NTRODUCTON: These AEVT- Management and Procedural Guidelines complete an important stage in the development of AEVT education programs and services. They provide information for newly recruited and currently employed education staff to assist them to understand the organisational aspects and requirements of AEVT within NSW Corrective Services. Although some of this information is available in other departmental publications and some has been held as common practice, this is the first time it has been published in guidelines framed for the AEVT inmate education service. These guidelines together with other material circulated from AEVT Head Office provide a comprehensive compendium of information designed to enable AEVT staff to function more effectively in the correctional environment. They provide the organisational and professional base for all AEVT programs and services within this department. t is hoped they also provide direction and support. These guidelines are intended as a developing document and consequently, suggestions for changes and/or improvements in further editions are encouraged from users and other interested departmental staff. Senior Education Officers (or Education Officers in those correctional centres without a Senior Education Officer) have local responsibility to ensure all Education Staff have access to, and are provided with, a copy of these guidelines. This document should be placed on agendas for, and discussed at, Moderation of Procedures and Processes/Verification sessions. AEVT PROCEDURES NUMBER: P 97/001 AEVT HEAD OFFCE The purpose of AEVT Head Office is to provide overall AEVT Statewide policy, coordination, resource materials, professional advice and management facilitating the delivery of accredited educational, vocational, recreational, special needs and library programs that reduce offending behaviour through addressing inmates' assessed needs. AEVT!-lead Office's role is to: Develop and implement strategic policy related to the provision of education, vocational, recreational, special needs and library programs for inmates on a Statewide basis to ensure Government and Departmental inmate education rehabilitation objectives are being met. Develop and control the implementation of AEVT plans, within budget resources allocated, to ensure Statewide continuity and consistency in the delivery of AEVT education programs and services. By negotiation ensure the accreditation of all AEVT education programs with the appropriate State or Commonwealth Board to maintain best practice provision, articulation, cross sectoral links and program pathways to release. Direct the full range of AEVT education programs and services across the State's correctional centres to ensure cost efficient and effective service delivery. Direct the provision of professional, technical and specialist advice and support on Statewide education programs to Regional Commanders, Governors, Program Managers, AEVT Education Staff and T AFE NSW staff to ensure efficient and effective delivery of programs and services. Control Statewide inmate education budgets to ensure efficiency and effectiveness in the use offunds allocated. nitiate statewide inmate education program quality assurance reviews with other nmate Development Services areas such as Drug and Alcohol, Psychology, and Welfare to ensure best practice service provision. Maintain cross sectoral links with NSW TAFE and other Government and Community Agencies on a Statewide basis through formulated committees to ensure 6

development of accredited curriculum, articulation and program pathways to release. Ensure procedures and practices regarding occupational health and safety, EEO, EAPS and the Charter of Principles for a Culturally Diverse Society are incorporated in AEVT programs and services. Perform legislative functions for the Serious Offender Management Committee (SOMC) and SOMC Assessment Committee. The Principal, AEVT, reports directly to the Assistant Commissioner (nmate Management). The Deputy Principal, AEVT directly reports to the Principal, AEVT. Positions reporting directly to the Deputy Principal, AEVT positions are: State Manager, Vocational Education & Training; State Manager, Fitness & Recreation; nformation/resource Officer; Systems Analyst; and, Client Liaison Officer. Principal, AEVT, has direct responsibility for the professional supervision of all education field staff including: Senior Education Officers, Education Officers, Permanent full-time and Permanent part-time Teachers, Contract Teachers, AEVT contracted NSW TAFE teachers, fee for service contractors and inmate peer educators. AEVT PROCEDURES NUMBER: P 97/002 NMATE EDUCATON ACCOUNTS NTRODUCTON The Principal, AEVT, each calendar year, calls for budget estimates across AEVT campuses and allocates budgets according to Departmental policy, inmate need and performance budgeting of each centre. During the year the Principal, AEVT, monitors individual correctional centre expenditures, against the allocation. AEVT Education is Program 8 in the Department's Chart of Accounts. AEVT inmate education related accounts at the correctional centre level will be utilised and managed by the Senior Education Officer throughout each financial year for the sole purpose of funding AEVT inmate education programs. nmate education accounts, listed below, are protected items. They cannot be used as savings for overspends against other correctional centre accounts. These accounts are: ** * -08-0124-000 * * * -08-124 3-002 * * *-08-1243-00 ***-08-1243-004 * **-08-124 3-005 *** -08-1243-006 ** * -08-1243-009 CONTRACT TEACHERS NSW TAFE TEACHNG HOURS FEES NMATE EDUCATON NMATE EDUCATON ACTVTES NMATE LESURE ACTVTES MACKAY LBRARY COMPUTER LEASE FEES Some of these accounts such as TAFE and computer leasing arrangements, and in particular Contract Teacher salaries will be predetermined in each financial period. How they are spent and how they are targeted should always consider the aims and aspirations of AEVT and be in accordance with Departmental policy and procedures. EXPENDTURE AEVT Accounts should always be used according to their specific purpose as stated in the Chart of Accounts. While it is possible, with the approval of the Governor, to offset one 'B' item account against another 'B' item account, at all times expenditure from each account (also called Cost Centre) must reflect its definition of use. The incorrect debiting of one account, for example the use oflnmate Education Fees to purchase items for inmate education activities, will cause ettors and difficulties in budgetary forward planning as one account will appear to have excessive use and yet real use will be in 8

another account. ACCOUNTS The following account is an 'A' category account and other accounts must not be offset against it: * * * -08-0124-000 CONTRACT TEACHERS The following accounts are all 'B' category. With the exception of both ***-8-1243-002 NSW TAFE TEACHNG HOURS and ***-08-1243-009 COMPUTER LEASE FEES these accounts can be offset against each other : ** *-08-1243-002 ***-08-1243-00 1 * **-08-1243-004 * **-08-1243-005 ** *-08-1243-006 ***-08-1243-009 NSW TAFE TEACHNG HOURS FEES NMATE EDUCATON NMATE EDUCATON ACTVTES NMATE LESURE ACTVTES MACKAY LBRARY COMPUTER LEASE FEES This predicates that the Senior Education Officer (or the Education Officer where there is no Senior Education Officer) must be the responsible officer, however, this does not remove the Governor's authority as Cost Centre Manager. All Senior Education Officers should avail themselves of monthly cost centre printouts, available through the correctional centre Administration Manager, as a means of auditing account expenditures against commitments. AEVT PROCEDURES NUMBER: P 97/003 CONTRACT TEACHERS ***-08-0124-000 DEFNTON A "Contract Teacher" means a teacher employed on an hourly basis to conduct classes (or individual instruction) in accordance with the Depm1ment's education program (Crown Employees [Education Staff Salaries Department of Corrective Services] Award 1996, p2). Contract Teachers are directly responsible to the Senior Education Officer. FUNDNG The Principal, AEVT, each calendar year, calls for budget estimates across AEVT campuses and allocates a budget for this item according to Depm1mental policy, inmate need and performance of each centre. Funding for Contract Teachers is from account ***-08-1243-000. This is a protected account to be used solely for the purposes of employing Contract Teachers in accordance with the direct aims and objectives of AEVTL As this is an 'A' category account, other accounts must not be offset against it. EMPLOYMENT The final arbiter on qualification disputes rests in the delegated authority of the Principal, AEVT (P.AEVT). Contract Teachers will be required to be qualified fully in the discipline in which they are employed to teach. Contract Teachers will be employed to teach only accredited cuniculum. Contract Teachers are employed under a contract for a period not exceeding six (6) months. Each contract will not exceed a weekly hourly rate of fifteen (15) hours. Recruitment of Contract Teachers will be at the correctional centre level as directed by the Senior Education Officer (or Education Officer in those institutions without a Senior Education Officer). i t Conditions of employment for Contract Teachers including salaries and sickness benefits are set out in the Crown Employees (Education Staff Salaries Department of Corrective Services) A ward 1996. Prior to the employment of any Contract Teacher a Security Check will be carried out in accordance with Section 8.9 of the NSW Department of Corrective Services Operations Procedures Manual. n matters relating to security, Education Officers are to liaise with the Programs Manager/Security Manager. 10 : i

SALARY RATES Contract Teachers shall be paid in accordance with the Crown Employees (Education Staff Salaries Department of Corrective Services) Award 1996. ALLOWANCES Contract Teachers shall be paid an environmental allowance, at time of publication was $1.00 per hour. SCK LEAVE FOR CONTRACT TEACHERS Refer to the current (Crown Employees (Education Staff Salaries Department of Corrective Services) Award 1996, p9). NDUCTON PROGRAM The Principal, AEVT provides information on policy and procedures that might be included in an nduction Program for Contract Teachers. Following confirmation of the appointment of a Contract Teacher the Senior Education Officer, in consultation with the Programs Manager, will implement a Teacher nduction Program. An updated nduction Program might also be devised for renewal Contract Teachers and can be incorporated in Moderation Sessions. The induction program should : review with the Contract Teachers Curriculum Outline and Employment Contract; go through emergency procedures for non-uniformed staff in consultation with Programs Manager; discuss role/function of AEVT (refer to copies of'frameworks' AEVT Staff Journal); discuss 'Code of Conduct', 'Duty of Care', Workplace Harassment; go through 'Guidelines Notes for Education Staff Working in NSW Correctional Centres' (M97/003); arrange a security briefing for the Contract Teacher in consultation with the Programs Manager/Manager Security/Governor; discuss Correctional Centre Act/Regulations; attend Moderation of Procedures and Processes Session; distribute Contract Teacher nduction Kit (to include above). 11

REPORTNG ARRANGEMENTS The Contract Teacher will report directly to the Senior Education Officer (or Education Officer where there is no Senior Education Officer) on all matters relating to professional conduct. OPERATONAL MATTERS The DP.AEVT has final authority regarding the appointment and renewal of Contract teachers. The Senior Education Officer will be responsible for ensuring that Contract Teachers are aware of their responsibilities in terms of attendance book, pay sheets, sick leave forms, teachers roll book, submission of Monthly Student Progress Reports, student files particularly CGEA Student Master Profile. The Senior Education Officer is responsible for the recruitment, selection, induction and evaluation of Contract Teachers within Departmental and AEVT procedural guidelines. PROFESSONAL DEVELOPMENT All staff training and professional development will be arranged and supervised by the Senior Education Officer. Security awareness training for Contract Teachers should be arranged by the Senior Education Officer in consultation with the Programs Manager. External staff development should be discussed with the Senior Education Officer in the first instance, and then Deputy Principal, AEVT (DP.AEVT). Contract Teachers are encouraged to participate in professional development workshops with cross sectoral providers and attain the Certificate in Workplace Training Category. Support to attend conferences will be given to staff who are at the conference, presenting a paper or leading a workshop. As part of the overall staff development program Contract Teachers must participate in all AEVT quality assurance programs (Moderation for Procedures and Processes and Moderation for Verification). i TERMNATON OF CONTRACT Circumstances may arise where a contract is terminated or a contract is not renewed. These may include: course or subject no longer required insufficient inmate attendances poor teaching performance obvious breach of contract 12, i u r [ i ~- ~ % ~ ~-, j!

breaches of the Correctional Centres Act 1995 and/or Code of Conduct teacher's own request Prior to termination, and where practicable, Contract Teachers are to be offered counselling and/or in service training. Such counselling or disciplinary interviews should be fully documented along with a written record of any misconducts, incidents or breaches of contract. Where possible at least two weeks' notice of termination is to be provided. Decisions to terminate or not renew should be discussed with the Programs Manager. Applications to have a Teacher's Contract terminated must be forwarded to DP.AEVT for signature. Senior Education Officers will be given staff development to assist their understanding of unfair dismissal procedures and the relevant legislation. NEW CONTRACT TEACHERS Refer to: p 97/015 Page No 41 RECRUTMENT/SELECTON OF CONTRACT TEACHERS RENEWAL OF EMPLOYMENT AND EVALUATON OF CONTRACT TEACHERS The renewal of Contract Teacher employment will be subject to evaluation by the Senior Education Officer. The Senior Education Officer will complete the Curriculum Outline, Curriculum Outcomes, Contract Teacher Data Form and Employment Agreement for all Contract Teacher Renewals and forward these by the due date to P.AEVT, Head Office. During the period of the contract the Senior Education Officer will conduct on-site evaluation of the Contract Teacher's program. This will include: observation of the Contract Teacher's classroom performance; analysis of the Contract Teacher's performance through the Monthly Student Progress Reports/Monthly AEVT Statistics; examination of nmate Education Files in relation to the Contract Teacher's program/course; recording attendance of Contract Teachers at AEVT Moderation of Procedures and Processes/Moderation for Verification Sessions; monitoring Contract Teacher progress towards Registration with AEVT, where applicable; 13

feedback from inmate students (see AEVT Business Plan 1997/99 'Meeting Service User Needs' refer to M97/002); self evaluation by Contract Teacher; and other evaluation strategies, as appropriate. All evaluation reports on the Contract Teacher must be sighted, discussed with, and signed by the Contract Teacher prior to being forwarded to Principal, AEVT Head Office. Establishment of Correctional Centre Library * * * * Each correctional centre has a dedicated library for the use of inmates. These libraries meet the recreational, educational and other information needs of inmates during their sentence. Each centre receives an allocation referred to as the Mackay Library Allocation. Funding received within this allocation is to be spent on text books, journals, magazines, videos, newspapers, cassettes, foreign language publications, law library 'CD ROM', software, recreation books/magazines and general reading material The primary concern of the Senior Education Officer is to provide students with appropriate text and instructional books, related to their programs. To complete the proforma correctly, the following steps need to be followed: Step One The JCCLO will initiate the course approval proforma by supplying the following details: nstitute: Name of institute providing the program. College/campus: Name of college/campus providing the program. nstitute CC Liaison Officer: For the institute providing the program. Fax no: All documentation in the approval process should be faxed to ensure a minimum turnaround time. TAFE ADM/AC:TAFE NSW Aboriginal Development Manager (ADM) and/or Aboriginal Coordinator (A C) for the institute providing the program. This is required where programs are targeted for Aboriginal and Torres Strait slander inmates. Start/end date: These must be completed. Start and end dates are required by both TAFE NSW and DCS to monitor the progress of fund allocations. Where courses are approved months in advance, estimated dates are acceptable. Course title: This is the TAFE NSW course title, eg Small Motor Service. Course no: This is the applicable T AFE NSW course number, eg 7253 for Small Motor Service. CCLO no: This number is allocated locally by the CCLO for monitoring purposes only. t will have identifying initials for the institute, financial year, and local course number, eg WS/93/94/020 would mean the twentieth course at Western Sydney nstitute for the 1993-1994 financial year. Additional hours: This covers allocations for teclmical officer support (two teclmical officer hours =one teaching hour) as indicated in the T AFE Handbook and/or agreed by AEVT, and security induction (up to four hours). Details of hours claimed under this section must be included in the notes below. n the case of lock downs, a separate form should be completed and the hours claimed under additional hours. Total hours: This covers all hours claimed under the approval, ie the sum of course hours and additional hours. Accreditation/articulation etc: Relevant accreditation and articulation details should be included in this section, together with any clarifying notes to support the application for approval. Special target group: Some courses will be designed for specific target groups such as women, Aboriginal and Torres Strait slander people or people with disabilities. These should be identified in the course approval. The main target group should be underlined, eg a course may have three target groups,- ntellectually Disabled, Aboriginal and Torres Strait slander inmates and women. - but the main target group might be women. Other target groups should be ticked. Approved by supplying college/campus director: This signature confirms the supplying college is able to provide the course outlined in the forms. Please note that this signature may be obtained after completion of Step Two if this is more convenient but it is essential that it is signed before Step Three can be completed. Fax to NSW DCS SEO: This direction is given to indicate that the next part of the proforma (Step Two) requires completion by the DCS SEO. f Step Two has already been completed (including signatures), the CCLO may fax direct to DCS Adult Education & Vocational Training nstitute (AEVT) for Step Three completion. OTEN provision is particularly appropriate for inmates confined in correctional centres who cannot attend internal classes. Student inmates can study a wide variety oftafe NSW accredited courses through OTEN. These courses are written as a series of lessons which are sent to the student for them to complete. nmates are eligible to enrol in most courses that OTEN delivers, providing the inmate satisfies entry criteria. However, when considering student applications for OTEN courses, the following need to be taken into account: suitability of course - eg explosives is obviously not appropriate course requirements -practical sessions or compulsory tutorials may prevent inmates from successfully completing courses. The procedures for negotiating and establishing a TAFE NSW course in a correctional centre do not generally apply to OTEN courses. Courses provided through OTEN are not covered by the Memorandum of Understanding and so the normal enrolment fee applies. However, the agreement can be used to provide hours for practical or tutorial sessions, either through the local institute or direct from OTEN. Correctional Centre Senior Education Officers or Education officers enrol inmates with OTEN, and the conectional centre is bulk invoiced for the normal TAFE NSW Administration Charge for the courses in which its inmates are enrolled. This provides valuable information for staff when considering distance learning options for imnate students. When emolling students the following need to be taken into account: All OTEN enrolment forms must be pre-stamped CORRECTVE SERVCES and pre-coded CORR. The address on the enrolment form must be c/- Education Officer at the appropriate correctional centre to which the course material is to be sent. Student name, course name and number and administration fee details need to be entered on an Enrolment Authorisation Form. Enrolment Forms and Enrolment Authorisation Form are sent to OTEN (Attention: Prison Liaison Officer- ndustry ) The enrolling correctional centre will be bulk billed for Semester enrolments. Senior Education Officers are advised to keep a record of each OTEN enrolment as a means of auditing the Semester invoice and cost centre commitment. Applications for refund of fees need to be made in writing to the Refund Committee of OTEN. Refunds are only granted in special circumstances. Changes to student records (withdrawals, transfer, change of address) are to be notified on the Pink Query Form. New South Wales Curriculum Clearing House The purpose of the New South Wales Curriculum Clearing House is to make available NSW Crown Copyright accredited course and module descriptors, such as NSW T AFE cuiticulum to registered providers. AEVT PROCEDURES NUMBER: P 97/012 NMATE EDUCATON FULL TME STUDENTS, NMATE TUTORS, EDUCATON CLERKS AND LBRARY ASSSTANTS NTRODUCTON Full-time students, inmate tutors, Education Clerks and Library assistants comprise Service ndustries work positions and form part of the nmate Services Employment Profile for each correctional centre. At each correctional centre the Assistant Superintendent oflndustries (AS nmate Employment) is responsible for the maintenance of this profile. Senior Education Officers should liaise with the Manager oflndustries/ AS! nmate Employment regarding the accessing of these positions. FULL-TME STUDENTS Selection and approval of full-time students is the responsibility of the Senior Education Officer (or Education Officer in those correctional centres without a Senior Education Officer). When selecting and approving full-time students the following should be considered: availability of vacant positions educational needs program priorities commitment to educational/vocational training past and current work record. established Program Pathways Full-time students must undertake a full education workload which may include class attendance, self-paced study, tutorials and should be equivalent to other Service ndustry positions. Full-time students must attend a nominated period per week at either supervised classes/tutorials or as an individual learner. These attendances are to be recorded individually by the Senior Education Officer. Full-time students must be enrolled in either AEVT, TAPE or other AEVT approved tertiary studies. Full-time students are required to work consistently towards achieving agreed educational goals (passing an exam, completing a series of assignments, achieving a CGEA Stream Module) in order to maintain full-time student status and secure wage payment increases. 35
