Should you have any questions regarding this correspondence I request you send them by mail as last year I had a near-death situation, surgery related to that situation in January of this year, and am currently undergoing radiation. I will respond to any inquiry as soon as my medical situation allows. Box 1364 Hereford, Arizona 8 5 6 1 5 June 2,2005 The Base Realignment and Closure Commission 252 1 South Clark Street Suite 600 Arlington, Virginia 22202 Dear Commissioners: This communication is in respect to the United States Army Intelligence Center and Fort Huachuca, Fort Huachuca, Arizona. Enclosed are documents that strongly suggest that the Intelligence activity on this Army Post warrants its re-location to another military installation where its day by day unclassijied activities can be more closely watched by others, including the general public and our nation's print and electronic media. That re-location might best be to an installation in the area of the District of Columbia. Transparency in terms of its activities that are unclassifed would be a positive step in the right direction. Enclosed are documents that show that two Army Public Affairs General Officers have elected to ignore the requirements of the Freedom of Information Act by failing to even acknowledge receipt of certified mail regarding misconduct at the United States Army Intelligence Center and Fort Huachuca including matters such as "black files" on US citizens and lawfblly admitted permanent residents (these files were protected under an order of the United States Courts), unlawful representations of government employees in violation of the Westfall Act, unlawful wire taps, the use of the "Attorney Work Product Doctrine" to conceal unlawful activity, and other matters.

Fort Huachuca is an asset to our nation and warrants remaining open given its electromagnetic environment and its air and land space. There is no reason why all other functions could not remain in place. The vacancy left by the Intelligence Center could be taken up by some other Army or DOD activity, or some other federal function. In fact, it might make an excellent training location for certain activities of the Department of Homeland Security such as those mandated to the Border Patrol along the US-Mexico Border. The fact of the matter is that the Intelligence Center and School could even be located on an existing Air Force, Navy, or Marine Corps facility with little reduction in capability to perform its &w_fuz missions. Carl Bloeser Enclosures: 1. One page letter to the Hon. Francis J. Harvey, Sec'y of the Army 2. Nine pages to Commanding Generals of US Army Public Affairs: BG Vincent K. Brooks, and BG Robert E. Gaylord 3. Ten pages titled "United States Government Representation of Personnel Accused of Torture and Other Acts in Iraq, Afghanistan, Guantanamo Bay and other Secret Locations Worldwide."

Box 1364 Hereford, Arizona 8 5 6 1 5 July 8,2005 Office of the Secretary of the Army Office of the General Counsel Army Pentagon Washmgton, DC 203 10 General Counsel: As neither the Office of the Chief of Public ABirs, Department of the Army to whom FOIA and PA requests were addressed, nor the Public Affairs Office of the United States Army Intelligence Center and Fort Huachuca who received those same requests by certified US mail met the statutory requirements of responding on a timely basis, please consider this an immediate appeal warranting the immediate release of the requested records. There is reason to believe that unknown parties decided, possibly with the concurrence of others, or at the direction of others, to the delivery of US mail to persons to whom the correspondence was addressed. That deliberate withholding of correspondence h m the intended parties and the failure to meet statutory requirements warrants this immediate appeal to your office. Attached is a copy of a letter fiom Mr. James W. Hill, Chief, Office of Security Review, Office of the Chief of Public Affairs, Department of the Army and copies of the three Freedom of Information and Privacy Act Requests for which a response has yet to be received. Sincerely, CQ,~KKLP/ Carl Bloeser enclosures

DEPARTMENT OF THE ARMY OFFICE OF THE CHIEF OF PUBLIC AFFAIRS 1500 ARMY PENTAGON WASHINGTON DC 2031 0-1 500 June 29,2005 SAPA-OSR Carl Bloeser Box 1364 Hereford, AZ 85615 Dear Mr. Bloeser: This letter is in response to your June 1, 2005 letter to the Secretary of Army concerning three Freedom of lnformation Act requests for which you have not received a response. Although your requests were addressed to Brigadier General Gaylord and Brigadier General Brooks, none were received by the Office of the Chief of Public Affairs, possibly because you mailed them to Fort Huachuca, and not to the Office of the Chief of Public Affairs in the Pentagon. In any event, the Chief of Public Affairs is not responsible for the Freedom of lnformation Act release of any records outside of the immediate Office of the Chief of Public Affairs. Our office will have no access to any such records, if they in fact exist. Public Affairs officers at subordinate Army commands and installations work directly for their command or installation, and do not report to the Army Chief of Public Affairs. If you are concerned with documents or records regarding you personally, held or released at Fort Huachuca, your Freedom of lnformation Act requests should be addressed directly to that installation's Freedom of lnformation Act officer. To my knowledge, there is no such position as the Senior Disclosure Officer at any level of the Army Since you have not received a response to your requests in the timeframe allowed under the law, you may choose to file an immediate appeal with the Army Office of the General Counsel. That office's address is Office of the Secretary of the Army, Office of the General Counsel, Army Pentagon, Washington, DC 20310. Sincerely, I/ JAMES W.
