The Agency has a fiscal duty to sell these properties for at least the fair market value, as outlined in the Agency's Long Range Property Management Plan. The two properties are listed below: 1. APN 118-070-08 2. APN 118-070-14 : The purpose of the RFP is to seek and enter into a contract with a licensed real estate professional firm or individual ( Proponent ) who has the requisite experience, understands the local real estate market, and is effective at marketing government-owned real estate. The City of Crescent City (the "City") will act on behalf of the Agency in order to select a Proponent and work with the Proponent to sell the properties. The main objective is to sell both properties owned by the Agency for fair market value or greater. Properties will be evaluated by the selected Proponent and the City with regard to qualifications, marketing strategy and market pricing, prior to placing each property for sale. All activities related to the marketing and sale of the selected properties are subject to the review and approval of the City. The successful selected Proponent will act effectively at attracting and securing well-funded and wellqualified buyer(s) for the properties offered. This RFP is designed to provide interested Proponents with basic information to submit a proposal that will meet the minimum requirements. It is not intended to limit a proposal's content or exclude any relevant or essential data. Proponents are encouraged to expand upon the minimum requirements of this RFP. Page 2 of 5
SCOPE OF REQUEST FOR PROPOSALS The following minimum information should be contained in the RFP response: 1. Name of Individual / Firm / Organization making the proposal 2. Contact information of person(s) with primary responsibility for the proposal 3. Local address of Individual / Firm / Organization 4. Telephone / fax / email / website 5. Description of strategy to attract qualified buyers: should include discussion of the overall strategy, timing, methods (print, media, internet), advertising schedules, target attraction initiatives, etc. 6. Compensation being requested: should reflect the proposed compensation package including all fees and commissions charged by the Proponent for each property or real estate transaction, including, but not limited to, costs of marketing, research, meetings with City, meetings with prospective clients, etc. This sheet shall be included in the RFP submittal and shall be in a separate, sealed envelope. 7. Experience which can include: a. examples of the Proponent's experience in similar buyer-attraction approach, especially those involving government-owned properties b. portfolio of related information and printed materials of similar successful sales including public/private partnerships c. qualifications and experience of key staff of Proponent proposed for this response; 8. Signature and title of RFP Proponent 9. Two references associated with similar, successful campaigns 10. Proof of current license in good standing with the California Department of Real Estate and, if selected, must obtain or hold a current City of Crescent City Business License 11. DUNS number 12. Tax ID number EVALUATION PROCESS The City will evaluate all responsive (complete) proposals received prior to the submission deadline, using the following evaluation criteria: Criteria Points Comprehensiveness of marketing strategy 10 Demonstrated ability to market this type of property in a timely manner 10 Demonstrated ability to use creative marketing 10 Demonstrated skill and expertise 10 Previous experience working with municipal governments in the last 10 years 10 References 5 Based on these criteria, a single successful proposal may be selected. If proposals are short-listed, the top-ranked Proponents will be interviewed by the City. If interviews are held, the Proponents will be contacted by the City to set up an individual time for an interview. During the interview, the Proponent Page 3 of 5
will be asked to make a brief presentation to outline the proposed approach to recruiting a qualified buyer. The Proponent may subsequently be asked questions by the evaluation committee relating to the information presented. Upon completion of the interviews, the City will make a final ranking of the Proponents to include both the submitted proposal and the interview. The top-ranked Proponent will then enter into contractual and fee negotiations with the City. Should the City and the top-ranked Proponent not satisfactorily negotiate a contract, the City will then enter into negotiations with the 2 nd, 3 rd, etc. ranked Proponents in order as required until a successful negotiation is reached. Upon successful negotiation, the Agency will be requested to approve the award of the contract and authorize the City Manager to execute the contract. The City will exercise its discretion in selecting a Proponent that, in the sole judgment of the City, best serves the interest of the Agency. The City reserves the right to waive minor irregularities in any proposal, to reject any proposal that fails to meet the RFP requirements in any respect, to reject all proposals for any reason, to modify and reissue the RFP, or to cancel the RFP. Any person or firm on the federal debarred list will not be eligible. PROTEST Any Proponent that submitted a proposal may protest another Proponent s proposal by submitting said protest and the reasons therefor to the City Manager within five (5) calendar days of the announcement of the selection committee s choice. Protests must be based on the proposal s lack of responsiveness or the Proponent s lack of responsibility. The City Manager will then have five (5) calendar days to respond with a determination to affirm or deny the protest. The City Manager s decision is final. PUBLIC RECORDS ACT Proponents should be aware that submittals are subject to the conditions of the California Public Records Act unless specifically marked confidential with regard to any trade secret information. TERMS OF PROPOSAL Proposals are to remain irrevocable and open for acceptance and negotiation with the City for a period of 45 calendar days from the closing date. ADDITIONAL CONDITIONS The costs and expenses to the Proponent associated with the submission are the responsibility of the Proponent. Page 4 of 5
All correspondence, documentation and information provided by City staff to any Proponent or prospective Proponent in connection with, or arising out of this RFP process or the acceptance of any submission shall remain the property of the City. All submissions received as part of this RFP process shall remain the property of the City. Proponents must notify the City prior to any acceptance of the listing of any conflict of interest they may have with any property being offered. ACCEPTANCE OF CONDITIONS AND DISQUALIFICATION Submissions in response to the RFP constitute an acknowledgement and acceptance of the conditions set forth herein. Proponents that fail to observe the conditions set forth herein will be declared ineligible and their submission disqualified. Doing so will ensure you receive any schedule updates or addendums to this RFP, as well as responses to any questions received by the Agency. QUESTIONS Questions regarding this RFP must be submitted in writing on or before January 26, 2018 at 5:00pm PST. Only written questions will be accepted. All questions received prior to the above deadline and the Agency s response to those questions will be posted on the City s website and issued to all registered respondents by February 2, 2018.
