APPLICANT: The Futbol Club, Inc The applicant is proposing to operate The Futbol Club, a training facility center, in a Light Industrial zone (M-1). In accordance with Article XVI Industrial M-1 District, Section 106-488, Special Exception Uses 106-488, an athletic club requires a special exception use permit when located in a Light Industrial District. The applicant is proposing to operate this facility in the Town Center located at 5219-5223 NW 35 Avenue. The hours of operation are Monday through Friday after 5:00 P.M. and on the weekends from 9:00 A.M. to 3:00 P.M. The specific extent of the anticipated use is explained in Attachment A, and made a part of this report. Staff has reviewed the proposed request in light of the guidelines and criteria contained in Section 106-158 & 106-159 of the City Code, and determined that an athletic club is a compatible use at this location. This area would be able to accommodate any anticipated effect on access, traffic generation, road capacities and parking needs caused by the use for which the special exception permit is being requested. The proposed use does not create any additional impact upon the capacity of utilities, or public services, and conforms to the goals, objectives, policies and land uses established by the City s code of ordinances. Since the bays have been vacant for more than a year, the opening of this business will create a positive impact in the area. Furthermore, the athletic club would be a welcome addition by increasing the City s effort to offer more health conscious activities to the residents.
It is anticipated that this location will be able to accommodate any effect on access, traffic generation, road capacities and parking needs caused by the use for which the special exception use permit is being requested. If for any reason in the future, there is any negative impact upon the capacity of utilities, or public services, the applicant will be required to provide for the mitigation. The Planning and Zoning Board meeting was held on June 5, 2012. Staff made a detailed presentation regarding the purpose of the proposed athletic facility within the City of North Lauderdale to further the City s efforts in healthy development of children. The Board voted 4-0 to recommend approval of the SEU permit to the City Commission with two additional safety conditions; adding protective coverings cases to the lights in the building and to protect the windows by covering them with a mesh. Recommendation Staff recommends consideration and recommendation of approval by the Planning and Zoning Board to the City Commission of the proposed SEU permit subject to the following conditions: 1. That the applicant complies with all applicable codes of the City regarding the development and operation of an athletic club. 2. That all terms, conditions, and provisions imposed by the City Commission, Planning and Zoning Board, and staff, including all life, health, and safety Codes pertaining to this facility are met prior to commencing and during operation. 3. In the event that any problems arise as a result of the operation of this establishment, such as noise, parking, traffic and/or other nuisances, the applicant makes all improvements required to mitigate these nuisances so as not to negatively impact adjacent commercial/residential areas. 4. Applicant shall obtain proper approvals such as Certificate of Occupancy, Local Business Tax Receipt from the City and any other appropriate approvals from outside agencies. 5. That all applicable City and Florida Building Codes regarding such an operation shall be met and necessary building permits obtained and final inspections approved prior to opening for business. 6. If the club decides to host competitions and or increase activities that would impact the parking within the industrial park, then the applicant must submit a request for amendment to the SEU to accommodate these changes.
7. Applicant shall install protective coverings over the lighting in the building prior to opening for business. 8. Applicant shall cover all windows with a protective mesh prior to opening for business. If the Commission concurs with this request, the following motion is in order: Motion to approve the proposed Special Exception Use permit to allow The Futbol Club to operate in an Industrial (M-1) Zoning District subject to the conditions as outlined in the staff s memorandum.
