(BCA) for the Rosecrans/Marquardt Grade Separation Project (Project) in the amount of $6,273,306, inclusive of all design phases. This contract is for a base of three years. The base contract is for the amount of $6,273,306. ISSUE It is the intent of Metro Regional Rail to award a professional services contract to provide engineering services including developing alternatives acceptable by all stakeholders, development of the necessary environmental documentation for the Project, preparation of Plans, Specifications, and Estimates (PS&E), and right of way engineering for the construction of the Project and bid and design support during construction. DISCUSSION The Rosecrans/Marquardt Grade Separation Project located at milepost 157.8 on the BNSF San Bernardino Subdivision, was environmentally cleared in 2003 with the Third Track and Grade Separation Project on the BNSF Railway Company East-West Main Line Railroad Track EIR SCH #200204111 (Triple Track Project). The objective of the Triple Track Project is to increase the efficiency of the BNSF main east-west corridor to better accommodate existing and future freight and passenger service and to allow specific increases in the speed and volume of planned intercity and commuter rail passenger service. Specific improvements include: Installation of a specific set of grade separations to substantially enhance safety and traffic flow on surface streets throughout the rail corridor; and

Installation of a third main track to enhance the efficiency of train movement along this corridor to ensure passenger service operates on a frequent and reliable schedule. The Rosecrans and Marquardt at-grade crossing was listed in the California Public Utilities Commission (CPUC) Section 190 decision, dated February 10, 2014, as the number one ranked crossing in the state applying for Section 190 funds. Additional state and local funding has been allocated for the Project. The Project will alleviate the current and potential traffic impacts and hazards posed by the existing at-grade rail crossing. Several options have been analyzed for the ultimate configuration of the Project. The Contractor will provide the following services: Identify and evaluate viable alternatives Provide the necessary environmental documentation for the Project Develop the PS&E documents for the preferred alternative Provide Bid and Design Support services during construction Funding Commitment This is one of the prioritized projects on the Advance Investment Memorandum of Understanding between several southern California agencies and the California High Speed Rail Authority. This project is eligible for funding under the State's Section 190 program. This Project also has funding from Measure R funds. FUNDING SOURCE Proposition 1 A Section 190 BNSF Railway MeasureR TOTAL FINAL DESIGN $53 million $15 million $7 million $35 million $110 million Funding for the engineering services is from Measure R. DETERMINATION OF SAFETY IMPACT This is a grade separation of the roadway from active railroad right-of-way. The Rosecrans/Marquardt intersection with the BNSF railroad has been rated by the CPUC as the most hazardous grade crossing in California. With the construction of this project, the at-grade crossing will be closed, eliminating the possibility of train to vehicle collisions. All aspects of the project will be designed to be in accordance with BNSF's current design standards. Rosecrans/Marquardt Grade Separation Project Page 2

FINANCIAL IMPACT The total funding from MeasureR is $35 million of which $545,000 for this project is included in the FY15 budget in department 2415, Regional Rail, Project No. 460066, Task 6.3.01.01. Since this is a multi-year contract, the cost center manager, and Executive Director, Engineering and Construction will be accountable and responsible for budgeting the cost of future fiscal year requirements. Impact to Budget Source of Funds: $545,000 in Measure R funds. ALTERNATIVES CONSIDERED The Board could choose not to award the contract to BCA, and decide not to pursue the Rosecrans/Marquardt Grade Separation Project. This alternative is not recommended due to the significant benefits that the Project offers to all stakeholders. NEXT STEPS Upon approval by the Board, staff will execute the contract, and begin the services for the Rosecrans/Marquardt Grade Separation Project. ATTACHMENTS A. Procurement Background This Board Action is to approve Contract No. PS2415-3420 issued in support of the Rosecrans/Marquardt Grade Separation Project for professional Architectural and Engineering (A&E) services. The RFP was issued in accordance with Metro's Acquisition Policy and Procedure, and the contract type is cost-plus-fixed-fee. Two amendments were issued during the solicitation phase of this RFP: Amendment No. 1, issued on October 9, 2014, provided minutes of the Pre Proposal Conference and attendee sign-in sheets; Amendment No. 2, issued on October 16, 2014, provided answers to questions received regarding the RFP. A pre-proposal conference was held on October 8, 2014 and was attended by 49 participants. Thirty-two questions were asked and answers were released prior to the proposal due date. B. Evaluation of Proposals/Bids A total of five proposers responded to this solicitation. A Proposal Evaluation Team (PET) consisting of staff from Metro Regional Rail and Highway Programs, Caltrans Division of Rail, BNSF Railway, and City of Santa Fe Springs was convened and conducted a comprehensive technical evaluation of the proposals received. The proposals were evaluated based on the following evaluation criteria and weights: Skill and Experience of the Team 35 percent Project Management Plan 25 percent Project Understanding 40 percent The evaluation criteria are appropriate and consistent with criteria developed for other, similar A&E services. Several factors were considered when developing these weights, giving the greatest importance to the qualifications and experience of the personnel and the demonstrated understanding of the project. This is an Architect and Engineers, qualifications based procurement. Price cannot be used as an evaluation factor pursuant to state and federal law. Small Business Enterprise preference is not applicable to A&E procurements. Of the five proposals received, two were determined to be within the competitive range. The firms within the competitive range are listed below in alphabetical order: 1. Biggs Cardosa Associates, Inc. 2. T.Y. Lin International, Inc. During the period November 3, 2014 to November 12, 2014, the PET evaluated and independently scored the technical proposals. The PET met on November 12, 2014 and determined a list of proposers in the competitive range. On November 19, 2014, the PET met to interview the firms and their proposed teams. The firm's proposed project managers and key personnel had an opportunity to present their team's qualifications and respond to the PET's questions. Each team's presentation addressed the requirements of the RFP, experience with complex engineering specific to grade separations, and proposed solutions. Each team was asked questions relative to each firm's qualifications and understanding of the project. At the conclusion of the interviews, the PET met and completed their technical scores based on both written proposals and oral interviews. Biggs Cardosa Associates's proposal was ranked highest qualified pre-interview and their technical proposal's score remained unchanged after the interviews. The PET was particularly impressed with BCA's thorough understanding of all features of the project and how risks and the proposed schedule were addressed in the Project Management Plan. Biggs Cardosa Associates, Inc. Biggs Cardosa Associates, Inc. (BCA) has successfully provided services on over 1 00 grade separations and related rail projects. BCA has a long history of established relationships with stakeholders important to this Project including the BNSF Railway, Caltrans, the CPUC, the California High Speed Rail Authority, and Metrolink. BCA's proposed Project Manager has 25 years of experience managing grade separations including leading the preparation of PS&E for 15 grade separations. Major grade separation projects successfully delivered include five at BNSF grade crossings and the Burbank Boulevard Bridge over Metrolink in Burbank. BCA's project team includes Small Business Enterprises well known to Metro with a history of performing satisfactory services. D. Background on Recommended Contractor The recommended firm, Biggs Cardosa Associates, Inc. (BCA), is a California corporation founded in 1986 with headquarters in San Jose, California, and offices throughout the state including Orange, CA. BCA is a leader in transportation projects and was selected by the Port of Long Beach, County of San Bernardino, County of Orange, the Alameda Corridor East Construction Authority, and OCTA as prime contractor for major grade separation projects.
