Expression of Interest for empanelment of plantations agencies undertaking plantation and maintenance work along the National Highways 1. Objectives of this Expression of Interest (EoI) 1.1 The objective of this EoI is to solicit proposals from the eligible (qualifying eligibility norms as per this EoI) and interested agencies for empanelment to undertake and execute roadside plantations, landscaping, beautification and maintenance works along National Highways. This EoI intends to bring out the details with respect to scope of services that are deemed necessary in the opinion of National Green Highways Mission (NGHM) to share with the interested/eligible agencies. 1.2 This EoI also invites site specific roadside plantations proposals from interested agencies for approximately 550 km stretch of NHs. The details regarding the same may be referred from Section 8 of this EoI document. 2. EoI Issuing Authority This EoI is being issued by NGHM for inviting expression of interest from interested/eligible agencies for empanelment to execute plantation and its maintenance work alongside/on median of National Highways as per the Green Highways (Plantation, Transplantation, Beautification & Maintenance) Policy- 2015 and the amendments as may be warranted thereunder. The decision of NGHM with regard to the short-listing of agencies through this EoI shall be final and NGHM reserves the right to reject any or all the applications without assigning any reason whatsoever, and no agency shall object/protest/demur/challenge the said decision of NGHM in any manner whatsoever and no solicitation in this regard shall be entertained by NGHM. About National Green Highways Mission NGHM has been entrusted with the task for implementing entire green highways program for the MoRTH, NHIDCL and NHAI. 3

Green Highways (Plantation, Transplantation, Beautification & Maintenance), Policy 2015 (GHP 2015) Ministry of Road Transport & Highways, Government of India has recently promulgated Green Highways (Plantation, Transplantation, Beautification & Maintenance) Policy-2015, with the vision of developing eco-friendly highways with participation of farmers, NGOs, private sector, institutions, government agencies and the Forest Department for economic growth and development in a sustainable manner. The objectives envisaged from the implementation of GHP 2015 are as follows:- i. evolve a policy frame work for plantation along National Highways. ii. reduce the impact of noise and air pollution as trees and shrubs are known to be natural sink for air pollutants iii. provide much needed shade on glaring hot roads during summer iv. arrest soil erosion at the embankment slopes v. prevent glare from the headlight of incoming vehicles vi. moderate the effect of wind and incoming radiation vii. create employment opportunities for local people The Policy document is available on the Ministry s website www.morth.nic.in Thus, all works to be carried out pursuant to and in relation to this EoI, shall be under the spirit of GHP and the amendments thereof. 5. Scope of Work Agencies found eligible for registration will be awarded works based on the site specific proposal for plantations, landscaping, beautification and maintenance works on different stretches of National Highways. The scope of work would include but not limited to Plantations/ transplantation/ landscaping and maintenance works along National Highways in accordance with the site specific proposal and approved Guidelines for implementation of Green Highways Policy (may be referred from IHMCL website). NGHM has adopted plantation SoR (Annexure I) of Ministry of Rural Development for awarding plantation and its maintenance works. The details regarding payment 4

terms and condition may be referred from the Guidelines for implementation of Green Highways Policy -2015. 6. Who can apply? All the Plantations agencies such as Private Limited Company, Proprietor, Cooperative, NGOs, Registered Societies, SHGs, Gram Panchayats, JFMCs, Watershed Committees, etc. having qualified manpower, experience and expertise in Plantations/ Transplantation/ landscaping and maintenance can apply for empanelment by submitting complete application form as prescribed in application form enclosed at Format I. 7. Eligibility Criteria Given below is the eligibility criteria for different types of agencies. However, all the type of agencies as mentioned below should not be facing any kind of winding up/ dissolution/ criminal proceedings, as the case may be, detrimental to the objective sought to be achieved under this EoI. 7.1 Private Limited Companies, Proprietors, Consortiums etc. Plantation agencies must have following resources to be considered for empanelment S.no Resources Eligibility Criteria 1 Team Leader (1) 2 Team Supervisor (1) 1. Minimum 3 years of Experience in Plantation/ Transplantation/ Landscaping Activities 2. Education Qualification: Post Graduation/ Graduation in Forestry/ Agriculture/ Horticulture or other relevant stream. 1. Minimum 2 years of Experience in Plantation/ Transplantation/ Landscaping Activities 2. Education Qualification: Post Graduation/ Graduation in Forestry/ Agriculture/ Horticulture or other relevant stream. 5

3 Team Members (2) 1. Minimum 1 year of Experience in Plantation/ Transplantation/ Landscaping Activities 7.2 Empanelment of Cooperatives, Registered societies and NGOs Agencies must have following resources to be considered for empanelment S.no Resources Eligibility Criteria 1 Cooperative/ NGO Head /Representative 2 Cooperative / NGO Members 1. Minimum 3 years of Experience in Plantation/ Transplantation/ Landscaping Activities 2. Technical Qualification: Graduation in Forestry/ Agriculture/ Horticulture or other relevant stream. OR Certificate from recognized govt. agency of any professional course/training in Plantation/Agriculture or other relevant stream. 1. Minimum 2 years of Experience in Plantation/ Transplantation/ Landscaping Activities 2. Technical Qualification: Graduation in Forestry/ Agriculture/ Horticulture or other relevant stream. OR Certificate from recognized govt. agency of any professional course/training in Plantation/Agriculture or other relevant stream. Important Condition 1. Consortium will be required to submit a legal joint venture certificate along with affidavit clearly stating the lock in period of minimum 2 years. Consortium can 6

have a maximum of three members with minimum stake of 26 % with each member. 2. The proposed technical team composition will be for awarding plantations work up to 10 km. Number of technical resource person will be increased as per the scope and requirement of the project. Same will be prescribed by NGHM in project specific MoU to be signed with agencies. 3. One resource person can only be part of one agency. If duplicity of same resource person is found in more than one agency, then credentials of that particular resource person will not be considered by NGHM. Relevant Work Experience Plantation agencies should have completed plantation projects of minimum Rs 5 lakh project cost. Plantation agencies will be eligible for getting work order equivalent to their work experience in plantations projects. Work award eligibility will be enhanced in proportion to amount of work completed. Same will be updated in the empanelled list on the website of MoRTH, NHAI and IHMCL. *STARTUPs will be exempted from work experience qualifications, but they will be required to fulfill technical credential criteria. Initially STARTUPs will be awarded work for 2 km and based on their performance further works will be awarded. 7.3 Empanelment of Community Based Organizations/LSGs such as FPOs/ SHGs/ JFMCs/ Watershed Committees/ Gram Panchayats etc. Community Based Organizations/ LSGs will be considered for empanelment based on the accreditation received from Revenue/Forest/ Horticulture Department or RO/PIU office of NHAI. Initially CBOs/LSGs will be awarded work for maximum for 2 km. Work award eligibility will be upgraded on annual basis for CBOs/LSGs on successful completion of project awarded. Eligibility can also be upgraded earlier, in case CBOs/LSGs are able to complete their previous project before scheduled annual up gradation. 7

8. Green Highways Project Award Methodology 8.1 First Step: Identification of NHs Stretch for Green Highways Projects There are many developed and existing highways on which plantations works are to be undertaken. Such highway stretches will be identified in consultation with local Regional Offices (ROs) and Project Implementation Units (PIUs) of NHAI. Based on the information received from ROs & PIUs an exhaustive database of all National Highways will be prepared by NGHM. The details of projects proposed to be undertaken will be uploaded on the website of IHMCL in phase wise manner. Accordingly site specific project proposal will be invited from empanelled plantations agencies. 8.2 Second Step: Empanelment of Plantations Agencies NGHM will seek applications from interested plantation agencies by calling Expression of Interest. Agencies qualifying the eligibility criteria as set forth in the Guidelines (for implementation of Green Highways Policy) will be empanelled with NGHM. The list will be uploaded on the website of IHMCL. NGHM intends to maximize the participation of plantation agencies in the empanelment process and in order to do so; empanelment process will remain open till 31 st March 2017. But the evaluation of applications received will be done on monthly basis. Applications received till 25 th of every month will be evaluated by internal expert committee of NGHM. The list of applications received and agencies empanelled will be uploaded on the IHMCL website on 26 th of every month. 8.3 Site specific proposals for Green Highways Projects Empanelled agencies will be asked to submit site specific proposal for roadside plantations along different stretches of NHs. The proposal shall be based on the norms prescribed in the guidelines. It is the responsibility of the empanelled agencies to refer plantation SoR of MoRD for developing financial estimate for plantations projects. NGHM will not pay any expenses incurred by the agencies I developing site specific plantations proposal. NGHM intends to start plantations work on 550 km stretch in this rainy season and hence seek site specific proposals for plantations and maintenance activities from interested agencies along with the empanelled agencies. Submitting site specific proposal is not mandatory, it depends on the agencies whether they want to opt for a particular project. As this process is a year round process, agencies are requested to keep referring details about the new projects available on the website of IHMCL in the 8

Green Highways Section. The last date for submission of site specific proposals may be referred from the website. The last date for submitting site specific proposals for green highways projects intended to be awarded in this rainy season is fixed as 25 th June, 2016. The details regarding stretches available for roadside plantations are enclosed at Annexure III of the EoI. Project Appraisal: Site specific project proposals developed in accordance to the guidelines will be vetted by NGHM through an internal expert committee. 8.4 Project Award The site specific proposals found in accordance with the guidelines will be approved by NGHM and the project will be awarded to the project proponent agency based on their project award eligibility. The details regarding project award eligibility may be referred from the Guidelines for implementing green highways policy. In case more than one proposal is received for the same stretch of highways than the agency scoring higher during project appraisal will be awarded the project. The details project appraisal will also be uploaded on the website of IHMCL. In any case project award eligibility will be guided by the prescribed norms of the Guidelines. 9. Coverage of the proposed work EoI can be downloaded from the IHMCL s website (www.ihmcl.com) under Green Highways section. The applicants are expected to examine all instructions, application form, terms, requirements and other details in the EoI documents. Failure to furnish complete information as mentioned in the EoI documents or submission of application not substantially responsive to the EoI document in every respect will be at the applicant s risk and may result in rejection of the application. 10. EoI Processing Fee A non-refundable processing fee of a) Rs. 2500/- in case of companies and proprietorship firm, b) Rs.100/- in the case of SHGs / JLGs/ Watershed Committees; and JFMCs c) Rs. 500/- for all other eligible agencies (NGOs, Cooperative, Registered Society) 9

in the form of a Demand Draft or Pay Order or Banker s Cheque drawn in favour of the Indian Highways Management Company Limited payable at New Delhi has to be submitted along with the application. Applications received without required EoI Processing fees will not be considered for evaluation. 11. Last date for submission of proposals and Opening of Proposals NGHM intends to maximize the participation of plantation agencies in the empanelment process and in order to do so; empanelment process will remain open till 31 st March 2017. But the evaluation of applications received will be done on monthly basis. Applications received till 11: 30 Am on 25 th of every month will be evaluated by internal expert committee of NGHM. The list of applications received and agencies empanelled will be uploaded on the IHMCL website on 26 th of every month. NGHM intends to start plantations work on 550 km stretch in this rainy season and seek site specific proposals for plantations and maintenance activities from interested agencies. Proposals received till 11:30 AM on 25 th June will be considered for appraisal. Applications complete in all respects as specified in the EoI, must be submitted to NGHM so as to reach NGHM at the following address: National Green Highways Mission MTNL Building (1 st Floor), Sector 19, Dwarka, New Delhi-110075 NGHM may, in exceptional circumstances and at its discretion, advance or extend the last date for submission of applications by issuing an addendum to be made available on the IHMCL s website. A prospective applicant requiring any clarification on the EoI document may request NGHM through email at nationalgreenhighways@gmail.com on or before 5:00 PM on 20/06/2016. Requests received for clarification within the stipulated date, which are found relevant in the opinion of NGHM for submission of EoI will be replied by NGHM. The responses will be put up on the official website of IHMCL (http://www.ihmcl.com) with a description of the enquiry latest by 21/06/2016. In the event, no reply/clarification is provided by NGHM latest by 21/06/2016, it shall be 10

deemed that such clarification as sought by the prospective Applicant is unsolicited for and NGHM shall not be obligated to make any correspondence in this regard to such prospective Applicant. At any point of time prior to the deadline for submission of Application, NGHM reserves the right to modify/amend any content(s) of this EoI by issuing an addendum (the Addendum). Any Addendum thus issued will be put up on the IHMCL website. In the event of issuance of such Addendum, NGHM may extend the Application deadline in order to afford the prospective/intending Applicants reasonable time to take into consideration the Addendum while applying for this EoI. However, agencies who have already submitted their registration application pursuant to the release of guidelines on the IHMCL website will only be required to submit requisite EoI processing fee, but if they desire to submit a fresh proposal, they can do so. The results regarding their empanelment will be released along with applications received through the EoI process. List of agencies who have already submitted their application is enclosed at Annexure II. Applications received till the last date of submission and before prescribed time (11:30 AM) will be opened at 1200 hours (12:00 PM) on 25 th of every month in front of applicants who wishes to be present. The last date for submission of site specific plantations proposal for 550 km stretch of NHs is 25 th June, 2016 till 11:30 AM. Technical presentation with respect to the proposal submitted will be organized on 27 th and 28 th June, 2016 in the NGHM office. NGHM will disclose the name of all agencies who have submitted their applications. The results for empanelment will be released later on website of IHMCL after further evaluation by internal committee of NGHM. 12. Conditions under which this EoI is issued i. This EoI is not an offer and is issued with no commitment to empanel any or all the applicants. NGHM reserves the right to withdraw the EoI and change or vary any part thereof at any stage. NGHM also reserves the right to disqualify any applicant, if necessary, at any stage. 11

ii. NGHM reserved the right to call fort site specific proposals from empanelled agencies for further short-listing and accordingly the formal award of work will be issued to shortlisted agencies by NGHM, iii. Timing and sequence of events resulting from this EoI shall ultimately be determined by NGHM. iv. No oral conversations or agreements or promises or assurances by/with any official, agent, or employee of NGHM shall affect or modify any term of this EoI and any alleged oral agreement or arrangement or promise or assurances made by/with an applicant shall be treated as binding on NGHM unless a definitive agreement is executed and affected resulting out of this EoI process. v. Neither the applicants nor any of the applicants representatives shall have any claims whatsoever against NGHM or any of their officials/employees, agents, consultants and their respective employees arising out of, or relating to or concerning this EoI or these procedures. vi. Applicants who are found to canvass, influence or attempt to influence in any manner the qualification or selection process for empanelment, including without limitation, by offering bribes or other illegal gratification, shall be disqualified from the process at any stage and also shall be debarred from the future processes for specific period as may be decided by NGHM and besides, in such cases, NGHM shall be at liberty to draw appropriate legal proceedings against the delinquent applicant. vii. Each applicant shall submit only one application against the invitation for EoI. viii. One resource person can only be part of one agency. If duplicity of same resource person is found in more than one agency, then credentials of that particular resource person will not be considered by NGHM. ix. NGHM reserves the right to call project specific EoI for implementing technical tasks such as Hydroseeding/Transplantations. x. NGHM reserves the right to verify original documents of the applicants at any point of time, which shall not be questioned or objected in any manner by the applicant agencies. xi. Disputes relating to or concerning or arising out of this EoI shall be subject to the exclusive jurisdiction of courts in Delhi only. xii. The MD of NGHM or on his behalf, his duly appointed/nominated person/agent, shall be the only competent authority to interpret the contents, words, sentences, 12

xiii. terms and conditions etc. of this EoI and the interpretation of MD of NGHM or on his behalf, of his duly appointed/nominated person/agent, shall always prevail and shall be binding on the applicants. If, on verification, any of the information provided in the EoI is found to be misleading or any document is found to be forged or tampered or any concealment of material information/substance is detected during the short listing process or any other stage thereafter resulting out of or concerning the objective of this EoI, the applicant / agency shall be liable to be dismissed from the selection process or, if already selected, or already awarded contract for execution of a project, in that case, 13. Rights to the content of the proposal For all the applications received before the last date and time of submission, the proposals and accompanying documentation of the application will become the exclusive property of NGHM and will not be returned to the applicants. NGHM is not restricted in its rights to use or disclose any or all of the information contained in the proposal and accompanying documents and can do so without consideration of compensation of whatsoever kind to the applicant. NGHM shall not be bound by any language in the proposal or in any other document indicating its confidentiality or any other restriction on its use or disclosure. 14. Acknowledgement of standing of Terms By submitting application, each applicant shall be deemed to acknowledge that one has carefully read and understood all sections of this EoI, including application form, schedules and annexure hereto, and has fully informed itself as to all the existing terms and conditions and limitations and unconditionally and irrevocably accepts all the terms and conditions and limitations of this EoI, being fully aware about the intent and purpose thereto. 15. Language The Application and all related correspondence and documents should be written in English/Hindi language. In case, if the supportive documents are in regional/ local language, a duly translated and self-attested copy has to be sent. 13

16. Application Procedure An applicant agency may submit the application through any of the two ways prescribed below; a) Through Hand/Postal Services: Duly filled in application and the required supportive documents can be submitted in a sealed envelope superscribed EoI for Empanelment with NGHM. b) Through Email: The applicant may also take a print of the form annexed to this document and can email the scanned copy of filled in form and required supporting documents on nationalgreenhighways@gmail.comwith the subject line EoI for Empanelment with NGHM. 17. Appraisal of EoI applications NGHM shall adopt such mode/procedure as may be deemed proper for the purpose of determining the appraisal of the Applicants. NGHM reserves the right to call for any additional information or document or seek clarification at any point from the applicant for appraisal of EoI. 18. Empanelment Procedure The agencies qualifying in respect to eligibility criteria stipulated in para 7 of this document will be empanelled with NGHM. Successful agencies will be issued a formal letter confirming their empanelment. The list of empanelled agencies will be declared and displayed on the website of IHMCL. The NGHM is not obligated to notify any unsuccessful agencies about the reasons of their being unsuccessful. 19. Period of validity of empanelment Empanelment will be valid for a period of 5 (five) years from the date of empanelment, subject to renewal from time to time on such terms and conditions as may be decided by NGHM. An agency may, however, be removed from the panel either on its own request by providing at least 15 (Fifteen) days notice in writing to NGHM or on the motion of NGHM, if at any point of time, NGHM is of the opinion that the empanelled agency 14

has acted contrary to the spirit of this EoI, which includes without limitation breach/violation of terms and conditions of this EoI. 15
