on June 22nd 2014 and make your presence in large numbers to discuss important issues like standardisation of Hospitals and Clinical Establishment Act. Clinical Establishment Act IMA TNSB is discussing with Tamil Nadu Government about the Clinical Establishment Act. An appeal is sent to the State Government to implement the Act to be Doctor Friendly and Protocols of Treatment etc., The Regulation of the Clinical Establishment Act discussed on May 24th 2014 at IMA Hall Trichy. IMA Doctors Day Celebration Doctors Day is going to be celebrated on July 6th 2014, IMA Hall, Madurai, the nomination for the Best Doctors Award can be sent on or before June 20th 2014. Kindly refer the criteria for the Best Doctor in TIMA. Child Protection and Child Sexual Abuse Indian Medical Association & CMAAO is organizing a Symposium on Child Protection and Child Sexual Abuse in collaboration with UNICEF on 7th June, 2014 at India Habitat Centre, Lodi Estate, New Delhi. Work shop on Basic bedside procedure, etc was conducted at Chennai-Thambaram, Thivuvarur organized by Tiruvarur Medical centre and IMA Tiruvarur on 27th April. Nearly 100 participants got benefited with this practical work shop. Our next Work shop is at cuddalur on 21st june ZONAL MEET: We had 9th zonal meet and work shop of IMATNSB PARAMEDICAL WING at Chennai on 8th March. 10th Para Medical Zonal meet cum workshop is to be held at Cudalur on 21st June. Cudalur IMA is actively and enthusiastically organizing the meet, planning to get CME credit hours for participants and also to add in addition to workshop Role Plays, Poster competition etc.. We have been very busy with various activities. Our centenary meet at Mahabalipuram was a great success. Nearly 300 delegates participated. A souvenir with useful details was released by our health secretary Dr.J.Radhakrishnan. We also had the privilege of releasing a postage stamp to mark the event. The stamp was released by our National President Dr.Jitu Patel. There were useful discussions, the star topics was a panel discussion on Insurance. We made a profit of Rs.1,13,000/- from the meet. Subsequently we have been engaged in negotiations with the state government regarding the clinical establishment act. This act is in the final stages of drafting and expect to be implemented soon. We have managed to extract reasonable concessions in the rules of the act from the government. The NHB is also busy in collecting data from all our members to determine the levels of hospitals based on the criteria set by government of India. The response from our members is encouraging. Meanwhile we have circulated protocols of treatment as set by government of India to all our members. We have sought suggestions regarding the standards from eminent personalities and professors. All this efforts have kept up us busy but we are happy serving you. After we taking over the FSS we have collected One Crore and Forty Lacks Rupees upto 16th dues. It is unfortunate that first time we have deleted 77 members permanently from FSS. They cannot join in FSS in future. We have circulated all the defaulters list to all the branch of IMA and we are thankful to the branches within 10 days 30 laks Rupees were the collected. Hence General Body of the FSS has decided to give 5% as incentive from the Entry fees to all the branches of IMA and also some awards and rewards for the branches which collect the maximum money. Dear members everybody knew that our FSS Scheme is much beneficial than any other Insurance schemes and we have attractive concession for the youngster to join FSS. The entry fees for below thirty years is only 3000/- while entry fees from 40 to 50 is enhanced to 50,000/-. I appeal to all the young doctors to join FSS before 40 years. Dear members the General Body has decided to delete the chronic defaulters permanently to save the scheme. We have 9504 members and members are regular in payment will be around 7000/- unless all the members are made regular it is very difficult to sustain the scheme. Dear Friends we are paying Rs.190/- per death is not for our Family Security, alone it is only for our poor colleague's family also. Last year total no of deaths are 50 and till date (upto may 2014 it is 24 deaths). We have decided to collect the money for the actual deaths and for last year's due to collect money for extra 20 deaths. Hence all the members are requested to pay the dues Rs.3800/- before July 30TH any excess money will be adjusted in the next year dues. MEDICO LEGAL IMPLICATIONS OF SURGICAL DIATHERMY BURNS: Diathermy plays an integral part of most operations, either for dissection or coagulation and it is used on a regular basis by surgeons of all specialities. Even though modern diathermy equipment is considered to be safe, accidents still do occur. These accidents particularly happen if the operation is performed in emergency situations in which the patient's clinical condition is urgently fatal and members of the team could only focus to the surgical area. The false steps in monopolar diathermy application cause a situation called the diathermy burns. Although most of the newest diathermy machines are largely safe, the electric fields they generate are still inherently hazardous for the patient, operating surgeon, and theatre staff. They can cause burn injury, electrocution, operating room fire, smoke inhalation and gene mutation. Iatrogenic cautery burns during surgery may result from one of the following four mechanisms: Direct contact burns from the active electrode resting on the patients skin or contacting the operating staff. Burns at the site of the grounding electrode Burns resulting from electrode heating of pooled solutions such as spirit and Burns occurring outside the operative field as a result of circuits generated between the active electrode and an alternate grounding source. Electrical burns to patients are usually predictable and easily preventable and have been reported to result from insulation failure of the active electrode direct coupling from the active electrode to another conducting instrument or capacitive leakage of current. Safety precautions for preventing or minimizing electrosurgical injury:- Identifying risk managers in the operating room Ensuring proper education of all staff Awakening of the capabilities and drawbacks of equipments Strict adherence to the manufacturer's instructions Inspecting insulation carefully Using the lowest possible power setting Using a low-voltage(cut)waveform 14 J U N E 2 0 1 4 Transfusion of blood and blood products helps save millions of lives every year.

Using brief intermittent activation vs. prolonged activation Not activating in an open circuit Not activating an electrode in close proximity or direct contact with a metal/ conductive object Using of disposable neutral plates with conductive gel coating. If reusable plates are used, the insulation should be checked daily Proper application of neutral plates in carefully located areas that are away from potential areas of pooling Avoiding of metal contact with the patient's body Avoidance of spirit-based disinfectants and pooling of preparing solutions Using bipolar electro surgery when appropriate Selecting an all metal cannula system as the safest choice in the operative channel for active electrodes Not using a hybrid system (metal and plastic components) Organizing a team that includes also a biomedical engineer and perioperative nurses Most of the burns are not detected early, so inspecting the patients have to be common rule prior to shifting them from the operating room. Considering number of operations performed annually, the reported rate of complications from electrosurgery is extremely low. However when such accidental burns produce unsighty scars from superficial burns and if disability occurs patients may file legal suits in consumer fora. Section 287 IPC: Negligent conduct with respect to machinery : Whoever does, with any machinery, any act so rashly or negligently as to endanger human life or to be likely to cause hurt or injury to any other person, or knowingly or negligently omits to take such order with any machinery in his possession or under his care as is sufficient to guard against any probable danger to human life from such machinery, Shall be punished with imprisonment of either description for a term which may extend to six months, or with fine which may extend to one thousand rupees or with both. As long as we continue to use the available conventional unipolar electrocautery, the hazard of burns to patients particularly at the grounding pad side must be born in mind. The operating surgeon should be mindful of the risks involved and be proactive to ensure the patient's safety and personal safety so that we doctors will avoid litigations. In many countries, there is not an adequate supply of safe blood, and blood services face the challenge of making sufficient blood available, while also ensuring its quality and safety. Cell: 94430 22328 / e-mail: lccpplsssgobi@gmail.com Warm Greetings, In the last issue we stated why Kolkatta AMRI Hospital had to pay around Rs 11 crores as compensation and the importance of keeping good records and recording any event that is not a normal occurrence. Now, the painful part, we shall see how we behaved in the litigation. Here the one's competence in his medical knowledge and treatment is not questioned by the court. How medical men behaved as educated, respected persons of the society is questioned by the Court.. In this case of Kunal Saha Vs Kolkatta doctors, D-1, a consultant, denied prescribing Depo- Medrol in the court; but when confronted with his own prescription slip prescribing depomedrol, he has to swallow his earlier statement. Secondly, he said that his prescription is invalid since he left India on the same day. The court rightly held that the prescription is valid for the whole period he prescribed irrespective of his presence or absence in the country. Thirdly, he blamed the in charge specialist of the patient- D-5, for carrying out his prescribed treatment. So that Doctor-D-5, has to make a statement against Dr-1,- mudslinging. The Supreme Court ordered D-1 to pay Rs 10 Lakhs compensation These are all not my statements. It is all given in the Judgment of Supreme Court. Then D-2, a consultant, correctly diagnosed the case on the day he saw the patient and prescribed prednisolone -heavy dose without any schedule for tapering it. When asked, he stated that he was not seeing her after the first consultation, nor he was informed about the case. But he signed a certificate after 5 days stating that the patient is fit for transfer from Kolkatta to Bombay. When confronted with the certificate in the court, he had no answer. Then he blamed the specialist doctor in charge of the patient D-5, at AMRI Hospital for not tapering the dose. Since he issued certificate after 5 days, Court concluded that the patient was under him for treatment and asked him to pay compensation of Rs.10 lakhs. The specialist doctor in charge of patient at AMRI Hospital D-5, stated that even though he is looking after her in the Hospital, he was made to carry out the orders of the senior consultants D- 1 & D-3 and so he is not at fault. Since he is also a consultant, though junior and should have raised objections to the irregularities in treatment. A specialist cannot be mute when a wrong treatment was being carried out. D-5 was also ordered to pay compensation of Rs 5 Lakh. WHAT IS THE VIEW OF THE COURT? 1. It is also of some great significance that both in the criminal as also in civil cases, the concerned doctors took recourse of the blame game. Some of them tried to shrink their individual responsibilities. 2. It is generally expected that very senior doctors would behave responsibly, and they were entitled to take any defense which is available to them, but should not resort to mudslinging. This being the case, where both sides being doctors, fair dealings were expected from them. What is the lesson for us? When treating a patient we should work as a team and when legal problem arose, defend as a combined team. Indian Medical Association Tamil Nadu State Branch discussed with Indian Red Society Tamil Nadu State Branch so that all the Branch President and Secretaries are requested to contact the respective Indian Red Cross district coordinators to make elaborate arrangements for the Blood Donation Camps. Indian Red Cross Society has already sent circular to their district Office Bearers. Kindly make this National program grand success. So that we will be No.1 in the country. How to Organize Blood Donation Camps? Aim : To do good work in society and help the needy on behalf of Doctors Day 2014. Purpose: Shortage of Blood in all Blood banks and lack of motivation in society about Blood donation. Procedure: 1) Contacts Blood Banks for fixing date (1st July, Doctor Day-for convenience nearing Sunday i.e. 26th June or 4th July + 1 week) and Venue. 2) Organizing Group: With IMA members you should contact in general AMC members and other groups like Rotary Club, Lions Club, Youth Club, Local Doctors Association, Railway Union, Medical Stores, Chemist Association, Non-Political social organization, Religious, corporate groups and other NGO's as a supportive group to bring donors, sponsors and Volunteers to work during the camp. 3) Fixing Venue: Fixing Common public places for Blood Donation Camps like Hall, Railway Station, Hospital, School/College etc., (Having are of approx 1500Sqft). 4) Eligible Donors: Age 18-60 years, Weight more than 45kg, male or female. a) History taking of the patients is very important. b) Pregnant lady not permitted. c) Hb level not less than 11.5gms d) Heart diseases patients & certain medical condition like T.B, Cancer, Thallasemia, HIV etc., 5) Motivation: a) By sending SMS, Doing personnel phone calls to the eligible donors. b) Print Banner (approx 5-10 nos) & Hand Bills (1000-5000 nos) for promotion having footings of those who sponsor. 6) Preparation in the Venue: During day of camp preparation in the venue should be completed at least in one hour in advance (approx 8.00am) by keeping the following things ready. 1) Clean flooring (carpet sos if required) 2) Arrange 6 to 10 cots ( inquire if Blood Bank brings the cot, otherwise arrange yourself) 3) 4-6 Tables (for registration, Hb estimation, Blood Collection etc.,) 4) 30-40 chairs (variable for the Blood Bank people, donors, etc.,) 5) 4-5 fans(having nice air flow) 6) Ensure Electricity is there or might have to arrange generator. 7) Arrangement of Tea, Coffee, Biscuits for donors, Organizer, Volunteers. 8) Breakfast for the team of Blood bank (10-15) and Volunteers, doctor s(e.g Poha, Vada-pav sanmosa etc.,) 9) For details, see the work list, Contact convener, coordinator 7) Promotion of Donor: Promotion of Donor by giving some incentive like Batch, Certificate, Trophy, motivational Gift like Tree plant, flower, book etc., 8) Food: Lunch for Blood bank team after completion of camp. However some snacks in between. With appropriate visuals, posters and stickers may be prepared with these slogans. In hoardings and TV spots these Slogans may also be used: 1) Blood donation is friendly gesture. 2) Blood Owners should be Blood donors. 3) Blessed donation will cost you nothing but it will save a life! 4) Share blood- Share life. 5) A life is waiting for a bag of blood from you. 6) Blood is meant to circulate. Pass it around. 7) Let us be blood brothers. 8) Smile and give, someone will smile and live. 9) Let blood bind us together in friendship forever. 10) Share a little, care a little- Donate Blood.
