Introduction VETS 4212 Report What? Vietnam Era Veterans Readjustment Assistance Act (VEVRAA) required Federal Contractors and subcontractors to report annually, as of a reporting period by job category and hiring location, the total # of: o protected veteran employees/employees o protected veterans hires /new hires Agency VETS Office (Veterans Employment and Training Service) Other Info: o Proof of filing is requested during an audit o Records should be kept for 3 years o To check if you filed in the past years, you can download a report from DataDotGov https://devtools.dol.gov/developer 7
Who Must File VETS 4212 Report Federal Contractors ONLY 61-300 of the C.F.R. VETS 4212 o NEW: Those who have a federal contract of $150,000 or more entered into or modified after October 1, 2015. o Note: In prior years, the threshold was $100,000. 8
When to File VETS 4212 Report Annual report(s) must be filed no later than September 30 th VETS 4212 reporting application opens August 1 st of every year. 9
Reporting Information VETS 4212 Report Employment data should include all employees (part-time and full-time) and identify those who are protected veterans for any payroll period ending between July 1 through August 31 of the current survey year Report all new hires (full time and part-time; protected veteran and non-veteran) during the 12 month period from the chosen payroll period No longer required to report the specific protected veteran category 10
VETS 4212 Report 61-300 of the C.F.R. VETS 4212 Categories Active duty wartime or campaign badge Veteran means a veteran who served on active duty in the U.S. military, ground, naval or air service during a war or in a campaign or expedition for which a campaign badge has been authorized under the laws administered by the Department of Defense. Armed Forces Service Medal Veteran means any veteran who, while serving on active duty in the U.S. military, ground, naval or air service, participated in a United States military operation for which an Armed Forces service medal was awarded pursuant to Executive Order 12985 (61 FR 1209, 3 CFR, 1996 Comp., p. 159). Disabled Veteran means (1) A veteran of the U.S. military, ground, naval or air service who is entitled to compensation (or who but for the receipt of military retired pay would be entitled to compensation) under laws administered by the Secretary of Veterans Affairs, or (2) A person who was discharged or released from active duty because of a service-connected disability. Recently Separated Veteran means a veteran during the three-year period beginning on the date of such veteran s discharge or release from active duty in the U.S. military, ground, naval or air service. 11
Reporting Information VETS 4212 Report Employees (and Hires) will be reported by: o EEO category o Protected veteran status o Location (establishment) Data/Information Needed: o List of employees and new hires o EEO cat. for each employee/new hire o Protected veteran status o Complete work location address* o NAICS o Dun and Bradstreet number o Federal Tax ID number o VETS number 12
How to File VETS 4212 Report Website: File online at DOL VETS website: http://www.dol.gov/vets/vets4212.htm Log-in Information: o First Time Filer Select Request Access for a New Company, you will need to enter your company s information (i.e. name, address, EIN, DUNS, NAICS) o Returning Filer Passwords will need to be reset every 60 days https://vets4212.dol.gov/vets4212/account/resetpassword 13
How to File VETS 4212 Report Method Manual Input or Batch Filing Manual Input o This is the preferred method for organizations with only one or very few locations to file o Can utilize pivot tables to create data counts for manual input into the website (employees and hires) Batch Filing o This is the preferred method for organizations with multiple locations to file o Much more convenient o Need some programming work to get the data conform according to the specifications set-up by the VETS Office http://www.dol.gov/vets/programs/fcp/vets-4212_upload_inst_requirements.pdf 14
How to File VETS 4212 Report Batch Filing (Cont.) o Data files will have to be converted into ASCII/Text or CSV/XML format o Contractor is responsible for uploading the final data file into the VETS website o All company-related information must exactly match the information in the VETS database (i.e. company name, address, VETS number). If not, the report will generate an error o Reports should be available right after an upload; please note, if you re a larger organization it may take longer for the reports to show 15
How to File VETS 4212 Report Notes Employers MUST file a report for each establishment (i.e., physical work location) with 50 or more employees ONLY employees who identified as protected veteran should be included in the report. The total employees and total new hires counts should include both protected veterans and non-veterans Establishments with less than 50 employees can be consolidated into a State report (e.g., employer has 5 locations in CA all of which has less than 50 employees, a CA report can be filed for all 5 locations) Contractors have the option to file individual reports for each of their locations and forego the use of the State-consolidated report 16
