Office of the Nursing and Midwifery Services Director Clinical Strategy and Programmes Directorate Dr Steevens Hospital Dublin 8. Tel:+353-1-6352381 Fax: +353-1-6352509 Mobile 087 2276399 Email: Michael.shannon@hse.ie DISCLAIMER FOR THE PROVISION OF EDUCATION/TRAINING BY THE CENTRES OF NURSE AND MIDWIFERY EDUCATION Dear Director, You may be aware that my office has sought clarification around a number of issues relating to the area of education/training provision by the HSE/voluntary organisations to healthcare staff employed in the private sector. In this regard the Director of the State Claims Agency has confirmed that the Clinical Indemnity Scheme will indemnify the HSE in circumstances where it has provided education to a staff member employed in the private sector and where there is an allegation, arising in the context of a claim in negligence for personal injuries, that such educational advice contributed to or caused the occurrence of the personal injury. On the advice of the State Claims Agency separate legal advice was sought by the ONMSD in relation to limiting potential liability to the HSE. The attached disclaimer for the provision of education/training by the s applies to nurses, midwives and other healthcare staff who are engaged in a clinical environment whether public and /or private. The disclaimer should form a fundamental part of the terms and conditions upon which the HSE provides the education/training. The disclaimer has been drafted so as to make clear that the education/training programmes have an educational purpose and are designed to supplement (and not replace) the professional responsibilities of every nurse and midwife. It is not required to be signed by participants; however it is necessary to ensure that it is communicated clearly in respect of all education/training programmes. If a person disagrees with the disclaimer being a term and condition of the education/training programme, then it should be explained to the individual that the disclaimer is non negotiable. It should also be noted that the HSE does not have statutory power to charge its employees, agency nurses, practice nurses or other individuals in respect of education/training programmes provided to those individuals. Accordingly a risk exists that any charges applied by the HSE in this regard are beyond its powers and thus, may be liable to be repaid. Therefore any (HSE) which has imposed charges for education/training provision must now discontinue this practice. Thank you for your ongoing support and please do not hesitate to contact my office if you require further clarification. Yours Sincerely, Dr Michael Shannon Nursingand Midwifery Services Director Assistant National Director, Clinical Strategy and Programmes Directorate, Health Service Executive Adjunct Professor, UCD School of Nursing and Midwifery and Health Systems 70

Title Summary Access at Quality and Safety; sharing our learning A framework for governance of quality and safety was developed in collaboration with health service providers, the framework is made up of vision, principles and matrix of structures and processes that support clinical governance development set out below. The main purpose of this report is to consolidate the learning and make core recommendations for health service providers, policy makers and commissioners to inform their own specific actions plans. Quality does not happen by accident across this initiative there was tremendous learning which is captured in the report. Some of our important insights are: - Active listening with patients and staff - understanding the experience of patients (what matters to them) and what motivates staff is central in creating a quality culture. - Real time measurement prompts wise decisions which lead to the need for good quality data and transparency - Terminology matters in avoiding confusion - the term clinical governance was seen by some as management speak - therefore, we are proposing the term quality and safety and specifically governance for quality and safety. http://hsenet.hse.ie/mk5qhhl PmjIti9clXfw4Xg%3d%3d/eng /about/who/qualityandpatient safety/clinicalgovernance/cg_ docs/sharingourlearningfinal. pdf?importedresourceid=mk5 QHhLPmjIti9clXfw4Xg%3d%3d OPEN DISCLOSURE The single most important obligation for any health system is patient safety and improving the quality of care. Title Summary Access at Guidance for Setting up and Engaging Patients/Service Users on Patient/Service User Councils The experience of care, as perceived by the patients and service users, is a key factor in health care quality and safety. International studies show that bringing the perspectives of patients, service users and families directly into the planning, delivery and evaluation of health care and working in partnership with patients and families improves the quality and safety of health care and patient and staff experience. http://hsenet.hse.ie/mk15jvny VV9tGKm6ttuV2w%3d%3d/en g/about/who/qualityandpatien tsafety/nau/central_office,_n ational_advocacy_unit/guidan ce_for_setting_up_and_engagi ng_patients_service_users_on _patient_service_user_council s.pdf?importedresourceid=m k15jvnyvv9tgkm6ttuv2w%3d %3d Listening to older people report 2015 Listening meetings are designed to elicit issues of importance to the groups who attend such meetings.
