1. Consulting you on NuGen s proposals NuGeneration Limited (NuGen), is currently developing its proposals for the Moorside Project. The Moorside Project includes the construction and operation of a new nuclear power station of up to 3.8 GW gross capacity. This figure is subject to turbine and technology choices which NuGen is currently considering and as a result, the actual generating capacity for the turbine and technology that is ultimately selected may be 5% higher or lower than this figure. The Moorside Power Station will be located on land (referred to in this document as the Moorside site ), which is to the west and north of the existing Sellafield Site, in Cumbria. The Moorside Project also includes other development such as worker accommodation, railway works and highway works. The entirety of these works comprise the Moorside Project, and the sites are collectively referred to as the Moorside Project sites. The Moorside Project is what is known as a Nationally Significant Infrastructure Project (NSIP) and so must be consented through the Planning Act 2008 via a Development Consent Order (DCO). Any decision on consenting the Moorside Project under the Planning Act 2008 would be made by the Secretary of State, following submission of an application by NuGen (anticipated to be made in Spring 2017) and an examination of that application which would be conducted by the Planning Inspectorate (anticipated to be in 2017/2018). The land for the future Moorside Power Station has been identified by the Government in a national policy statement as potentially suitable for a new nuclear power station. Before a DCO application can be made, NuGen is required to consult with those living in the vicinity of the land to which NuGen s proposed application relates (under Section 47 of the Planning Act 2008). NuGen is also required to consult with local authorities, persons with an interest in the land and prescribed statutory bodies (under Section 42 of the Planning Act 2008), as well as publicising its proposed application nationally (under Section 48 of the Planning Act 2008). NuGen is very keen to hear the views of local people that can help it develop the project in the best way. PAGE 3

Consulting you on NuGen s proposals NuGen s process for consulting people living in the vicinity of the land involves two stages: Stage One: Strategic Issues Consultation, which was carried out from 16th May 2015 to 25th July 2015. Information on how NuGen has taken into consideration the feedback received during Stage One consultation can be found in the Stage One Consultation Feedback Report, which is available at www.nugeneration.com. Stage Two: Proposed Scheme Consultation which will run from 14th May 2016 to 30th July 2016. This Statement of Community Consultation (SoCC) sets out how NuGen will carry out the Stage Two Consultation and consult with people in the vicinity of the development. The two stages of consultation will together help to shape the Moorside Project prior to the DCO application being submitted in 2017. In developing this SoCC, NuGen has consulted with the relevant local authorities and has taken their views into account. The relevant local authorities are: Copeland Borough Council the Moorside site is in Copeland and what is known as Associated Development will also take place there. Associated Development is defined in the Planning Act 2008 and is development which is associated with all or part of an NSIP. Allerdale Borough Council Associated Development may also take place in Allerdale. Cumbria County Council the Moorside site and any Associated Development would be located within Cumbria. NuGen also consulted with and has taken into consideration any comments from Eden District Council, Barrow-in-Furness Borough Council and Carlisle City Council on a draft version of the SoCC. This is because NuGen was considering potential development in these areas at the time of consulting on the draft SoCC, which are not now being taken forward by NuGen as part of its proposals for the Moorside Project. This SoCC covers details of: WHO WHEN WHAT HOW NuGen describes which groups of people it will be consulting. NuGen sets out when it intends to consult with you. NuGen describes what it is proposing to develop, what the process is for getting consent to carry out the project, and what it will be consulting on. NuGen sets out how it will consult with you and how it will take into account the responses we receive. PAGE 4

2. About NuGen and the Moorside Project NuGen is a UK nuclear company and is a joint venture between Toshiba and Engie. NuGen combines the strengths of its two parent companies two strong multinational companies with reputations for operational and engineering excellence, combined with comprehensive experience and expertise in the energy sector and over 350,000 employees worldwide. NuGen s nuclear reactor technology provider is Westinghouse Electric Company, a group company of Toshiba, and a leading supplier of nuclear plant products and technologies to utilities throughout the world. Westinghouse technology is the basis for approximately onehalf of the world s operating nuclear plants, including more than 50 percent of those in Europe. NuGen is proposing to construct, operate and maintain a nuclear power station at the Moorside site in West Cumbria with the capacity to provide approximately seven percent of the UK s current electricity requirement of low-carbon electricity, equivalent to meeting the electricity needs of about 6 million homes. The Westinghouse AP1000 Reactor The Moorside Power Station will include up to three Westinghouse AP1000 reactors, supporting cooling tunnels and related infrastructure, fuel and waste storage facilities, offices, training facilities, a visitor centre and other ancillary buildings, electricity transmission infrastructure, earthworks and landscaping and access and transport arrangements. NuGen is also proposing to carry out works to create new stretches of railway stations and platforms on additional sites at and between Corkickle and Mirehouse, new track at St Bees and at least one rail spur into the Moorside site with associated stations, platforms, sidings and rail freight facilities. These railway works may also qualify as an NSIP, subject to their final design. Similarly, NuGen is proposing to carry out works for a Marine Off-Loading Facility (MOLF), which will comprise various elements to allow for ships and vessels to load and unload cargo, which may also, subject to final design, qualify as an NSIP. 2. About NuGen and the Moorside Project NuGen is also proposing to seek consent for development associated with the Moorside Power Station (Associated Development). This will include works at the Moorside site, worker accommodation sites at Corkickle, Egremont and Mirehouse, and highways improvement works on a further nine additional sites within Cumbria. If the railway works or the MOLF are not ultimately definable as an NSIP, they may be included in the proposed DCO as Associated Development. Highway, bridge, rail and storage buildings and facilities works are also proposed at the Port of Workington, unless final logistics assessments prove they are not necessary to support the project. For Associated Development required by NuGen only during the construction phase of the Moorside Power Station, but not during its operational phase, NuGen will seek to encourage the potential for alternative permanent uses for the land, infrastructure and buildings as appropriate. The project will also use existing facilities to support the development of Moorside which will not need to be built. In these cases NuGen or its contractors will enter into commercial arrangements for use of these facilities. The Moorside Project is anticipated to generate up to 21,000 jobs in total through the construction, operation and eventual decommissioning of the Moorside Nuclear Power Station. NuGen will seek to maximise the opportunities for local jobs, resulting both directly and indirectly from the Moorside Project during construction and operation. The large increase in expenditure locally will also have benefits for local businesses, services and the Cumbrian economy in general. More detail about the Moorside Project will be available from 14th May 2016 in NuGen s consultation documents. PAGE 6

3. National policy The Secretary of State has set out policies in relation to NSIPs in national policy statements. The Secretary of State must determine NuGen s future application for a DCO in accordance with the Planning Act 2008 and the following national policy statements: overarching National Policy Statement for Energy (NPS EN-1); and National Policy Statement for Nuclear Energy Generation (NPS EN-6). These documents can be viewed in detail at the following web address: www.gov.uk/government/publications/national-policy-statements-for-energy-infrastructure Collectively, these national policy statements establish that there is an urgent need for new electricity generating capacity, including from nuclear. NPS EN-6 makes clear that the need for a nuclear generating station at what is named the Moorside site has been demonstrated (it is referred to in the national policy statement as Sellafield ). The Moorside Project is a priority project in the National Infrastructure Plan (2014). The national policy statements also direct the Examining Authority about the matters, which they should and should not examine. In particular paragraph 2.7.3 of NPS EN-6 states that the Examining Authority should not duplicate the functions of the nuclear regulators the Office for Nuclear Regulation (ONR) and the Environment Agency (EA). As such the remit of the DCO process will focus on local impacts but not matters related to nuclear safety, security, protection of people or the safe transport of nuclear material, or in the case of the EA, environmental protection. These matters will be considered by the ONR, the EA and other agencies through the nuclear site licence process. PAGE 7

4. The Development Consent Order process NuGen will apply to the Secretary of State under the Planning Act 2008 for a DCO to construct, operate and maintain the nuclear power station and the Associated Development related to it. The DCO is also proposed to include powers for the compulsory acquisition of land and interests in land in order to allow for the effective delivery of the Moorside Project. NuGen s application would be submitted to the Planning Inspectorate in 2017. If the application is accepted, an Examining Authority will be appointed to examine NuGen s application and representations made on it by interested parties. The Examining Authority will then submit its recommendation on the application to the Secretary of State who will make the final decision. Relevant local authorities will have an important role in this process. Local authorities, which may include Copeland Borough Council, Allerdale Borough Council, Eden District Council, Barrow-in- Furness Borough Council, Carlisle City Council and Cumbria County Council, may comment upon both the content and the quality of the Stage One and Stage Two consultations by making an adequacy of consultation representation to the Planning Inspectorate shortly after the application is submitted. Relevant local authorities will also be invited to produce a local impact report following the submission of NuGen s DCO application, which will give details of the likely impacts on the authorities area(s) arising from the Moorside Project. The Secretary of State must have regard to any local impact reports when making a decision on whether or not to grant a DCO for a project. Anyone will be able to comment on the proposals during the Stage Two Consultation and views from consultees will be important in helping NuGen to develop the Moorside Project further. Once NuGen s application has been submitted to the Planning Inspectorate in 2017, then anyone will be able to register and make representations regarding the Moorside Project to the examining authority. Further information on the DCO process can be found on the Planning Inspectorate s website at the following web address: www.infrastructure.planningportal.gov.uk/application-process/the-process/ Possible planning application for site preparation works In addition to the DCO for the Moorside Project, NuGen may also consider submitting a planning application to Copeland Borough Council (as the local planning authority) under the Town and Country Planning Act 1990 for certain early site preparation works, seeking permission for these works in advance of the decision on the DCO. If so, NuGen will aim to carry out a consultation on the scope of any proposed early site preparation works at the same time as the Stage Two Consultation starting in May 2016. PAGE 8

5. Environmental impact Site characterisation work at the Moorside site For any project of this scale it is necessary to produce a detailed assessment of the likely significant environmental effects both positive and negative, and to consider the best way of mitigating significant adverse effects. This process is known as an Environmental Impact Assessment (EIA). The Moorside Project falls within the scope of the Infrastructure Planning (EIA) Regulations 2009 (as amended) and as such, an environmental statement will be submitted with the DCO application in 2017. Preliminary environmental information will be presented with the Stage Two Consultation through the Preliminary Environmental Information Report (pursuant to Regulation 10 of the Infrastructure Planning (EIA) Regulations 2009 (as amended)) in order to allow consultation feedback to be given. Where there are significant adverse effects arising from the Moorside Project, NuGen will, where possible, propose mitigation measures to prevent, reduce and where possible, offset them. PAGE 9

6. Local context NuGen s plans for consulting people living in the vicinity of the Moorside Project sites have been developed with consideration to the local context in West Cumbria and Cumbria. Cumbria is a geographically large county with a relatively small, dispersed population. Physically it is dominated by its mountainous centre, which is recognised for the importance of the tourism economy and for its environmental and landscape quality (by its designation as the Lake District National Park). The Moorside site sits on the coast in West Cumbria in the western extremity of the county. A characteristic of West Cumbria is the undulating coastal strip of land between the mountains to the east and the sea to the west. Its transport links have developed north to south along the coastal strip and its economic and social links reflect this. The coastal strip has historically had a higher concentration of industrial activity, which has included shipping, coal, iron and steel, chemicals and more recently, the nuclear industry. This activity was supported by sea-based transport. The functional area of West Cumbria includes Copeland and Allerdale Borough Council areas. Barrow-in-Furness to the south has a similar industrial background but is geographically separated by the Duddon Estuary. Data from the Cumbria Intelligence Observatory indicates that international inward migration has had little impact on the character of the West Cumbrian and Cumbrian communities. Ninety six percent of Cumbrian residents and ninety seven percent of West Cumbrian residents were born in the UK compared to eighty six percent of UK residents. There has been a trend of young people leaving the area to develop their careers and, compared to the national average, West Cumbria has a lower proportion of people in the age range 0-44, a higher proportion of people in the age range 45-84, and a similar number of people aged 85-and-over. Statistics released by the Department of Communities and Local Government in September 2015, show that Copeland is in the top thirty percent of deprived districts nationally. Parts of Cleator Moor, central and south Whitehaven and Frizington fall within the most deprived ten percent nationally across a range of indicators. Parts of Workington and Maryport also fall in the most deprived ten percent. Remoteness from services, poor transport and poor broadband facilities affect more rural parts of the area. These factors have been taken into account in developing NuGen s approach to this consultation as set out in this SoCC. Previous consultation The DCO Stage One Strategic Issues Consultation, was carried out from 16th May 2015 to 25th July 2015. This previous stage of the consultation was focused on strategic issues for the Moorside Project, including NuGen s requirements and approach, broad locations and search areas for Associated Development, preliminary environmental information compiled by NuGen to date on the Moorside Project, and an indication of the scale of development. This consultation did not include detailed proposals for development, site layouts or designs. The responses received have been used to guide NuGen s development of proposals for the forthcoming DCO Stage Two Consultation. Included in the consultation materials for DCO Stage Two will be an Interim Consultation Report which sets out how NuGen has had regard to the responses received during the Stage One Consultation and where NuGen has not been able to act on feedback. In the case of the latter NuGen will explain why. PAGE 10

7. DCO Stage Two Consultation When NuGen will consult The Stage Two DCO Consultation will begin on 14th May 2016, for 11 weeks, finishing on 30th July 2016. The consultation will be aligned with the publication of national and local notices under Section 48 of the Planning Act 2008. It will also align with consultation with key local authorities, prescribed statutory consultees and those with an interest in the land under Section 42 of the Planning Act 2008. A DCO application is anticipated to be submitted in 2017. What NuGen is consulting on The DCO Stage Two Consultation is the Proposed Scheme Consultation. This stage will present details of the proposed Moorside Project, including: site layout and design principles for the Moorside Power Station; proposals for the railway works, MOLF and specific Associated Development; preliminary environmental information and supporting technical documents for the Moorside Project; and details of feedback received under the Stage One Consultation and how NuGen has taken into account this feedback. NuGen is not seeking feedback on the need for a nuclear power station at the Moorside site as this issue has been covered through the national policy statements. In this stage of consultation, we are seeking your feedback on: the draft proposals for the Moorside Power Station; the draft proposals for the railway works and Marine Off-Loading Facility and the Associated Development; NuGen s proposed mitigation measures; the preliminary environmental information; and any other issues, suggestions or feedback that you may have. What documents NuGen will consult on for the Stage Two Consultation Consultation materials will be made available to explain various elements of the Moorside Project. Information will be available at three broad levels of detail. The following documents will be available throughout the consultation period, starting on 14th May 2016. Promotional: this material will contain summary information about the Moorside Project. Its primary role is to promote the consultation and direct people to where they can find more information. More detail about NuGen s promotional campaign can be found on page 15 of this document. PAGE 11

DCO Stage Two Consultation Overview: this material is designed to give a thorough but non-technical overview of the proposals, key issues, benefits and potential impacts of the Moorside Project and will include: Proposed Scheme Overview: this will contain non-technical information about the proposals, including a guide to which documents contain more detail on specific issues. Statement of Community Consultation (SoCC): this document. Detail: this material will contain a variety of more detailed information and will include: Proposed Scheme: this will include more detail about the Moorside Project proposals and a non-technical summary of the Preliminary Environmental Information Report. Technical Pack: this will include the Preliminary Environmental Impact Report and Technical Figures and Drawings. In addition, the following documents will be provided: The Interim Consultation Report will set out the responses received in the DCO Stage One Consultation and how NuGen has taken account of these responses. A feedback form will be available in order to collect responses to the consultation. This will be available as a printed form as well as being available online. Where to find more information From 14th May 2016 to 30th July 2016, hard copies of all of Stage Two Consultation documents (including this SoCC) will be available to view at NuGen s Moorside Information Centre at the Civic Hall in Whitehaven town centre, where we will also maintain an exhibition throughout the consultation period. The centre will be open Monday to Friday 10am to 4pm and Saturday mornings 10am to 12pm. The documents will also be available at all of NuGen s public exhibitions which will be open between 11am and 7.30pm. They will be available from 14th May 2016 to 30th July 2016 in selected libraries and in the main offices of relevant district and county councils (see below). Copies of the documents will be available to view and to download from the project website (www. nugenconsultation.com), and will also be made available on a digital storage device at no charge. Printed copies of the technical documents and plans are available upon request, however there may be a charge required to cover the cost of printing larger documents. 7. DCO Stage Two Consultation How will NuGen engage with people? NuGen will engage with people in a number of ways throughout the consultation process to ensure people are given the opportunity to find out more and take part. Exhibitions Exhibitions: NuGen will provide information and the opportunity to talk to its expert team about the Moorside Project, helping you to understand the proposals and reply to the consultation. These public exhibitions will be open from 11am to 7.30pm to allow access for as many people as possible (with the exception of NuGen s permanent exhibition at the Moorside Information Centre, see below). A list of where NuGen will be holding exhibitions can be found on page 16 of this document. You will find more information on when and where the events are taking place in NuGen s newsletter (see overleaf) and on the consultation website: www.nugenconsultation.com. NuGen will also advertise in the local press and media. NuGen s Moorside Information Centre at the Civic Hall in Whitehaven town centre will hold a continuous exhibition for the period of the consultation, which opens Monday to Friday 10am to 4pm and Saturday mornings 10am to 12pm. Here you can get information, ask questions and feedback your views. Direct Mail Direct Mail: NuGen will send the Proposed Scheme Overview, which will include details of all the exhibition events and a feedback form to all postal addresses within the area shown on the map below. This area equates to the Whitehaven Travel to Work Area (TTWA*) combined with addresses within 0.5km of any Moorside Project site that is located outside this area. NuGen will also send copies to those within the vicinity of a Moorside Project site on request. If you don t receive a copy of these documents, and believe that you should have, please contact NuGen for further copies to be sent out. DCO Stage Two Consultation Newsletter Newsletter: NuGen will produce a newsletter which will be available on its consultation website: www.nugenconsultation.com and will be emailed to everyone who registers via the website to receive it. The newsletter will provide detail on the consultation, including how to get involved and where more information can be found. This is the newsletter that will be sent to certain addresses by direct mail as described in the direct mail section. This campaign will announce and give information on NuGen s consultation events in advance of the start of the consultation period on 14th May 2016 and will run throughout the consultation period. TV/Radio: NuGen will promote the consultation and events by offering interviews and briefings. Posters: These will include details of local exhibitions and how to respond to the consultation. NuGen will send these to all parish and town councils in the districts where development is proposed as part of the Moorside Project to enable them to promote the consultation. Website: All consultation documentation and details of all stages of consultation, including event locations and timings, will be available on the consultation website: www.nugenconsultation.com, which will be sign-posted in all key literature. Social media Presentations Social media: NuGen will use social media to publicise each stage of the consultation and to provide information on how to access events and how to respond. Presentations: NuGen will offer to provide presentations on its proposals to councils in the vicinity of the Moorside site and close to the sites where Associated Development is proposed upon request. It will also offer presentations to schools and colleges and other organised groups upon request. Priority will be given to young people s organisations or groups. PAGE 15

7. DCO Stage Two Consultation Where NuGen will consult This SoCC is concerned with NuGen s approach and process for consultation with people living within the vicinity of the Moorside Project sites. NuGen recognises that the development will have the greatest impact on the people that live nearest to the Moorside Project sites and consequently they are likely to have the greatest interest in the proposals. However, this is a very large scale development with wide impacts and interest is likely to be widespread. Near the Moorside site, on the West Cumbrian coast, NuGen will hold a number of public exhibitions. Locations have been selected so that the majority of people in Copeland will be within five miles of an event. NuGen will hold public exhibitions at: Whitehaven Cleator Moor St Bees Egremont Beckermet Braystones Mirehouse Gosforth Seascale Bootle Ravenglass Distington Millom Further out from the Moorside site, NuGen will hold public exhibitions in larger population centres. These have been selected so that the majority of people in West Cumbria would be within eight miles of an event within the West Cumbria area: Workington Maryport Wigton Cockermouth Keswick Broughton-in-Furness Askham-in-Furness To allow good access for working people, NuGen will also hold events specifically aimed at businesses, employees and students at a number of employment centres in West Cumbria: Sellafield Site (please note that due to site security arrangements, this is not a public event and will be open to Sellafield Site employees only) Westlakes Science and Technology Park Lillyhall In the wider sub-region, we will hold public exhibitions at the following key population centres: Carlisle Penrith Kendal Barrow-in-Furness NuGen will also reserve a week within the consultation period where its consultation team will be available to engage in further events with schools and young people s groups. The times, dates and locations of all consultation events will be publicised in NuGen s newsletter, on the consultation website (www.nugenconsultation.com) and in local newspapers before they occur. 7. DCO Stage Two Consultation Broadening the engagement There are a number of categories of people in the area who may have more difficulty in accessing the consultation. These include younger people, working people, those living in socially deprived or geographically isolated areas, people with disabilities and other minority groups. Following the analysis of the results from the Stage One Consultation, NuGen has identified an under-representation from young people and working people. To increase engagement with these groups, NuGen will provide consultation events within employment centres, will open the Moorside Information Centre on Saturday mornings and will keep its exhibition events open until 7.30pm and during the school holiday periods. Additionally, NuGen will invite schools to events which specifically cater for students and it will welcome requests for briefings or bespoke events from these under-represented groups. NuGen has taken into account all hard to reach groups in the development of this SoCC. The variety of channels that information is available through is designed to ensure that the majority of such groups are included in the consultation; this includes the provision of summary documents in plain English and making documents available online and at multiple locations in hard copy. Other major consultations NuGen is aware that other consultations have already taken place or may take place over the next 18 months that relate to planning, energy or nuclear related issues. NuGen wishes to make it clear that these consultations are separate and not linked to NuGen s consultation on the development of Moorside. The National Grid will be carrying out its second stage of consultation relating to the North West Coast Connections Project which seeks to strengthen the electricity transmission infrastructure in the area. This is expected to take place from June 2016. NuGen wishes to ensure that all consultation responses received are carefully considered. Where the substance of a consultation response relates (in whole or in part) to the proposals by National Grid for new electricity transmission infrastructure to connect the Moorside Power Station to the National Grid, NuGen will forward a copy of the response to National Grid. Details will be publicised in a newsletter, on the consultation website (www.nugenconsultation.com) and in local newspapers before the events occur. What happens to your response? Comments submitted electronically via the haveyoursay email address will trigger an automated confirmation of receipt during consultation periods. All responses will be recorded, reviewed and considered as part of the consultation process. Following the Stage Two Consultation, NuGen will produce a feedback report in late 2016 that will summarise the key points arising from the Stage Two Consultation. A final consultation report will be submitted with the application for a DCO in 2017, explaining how responses from each of NuGen s consultations have been considered and taken into account in the development of the Moorside Project proposals. Where NuGen has not altered the proposals to reflect comments, it will explain the reasoning. PAGE 18

DCO Stage Two Consultation How your information will be used Personal information that you supply to NuGen in response to this consultation will be treated confidentially and processed and handled in accordance with the Data Protection Act 1998. Your information may be disclosed to or shared with NuGen s agents, contractors and advisors who provide services to NuGen. This will allow NuGen to fully consider your responses and use them in the preparation of application materials. Upon submission of NuGen s application for a DCO under the Planning Act 2008, the Secretary of State may require NuGen to supply copies of all consultation responses received. If a request is made, NuGen is under a legal obligation to supply copies of your response to the Planning Inspectorate. By submitting your consultation response to NuGen, you agree that NuGen may supply a copy of your response to the Secretary of State via the Planning Inspectorate, if required to do so. In addition, NuGen will share your response with the National Grid if it believes the content to be relevant to National Grid s North West Coast Connections Project (see page 17). What happens next? In spring next year, NuGen s final proposals for the Moorside Project, which take into account the responses received from this consultation, will be submitted to the Secretary of State for consideration under the Planning Act 2008. Once accepted, the application will be examined by a panel of inspectors for up to six months. Anyone can register to make representations as part of this examination process. The panel will then have up to three months to report their recommendations to the Secretary of State. The Secretary of State will then have up to three months to decide whether or not to grant a DCO under the Planning Act 2008 for the Moorside Project. It is expected that a decision will be reached by the Secretary of State on the proposals by late Summer 2018. 8.
